At the same time, little has been made public, and what statements have been made are more confusing than enlightening. Over the course of last year, three claims of note have surfaced:
Crash data sources As some of you may have guessed, the way to reconcile these seemingly contradictory statements is to recognise they actually refer to separate, mostly independent data sources. Let’s briefly go over them:
With these distinctions in mind, we can try to untangle and assess the three claims we started with. First off, we have good reason to believe the representations offered by the defense vis-à-vis the contents of the EDR are accurate. Aside from the fact that the Commonwealth has had over a year to refute the claim no events had been recorded, yet has not done so, the specific language used by their crash reconstructionist leads one to believe they’re relying not on the EDR, but rather the VCH (briefly put a pin in that). If it is the case that the EDR did not record any events, it also has not stored any vehicle data that is captured in fixed time periods in the lead-up and aftermath of an event trigger. In other words, it really contains nothing at all, and can be considered functionally useless. Be that as it may, an absence of recorded events does not ipso facto mean there was no collision. Especially in cases where a motor vehicle impacts a cyclist or pedestrian, collisions have been known to take place that did not cause sensors to register values in excess of the trigger thresholds. And as we said, a set of circumstances that does not rise to the level of a crash event for the EDR may still be flagged – and saved – as an event by the VCH. Demystifying the VCH Let’s start with a close reading of the Commonwealth’s position: Subsequently, an extensive collision reconstruction was conducted, which included the retrieval and review of data created and stored by the Lexus Safety System, including data of the vehicle’s speed, distance of travel, triggering events, and the opening angle of the accelerator pedal. Based on a review of this data and other factors, the crash reconstructionist opined that the defendant’s vehicle travelled in reverse for approximately 62 feet before striking the victim at a possible impact speed of 24.2 mph. Post impact with the victim, the defendant’s vehicle continued in reverse before leaving the scene.Two elements alert us to the fact this reconstruction is based on the VCH:
“What’s a key cycle?”, I hear you say. I’m so glad you asked. Each time you turn your Now, normally an event will also have a regular UTC timestamp attached, but crucially, only when the vehicle sports a factory-standard navigation system. This would be far too convenient for the cursed mess that is the Commonwealth of Massachusetts v. Karen Read: her Lexus had an after-market infotainment unit installed to facilitate Apple CarPlay, and as this module did not interface with the VCH system, trigger events would not be paired with any form of standard UTC timestamp. As a result, we’re left with key cycles as the only proper measure of time accounting. An extracted VCH report may look something like the following:
In order to match a particular event entry in the VCH to a specific time and place – say Fairview Road around 12:30 A.M. – one would have to reason backwards from the closest key cycle linked to an event that is unambiguously dateable and locatable. In our case, this might be a trigger event that was recorded during the towing of the Lexus prior to being impounded. Then, one would need to account for each time the ignition switch had been actuated along the itinerary and during the time-frame between the towing and the posited collision in front of 34 Fairview. Only by matching such a detailed account to the difference in key cycles between the known/locatable trigger event and the event alleged to have been triggered by a collision, can one attribute the latter to an incident believed to have occurred in a particular place at a specific time. As a quick sidebar, it could make sense to me why the testimony of the Commonwealth’s crash reconstructionist would have to scheduled nearer to the end of her case in chief, give one would need to lay the foundation for the comings and goings of the Lexus from impact to impoundment. And as this very foundation would become the target of expert disagreement, it may not easily be subject to stipulation. In any case, if the above analysis holds water, we can also articulate what the defense’s expert Van Ee will likely argue in order to refute it. As explicitly stated in the final round of pre-trial pleadings, Van Ee will offer a different interpretation of the key cycle data extracted from the VCH. Based on what we now know, he will likely endeavour to frustrate the Commonwealth’s attempt to tie a certain recorded event to Fairview Road in the earliest hour of the 29th, either by arguing ignition has been actuated more often than the Commonwealth contends; or demonstrating certain key cycles ought to be collapsed by presenting evidence the engine had been left running, for example. This would push the trigger event further back in time or pull it closer, respectively. And beyond We can go a little further than that, although we do have to make clear that we are now firmly within the realm of conjecture. There are twenty distinct trigger events defined, each of which can cause a different combination of data sources to be stored. Of these, we could venture a guess which the Commonwealth basis their reconstruction on – personally, I’d say trigger event 5-1 is worded in a way that is awfully similar to the description of the alleged collision we find in Commonwealth filings: Accelerator pedal opening angle is medium or higher immediately after shifting to RAs we saw, the opening angle of the accelerator pedal – and, of course, reverse travel – feature prominently in their rendition, and the data sources collected by a 5-1 trigger event would plausibly allow the reconstructionist to make claims as to collision speed and distance of travel, as relevant parameters such as vehicle speed, engine rpm, throttle opening ratio, and longitudinal G values would be recorded for a time span of 10 seconds at a polling rate of 2Hz surrounding the event. Just for the sake of argument, let’s say such an event has in fact been recorded in the VCH, which could reasonably be correlated to Fairview Road the 29th. Another tantalising opportunity to contest that data would be to attribute the trigger event to another known movement of the vehicle within the same key cycle. Based on GPS data pulled from O’Keefe’s phone, his overall itinerary from Waterfall to Fairview is known. As Guarino describes in his report, Read and O’Keefe first drove past Fairview Road while driving on Cedarcrest, and according to Guarino, they then turned around, drove a small way back, and took a right turn onto Fairview. Yet, what if they didn’t turn around? But what about Ryan Nagel you overstretched giraffe!!! As the observant among you may now be protesting, this rendition of events is incompatible with Ryan Nagel testimony, as he mentions seeing a set of headlights from an SUV coming towards them from the opposite side Cedarcrest Road, to which they yielded as it turned right onto Fairview, while Nagel’s group took a left and followed close behind. This testimony would indeed appear mutually exclusive to Read’s Lexus backing up on Cedarcrest, although Nagel’s testimony itself seemingly consists of mutually exclusive elements. After all, if they had closely followed the Lexus as they both pulled up to the Fairview residence; none of the three occupants see O’Keefe stepping out of the vehicle in front of them; nor do they see anyone besides Read sitting inside the Lexus as they overtake it on their way out – something has to give. Hence, the present theory is predicated on the reasoned timeline set out by cwf1984 in this exchange with Sbornak, which itself forms an attempt to integrate conflicting data sources into a cohesive sequence of events. Per this account of the timeline, O’Keefe and Read arrive at Fairview sometime around 12:19 to 12:20, well ahead of the 12:23 arrival time of Nagel’s party. Addendum I'd like to end with some general comments on the use of VCH for the purpose of crash reconstruction. It may be salutary to keep in mind this system was not primarily intended to aid in accident forensics, but rather as a diagnostic tool to assist vehicle repair and maintenance. (Or more cynically: as a way for Toyota to shield themselves from unintended acceleration claims – note the primacy of the pedal opening angle throughout.) It can of course provide invaluable data to crash reconstructionists, but its aim is not to relieve the EDR from its task. A further complication results from a rather banal observation: most of the times, when a crash occurs, it is pretty clear that a crash has occurred. Deformed metal wrecks tend not to be overly inconspicuous. The exercise required to correlate a recorded event in the software to an actual event in place and time tends not to cause all too much trouble if the last recorded event is all she wrote, so to say. Often eyewitnesses to the event (other motorists, pedestrians, responders) can aid in narrowing down questions of sequence or timing if required. We don't have any such luxuries in Commonwealth v. Read, instead we are in the peculiar position of having to parse the data with a view to inferring whether a collision happened at all. This stretches the capabilities of the software well past its intended use, possibly to an untenable degree. And as they sometimes say in data sciences, if you torture the data long enough, eventually it'll talk. The PeloSwing Trading group was able to capture a 1600% bagger on AMC 3.5C on the 5/17 EXP, as AMC also flew 31% in the trading session. There are plenty of other companies that have fallen into this category and in some cases are truly undervalued companies that still have some upside potential, just with WAY more risk and a potential LONG wait time to see the fruits of an investment. Other players in this space that have seen a recent surge are BlackBerry with a 12% run up in the market recently as well, more than 44 million shares were exchanged in Tuesdays trading session, when the average volume is 8.8 million. This recent rise back into the meme stock industry is showing that gains from 2021 might be on the table again for 2024. I didn't think I would ever enjoy something like this as much as I did, but man did I get some immense enjoyment and dopamine spikes partaking, ha. That being said AGAIN this is all just for fun and I tried to rely just on the numbers I've captured and biases aside; SO if you think someone is better than x or if you think this is wrong good for you. I'm just trying to share my experience because none of my friends wanna play with me, haha. I started by grabbing all my favorite nostalgic players ie Barry Bonds, Strawberry, Thome, Griffey Jr, ARod, Derek Jeter, Greg Maddox, Chipper Jones, Sammy Sosa, Mark McGwire, John Smoltz, etc. After this I just started going through MVPs and All Stars over the last 50 years just to see who was this shit and who wasn't (tried to stay away from 1 hit wonders). I wanted to keep it somewhat narrow, but tried to grab like the best 15 players from each position give or take. Batter - Actual Stats So after entering these years(rows) of data for each player into a Excel Spreadsheet I setup many formulas to give me an idea of what was high, avg and low for each stat category I wanted to capture. Example - I took a few of the best years Barry Bonds and Babe Ruth had and figured out what their ISO, wOBA, wRAA, wRC+, Off, BABIP, AVG, BsR, SBs(for speed) was. (I did the same concept for Pitchers trying to assign different stat categories to ability points ie K/9/FIP = Velocity, BABIP/FIP = Junk, B/9, FIP = Accuracy... Pitchers were much harder to find good stat categories for comparison so take it as it is.) (Fielding was also difficult, but I found a few stat categories like DRS, UZR, Def, Arm(for both OF and C) that were good at comparing each other and by positions. Then with a little more research on who was winning Glove Gloves, who was throwing people out from the OF, who had cannons, C throwing out baserunners, etc. I was able to get a good idea on how to match my stat categories/ability points to this. I also did the same for Batters/Pitchers, but I will get more into that when I talk about traits below.) Obviously these stat categories for Barry Bonds and Babe Ruth were all incredibly high for their best years so I had to figure you how to compare others to this, so that is where I got an avg stat category number for each for all players + every year they played. I created a sliding scale that started with that avg stat category number of that specific stat category equaling 50 ability points. Then I would assign a specific value that would increase/decrease it incrementally to give it a 0-99 ability point value ie ISO for both these players were so high it didn't make sense for those to be max on the sliding scale so sometimes players were wayyy above the max value so it is what it is. I wanted to grab more categories that I could apply to each of the main abilities points ie Power, Contact, Speed, etc. to average this out. ISO Table I ended up making 5 different stat categories for Power, 3 for Contact and 2 for Speed. I would say this isn't perfect, but it was fun. Pitching was 2 for each Velocity, Junk, Accuracy. Fielding was 3 and for Arm it was combination of things depending on your position ie IF, OF and C. After this I created a Pivot Table with a few more formulas to grab all the Seasons that would be qualified ie Batters had a PA minimum and Pitchers had an IP minimum. Batters - Pivot Table And then after this I had my main tabs for Batters/Pitchers that were just a simple ArrayFormula to go grab the best 5 Seasons/years for each ability point category(you can refer back to the Batters/Pitchers - Main Tab Screenshots to see that). I experimented with many different numbers for Seasons/years that would be included, but felt like 5 was the most fair or if at least anything created a little space in-between players. So my last step was going through all these Batters/Pitchers and doing a few double checking of data points ie researching/Googling best OF/C/IF arms in Baseball, best Pitchers, best CF, LF, etc., best fielders in those positions, clutch players, most RBIs, SBs, HRs in a single season to see if my numbers made sense with what people were saying. After some small adjustments to make those make sense I had my ability points. So I took this step above also to figure out who was going to get what trait wise. I looked for Clutch, RBI Hero, Stealer, Elite 4F, Specialist or any trait that I felt like matched what that player was known for. This is probably the most subjective part and sometimes I just gave them something if they were a top player in that ability point category ie 90+ Power, 90+ Speed etc. I wasn't stingy with these traits either I pretty much gave everyone 2 albeit the strong traits to the better players. If they weren't an already created Legend I made sure to try to create their look based on a quick Google search of there most ridiculous features ie hair, beefy/ripped, ridiculous batting/pitching stance. I also prefer the announcer says a name rather than just putting in their name via text ie Wade Boggs is Wade Biggs; Derek Jeter is Derek Jeterson. Examples of Players I guess last thing would be I created a 32 Team League with some of the already created teams from SML and Legends League and then created a few others I just liked Mascot wise. I picked a funny State and actually divided up Teams based on Regions and tried to match a good Stadium for each. Created/Generated Teams:
Team Names + Stadiums + Misc I've set it up also so I can add in Players pretty easily(added Acuna Jr and updated Judge, Ohtani 2023 Season/year) just put in the years you want calculated on the stats tab and add them to the main tab and the formulas do the rest! Hope at least 1 person enjoys! haha. Since I've finally finished I've been running shuffle draft modes constantly so much fun! Edit 1 - u/meriweather2 asked me "Any players that stand out as your favorites in terms of their ratings and design?" and I felt like it was good enough to add to the main post: When I first started this endeavor I was just going to do their best Season and I'm glad I picked Bonds and Ruth to compare first because some of their single Season stats were/are insane! ha. They both would be 99 on almost everything so I had to start thinking of ways to make them worse?? Ha. Also it was kinda hard to pick their "best" Season because what is their best? Hitting for Average? HRs? RBIs? So I started thinking 3 of their best Seasons and they blew that out of the water also... so I was like what about 5 or 7? And I started making a little progress that they both weren't all 99s. Outliers:
And you know what usually comes along with that? More tinkering... lol. I've made even more fine tuning on everything(tab looks, stat category cleanup, added more Pitcher stat categories to compare, reworked the data tabs so you can just re-import new Seasons if you want and it should auto update). I also re-imported all new FanGraphs data. It's no longer $10 bucks a month($60 for the year) so I've officially spent more on FanGraphs subs then the game, ha. This version is a copy from my own, but still exactly the same as I have it today - 5/15/24. It's view only so you can make a copy of it. I've also hidden all the formula and pivot table tabs as default so you can just un-hide them all if you want to play around with what I've added.
