2024.05.19 16:51 8bagels I witnessed a personal injury, got a call from a law office, what to expect next?

I’m in Utah. A year or so ago while traveling with my spouse and children through Arizona we stopped by a NPS site. While browsing the gift shop my spouse heard a commotion and summoned me to see if somebody was in need of help (they had their hands full with the youngest). I investigated and found a gift shop employee was injured. I helped the best I could and sent my spouse to find further help. NPS “rangers” came and later the police. I was asked to make a written statement about what happened, I mentioned my spouses involvement, I signed my name and provided contact info, and gave that statement to the police. No ambulance came but I believe the employee was driven to a hospital in a police car or a ranger truck. The employee and I exchanged some contact info and a few days later we texted. Employee said recovery was slow going (or something like that), provided some anecdotal details amongst the small talk, and thanked us for helping. The injured employee lives in Utah also.
Fast forward to a week or so ago. I get a call from an Utah area code stating to be a law firm. (An internet search later I find the number is associated to a personal injury law firm in NV) They confirmed my witness/involvement on a high level, confirmed my phone number and address. They didn’t ask about my spouse. They said they were representing the employee. They said as this case moves forward there is a small chance my involvement could be beneficial and asked if I would be open to another conversation sometime in the future maybe.
To me it sounds like a law office making sure they know where a witness is in case it’s helpful. From your experience what can you tell me about where this case (or suit or claim) might be in the process and what I might expect next should my involvement be requested again? Any advice should they call back?

Ynet article (https://archive.is/F1sJW):
"Stalin's Jews: We mustn't forget that some of greatest murderers of modern times were Jewish"
Here's a particularly forlorn historical date: Almost 90 years ago, between the 19th and 20th of December 1917, in the midst of the Bolshevik revolution and civil war, Lenin signed a decree calling for the establishment of The All-Russian Extraordinary Commission for Combating Counter-Revolution and Sabotage, also known as Cheka. Within a short period of time, Cheka became the largest and cruelest state security organization. Its organizational structure was changed every few years, as were its names: From Cheka to GPU, later to NKVD, and later to KGB. We cannot know with certainty the number of deaths Cheka was responsible for in its various manifestations, but the number is surely at least 20 million, including victims of the forced collectivization, the hunger, large purges, expulsions, banishments, executions, and mass death at Gulags. Whole population strata were eliminated: Independent farmers, ethnic minorities, members of the bourgeoisie, senior officers, intellectuals, artists, labor movement activists, "opposition members" who were defined completely randomly, and countless members of the Communist party itself.
In his new, highly praised book "The War of the World, "Historian Niall Ferguson writes that no revolution in the history of mankind devoured its children with the same unrestrained appetite as did the Soviet revolution. In his book on the Stalinist purges, Tel Aviv University's Dr. Igal Halfin writes that Stalinist violence was unique in that it was directed internally. Lenin, Stalin, and their successors could not have carried out their deeds without wide-scale cooperation of disciplined "terror officials," cruel interrogators, snitches, executioners, guards, judges, perverts, and many bleeding hearts who were members of the progressive Western Left and were deceived by the Soviet regime of horror and even provided it with a kosher certificate. All these things are well-known to some extent or another, even though the former Soviet Union's archives have not yet been fully opened to the public. But who knows about this? Within Russia itself, very few people have been brought to justice for their crimes in the NKVD's and KGB's service. The Russian public discourse today completely ignores the question of "How could it have happened to us?" As opposed to Eastern European nations, the Russians did not settle the score with their Stalinist past. And us, the Jews? An Israeli student finishes high school without ever hearing the name "Genrikh Yagoda," the greatest Jewish murderer of the 20th Century, the GPU's deputy commander and the founder and commander of the NKVD. Yagoda diligently implemented Stalin's collectivization orders and is responsible for the deaths of at least 10 million people. His Jewish deputies established and managed the Gulag system. After Stalin no longer viewed him favorably, Yagoda was demoted and executed, and was replaced as chief hangman in 1936 by Yezhov, the "bloodthirsty dwarf." Yezhov was not Jewish but was blessed with an active Jewish wife. In his Book "Stalin: Court of the Red Star", Jewish historian Sebag Montefiore writes that during the darkest period of terror, when the Communist killing machine worked in full force, Stalin was surrounded by beautiful, young Jewish women. Stalin's close associates and loyalists included member of the Central Committee and Politburo Lazar Kaganovich. Montefiore characterizes him as the "first Stalinist" and adds that those starving to death in Ukraine, an unparalleled tragedy in the history of human kind aside from the Nazi horrors and Mao's terror in China, did not move Kaganovich. Many Jews sold their soul to the devil of the Communist revolution and have blood on their hands for eternity. We'll mention just one more: Leonid Reichman, head of the NKVD's special department and the organization's chief interrogator, who was a particularly cruel sadist. In 1934, according to published statistics, 38.5 percent of those holding the most senior posts in the Soviet security apparatuses were of Jewish origin. They too, of course, were gradually eliminated in the next purges. In a fascinating lecture at a Tel Aviv University convention this week, Dr. Halfin described the waves of soviet terror as a "carnival of mass murder," "fantasy of purges", and "essianism of evil." Turns out that Jews too, when they become captivated by messianic ideology, can become great murderers, among the greatest known by modern history. The Jews active in official communist terror apparatuses (In the Soviet Union and abroad) and who at times led them, did not do this, obviously, as Jews, but rather, as Stalinists, communists, and "Soviet people." Therefore, we find it easy to ignore their origin and "play dumb": What do we have to do with them? But let's not forget them. My own view is different. I find it unacceptable that a person will be considered a member of the Jewish people when he does great things, but not considered part of our people when he does amazingly despicable things. Even if we deny it, we cannot escape the Jewishness of "our hangmen," who served the Red Terror with loyalty and dedication from its establishment. After all, others will always remind us of their origin.
HistoryHeist.com article (https://archive.is/u6cM3):
"The Bolshevik Revolution: An Iluminati takeover of Russia?"
The murderous Bolshevik Revolution made communism a political reality by mostly Jewish activists. Alarming similarities to today’s political climate invite comparison.
Czar Nicholas II abdicated in March 1917. Since Bolshevik leaders Vladimir Lenin and Leon Trotsky weren’t even in Russia then, how did they gain control of it by November 1917? Western analysts uncovered parts of this mystery, but much remained unknown due to the Soviet government’s stranglehold on its history – as Orwell said, “Who controls the present controls the past.” With glasnost, archives creaked open. Perhaps no one has collated the information better than Juri Lina in his book Under the Sign of the Scorpion.
The Rothschild-Illuminati axis, through their network of banksters and Freemasons, controlled the Bolshevik operation.
In February 1917, an artificially induced bread shortage accompanied orchestrated rioting in Petrograd (then Russia’s capital). In a “false flag,” the mobs were machine-gunned from hidden positions; the casualties were blamed on the Czar.
British agents bribed Russian soldiers to mutiny and join the rioting. White Russian General Arsene de Goulevitch wrote: “I have been told that over 21 million rubles were spent by Lord Milner in financing the Russian Revolution.” 33rd degree Freemason Alfred Milner was a Rothschild front man.
Several Russian generals were Freemasons who betrayed the Czar under Masonic instructions.
Russians thought the provisional government, established under Alexander Kerensky after the Czar’s fall, meant future democracy. But Kerensky, Grand Secretary of Russia’s Grand Orient, was “phase one” of communist takeover. His government pardoned all political exiles – green light for return to Russia of fellow Freemasons Lenin and Trotsky.
Jacob Schiff and Federal Reserve founder Paul Warburg ran Kuhn, Loeb & Co. – the Rothschilds’ New York banking satellite. Schiff supplied $20 million in gold to Trotsky, who sailed from New York with 275 other terrorists on a passport obtained through pressure the bankers put on the Wilson administration.
In Germany, Warburg’s brother Max helped persuade the government to provide millions to Lenin and allow him to cross Germany with other revolutionaries in a special train. The Germans agreed because the Bolsheviks promised to remove Russia from the raging First World War after taking power.
The Bolsheviks succeeded because they had what other revolutionaries (e.g., Mensheviks) lacked – limitless cash. By May 1917, Pravda already had a circulation of 300,000.
It is a myth that Kerensky and the Bolsheviks were adversaries. Kerensky received $1 million from Jacob Schiff. During summer 1917, when it was revealed the Bolsheviks were on Germany’s payroll – treason during wartime – Kerensky protected them. When the Bolsheviks moved to seize power that autumn, he declined the option of requesting troops to preserve the government. Lenin and Trotsky gave Kerensky money and safe passage out. He died wealthy in 1970 in New York, where the Russian Orthodox Church refused him burial services.
Postwar Britain sent the Bolsheviks rifles and ammunition for 250,000 men. With this and other Western assistance, the Reds crushed the White opposition. Loans and technology from Western capitalists poured in for decades, as documented in such books as Antony Sutton’s Wall Street and the Bolshevik Revolution and Joseph Finder’s Red Carpet.
In 1992, the newspaper Literaturnaya Rossiya estimated that, including starvation and civil war, Soviet communism left 147 million dead. Even accepting the more moderate claim of Harvard University Press’s Black Book of Communism – that communism murdered “only” 100 million worldwide – what these numbers represent is beyond comprehension. Stalin reportedly said: “One death is a tragedy; a million is a statistic.”
Leon Trotsky (Jewish born “Lev Bronstein”) and his 300 well-trained Jewish communists from Manhattan’s Lower East Side, boarded the Norwegian steamer “Kristianiafjord” for a journey that brought them to St. Petersburg in Russia. Their purpose was to establish a Marxist government under the leadership of Lenin, Trotsky, and Stalin. Before departing, Jacob Schiff gave this group $20 million in gold to accomplish the task, but the plan was already under way before they even boarded the ship thanks to the Rothschilds.
By December 1917, the Bolsheviks established their instrument of terror, the Cheka (the KGB’s precursor). Lina writes: “Lists of those shot and otherwise executed were published in the Cheka’s weekly newspaper. In this way it can be proved that 1.7 million people were executed during the period 1918-19. A river of blood flowed through Russia. The Cheka had to employ body counters.” By contrast, under the czars, 467 people were executed between 1826 and 1904 (78 years).
Trotsky declared: “We will reduce the Russian intelligentsia to a complete idiocy.” Lina writes: “1,695,604 people were executed from January 1921 to April 1922. Among these victims were bishops, professors, doctors, officers, policemen, gendarmes, lawyers, civil servants, journalists, writers, artists…” The Bolsheviks considered the intelligentsia the greatest threat to their dictatorship. This sheds light on the Marxist buzzword “proletariat.” The Illuminati knew nations are easier to enslave if only peasants and laborers remain. But even the proletariat wasn’t spared. The Cheka brutally suppressed hundreds of peasant uprisings and labor strikes, executing victims as “counter-revolutionaries.”
Satanic torture often accompanied killings. Many priests were crucified. Some victims had eyes put out, or limbs chopped off, or were otherwise mutilated, while the next victims were forced to watch.
Although Russia had been “the world’s granary,” over five million died of starvation during the famine of 1921-22. This wasn’t “socialist inefficiency,” but genocide from grain confiscation. In the Holodomor, Stalin murdered 7 million Ukrainians, including 3 million children, by ordering all foodstuffs confiscated as punishment for resisting farm collectivization. Communist brigades went house to house, ripping down walls with axes searching for “hoarded” food.
In Soviet gulags (concentration camps) millions perished. Aleksandr Solzhenitsyn estimated that, just during Stalin’s “great purge” of 1937-38, two million died in gulags.
The Bolsheviks meanwhile lived royally. Lenin, who occupied Grand Duke Sergei Alexandrov’s estate, placed 75 million francs in a Swiss bank account in 1920. Trotsky, who lived in a castle seized from Prince Felix Yusupov, had over $80 million in U.S. bank accounts. Top Cheka officials ate off gold plates. Communism was plunder masked by ideological slogans. Money and jewelry were stripped from homes at gunpoint.
Lenin and Trotsky repaid their masters. Lina writes: “In October 1918, Jewish bankers in Berlin received 47 cases of gold from Russia, containing 3125 kilos of gold.” The Grand Orient de France refurbished its Paris Lodge with money Lenin sent in 1919. In New York, Kuhn, Loeb received, in the first half of 1921 alone, $102 million in Russian wealth.
Bolsheviks were predominantly Jewish – unsurprising given the long linkage of cabalistic Jews to Freemasonry and revolution. I state this objectively, without anti-Semitism. I am half-Jewish; my paternal grandparents emigrated from Russia in 1904.
In Les Derniers Jours des Romanofs (1920), Robert Wilton, The Times’s Russian correspondent, named each person in the Bolshevik government. The tally:
Bolshevik Party Central Committee: of 12 members, 9 were Jews. (NOTE: Actually 10 now that we know Lenin has been declassified to be part-Jewish)
Council of People’s Commissars: 22 members, 17 Jews.
Central Executive Committee: 61 members, 41 Jews.
Extraordinary Commission of Moscow: 36 members, 23 Jews.
In 1922, the Morning Post listed all 545 civil servants in the Soviet administration; 477 were Jews, 30 were ethnic Russians. “Russian” Revolution was a misnomer.
Leon Trotsky (real name Lev Bronstein) was a Ukrainian Jew. He introduced the cabalistic five-pointed star as the Red Army’s symbol. In New York, Trotsky belonged to B’nai B’raith – the Jewish Masonic order – as did his financial angel, Jacob Schiff. Juri Lina has unearthed evidence that Schiff ordered the murder of the Czar and royal family.
Under Lenin, anti-Semitism became a capital offense. [lightbox full=”https://www.youtube.com/watch?v=uoAEKHBtNIA”]The Bolsheviks destroyed 60,000 churches[/lightbox]; many became latrines or museums of atheism. Yet Russia’s synagogues went untouched.
Jews dominated the Cheka (formed of 23 Jews and 13 others). Lina lists 15 Jewish gulag commandants (Under the Sign of the Scorpion, p. 310). The Cheka targeted classes and ethnicities: the “bourgeoisie”; “kulaks” (landowning farmers); and Cossacks, whom the Central Committee declared “must be exterminated and physically disposed of, down to the last man.” They tried to eradicate [lightbox full=”https://www.youtube.com/watch?v=2kW4T8m2wWc”]Russian culture[/lightbox], renaming Petrograd and Tsaritsyn after the revolution’s psychopaths. In Ukraine, the Bolsheviks seized traditional national costumes. Obliterating nationalism is a precursor to the Illuminati world order.
Though it is sometimes claimed Jewish dominance ended under Stalin, in 1937 17 of 27 Presidium members were still Jewish, and 115 of 133 Council of People’s Commissars. Stalin did turn against the Zionists in 1949, heavily persecuting Jews during 1952, after which he was poisoned.

"THE FINANCING OF THE OCTOBER REVOLUTION OF 1917 BY WARBURG AND THE CONTROL OF THE RUSSIAN CENTRAL BANK BY ROTHSCHILD"
Tsarist Russia was a thorn in the side of western high finance because at the end of the 19th century the Russian empire was the only European power not to have a central bank. “It was still the tsar who decided on coinage in his country”. "It was very simple: the money was his and he controlled the amount." That was to change quickly when the communists came to power: one of Lenin's first measures was the establishment of a Russian central bank after the fall of the tsar. After the Bolshevik Revolution, “unimaginably large sums of money from the private assets of the Russian tsarist family flowed into the hands of international bankers”. It is easy to guess why that happened.
The October 1917 Revolution under Lenin, or the violent seizure of power by the Russian Communist Bolsheviks, was co-financed by German bankers. There are estimates that 50 million marks flowed back then, which today corresponds to at least half a billion euros. The saying of the mother of the 5 Rothschild sons is well known: "If my sons don't want it, there is no war." Anyone who wanted to wage war needed money; but money was only available from the Rothschilds at the time. So the success of the Russian Revolution of 1917 was dependent on money. The money came from Trotsky, who was hooked up with the Wall Street banks. Trotsky married Sedova, the daughter of Jivotovsky, who was closely associated with the Warburg banking house and the cousins of Jacob Schiff, the financial group that financed Japan in the war against Russia. Here an ominous as well as powerful connection opens up, the alliance between capitalism and communism. Thus there is the apparently paradoxical connection that private capitalism, as the arch enemy of communism, financed its revolution in powerful Russia (thesis and antithesis).
Alexander Solschenizyn:
“We cannot state that all Jews are Bolsheviks. But – Without Jews there would never have been Bolshevism. For a Jew nothing is more insulting than the Truth. The Blood Maddened Jewish terrorists had murdered 66,000,000 in Russia from 1918 – 1957.
Between the years 1917 and 1991 preceding the collapse of the Soviet Union, it is estimated that Communist Jews murdered somewhere between 60 and 135 million innocent people."

2024.05.19 16:16 Special_Elephant_278 Any advice on what kind of account to my child’s settlement money in?

I am on mobile sorry and thanks for letting me post here as I have seen a lot help from people being very knowledgeable, I need help on what kind of account to open for my 13 yr old son as x husband and I are running into a situation with his current wife. About 4 yrs ago my son suffered a traumatic and tragic situation at a big box store that is very well known in the US(world wide too) he lost his legs from the knee down and suffered some spinal injuries.Thankfully I had my niece who worked at very well known law firm represent my son, we used my health insurance and my insurance went after big box store.Judge ordered big box store to pay for all his medical expenses until he is fully grown and can receive proper prosthetic legs for his age also medical expenses that were related to these injuries. Now to the financial part,my niece brought in her boss I am guessing the owner of the law firm(not sure how to call them as he is known to go after these big corporations. They had offered 1 million for both the loss of the legs our attorneys said no absolutely not, they pushed for close to $4.7million and it settled. My son already has a college fund thanks to grandparents,my ex husband, current husband and my self so now here comes the ex husbands wife claiming half as she says our son has a father which means half of ex husbands money belongs to her.Thankfully my niece was smart enough to make sure the money is payable to only my son, what kind of account would you all suggest to put his money in? Neither parents or spouses will touch this money as we don’t deserve any of it,sorry for lack of writing I am not good at this, any advice would be appreciated as I want to get this handled because stepmom is taking me to court for it which is whole another story.

2024.05.19 16:12 chazthemannn Dui update and vent/confusion az

Update super extreme az .22 bac. Public defender, dropped to extreme, 2 days jail 7 days house arrest 12 months interlock. That's all, that's kinda weird but I ain't complaining.
This is the beginning of the end. I'm glad court is over, and I can soon start to move on with life.
JUST completed my jail time. This us what's confusing and kinda stupid. For one it's stupid that every dui gets jail time here for a run of the mill basic dui down to even having a gulp of beer immediately before driving, doesn't make sense if it wasn't aggravated, kids in car, wrong way, accident yadda yadda.
In jail there were 5 or 6 of us with a dui nearby in conversation distance, one, is doing 30 days(not sure level of dui) another, super extreme doing one day, another doing 3 days for dui in the slightest, and another doing a dui after a .00 breath test and passed fst (he walked out with me too (he was just arrestedthat night)), mvd is probably still gonna screw him (I think). I self surrendered with 3 people doing "1day" and walked out with them 9 hours later (not complaining but that doesn't add up) but like sit in an ice box waiting room basically with people that did actual crime taking up space for a first cookie cutter dui? Might as well waste people's time when they run a red-light by a quarter of a second too. Just another way to give them money to not fix the streets.
One other complaint, the court system, they were nice to push my court date one extra month for a chance to get things in order, though it didn't help me much as work is hard to get right now. But I am just recently UNDERemployed from my arrest, and filled out the payment plan application, showing ON PAPER that my minimum living expenses exceed my income, and they set my payments for 150 a month, whereas two of my friends that easily double, almost triple my income, pay 50 bucks a month for the same charge....
The system ain't right.
Edit: my closest friend who has a dui, got arrested with barely extreme, didn't have it lowered, paid 8k for top of the line lawyer, got 3 days jail and actuallyhad to go to a cell and all that, same fines, but had to take all the classes and stuff too, which I don't. So now naturally he's very annoyed he hired a lawyer. But he's one of the ones that has a lower monthly payment.

2024.05.19 15:50 FreeHoopStreams What is this front office’s vision for the team?

Inspired by a Locked on Hawks podcast between Brad Rowland and Tyler Jones, I think it’s a good topic for the sub.
Schlenk’s vision was a roster full of guys who can “dribble, pass and shoot.” It became a meme and he wasn’t perfect, but he believed in it. Nate took over and had our boys playing a style that didn’t fit the roster Schlenk built AT ALL but that’s a conversation for another time.
What is this front office’s “dribble, pass and shoot?” I would argue that so far, we haven’t seen them make any move that tells us what their vision is. We’ve seen some great decisions in DJ and OO’s contracts. Not rushing to resign Bey put us in a better position post-injury. And we’ve seen some cost-cutting moves that are surely ownership-driven. But none of those tell us how they want this team to play. “Hawks DNA” is cool corporate speak and I’m sure they value character, but how do they want this team to PLAY?
Quin was hired mid-season without waiting to talk with other teams. Considering his exit from Utah, I don’t think he’s doing that without getting significant input. He had us start the season playing “show and recover” defense on PNRs, but we didn’t have the personnel to recover. We got lost in the switches and gave up open shot after open shot. As the season went on we were forced into more drop coverage, relying on Clint to make up a lot of ground. Throughout this, Quin commented frequently on our lack of size.
In Utah, Quin built a top defense around Gobert as the anchor. They did play a lot of drop coverage because it fits Gobert best. This new show and recover scheme fits Sarr and Jalen best. They have the athleticism to show on the screen and stop the ball, then recover onto their man and keep Trae out of switches. I believe this is Quin’s vision for a strong defense around Trae.
Regardless of what we do, we need to make moves this offseason that establish a coherent vision of what they want this team to be. We can’t be caught in decision paralysis where we wait too long to make moves, ANY MORE. Drafting Sarr would show me that we have a clear direction and our FO is building a roster that matches what Quin wants to do.
If you don’t want to draft Sarr - say you like someone else, or you want to trade down or trade for a star. What is your vision for the team’s identity?

2024.05.19 15:50 merilel AITA for requesting a health refund after a traffic accident?

Sorry in advance since English is not my native language.
A few weeks ago I was returning from some errands because my cat had died so I was a little numb. However, regardless the situation, I'm always hyper aware of the traffic and also drive a 100 cc scooter. I was exiting a traffic circle - or rotunda, I don't know how you call that, but they are very common in my city - and the car in front of me reduced to stop and since there is a school nearby, I'm usually very careful and I began to slow down until... Another scooter crashed behind me and I flew away! At the time, I was confused and the adrenaline was rushing so I didn't feel much pain. The young lady behind me was full of bruises and very scared of the situation too. Even though she crashed behind me - and since I was really depressed because of my cat -, I tried to be nice and console her. Also, the military police was right behind us and they helped us to get our scooters out of the way and some lady from the restaurant nearby helped us. In my country, the military police does not take care of the traffic law thing, so they asked if they should call the traffic police or the ambulance. Since, for me, it was very clear that it was the other person's fault and she was very easygoing about that, we agreed that it wasn't needed. BIG MISTAKE.
Then her fiancé and future father-in-law arrived. The FIL was very nice and fiancé was very angry. She cried as soon as she saw him. Maybe relief? I'll never know. So... Since she was being taken care of, we exchanged numbers and I ignored my pains and went back home. The next day was a holiday and my body began to hurt. I thought it was just the impact and at night I asked my boss to work at home the following day.
Then while working I felt pain every time I sat down or stood up... Uh oh! I went to the hospital and guess what, my coccyx was fractured. The doctor from the emergency room sent me home with some prescriptions, told me to do a MRI and schedule with a specialist. So I did that.
Hospital bills are not a problem and even though I live in a country with free healthcare, if possible, we do have insurance because private hospitals are less crowdy. And that was the kind of hospital I went to. My insurance covers part of the hospital bills, but do not cover for medicine or health accessories used outside the hospital and those are EXPENSIVE!
So I contacted the young lady and told her what happened. I sent her the mechanic and the medicine bill and she refunded me. A week later I went to the specialist and he prescribed more pain medicine and a coccygeal protection cushion. I sent another message to the young lady and she told me to speak to the fiancé. Then he told me aggressively that they would refund me this time, wouldn't refund the next medical bills and I should go to use the free universal healthcare. I didn't answer to that and then sent him the bills a few days later. He got angry again and told me that he would refund only half of it and only next month.
For more context, I bought everything the cheapest place possible and I'm not even charging the part of the insurance will charge me. I could go to court for that but I'm the kind of person that avoids conflict. Also, I'm not really sure, but I also noticed my financial situation seemed slightly better than theirs and that amount of money isn't going to destroy my budget. So, AITA for asking for refund?

2024.05.19 15:45 777_heavy How to exacerbate the exodus from New York, as prescribed by the NYS Legislature:

https://spectrumlocalnews.com/nys/central-ny/politics/2024/05/17/n-y--businesses--pushback-heats-up-consumer-protection-debate-
The state needs consumer protection reform, as the standards for individuals getting their complaints to court are onerous and emulate that of a class-action lawsuit. However, like bail reform, where 42 other states have managed to pass reasonable and well-written bills for unfair and deceptive practices protections, the New York State Legislature is trying to drop this turd on us. In our bill, there is no definition of “deceptive” that doesn’t allow for subjective interpretation, and there doesn’t even need to be a complainant to file a suit - a non-profit organization will be allowed to bring forward a claim without a plaintiff and without any repercussion if they lose. What’s effectively being created is an avenue of legal extortion against NY businesses and to make matters worse, Hochul’s budget increased the minimum payout for class-action from $50 per complainant to $1000.

2024.05.19 15:38 gaiusvv would it be weird for me to start playing again?

i’m 20M and my previous sport were lawn tennis. I played volleyball for fun and I really love playing it with friends. the reason why i never joined the team in my school was because there are a lots of people who wants to join and as someone who doesn’t have any ‘real’ training/experience in the field, i feel discouraged that i might not get the position i want. recently, i watched videos about our national team playing against japan and it really made me feeling the ecstasy throughout my body. i want to experience it in person, in the field, on the court with everybody with people watching us playing the game. but i feel like i’m afraid that i might fail myself. what do i do

2024.05.19 15:37 therealmocha Can’t get an apartment, previous apartment says we owe $10k (IA)

Hello, if this is the wrong place for this lmk, I’m kind of stressing tf out right now. My fiancée and I are trying to get an apartment by the end of the month, since our current lease is up. Everywhere we’ve been applying keeps denying us, despite us making 3x rent and having decent enough credit.
One of the places sent me a copy of my report along with my denial letter, claiming unpaid rent as the reason I got denied. However, there was nothing showing in collections. When I called, they mentioned an apartment complex we lived in 2 years ago that popped up while doing background, that said we owed $10k?
I can get into those details if needed, but basically we came to the end of our lease there, were month to month for a bit, then moved out without letting the complex know. I understand now that that was stupid, since they ended up charging us rent for the next several months, which amounted to the $10k.
After calling the complex I talked to a guy who basically said “yea, you’ll just have to take it to court there’s not much I can do I’m sorry”. I really don’t have any idea how to do that, and still don’t have a place lined up.

2024.05.19 15:30 Tentenen_tenen PH agency breaching their own contract, delaying/refusing to return my money for 4 years now!

I have a contract with an agency last 2018 pa. It is a J1 internship, but I got refused for visa twice so I decided to just withdraw the application in 2020 before the Pandemic. Stated in the contract that they will return the money (my refund less the expenses) 45 days after they received the letter but its been 4 years already and puro lang sila pangako na mag rerefund, they even emailed me na before 2023 ends, they will give my refund. Talked to the owner already last Feb 2024 and he asked me to give him a month to settle it, I asked for an update after a month and of course another excuse na naman. I have all the evidence naman na they should return my money, I even contacted their partner agency in US already and they confirmed that they already refunded my placement fee last 2020 pa, and this agency here sa PH are saying na till now di na daw nila ma contact and di pa rin nila na rerefund money ko sa US. lol!!
I really don’t know my next action na since sobrang nakaka stress na silang kausap, tried filing a complaint sa DTI pero they endorsed me to Dole which is di naman nila tinanggap since di siya pasok sa jurisdiction nila.
Can I file this sa small claims court? Super desperate na since pinahiram lang siya ng tita ko sakin and sinisingil niya na ko 😩

2024.05.19 15:16 phospholipid77 Psychometrics and neurodivergence

I've noticed in a couple few of cases over the years that folks I've worked with who present with a sort of low-grade or even subclinical neurodivergence have come back with just bonkers psychometric results. In one case, alarming psychosis. In another, the results suggested high histrionics, superficiality, and shadow anti-social tendencies. There was one or two others. In all cases, the tests had perfectly apt validity scales. But it seems that the clients were either interpreting the questions hyper-literally and/or too expansively (via some form of literality).
For example, in one case I check in with a client who reported they hear voices others can't hear. This person was not at all psychotic, but did present as odd. They pointed out that when they think about things, they can hear their own voice in their head. This heavy literality was present in nearly all of the psychotic indicators, and it was that literality that pointed us towards ASD1, maybe 2. In another, a client reported that "too many rules" keeps them from getting what they want, an item meant to indicate entitlement and recklessness. This was a super tender human. They replied that the question wasn't asking about rules, which they like. It was asking about "too many" rules, and reflected back about his difficulties with insurance bureaucracies and dealing with the layers of traffic court. He was over-litigating about 30% of the test in his fixation on "being honest". In this case, that pointed us to ADHD and maybe ASD1.
I think of these cases and they really impart upon me the importance of going through individual items of interest and REALLY listening to the client when the results just don't quite make sense. I love these instruments, but I also don't.
EDIT: I'm recalling part of the latter conversation. You should have seen what they did with the item that said "I want to be as happy as other people seem to be."
"That one was hard. Who are other people? People happier than I am? All people? What does happiness mean? Does it mean they're more cheerful, or just more accepting? I want the latter, but don't need the former. What about the word "seem"? Does that mean they seem that way to me? Seem that way to themselves? Or they just broadly seem that way? Does the word "seem" mean the only "seem" happy but it's a facade? Or does it mean that their happiness is so inherent exudes in how they appear in the world? I don't know what it's asking. I said yes, because I thought of how effortless David Bowie is, and I'd like that. But I do really enjoy my life."

2024.05.19 15:06 SphericalDarkness Adopted 16-Year Old Forced To Destroy (Shoot Up) His Console By Adoptive Grandparents

Hello, everyone. I apologize for the length of this but I'd like to include as many details as possible here due to being fairly worried about this person.
A tiny bit of background info - I run a VR public group in a game called VR Chat. We allow anyone 16 and up to join. Hence I do not know this 16-year old personally but they have messaged me for help and advice. We will call them 'Tim' as I do not know their real name or other personal details apart from what I will describe. I also do not know much about US law, so apologies if what I am asking about has obvious answers.
Tim, who is 16 and lives in Tennessee, has been adopted by his grandparents, I believe very shortly after his birth. Both biological parents had signed the adoption papers. He thus lives in the grandparents' house.
His grandparents are very religious, so Tim has to attend church with them. Some weeks ago, they told him that he needs to "prove he is not weak". Apparently, this has involved taking his console and VR headset, then using some sort of a projectile weapon (pistol, I'm guessing) to shoot and completely destroy the said items. These items have since gone to the trash but Tim has photos of the items with bullet holes.
Upon being asked what the punishment for not doing so would entail, Tim replied that the grandparents had threatened to kick him out of the house.
This, coupled with a possible cirrhosis of liver (unrelated to this particular event - he also does not consume alcohol), has brought him great mental anguish and depression, as VR socializing was something that had helped him greatly.
Upon inquiring about his parents, he said his mother is 'interested' in getting custody back. But I do not know whether she is aware of his current situation.
Again, I have no relation to this person apart from them being part of my VR group (with over a thousand members). This is also all the information I had gathered so far. Tim can also provide the city in which they live in, if required, but I had told them to not disclose any such information to me at this time.
What could Tim do in this situation? He is clearly very distraught and depressed because of this event and, possibly, because of the general way his grandparents are treating him (conjecture on my part). Police? Small claims court? Child protection services?
Thank you very much for all of your answers.

With unmatched arrogance they thought they could nullify the legitimate votes of eighty-seven million Americans, overthrow our government and install a despotic tyrant in the White House. With complete disregard for the will of the people this cadre of criminals. political opportunists, and power-seeking megalomaniacs thought they could undo over two hundred and fifty years of democracy, shred the Constitution rescind civil rights, and with Mafia-like tactics bring our country to its knees.
If the Chinese, the Iranians, the North Koreans, or Russians attempted such a thing the nation would rise up and tear them to shreds; and that is just what the law enforcement agencies in seven states (With more coming) have done.
Each of these seditionists. traitors, and internal terrorists have been indicted and will be tried for this, the vilest of crimes, and will suffer long prison sentences for the lowest of crimes known to man. There exist a list of felonies for which they must answer, a list too long to enumerate here, but one that will illuminate just how despicable they are and will stain the names of their families for generations to come.
They thought they were smarter than us, thought we would roll over in fear of their power and influence, but that isn't what Americans are made of. Too many of our ancestors paid the ultimate price to ensure our freedoms and no cabal of smarmy thugs will ever waltz in and deny us what's been paid for by so many heroes.

A lawyer who was the architect of a plan to subvert the 2020 election and return Donald Trump to the White House denied all charges against him when he appeared in an Arizona court Friday. John Eastman is the first of 18 people charged in the battleground state to appear in court over the scheme to empanel fake electors to support their favored candidate. Others include Trump's former personal lawyer Rudy Giuliani, one-time Trump White House chief of staff Mark Meadows, attorney Jenna Ellis and campaign adviser Boris Epshteyn.
Eastman on Friday entered not guilty pleas to nine counts including conspiracy, forgery, and fraud.
If he is convicted at a trial currently set for October, the crimes could entail prison time. Eastman told reporters outside court that the charges should never have been brought. "I had zero communications with any of the electors in Arizona," he said. "Zero involvement with any of the litigation or the legislative hearings in Arizona. We will proceed to trial, and I'm confident, if the law is faithfully applied, I will be fully exonerated." A US Congressional committee examining the events leading up to the January 6, 2021 attack on the Capitol recorded that Eastman was the author of memos claiming that then-vice president Mike Pence could refuse to count electoral votes from certain states, thereby preventing Congress from certifying the results.
Democrat Joe Biden won Arizona, a critical election battleground, by just over 10,000 votes, but many Republican Party officials insisted -- without evidence -- that there had been fraud and that Trump had been the real winner.
Under the US electoral college system, each state appoints electors to represent the candidate who won the most votes in the presidential poll. Those electors sign official documents that are sent to Congress; these documents are tallied, and the winner is the person with the most electoral college votes. Despite Trump's loss in Arizona, his representatives nonetheless signed documents saying he had won.
When Congress reconvened after the violent attacks on January 6, it ultimately ignored Arizona's fake electors and certified the genuine results, officially sending Biden to the White House. Arizona is the fourth state to seek charges against people who tried to form an alternative slate of electors, after Michigan, Georgia, and Nevada. Meadows, Giuliani, Ellis, and Eastman have all been charged in Georgia, alongside Trump in what is probably the most explosive of the four criminal trials he faces. As a swing state and something of a ground zero for election conspiracy theories peddled by rightwing Republicans, Arizona is once again expected to be closely contested this November when Americans head to the polls.

2024.05.19 14:45 findingniko_ Any legal options for improper phone repair

I live in the US and just returned from a 2 week trip to Portugal where I ended in Porto. I spent time in the Açores where I dropped my phone on the last day. The drop resulted in damage that made it difficult to use the phone properly. When i arrived to Porto I took it to a repair shop on Rua Santa Catarina. They put a new screen on my phone, but when I got to my accommodation I noticed that the display was incorrect, it had rounded corners whereas there are supposed to be no rounded edges on this particular model ( Samsung S22 Ultra). I took it back to the shop and asked if they could put the original broken screen back on so I could just take it back to the US and have my phone service provider fix the phone with the proper parts, and asked for a refund since the service was incorrect. At this point the technician walked me down to a different shop (same owners I guess?) by São Bento, where they were adamant about me allowing them to put a new screen with the proper display instead of giving me a refund. I argued with them about this, but they said if they put the proper display on my phone, I could take it to analyzed by a Samsung technician and if there were any problems they would give me a refund. I said okay, and they put a screen with the proper display on my phone. The next day I went to tall to a technician at Samsung. The technician said that although the display was correct, there was an issue in the models. Being from the US, my phone is an American design. The screen they put on my phone was meant for European models. The technician said that this can cause problems like shortages because although the models fit, they are different and at Samsung they are not allowed to mix the different parts. Later that night I also noticed issues with the function, like delayed swipe times and my "back" button not always working. When I took it back to the store with this information, despite telling me they would give me a refund if a Samsung technician verified any issues, they refused to give me a refund. I ended up calling non-emergency police over this as I felt I was wronged, but the police stated that since there was no signed contract, they were not obligated to refund me. They said my only option was to write a complaint in the book regarding the fact thay they should have proposed a contract to sign and failed to do so, to have the fiscal authorities review the business. I wrote the complaint and intend on sending my copy in to be sure it is reviewed, but I'm wondering if this was truly my only option? I'm very aware of the fact that the laws in the US are different, but I know that here in the US I would have more options such as taking them to court to sue. Is this also an option in Portugal? I know it would be a hassle but at this point I'm more than happy to go back to Porto to go that route as well. Would it be wise to contact a lawyer?

2024.05.19 14:44 LetterGrouchy6053 On the inevitability of Justice.

There is an ultimate price for treason and with God's grace the worst of all will pay it at the end of a rope!
It starts here -- see below. Italics mine.
