Very long story but we tried to buy a house nearly five years ago and the seller couldn’t sell it due to bankruptcy. We waited over a month past closing, they never responded and we lost our mortgage rate lock, so we asked for the deposit back. Their response was to sue us in superior court in MA, so we’ve been wading through that since, but never had a trial, etc, but the judge asked them to do something that they didn’t do and now the court has issued a “judgement of dismissal for failure to comply.”
Aside from wondering if / how to move forward (since a new trial would probably surpass the deposit amount, given what we’ve already spent on lawyers fees), does this mean it’s over? Our lawyer is hesitant to celebrate and thinks they can ask the judge to reopen the case…
Can anyone lend more insight?

FLORIDA USA. Filed 02/20/24 CHAP7 Discharged today, $98,000.
Last August, I had a great score and suddenly it starting going down for no apparent reason. I had never missed a payment or been late ever in 25 years. C,h,a,s,e shrank the credit limits on my 2 accounts I had with them 11,000 went to 1200; 13000 was reduced to 500. I paid any remaining balance in an attempt to save my profile. it was too late and this reduction of credit line impacted my score even more. Like an avalanche, other creditors began shrinking and closing accounts. One financial person suggested getting a home equity loan to zero out my revolving credit accounts. I was about to do that when I was Laid off at the first of the year. I therefore was not qualified to take out a home equity loan. Meanwhile my score plummeted in to 590. Still never missing a single payment. I still can find no explanation for any of the.reductions. I was not maxed out. I still had available credit over 150K. Companies could not or would not explain their action. My credit profile was ruined. Combine that with the Lay off. Bankruptcy Chap 13 became an idea. I was reluctant at first, however, I was reminded of how my situation had been compounded because of creditors actions and proceeded. However, Chap 13 turned out be wrong as I was a good fit for CHAP7 I live in FLORIDA, where the exemption on a homestead has no limit. Fortunately, I had not been able to qualify for that equity loan. I have 100% equity in a 475,000 house that was fully exempt. I was able to keep everything including a retirement savings account. The only exception a small tax return, which I surrendered. I was able to keep 2 non-financed vehicles : one being a 1985 Lincoln Towncar. Several attorneys said that I would likely not be able to keep this vehicle. Although my attorney was willing to give it a try.

the a/c wasnt working so they gave it the lowest value offer of 1500. I am so glad to not have to go purchase a vehicle right after this. Im looking forward to staying at zero payments.
My Score was 760 last may, plummeted to 560 in December, filed in Feb 24 my score increase immediately to 590. after the 341 meeting my score increased to 680. it has been creeping upward since then.
I called up C.a.p.i.t.a.l.O.n.e. Venture which I had a zero balance account prior to the filing. The representative explained to me that they could not reopen my account, I needed to reapply I authorized them to process the application. It was subsequently approved for 7500. Basically, solving my only real concern of needing a card for travel, hotel, car rental as I begin working once again.
When I think about how this turned out, I cannot help but be pleased. It was an unusual case and I did honestly worry about the outcome. Technically, my net worth increased in bankruptcy additionally my score that was lowering for whatever reason is already now increasing. I was able to accept a much simpler job working less hours to cover my expenses.I have been rescued from these increasing interest rates. It is such a relief. NOT LEGAL ADVICE

I filed for bankruptcy in February. I will be receiving my discharge next week. This was mainly for business debts. I received notice today that a past client is wanting to sue me for work done that they didn’t like. They was not listed as a creditor because there never was a lawsuit, and technically the owed me money but they refused to pay. This was a year ago so I just let it go. My question is would I be able to reopen the case, add them as a creditor if they did win a lawsuit, then wait 60 days and close the case again? Thank you.

For years, Wilkeson Pointe at the Outer Harbor has been a magical waterfront destination. While much of the park has been an idyllic setting for visitors, there was a large swath of land that was completely underutilized. Now, that sprawling parcel (approximate 7-acre site, the area between the Wilkeson Pointe water edge and the nearby Fuhrmann Boulevard entrance) is being dug up in advance of a number of park amenities/infrastructure being added that will change the face of Wilkeson Pointe. Funding for this project is from the New York Power Authority (NYPA), via relicensing agreements from the operation of the Niagara Power Project. The first building on the North Aud Block is under construction. The Canalside Gateway Building, with an approximate 3,000 square perimeter footprint, will be a four-story structure that includes a level along the canal towpath. Medaille campus to be Buffalo Academy of Science Charter (buffalonews.com)
Buffalo Academy of Science Charter School’s plan to occupy the former campus of Medaille University has come to fruition.
CBRE Upstate NY, representing the Office of the Institution Formerly Known as Medaille University, announced Friday that it has closed a deal to sell the 15-acre campus to Charter School Development Corp., a nonprofit developer based in Maryland that helps charter schools with real estate transactions.
CSDC will now work with BuffSci in a lease-to-own agreement.
“It is a proud and exciting day for all of us,” said Ismet Mamnoon, president of BuffSci’s board of directors, in a news release from the charter school.
The purchase price was $9.9 million, according to a BuffSci spokesperson. BuffSci’s partnership with the National Charter School Growth Fund will provide $2.5 million toward renovating the campus, the spokesperson added. Renovations are slated to begin Monday.
(Note: I was kind of hoping this would be blown apart for housing, but this seems like a good plan too... especially since it appears the BuffSci team seems to know what they're doing)
Amherst Central Park critics see museum move as next target (buffalonews.com)
Under the proposal, announced last summer, the Heritage Village’s 10 historical buildings, two replica buildings, a gazebo, its cache of artifacts and a group of farm animals would move from the museum's home at Tonawanda Creek and New roads to the former country club at Sheridan Drive and North Forest Road.
Plans show the Heritage Village buildings surrounding its gazebo on a 22½-acre plot in the 170-acre park's southwest corner.
The village’s museum and collection of more than 60,000 artifacts would move into a new building originally expected to open by spring 2026.
Fields for its farm animals line the Frankhauser Road side of the site. A small section at the top of the plot is labeled “future BNHV expansion.”
The project requires the museum to arrange for the move of a one-room schoolhouse, woodworking shop and eight other Amherst buildings that date as far back as the 1800s from northeast Amherst to the Westwood property about 9 miles away.
While some residents have raised concerns about the fragility of the historical buildings, Stiver said they were moved previously to their current location, and they are sound enough to move again.
Building the new museum initially was estimated to cost about $6 million while moving, and refurbishing 13 buildings was expected to cost another $2.5 million.

I file for bankruptcy chapter 7 in October. My credit card debt and personal loan debt was dismissed fully. However, my student loan debt was not. I was advised to reopen my case by a lawyer because my loan debt was higher than the other unsecured debt. The judge has reopened the file, and I have a court hearing in one week. My student loan creditor has been calling me nonstop despite my conversations with them. I have sent them the information about the court case. However, they have called me, emailed me at my place of employment, called my parents, called my siblings and even, a college advisor I’ve been out of college for 15 years. I’ve been researching if this is legal or not. I’m representing myself in the court case. I plan to bring this constant harassment to the judge. Does anyone have any recommendations or suggestions on how I should handle this? BK lawyers would be great if possible.

This is for those in the US who want to understand more, how long it has been going on, why students should not be dismissed as "uninformed", date/time contexts, availability of data, legislation, investigations and some good citations sources that are legally recognized as legitimate in both Congress and the courts including the Supreme Court. Good for parents/family/friends, students/graduates, and general tax payers.
"Did some research crowd before you _______"
Well lets hop in on the fallacy; its really pointless. I might as well carry a gallon of water in a desert with colander at best a strainer is not a bad way of looking at it. Without contexts below taken into account you wouldn't bother making it if your not just trolling or apathetic to it; fair points that is why this post is not for you. For those in the older crowd this is why you should be even more cautious making this fallacy to people like myself outside of merely stating your opinion. The problem is we are now at a point to where it is going to affect you on a common factor such as taxes (state and federal), fiscal budgets of states and federal, as well as new regulations.
Why this post: I am documenting this as part of my journey to all of you outlining on how I arrived to getting my BDoR approved, and my loans discharged as well as what is not told going through the process much less before it and about it. Not so y'all can argue with yourselves, although your free to do so, is the intent. This is for explaining to those that "don't have skin in the game" as they actually do, serving as a really formed rebuttal against news media's clear motive on emotional engagements over pragmatic information.
I am a person foremost a Dad and a professional in the economy. It has and still is painful in various ways. My perspective is that I gained far more in personal finance understanding, debt and its implications, and the struggle of getting out of it made me hungrier to succeed as well as modeling to my daughter those principals.
Time Range - When something occurs especially in law time and dates really matter. Many attorneys informed me of this not only in my child custody case, my initial attempts in bankruptcy for adversarial proceedings, your tax filings, and of course the programs forgiving loan debts. Through this process I was given advice by legal counsel so I must certainly say this is for people and in no way shape or form constitutes legal advice in your own situation nor would I irresponsibly claim otherwise.
This is short circuit number one and to prevent the same wet blanket statement as a rebuttal I am going to set a timeframe that is applicable to myself. I am mostly looking at those that graduated high school from 2000 to 2004 as well as College grads in for-profit schools prior to 2009. That does not mean others cannot benefit from it outside this time range. If you were in the earlier 2000 - 2010 surge in technology you'd also know that <15% of Americans had access to the internet during this timeframe. The internet now is not what it was back then and must be recognized as such. You'll understand why as we go through this post, specifically in the next context.
Locality (Geolocality) - Laws when passed or litigated in court against persons or entities this is important. when rulings are made, being appealed, and when they are applicable. Luckily I was raised by my mom to keep good records in her short time working as a paralegal before she opened her day care that she ran for 15+ years.
One such example is if I looked up legal documents in California yet the lawsuit is filed in Denver they will not show in CA gov databases was very common back then. Private brokers of cross-walks did exist as I later found out often behind paywalls that at the time could very well be prohibitive especially in my journey. Prohibitive in what matter you may ask? I entered the local southern California economy as a graduate in May of 2008. According to Wikipedia: In the United States, the Great Recession was a severe financial crisis combined with a deep recession. While the recession officially lasted from December 2007 to June 2009, it took many years for the economy to recover.
Now that I mentioned Wikipedia let also establish another good factor to the "Did you research" statement: Wikipedia, a free-content online encyclopedia written and maintained by a community of volunteers known as Wikipedians, began with its first edit on 15 January 2001. Looking at the timeframe I listed earlier that'd make me a Sophmore in High School. Depending on your school's location and budget would play a role in the: Internet Access in U.S. Public Schools and Classrooms: 1994-99 (ed.gov) which challenged schools to have internet access by 2000 putting myself as an early adopter as the library had no more than 10 computers available for student use often with time limits per student.
Ok let's take a look at this in context assuming I would "Just Google'd the college". I went to Westwood college. According to Google Trends queries to the actual college entity vs the owning company alongside state localities to understand For-Profit colleges: For-profit colleges in the United States, Alta
Such a simplified query can encompass both good or bad results for students/parents/etc as determined by Google's search algorithm implementation they had in production at that time.
I can easily say we all enjoy the Wikipedia and Google search abilities, except those that were around BEFORE IT.
Alta College became an entry in October of 2009 according to Wikipedia's version history, I attended from 2005 to 2008. Yes, you may say this is anecdotal and situational. To that however I would state in regards to the information I've listed above in terms of accessibility of information including my lack of knowledge in LLC formation therein already is grounds to the why the statement of "If you did your research" come up short. Additionally the college I attended had its first wikipedia page published in July 2006 https://en.wikipedia.org/w/index.php?title=Westwood_College&oldid=65337438 now as I stated earlier I entered in August 2005. A good source of objective information on both companies DID NOT EXIST.
Another implicit assumption on each student would be the understanding behind incorporation, the legal benefits to do so and the implications of not doing so. Earlier I mentioned my mom owning her own business as a LLC. Oddly it never occurred to ask why'd you would have chained LLCs until I took my economics course in late 2008; I also can assert she wouldn't have been able to tell me either as she passed away in early 2008. I can firmly state it was not covered in my High School. Taking location in mind along with the time frame the Google Trend would make sense to me without this knowledge as a precaution when making my choice. If we improved American history classes to teach more about actual universities in High School as well as the business concepts of Inc, LLC, Liabilities ect we'd be more aware going forward. I cannot change the past, just learn from it. That is a point I think most can agree on. I only know this now in hindsight.
This now raises another misconception I encountered; that this is a "recent problem". No. It is not. When I researched how to approach my mounting student loan debt making $30K annually in California where my job was as a junior developer bankruptcy looked like a viable option. After speaking with several law offices I found out that was not an option. One case in particular was cited to me: United Student Aid Funds Inc. v. Espinosa (No. 08-1134). Toby J. Heytens, an assistant to the U.S. solicitor general, told the justices that “there is an important public interest at stake here, which is that the Department of Education is reinsuring all of these loans.”. Um I wasn't alive in 1980 much less in school. I can clearly affirm, even under perjury, that court case was never covered in any formal school setting. I will not assume for others.
This seemed odd to me as the IRS has insolvency guidelines which must be read, signed under perjury, if you're attempting to go through bankruptcy. According to the law office I was working with this is standard procedure. During that time I did more digging and found: Getting By: Economic Rights and Legal Protections for People with Low Income - Helen Hershkoff, Stephen Loffredo - Google Books that prior to 1976 student loans were dischargeable in bankruptcy like other unsecured loans. An undue hardship test was introduced for federally insured loans under five years. Higher Education Act of 1965 was a result of January 1965, President Lyndon Johnson told Congress that higher education was "no longer a luxury but a necessity" and urged Congress to enact legislation to expand access to college.\3]) Representative Edith Green of Oregon introduced H. R. 3220 this would be amended a lot through the following decades.
To me this was a pivot point in 2009 when my daughter would be born. This new sense of urgency to continue my career growth grew exponentially to say the least. I would later find out that as I did what I thought was the right thing in making more money I would eventually come into a catch-22 where I no longer could be insolvent due to income growth over my last 5 years yet not making enough to cover a realistic cost of living / quality of life. I like to call this the "green gap" where you make too much but not enough when taking the time and place of the person in question into account.
That last part is important in another way. On April 20, 2009, the United announced that Alta Colleges had agreed to pay the U.S. government $7 million to resolve allegations under the False Claims Act that Alta's Texas schools submitted false claims for federal student aid funds. The college admitted no wrongdoing and was not required to change any of its practices. 1863 was when it got passed. The laws are on the books, in Texas... GEOLOCATION matters here! Denver and California are not in Texas, nor does Alta College accept students. I realized later I was structing my searches in the context of California not Texas thus missing what could have served as a red flag and impeding troubles.
Did you also get that odd tidbit there? I went to Westwood College, owned by Alta College. Westwood College at one time had 17 campuses across California, Colorado, Georgia, Illinois, Texas and Virginia, as well as an online campus. Westwood College offered 27 degree programs, including in business, design, technology, industrial services, justice and health care. I didn't find that correlation until after I graduated while pulling fiscal records for approaching bankruptcy for the second time which again proved fruitless for the new reason. I made too much, according to the insolvency guidelines.
Talk about looking for the wrong thing in the wrong place. Veterans with GI PAY ATTENTION HERE. These documents I found on a google query back on May 2018 listed as plain pdf files in an IIS server that didn't have directory exploration OFF so it was indexed by Google. This is the beginning of how this snowball started especially for me. For-Profits took advantage of Veteran GI benefits with them having to show for it as the report further explains. Additionally, this is now a PRIME target for money.
Between 2006 and 2010, combined VA and DoD education benefits received by 20 for-profit education companies increased from $66.6 million in 2006 to a projected $521.2 million in 2010, an increase of 683 percent: o Between 2009 and 2010 alone, revenue from military educational benefits at 20 for-profit education companies increased 211 percent. o In the first year of Post-9/11 GI Bill implementation, the VA spent comparable amounts ($697 million and $640 million respectively) on tuition for students attending public schools and students attending for-profit schools, but the VA funded 203,790 students at public schools compared to 76,746 at for-profits. o Revenue from DoD educational programs at 18 for-profit education companies increased from $40 million in 2006 to an expected $175.1 million in 2010, a 337 percent increase. o Revenue from VA educational programs for the same 18 for-profit education companies increased from $26.3 million in 2006 to an expected $285.8 million for 2010, including a five[1]fold increase between 2009 and 2010. o Revenues from military education benefits at 20 for-profit education companies increased more rapidly than overall revenues for every year between 2006 and 2010.
Well, what about non-veterans? Now that these companies earned the ire of Congress because the GI money for education was not being used wisely a wide range of investigations opened up starting mostly from what I found in 2009; in simpler terms after I went through the program. Another report on September 30th 2010: 9 U.S. Senate Comm. on Health, Educ., Labor & Pensions, “The Return on the Federal Investment in For-Profit Education: Debt Without a Diploma” is an excellent accompaniment.
Now lets talk sales. The how/why of students, parents and guarantors agreeing to this madness. Well if you've learned ANYTHING from the prior sections with timeframe, locality, accessible information and how to apply all of it correctly we run into a sales person's dream buffet. We can see in HELP-ALTA-000271 that distrubition of reports clearly targeted veterans which correlates the findings in the Senate's investigation.
Often what is not discussed in detail is what is covered in document HELP-ALTA-000123 Key Responsibility #2 Lead Development. An internal training shared with counselors assisting in student sign up. Cross reference this with internal document HELP-Alta-000262 (Document 10 Page 2) that outlines new hire standards to meet a volume standard of 70% to 80%. Disclosure of these internal non-public, therefore NON-RESEARCHABLE documents was done via subpoena. Begs the question: How can a student research something they don't know about. Outside of the attorneys I have met in life this is well over the head of a lot of people I have had direct interactions with however I will NOT extrapolate over the US as a whole. Use the information in context with your experience.

This is where I made, in my life the worst mistake I have made in 18+ years. I saw the Ads on TV first during late-time hours in the Summer of 2005. I had graduated High School in 2004, now 18, working full time as data entry clerk, renting the floor from a family member (not a room, you read it right).
I watched as opiate addiction was ruining my mothers health, entering her in rehabs still holding my job down taking the bus. December 2004 I got my first ever bonus. In January I used it to get my first car as my mom urged me to get a degree. She had watched as I flipped burgers in 2003 for McDonalds to this data entry job knowing full well what CoL was in our area. Being tech savy as I built my own PCs for others, though never my own, when I was only 14 I turned to the internet to fact check these tv ads. NEVER believe what ya see on TV as the mantra. I found lots of materials of praise yet hardly anything at all in the reverse. Man if I only knew SEO tactics now as a Senior Full-Stack Engineer in this industry! Doesn't do any good to think about that now though, lets go back to 19 year old me. I made an appointment, toured the campus with my mom and here is how they got me. I could earn a Bachelors in 36 months in programming.
She knew full well I had technology in my DNA feeling assured I would excel in such a field. What went through my mind wasn't salary, it was my mother's health. The admissions rep stated I required a cosigner. My mom said she'd cover it so her last child can get a good job in a now fast growing industry. We talked it over deciding to visit a local JC. Their we found that I would not be able to attend for nearly 9 months out. Seeing the price differences I said maybe that was smarter. To my surprise my mom objected with getting me degree as fast as possible was a better idea. I didn't know why she said that till much later. "You just need the degree son, sometimes employers are even ok with it not being in the same industry as what ya get it in.". I signed the dotted line...
She died in March 2008, never seeing me graduate in May 2008; I completed the degree in 2.75 years in which I overtook, getting a Bachelors, over my sister's AA which she started 5 years ahead of me. To her grave she thought through and through everything was going to turn out well for me especially given my chosen field. In that regard she was not wrong because I MADE it that way. I still to this day have never let that degree define my credentials, nor would I let it stop me from providing for my daughter.
The last point in my long post here is the statement above make one other misconception. It assumes that you have a support network. I didn't. Dad left when I was 2 and never bothered with our family or siblings. Mom passed away. Lost the grandparents to Cancer when I was 9. With my nearest family member 1900 miles away from me I instilled a do or die attitude. My wife passed in 2021 from a hit and run so it is just me raising our daughter. 4 years to go until she is 18... Want to guess what I have told her about student loans, debt and credit cards? Spoiler: NO.
When my BDoR was approved it was not to "fix" my mistake. It was a breach of contract when the school lost accreditation and no longer deemed to meet the government standard for receiving loans for education. These loans are now a ledger correction in the eyes of the government, which if you've understood my points about timeframes was setup long before I was born. Any tabs on what transpired through various lawsuits from Sallie Mae -> Navient -> now MOHELA shows poor book keeping. I will simply echo "Too big to fail". This is where older folks best be wary... You setup the systems in place, voted or didn't vote is not relevant, at best you knew and at worse you didn't pay attention when it was under your nose. The reverse is also true though. My degree is not valid either according to the government. I didn't get one for nothing or no accountability.
I often do wonder what my mom would feel like if she had seen what happened, though I am glad she didn't have to see how the good intentions paved a hellish road.

I’m trying to get all of the endings for FNaF 6, and I just got the Bankruptcy ending (I just needed to get Blacklisted, then I’d have them all). I was directed back to the main title screen like normal. After a few moments, the game crashed or something - I didn’t see it happen, but the game was closed, so I had to reopen it. When I open the game now, I am greeted with the title screen you get when you first start the game - it’s as if I haven’t started a playthrough. Is this because it deleted my last playthrough save, since it was bankrupt? Do I still have my accomplishments saved?
Edit: I started a new playthrough, exited the game, reopened it... and everything is fine, all of my accomplishments are on the title screen like normal. If someone ever runs into this, let them know it’ll be fine and just make another playthrough.

I wrote this as a reply to yet another comment in this thread using short interest as a percentage of the float and "they can close whenever they want" to dismiss the potential for a squeeze on AMC stock.
This isn't financial advice and nothing is ever certain as we've learned over the last 3 years, but using short interest as a percentage of the float can be deceiving, especially when the decrease is based on dilution and not an actual decrease in total short positions.

Lets go! Short Interest as a Percentage of the float and why it can be misleading

 
If you actually look at the Total Shares Short for AMC:
Some recent discussions and data points about total shares short over time:
 

Conclusion: The total shares short on AMC is currently at all time highs and his climbed steadily since the run-ups in 2021 without any substantial drops that lasted.

In addition, the theories that the RS helped short close positions do not hold true as the positions only dropped temporarily and returned to where they were quite quickly, and got to growing again.
 

But what about dilution?

 

Conclusion: While the dilution is a factor and this most recent dilution at all time lows does represent potential shares that can be bought to close, dilution in 2023 was done at prices over double the current price and those shares likely wouldn't be available until in the money. While the current dilution at all time lows represents an excellent opportunity to close short positions opened at higher prices what we are seeing instead are millions more shares being borrowed short positions being opened. This is actually important.

 

BUT WHAT DOES IT ALL MEAN??

 
 

About that pressure....

 

So what, if retail can buy a share, shorts can buy a share and close

 

CONCLUSION: If and when the share price starts to climb, there are 32,957,077 shares short (likely many more based on the shares borrowed we'll see what the or text data says on Monday) that would want to close their positions before the price hits $6.81. not only with the shorts be competing with each other to close at that point but also with anyone who was lured by the price increase and thought they could benefit. Let's not forget those of us who have never stopped buying and might even have a little bit of powder in reserve for such an event.

TLDR

 

Ultimately a squeeze on short positions happens when shorts need to close, and can't. The factors are number of shares short, and how many they can buy at the current price without increasing the price. The lower the short positions were entered. The more pressure there is to close them as the price does increase and the more buy pressure that tends to create. Even if fundamentals are not the primary factor in a lot of people's AMC investments, they are important to the shorts because they work within the confines of the market and use fundamentals to justify their actions and gain support needed to carry them out.

Thank you for the opportunity to send general DRS questions. We wanted to send along this list of questions and reopen communication. Much of it is similar to the list of questions sent last year, but we've since answered some and come up with plenty of new ones. It was very nice to see you meeting criticism and concerns from some community members head on over the last week, and that's part of why we're reaching out now. We believe that investors choose to levy such accusations and air out their theories because they are passionate about ownership and want to know the truth. These theories can come from a lack of understanding and a drought of good information with strong citation. Hope we can connect and earnestly tackle this situation, and help everyone get to a more learned place. To start, here’s some context as to why investors are so concerned and curious.
We understand that you cannot answer specific questions on individual stocks, but we think it would be helpful to provide you (and others) a little context as to why investors are so concerned and curious before we list the questions. Approximately 25% of GameStop Corp.’s ($GME) outstanding shares have been registered with their transfer agent (Computershare) for over a year now. While it's possible that there is an innocent macroeconomic explanation for this consistently reported number, GameStop investors and all investors who are driven by a desire to own their investment via DRS want to know more about alternative explanations. Investors have noted anomalous trading volume, particularly on or around the dates for which GameStop reports registered shares (DRS and DirectStock plan shares). Most of $GME’s outstanding shares are accounted for by mutual funds, ETF’s, other funds, insiders, and DRS and plan shares, so it’s odd when 20-25% of the outstanding shares trade in a single day (or a couple days). It’s even more curious when the volume spikes near the DRS record dates.
It’s possible these large spikes in volume are related to illegal options trading used to avoid complying with close-out requirements under RegSHO (see August 9, 2013 SEC Risk Alert sec.gov/about/offices/…). While this is outside the purview of Computershare, there are concerns that a portion of the $GME shares held by Computershare, Computershare subsidiaries, nominees, etc. may be associated with these options trades via lending or as locates. It's with this context in mind that we'd appreciate your weighing in once again and providing some of your thoughts regarding not GME specifically but the ownership nuances within the current system.
You and other industry experts and veterans have provided many hours of your time to altruistically try and meet the needs of a newly emergent base of activated and curious retail investors. However, there is an ongoing confusion and request for clarity and to that end we've prepared an index of terms/definitions in order to confirm we're using industry terms with shared understanding and then several more in depth questions that speak to remaining uncertainties DRS enthusiasts have. Please refer to the Appendix for these terms. We would like to be deliberate about the terms used. Any industry terms should be individually defined in context and in the view of the person using the term.
We’ve gathered questions from several online investor communities. A dialog back and forth discussing the questions and making sure all questions and answers are thorough, in order to address the speculation and concerns of retail investors would be ideal. Considering the recent / ongoing theories and allegations regarding the degree to which Computershare has lagged on providing clarifying information in the investor communities. Answering these questions will put many investors as well as their speculation at ease and show that Computershare is committed to maintaining transparency and investor trust.
Key Questions: Ownership Structure
1) Some investors have started using the term ‘Sole Legal Title’ to refer to an investor who owns shares in their own name exclusively, on the issuer ledger, without any other entities involved (no nominees, no custodians, etc). ‘Pure DRS’ holdings would represent ‘Sole Legal Title’ while owning shares through a Plan or in an IRA with a custodian would not. Is there a better /more official term for this kind of ownership? An SEC bulletin uses the phrase ‘DRS Form’.
2) Who is the named owner on the share ledger for shares held at the DTC for Operational Efficiency? Is it Computershare’s nominee, DTC’s nominee, or someone else? It is understood that the investor will still be listed by name in a subclass.
3) Can you explain in detail exactly how the holding works for Plan shares held at the DTC? Are those shares considered "non-investor owned"? If so, what does that mean exactly? Are non-investor shares mutually exclusive with other holding types? What are the actual account types that CS uses to interface with the DTCC with for DRS purposes?
4) Which of the following descriptions would you say best describes Plan shares held with DTC for operational efficiency purposes: “held by Cede & Co on behalf of the Depository Trust & Clearing Corporation” OR “held by registered holders with the transfer agent”
5) Please clearly describe the location and settlement process for a market order for shares in the DirectStock plan vs a company sponsored DSP (such as DepotDirect). What is different about how these shares, once settled, are recorded on the issuer’s ledger?
6) Can you describe the possible chains of custody and ownership for shares in various holding types including Pure DRS and DirectStock such as: custodians, omnibus bulk owners, nominees, Computershare subsidiaries, including what account types are used to manage each. In addition, could you describe the way names appear on the ledger in each of these cases? Ex: “Pure DRS”, plan holdings only, mix of both, shares held in subclass, beneficial ownership outside of DTC, etc.
7) Currently, the common understanding is that Dingo & Co is a nominee used by Computershare for investors in DirectStock to enable features such as fractional shares and fungible bulk holdings. Individual investors names are listed as a subclass, which are on the issuer ledger under the name Dingo & Co. This is a form of beneficial ownership, but is not street name ownership, as shares purchased or through plan are removed from the DTC. Is this an accurate description of ownership structure?
8) Does Computershare or its subsidiaries have more than one nominee which holds shares?
9) In June 2023, the SEC’s OIEA and FINRA released bulletins (excerpts below) certifying that investors who purchased through plan and wished to hold shares directly on the issuer ledger needed to transfer those shares from plan to DRS. The CS FAQ uses similar language. Both Plan and DRS investors appear named on the issuer ledger. Could you describe the process of the Plan -> DRS transfer described here, and how the ownership record changes as a result?
10) “According to FINRA, the SEC, and Computershare: Purchases made through the issuer (or its transfer agent) of securities you intend to hold in direct registration are usually executed under the guidelines of the issuer’s stock purchase plan. 10) With DirectStock enabled, a user enters a principal-agency relationship with Computershare. Can you explain the principal-agency relationship Computershare has with an account holder? cda.computershare.com/Content/7bfc0b…
11) When Shares are transferred from a brokerage to a Computershare account, only whole shares can be transferred and documents from computershare say “DTC Stock Withdrawals (DRS)”. Are shares purchased through DRP/DSPP also “DTC Stock Withdrawals (DRS)”, but withdrawn to Computershare’s nominee rather than the investor?
12) If the reported DRS totals for an issuer for the last 5 quarters straight are consistent (within rounding of ~100k shares), what are some possible explanations for why this might be?
13) Is it possible any quantity of registered shares are not being counted in the total reported to the company for any reason? (plan designated, DRS shares, fractionals, "operational efficiency", etc) Per CS FAQ, issuers are provided Plan and Book holdings tallies separately.
14) If an investor has a Computershare Investor Center account that's holding shares of designation "Book", does enrolling that account in the DirectStock Plan have any effect on who holds title to those shares? Specifically, do they remain DRS (DRS Form/Pure DRS), or do those shares become held in the Plan? Does it matter the method by which the account is enrolled (such as: plan purchase, DRIP activation, or setting a limit sell order)?
15) If an investor is enrolled in the DirectStock plan, are all the shares (DRS and plan) in their account considered plan-enrolled shares per the Computershare FAQ?
16) Some of Computershare’s online customer service representatives have stated that Dingo & Co was nominee for plan shares for multiple companies, but Dingo & Co has only been found listed in a small number of filings such as proxy for MGE Energy or bankruptcy filings for SOUTHERN FOODS GROUP, LLC. How do investors find more information on Dingo & Co and their function?
Operational Efficiency (OE)
17) Is Computershare (or their subsidiary, nominee, or chosen broker dealer) compensated by the DTC, the Issuer, or any other third party for maintaining operational efficiency?
18) In the May 2, 2023 update video you appeared in, you said “typically we would hold somewhere between 10 and 20 percent of the shares that underpin the plan through our broker at DTC” and that “we need to maintain a small portion of the inventory at DTC so that we can have effective settlement.” Can you define ‘underpin’ and ‘the plan’? Is the "whole" all shares of a given security owned by accounts enrolled in the DirectStock plan?
19) How could an investor of a given security learn the exact number of shares kept with DTC for OE% by Computershare on a given date?
20) Are shares of any given security owned by accounts enrolled in the DirectStock plan maintained in fungible bulk and held by Computershare’s nominee?
21) Near the end of the 5/2/23 YouTube video “An update on Fractional and Plan Shares”, you said there was a "mischaracterization" of the problem online. What did you mean?
22) Computershare states on the FAQ that they determine the portion used for OE - how is that ratio determined, and how often is it recalculated? Is it a function of a market condition such as volume, price, or something else? Is there a way for investors to track how many shares are allotted for OE?
23) Are the claims made on Shareholder Service Solutions about DirectStock on this page correct, specifically regarding the cost to issuers who are interested in DirectStock? shareholderservicesolutions.com/news-item/onli…
24) You have stated in the past that DTCC typically holds 10%-20% of plan shares for operational efficiency. What about in atypical situations - How often and how far does OE% stray from the 10-20% range? Has any individual equity risen above that mentioned threshold, and what’s the highest percentage that an equity has ever experienced?
25) Does operational efficiency negatively impact the continuous holder requirement, as required for items like shareholder appraisal rights?
26) Are DRS designated shares pulled into the plan when DRP/DSPP (DirectStock) is enabled, or are only Plan designated shares affected by enrollment?
Reporting
27) Does Computershare directly provide issuers with a total account of issued shares, broken down by record holder, totaling up to shares outstanding? Is this data available to the issuer in real time through the Issuer Online portal?
28) Under what circumstances (if any) would DRS shares held with Computershare for which Cede & Co is not the registered holder be held at the DTC?
29) Under what circumstances (if any) would Plan shares held with Computershare for which Cede & Co is not the registered holder be held at the DTC?
30) Can you confirm if there are currently any ongoing corrections or dispute resolutions involving Direct Registration transactions, specifically using the '396 (Direct Registration Reclaim DK-Without Memo Seg)' code, that have impacted reportable DRS numbers in any stock significantly?
31) Could you provide details on how the application of the '396' transaction code for Direct Registration Reclaim DK-Without Memo Seg activities is being monitored to ensure the integrity of DRS numbers?
32) What procedures are in place to review and approve transactions under the '396 (Direct Registration Reclaim DK-Without Memo Seg)' code, and how are these documented in the context of DRS reporting?
33) Has computershare seen any significant volume increase in Delivery Orders marked with codes 391 or 396 around significant DRS reporting dates for any of its issuers?
34) Could you speculate as to why an issuer might choose to adjust the language in their 10Q/K of the way they report DRS totals, or what a change in language could imply? For example, if an issuer reported DRS shares as “directly registered” for almost two years and then changed the language to “registered” alone.
FRACTIONAL SHARES
35) Is it possible to be the sole legal title holder of a fractional share, meaning no other entities other than the investor are involved in the ownership of that fractional share?
36) Are fractional shares entitled to cast votes? Is this issuer dependent?
OTHER
37) Why does the issuer name come up on bank statements when purchasing through DirectStock?
38) Multiple French companies provide various benefits to “pure registered” shareholders, for example L’Oreal awarding an increased dividend payment. Does Computershare offer U.S. issuers the option to provide benefits like this? Does Computershare offer these benefits in other countries?
39) Computershare has indicated in the FAQ that it is up to individual issuers to disclose shares in DSPP in their tally of directly registered shares, and that such a disclosure may be subject to legislation and regulation. Could you direct us to the relevant legislation and regulation?
40) Between Feb 24 and March 20 of 2023 there was a change made to CS FAQ involving the maximum limit sell order amount reduction in 2022, citing the risk cap of the broker. The limit was changed again around Feb 22 of 2023 to 7x the price of the security. Why was this language removed from the FAQ? It would seem plausible to remove that if 7x the current security price is within the brokers tolerance, but it also had specifically mentioned that this change was made because of 2 specific securities who had >7x their price in 2021 from 2020.
41) Does Computershare have any input as to the language used in financial disclosures for DRS ownership (GME / 🍿 ) or do they provide the holdings data alone?
42) Computershare organizes recurring purchases for hundreds of stocks through various Plans, and specifically with DirectStock Computershare operates a predictable recurring market buy. Does Computershare profit (through PFOF or otherwise) through the provision of this market data and activity to its broker partners?
43) Do you feel that a recurring and predictable schedule for recurring buys creates an issue for recurring buyers? Predictable price movement can lead to arbitrage opportunities and can result in worse outcomes for plan participants in terms of dollars invested/shares owned.
44) Who, besides DTCC, can see ownership records of DTC members at the DTCC?
45) When participants log into the FAST system at the DTCC for DRS functionality, can they see anything about shares that the DTCC holds? The user manual for the FAST system has a DRS section but it is only a couple of pages with some screenshots, not granular data.
46) What are the effects of a “Chill” on DRS transactions?
47) What is Computershare’s regulatory requirement in reporting possible crime if you notice problems or discrepancies?
48) What are the effects of a Stop Trade designation on an account that holds either only Plan, only DRS, or both Plan and DRS shares?
49) Several investors with multiple Computershare logins have reported that placing a stop trade restriction on a single account is blocking their ability to login to all accounts. Should this be happening and if not, how can they get this resolved?
50) Certificated shares may be enrolled into "DirectStock plan", but they are labeled "not available". Can you clarify what "not available" means in that regard?
51) Is there a cost to an issuer for offering Computershare's QuickCert paper certificate service to their investors, by which Investors can pay $25 each to certificate their shares?
52) When a Transfer Agent and the DTCC disagree on the cause of a share discrepancy what is the share reconciliation process? How long do these instances take to resolve, and what is the largest instance of this happening to your knowledge?

Book Entry - All electronically tracked and uncertificated shares are considered book-entry shares.
Book Holdings - Shares labeled ‘Book’ on the Computershare Investor Center UI
Plan Holdings - Shares labeled ‘Plan’ on the Computershare Investor Center UI
Pure DRS - An investor center account with 0 Plan holdings and is not enrolled in DirectStock
DirectStock - Proprietary Computershare plan structure. Not sponsored or administered by the issuer. Investors will be listed on the share ledger in a subclass under Computershare’s nominee - this is technically a type of beneficial ownership.
Plan - A Plan allows investors to facilitate purchase of shares through the Transfer Agent’s interface. This can involve market purchases or can involve sale directly from the issuer.
DSP (Direct Stock Plan) - from what we can find, this is clearly defined by the SECand involves direct purchase from the issuer and special issuance of shares.
DSPP (Direct Stock Purchase Plan) - Not clearly defined by the SEC, but DirectStock is described as one and involves recurrent purchase at the market through Computershare broker partner.
Chain of Custody - A reflection of ownership rights through different market participants, tracing from legal holder to the ultimate beneficial owner at the other. EX: Investor>Broker>Cede and Co
On the Ledger / Registered holder - Registered holders, per CS FAQ, are listed by name on the company register. This would include both ‘Pure DRS’ investors along with ‘Plan’ investors.
Legal Title Ownership - An investor has legal claim to the underlying asset, and may share that claim with other entities.
Sole Legal Title Ownership - An investor is the only entity with legal claim.
Operational Efficiency - The process of keeping a portion of the fungible bulk of plan shares with a broker partner (with DTC) in order to facilitate quicker and more efficient settlement.
Underpin - We’d like a better definition for this. You used this word to describe the shares which are involved with the DirectStock Plan.
Nominee - Entity in which securities are kept in order to facilitate transactions more smoothly.
Custodian - When a firm is holding an investment on behalf of a client for safekeeping
Omnibus - The pooling of investments from multiple individuals under an entity such as a nominee.
Fungible Bulk - A description of shares kept in an omnibus. Fungible bulk shares are indistinguishable from each other and can be drawn down against the total without impacting the listed holdings of any participant.
Dingo & Co - Listed as Computershare’s nominee on an MGE Energy Proxy Filing. Does it also act as Computershare’s nominee for other plan structures?
Computershare Trust Co NA - A DTC Member and broker subsidiary of Computershare. Manages the sales facility, and when a limit sell order is placed, shares will be transferred to Plan designation under this section of Computershare.
Chill/Freeze : A method of preventing transactions from occurring on specific shares or a CUSIP involved in a corporate action. When shares are chilled, they cannot be moved.

2024.03.24 05:17 JustEarle Anyone actually familiar with reading Device Logs?

I'm having issues with Air Link freezing my headset while in the middle of launching a game (VR Chat) in the Rift environment. Suffice it to say, my PC is very capable, hard wired to my WIFI6 router, within 5ft. of my headset. All software and drivers are up to date. Cabled-Link and other games via Air Link work fine.
I end up having to close the Meta Link PC app and game via Task Manager, and the PC needs to be reset before I'm able to reopen the Meta Link PC app again.
I generated logs (below), and it looks like there are missing paths to files, possible corrupt files, etc. However I can't tell if these errors are concerning files with the Link PC app, files specific to the game, or files within the headset itself. Logically, the logs read in a way that makes me suspect software, and not hardware.
Meta Support isn't that great at suggesting things I haven't already done, and it seems like they're not even looking at the logs I sent them.
If anyone's familiar with reading these things, I'd sure appreciate some guidance on what my next steps should be.

Economy

It’s hard to believe that once upon a time, a blue-collar worker with a high school education could support a family, take vacations, and even save for retirement. Technology has made our productivity many times higher — so why is life poorer, not richer, than in the 1960s? Why do people just accept that life will get slowly worse?
Kennedy does not accept it. We can restore the American middle class by reversing the missteps of the last 50 years. A massive military machine has nearly bankrupted this country. Rampant corruption in Washington has put corporations in charge, enriching the wealthiest as working people have dropped out of the middle class. Official unemployment is low — but most of the new jobs are in the low-pay service sector. Wealth inequality in the country is at a 100-year high. More than 60% of Americans live paycheck-to-paycheck, with no savings for an emergency. Take-home pay after inflation and taxes has fallen 9% since Biden took office.
Under the Biden administration, the price of an average home has risen from $250,000 to around $400,000, and mortgage rates have more than doubled. Rents have followed the trend, putting more and more people on the edge of catastrophe.
But we can turn it around. Being able to afford a decent life doesn’t mean working more hours. It means higher pay and lower bills.
Here is what Kennedy will do to make that a reality:
  1. Raise the minimum wage to $15, which is the equivalent to its 1967 level.
  2. Prosecute union-busting corporations so that labor can organize and negotiate fair wages.
  3. Expand free childcare to millions of families with programs like that pioneered by the state of New Mexico.
  4. Drop housing costs by $1000 per family and make home ownership affordable by backing 3% home mortgages with tax-free bonds.
  5. Cut energy prices by restricting natural gas exports.
  6. Support small businesses by redirecting regulatory scrutiny onto large corporations.
  7. Secure the border and bring illegal immigration to a halt, so that undocumented migrants won’t undercut wages.
  8. Negotiate trade deals that prevent low-wage countries from competing with American workers in a “race to the bottom.”
  9. Rein in military spending and use the resources to fund infrastructure, health care, higher education, child care, and domestic prosperity.
  10. Reverse the chronic disease epidemic that is a $3.7 trillion drag on families and the American economy.
  11. Clean out the corruption in Washington, D.C., which funnels so much of our nation’s wealth to giant corporations and billionaires.
  12. Establish addiction healing centers on organic farms across the country.
  13. Make student debt dischargeable in bankruptcy and cut interest rates on student loans to zero.
  14. Cut drug costs by half to bring them in line with other nations.
People always ask, “How are we going to pay for all this?” The answer is simple. First is to end the military adventures and regime-change wars, like the one in Ukraine. The wars in Iraq, Afghanistan, Syria, and Libya already cost us over $8 trillion. That’s $90,000 per family of four. That’s enough to pay off all medical debt, all credit card debt, provide free childcare, feed every hungry child, repair our infrastructure, and make college tuition free — with money left over. That’s enough to make social security solvent for another 30 years.
Second is to end the corruption in Washington, the corporate giveaways, the boondoggles, the bailouts of the too-big-to-fail that leave the little guy at the mercy of the market. Corporations right now are sitting on $8 trillion in cash. Their contribution to tax revenues was 33% in the 1950s — it is 10% today. It’s high time they paid their fair share.
Other Presidents have tinkered on the edges, but Robert F. Kennedy, Jr. will make the deep changes necessary to put the economy on a sound footing. The broad prosperity of the Eisenhower and JFK era can be ours again. It is just a shift of priorities away.

Housing

The dream of home ownership is slipping away for many Americans with high mortgage rates, rising prices, and stagnant income. To make matters worse, venture capital firms and hedge funds are buying up single-family homes by the millions. As home ownership costs rise beyond reach, rents follow them into the stratosphere.
Consider these statistics:
  1. American homeownership is declining at the highest rate since the great depression.
  2. We lost more than 1 million homeowners in 2021 — more than in the housing crash of 2008 — and then another million in 2022.
  3. The median home price has risen from $250,000 in 2019 to $400,000 in 2023.
  4. Mortgage interest rates have more than doubled since President Biden took office.
  5. This rise in interest rates combined with skyrocketing housing prices has pushed the average monthly payment for someone buying a home from $1,050 in 2019 to over $2,600 per month.
  6. At the same time, take-home pay after inflation and taxes has fallen by 9%.
  7. At the current pace, by 2030 60% of single-family homes will be owned by corporations.
What this means is that home ownership is now out of reach for all but the top income bracket. Younger Americans in particular barely dream of ever owning a home. They face a future at the mercy of faceless corporate landlords who will raise rent to the highest level the market will bear.
None of this is inevitable, though. As President, RFK Jr. will enact a series of policies to put home ownership back within the reach of working families. Here’s how:
  1. Tax-free 3% government-backed mortgage bonds, to bring the mortgage interest rate back to 2019 levels and even lower. It’s like having a rich uncle — Uncle Sam — who is willing to cosign your mortgage. Because the financing will come from investors, the cost to taxpayers will be minimal. This measure alone will reduce monthly costs for the average home purchase by $1,000.
  2. Bring derelict land and buildings back online. Many cities have thousands of vacant lots and buildings that have been seized for tax arrears or other reasons. The Kennedy administration will incentivize local governments to bring city-owned land and buildings back onto the market.
  3. Zoning changes. We will encourage municipalities to change zoning laws to allow ancillary dwelling units (granny flats) on more properties, to make housing available, bring families together, and provide homeowners with rental income. More supply means lower prices.
  4. Tax code changes. Small changes to the tax code can make corporate investments in single-family homes uneconomic. For example, we can change business depreciation rules and reform the “enterprise zones” that have contributed so much to gentrification.
Together, these changes will restore home ownership to tens of millions of Americans, and lower costs for tens of millions more. We will get large corporations out of the single-family home business.

Environment

Robert F. Kennedy Jr. spent most of his career as an environmental lawyer, suing big polluters and government agencies that failed to enforce the law. By the early 2000s, he had become one of the most influential environmentalists in the United States, designated by TIME magazine as a “Hero of the Planet.”
RFK Jr.’s success came from uniting liberal environmentalists with conservative rod-and-gun folks who shared a desire for a clean, healthy environment. As President, he will bring the same commitment and coalition-building to address the most pressing environmental problems in America and beyond.Recent years have seen one environmental disaster after another: floods and droughts, fires, and toxic spills. Our soils are depleted, the weather is wacky, trees are dying, and the water in many places is toxic. Chronic disease is at an all-time high. These first two policies will vastly reduce the toxic waste, industrial poisons, and pesticides that make people and ecosystems sick.
  • We will protect wild lands from further development, by curbing mining, logging, oil drilling, and suburban sprawl. We will become a global advocate for rainforest preservation and marine restoration. We will rethink development policies that promised economic growth while ignoring ecological sustainability, and ended up delivering neither.
  • We will restore the USDA and the EPA to their proper role of protecting health and the environment. Today, corporate influence has severely compromised these agencies, resulting in a proliferation of highly toxic chemicals in our food, soil, air, and water. It’s time to clean it up!
In all of his policies, RFK Jr. will put people and places first. In recent years, climate change has made the environment a divisive issue, but there are many policies that make sense to skeptics and activists alike. We will emphasize those, and rebuild a broad environmental coalition to clean up this country.

Honest Government

A democratic government is supposed to be of, by, and for the people. But government institutions have betrayed our trust. The intelligence agencies spy on our own people. Government and tech platforms conspire to surveil and censor the public. Regulatory agencies have been captured by those they are supposed to regulate: Wall Street controls the SEC. Polluters and extractive industries dominate the EPA and BLM. Pharma controls the CDC, NIH, and FDA. Big Ag controls the USDA. Big Tech has captured the FTC. No wonder trust in government is at all-time lows. It’s time to earn it back.

Reconciliation

America is more polarized and divided now than at any time in living memory. Both sides seem to agree that the basic problem is the horrible people on the other side. Both sides are wrong. The basic problem is the division itself. A divided public lacks the strength to resist exploitation or to overcome the inertia of the status quo. The classic American can-do spirit exhausts itself in endless battles. So let’s heal the divide.
Today, powerful undemocratic forces have a death grip on our nation. There is only one way to break that grip and restore power to the people. That is a broad popular movement that unites left and right, Black and White, urban and rural, young and old, and working people of all ethnicities.
This populist uprising is not defined by its enemies. Robert F. Kennedy Jr. recognizes that even the elites have become prisoners of the system they have created. Many of them no longer believe in it, despite the wealth and power it gives them. They too are welcome to defect to the movement of people power.

Kennedy has clear positions on most of today’s divisive trigger issues like abortion, guns, and immigration, but he knows that both sides have legitimate concerns and legitimate moral positions. No one is deplorable. Furthermore, most of the disagreements obscure deeper shared values.
Everyone wants their children to be safe. No one wants more abortions, nor do they want to force women to undergo unwanted pregnancies. Everyone wants safe streets, yet few wish for millions of people to languish in prison.
Kennedy will draw on the broad moral agreements beneath our divisions. He will model careful listening, and create conditions where each group can hear the stories of the other. He will lead the way toward national reconciliation, respectful dialog, and willingness to change, to grow, and to forgive.
These commitments to respect and unity start right now, in the campaign. In Kennedy's own words, “Every nation, like every individual, has a darker side and a lighter side. The easiest thing for a politician to do is to appeal to our greed, to our anger, to our fear, to our xenophobia, our bigotry, all of the alchemies of tribalism. I will appeal instead to our generosity as a people, our goodness, our kindness, and our courage.”

Peace

In the long term, a nation’s strength does not come from its armies. America spends as much on weaponry as the next nine nations combined, yet the country has grown weaker, not stronger, over the last 30 years. Even as its military technology has reigned supreme, America has been hollowing out from the inside. We cannot be a strong or secure nation when our infrastructure, industry, society, and economy are infirm.
A high priority of a Kennedy administration will be to make America strong again. When a body is sick, it withdraws its energy from the extremities in order to nourish the vital organs. It is time to end the imperial project and attend to all that has been neglected: the crumbling cities, the antiquated railways, the failing water systems, the decaying infrastructure, the ailing economy. Annual defense-related spending is close to one trillion dollars. We maintain 800 military bases around the world. The peace dividend that was supposed to come after the Berlin Wall fell was never redeemed. Now we have another chance.
As President, Robert F. Kennedy, Jr. will start the process of unwinding empire. We will bring the troops home. We will stop racking up unpayable debt to fight one war after another. The military will return to its proper role of defending our country. We will end the proxy wars, bombing campaigns, covert operations, coups, paramilitaries, and everything else that has become so normal most people don’t know it’s happening. But it is happening, a constant drain on our strength. It’s time to come home and restore this country.

In Ukraine, the most important priority is to end the suffering of the Ukrainian people, victims of a brutal Russian invasion, and also victims of American geopolitical machinations going back at least to 2014. We must first get clear: Is our mission to help the brave Ukrainians defend their sovereignty? Or is it to use Ukraine as a pawn to weaken Russia? Kennedy will choose the first. He will find a diplomatic solution that brings peace to Ukraine and brings our resources back where they belong. We will offer to withdraw our troops and nuclear-capable missiles from Russia's borders. Russia will withdraw its troops from Ukraine and guarantee its freedom and independence. UN peacekeepers will guarantee peace to the Russian-speaking eastern regions. We will put an end to this war. We will put an end to the suffering of the Ukranian people. That will be the start of a broader program of demilitarization of all countries.
We have to stop seeing the world in terms of enemies and adversaries. As John Quincy Adams wrote, “Americans go not abroad in search of monsters to destroy.” Kennedy will revive a lost thread of American foreign policy thinking, the one championed by his uncle, John F. Kennedy who, over his 1000 days in office, had become a firm anti-imperialist. He wanted to exit Vietnam. He defied the Joint Chiefs of Staff and refused to bomb Cuba, thus saving us from nuclear Armageddon. He wanted to reverse the imperialistic policies of Truman and Eisenhower, rein in the CIA, and support freedom movements around the world. He wanted to revive Roosevelt’s impulse to dissolve the British empire rather than take it over.
John F. Kennedy’s vision was tragically cut short by an assassin’s bullet. But now we have another chance. The country is ailing, yes, but underneath there is vitality still. America is a land rich in resources, creativity, and intelligence. We just need to get serious about healing our society, to become strong again from the inside.
America was once an inspiration to the world, a beacon of freedom and democracy. Our priority will be nothing less than to restore our moral leadership. We will lead by example. When a warlike imperial nation disarms of its own accord, it sets a template for peace everywhere. It is not too late for us to voluntarily let go of empire and serve peace instead, as a strong and healthy nation.

Border

Robert F. Kennedy, Jr. sees the situation at the border primarily as a humanitarian crisis. It is a crisis that has spread far beyond the border, as a flood of migrants has overwhelmed the resources of cities as far away as New York. The suffering of the migrants at the hands of drug cartels, human traffickers, and exploitative employers is heartbreaking.
As President, Kennedy is going to end the humanitarian crisis, starting with its most immediate cause — an uncontrolled border. As he seals the border to illegal immigration, his administration will enact deeper reforms to stem illegal migration in the long term, while expanding lawful, orderly immigration according to principles of justice and fairness.
We must recognize that the foremost victims of a porous, chaotic border are the immigrants themselves. Compassion and decency demand that we do not allow the current situation to continue.

A humanitarian, economic, and public security nightmare
The criminal cartels that now control immigration across the Mexican border exact a high price. Migrants are routinely robbed, raped, kidnapped, and sex trafficked. These horrors are happening systemically and at scale. The whereabouts of some 85,000 children who have been separated from their parents are unknown. In May, a “stash house” with 135 kidnapped migrants was liberated just across the border in San Luis. For everyone that is discovered, many more operate undetected. Our unregulated border is not compassionate. It is an open opportunity for the worst kinds of organized crime.
The Mexican cartels controlling immigration are as ruthless in this business as they are in the drug business. Gang violence all along the border has spiked as the cartels vie for turf through assassination and torture. The Mexican state of Sonora recorded 1765 murders in 2022, and many unsolved disappearances. The Mexican government’s official tally of disappearances now approaches 100,000.
This civil disorder is encroaching into the US, as destitute migrants flood American cities, sleeping on sidewalks and overwhelming humanitarian resources. Here too they are easy prey for criminals.
Fentanyl and methamphetamine are flooding into the country across the border along with the migrants. That is part of the cartels' integrated business model.
Because migrants have no documentation, they have no bargaining power or recourse when employers take advantage of them. They work for $5 or $6 an hour. They exist as the permanent bottom layer of a shadow economy from which it is almost impossible to escape. A pool of cheap, exploitable labor lowers the floor for all labor, putting downward pressure on wages and harming the American working class.
As a young man, RFK Jr. had the honor to work with Cesar Chavez. He understood that farm laborers’ conditions would never improve when endless new busloads of undocumented immigrants were available to replace any workers who tried to bargain for better working conditions. He was no xenophobe. Immigration is good for this country. It is unlawful, disorderly illegal immigration that harms migrants and undercuts American workers.
In the long term, perhaps the most pernicious effect of the current border chaos is that a criminal infrastructure of well-financed, institutionalized cartels is taking hold, corrupting government officials and insinuating itself into society. Just as Prohibition was a tremendous boon to organized crime, birthing the American mafia of legend, so also does the border situation provide a financial foundation for criminal organizations that could persist of decades.
Tough and Humanitarian Policy
The first step toward fixing this situation is to reassert control over our border. Today there is no control, no effective policy and, as a result, there is a humanitarian, security, and economic disaster.
There are two ways people enter this country illegally. One way is by sneaking in. The other is by simply walking across at an entry point, claiming asylum, and disappearing. We have to address both. If we only shut down the asylum route, they will sneak across instead. If we only seal the border, they will overwhelm asylum processing resources. We must end both simultaneously. To accomplish this, the Kennedy administration will pursue the following policies.
  • Tighten border security to regain control over the border. We will use technology that was installed at the border then dismantled by the Biden administration, such as cameras, lights, and motion detectors, coupled with physical barriers in key areas (there is no need to build a wall across the entire 2,000-mile border). We have the technology to prevent people from getting through undetected. We can control the border. We have the technology. We can deploy the personnel. All we need is the will.
  • Get on top of asylum claims. We have to fully fund courts, services, and border agencies to allow lawful immigration in accordance with U.S. law and deny non-compliant access, and appoint more judges to handle asylum cases. There are woefully few asylum judges to process even the legitimate claims of political refugees. If claimants of political asylum knew their case would be heard swiftly, and that specious claims would be met with swift deportation, the cartels’ business model would fail.
There are 1.6 million immigrants living in the US while they await their asylum hearing. Fewer than 15% will be approved. We need to appoint hundreds more judges to deal with this backlog, and to ensure that newly arriving immigrants get a hearing before being admitted to the U.S.
This is a common-sense solution that can transcend partisan rancor. Democrats will support swift attention to asylum claims so that we meet our humanitarian obligations. Republicans will support an end to the flow of millions of unheard asylum claimants into the U.S. on their own recognizance.
Migrants will know that their case will be heard at the border and they will not be let through unless it is approved. Deciding to spend a lifetime of savings and risk injury, rape, and death to make this journey is the biggest decisions of most migrants' lives. They do not make that kind of a decision in a vacuum. We must give them forewarning that we are hiring hundreds more judges and they can no longer expect to be let into the country due to judicial delays.
We will work with the Mexican government to stem the flow of transit migration through Mexico. We have to cultivate a more positive relationship with Mexico and work closely with its people and government who desperately want to be free of the plague of cartel violence.
Together, these three policies will end the business model of the cartels. When we also expand legal immigration, migrants will rationally choose the legal path instead of putting their families’ lives at the mercy of criminals.
Long-term solutions
Beyond the immediate border crisis is a long-term immigration crisis, the result of lack of leadership, poor planning, little to no diplomacy, economic exploitation, and an inability to reimagine a regionally cooperative approach. We can control the border, but immigration pressure will not abate until we change the conditions that make so many people desperate to flee their homelands. Sadly, the United States has contributed to those conditions. As President, RFK Jr. will change that by implementing a new kind of Good Neighbor policy, starting in this hemisphere.
He will:
  • End military adventurism that destabilizes other nations and generates millions of refugees. That’s what happened in Syria and Iraq, which sent millions of migrants into Europe. The current flood of arms into Ukraine sends ripples of instability across the continent. Some of the weapons have already ended up in Africa and central Asia, two major sources of immigration.
  • Stop supporting despotic governments, juntas, coups, death squads, and repressive regimes that persecute and impoverish their own people. America will stop opposing governments that seek land reform, labor reform, and social welfare for their people. These create a desperate and miserable population prone to flee their homeland for a better life.
  • Cooperate with Mexico and Central American countries to improve economies and provide economic incentives to help build jobs and develop much-needed infrastructure and a better standard of living, so people will be motivated to stay in their home country and enjoy their natural culture and heritage.
  • Pursue a different trade and economic policy. Decades of neoliberal austerity measures will end. No longer will the US encourage financial institutions like the IMF and World Bank to demand that developing nations gut their social programs, privatize public assets, and strip away environmental and labor protections. We will reform the financial regime that holds countries in the global South subject to crushing debts that create poverty and send millions fleeing north.
Politicians in the past have appealed to xenophobia and bigotry in calling for a tough border policy. RFK Jr.’s call for a tough border comes from a different place. It comes from compassion and humanitarian conscience. He calls upon all Americans, of every part and political persuasion to face facts. President Biden’s loose border policy has been a disaster. It serves no one: not the migrants, not the nations south of the border, and not our own country. We are in the midst of a humanitarian nightmare, an entirely unnecessary one of our own making. Conscience demands that we stem the tide of illegal immigration so that we can return to the orderly, lawful immigration that has brought so much dynamism to our country.

Civil Liberties

Our administration will make it a top priority to protect and restore the fundamental civil liberties, enshrined in the Bill of Rights, that hold the essence of what America can be. These liberties have endured constant assault for more than 20 years, starting with the Bush/Cheney War on Terror, and accelerating in the era of Covid lockdowns.
Freedom of speech is the capstone of all other rights and freedoms. Once a government has the power to silence its opponents, no other right is safe. We will therefore dismantle the censorship-industrial complex, in which Big Tech censors, deplatforms, shadowbans, and algorithmically suppresses any person or opinion the government asks them to. We will respect the right to privacy and freedom from unreasonable searches and seizures, by ending mass surveillance of American citizens and the abuse of civil asset forfeiture. We will make sure that the Covid-era suspension of the right to assembly, trial by jury, and freedom of worship will never happen again. The same for the right to property. During Covid, 3.4 million businesses were forced to close. Many of them, including 60% of Black-owned businesses, will never reopen.
A Kennedy administration will respect American citizens and stop treating them like suspects and schoolchildren. We will stop manipulating the public with propaganda and targeted leaks. We will never weaponize the law against political opponents, nor hold our own officials above the law. We will return the intelligence agencies to their proper role as protectors not violators of liberty.

We will also take special care to ensure the civil liberties of minorities and the poor. We will end the failed War on Drugs and grant amnesty to nonviolent drug offenders. We will shut the school-to-prison pipeline, and transition prisons away from a punishment paradigm to a rehabilitation paradigm. Prisons will be an intervention in a life gone wrong, and a way to prevent offenders from harming others again.
Instead of defunding the police, we will transform the police. We will incentivize them to prevent violence, not make unnecessary arrests. We will train them in de-escalation and mediation skills and partner them with neighborhood organizations. No longer will their relationship to the public be adversarial. They will focus their attention on serious crimes, not harassing ordinary people.

So I have a lot on my mind and don’t really know how to sum it up. I am turning 28 next month, and my life feels like a mess and multiple areas. I have had 9 toxic relationships over the past decade, and been in therapy for many years-finding out right before Covid that I am a love addict. I have since been putting in so much work on myself, and for the past 1 1/2-2 years, I was in a DBT (Dialectical Behavior Therapy) program with group therapy and individual therapy every week. I finished the program, and now I just do individual therapy. That program helped me immensely, and now I’m a lot more self sufficient and able to handle intense emotions and difficult life situations without running to an escape-which for me was being addicted to and codependent with guys and bfs. When I started the program, I ended a nearly 2 year toxic long distance relationship, which I described at the time as hell to be in and hell to leave. I can’t do into all the details of everything in my life leading up to this point on why I’m so worried and anxious right now, but I’ll do my best to summarize it.
I have had a lot of trauma in my life, as a child, with friends, and in horrible and toxic relationships where some of the stuff I have experienced has shocked people. When I would find myself healing from one trauma, another one would hit me. This is has gone on for so many years. Of course I have trust issue because of this, because every time I tried to heal and move on, I would fight my trust issues and other issues and try so hard to make a relationship work and trust that person, and then my trust would get broken in more ways than one. After a decade of this happening, and nearly being close to being engaged to my ex that I broke up with in 2022, I felt broken and completely shattered. I felt like everytime something went wrong, I tried to pick myself up and have hope and heal, but I always chose the wrong guy, didn’t give myself the mouth time to heal, rushing into a relationship, and didn’t develop myself fully. I grew up in a codependent relationship with one of my parents, so this past couple years is the first I’ve developed myself and my identity that wasn’t attached to someone else’s life-which is already a lot to go through.
So basically, once in awhile I go on dating apps and see what’s out there or have a few conversations, but I almost feel repulsed by people and scared and anxious and just u comfortable. I don’t trust anyone, and the whole thing just reminds me of my ex. I have moved on in the sense that I don’t regularly think of and cry about my ex, and I remember the sick things that made me wanna get away from him, but I still cry sometimes about him and have dreams of him. I haven’t spoken to him in nearly a year, and never planned on talking to him again. But it feels like it was so traumatic, that I’m wondering if it will ever leave me, that energy and pain. It feels like whenever I go on dating apps, it’s like this dead limb that’s attached to me that is him, remembering him. And it almost like haunts me. It totally makes me feel emotional and not able to just get to know people and move on.
With all of this going on, I am turning 28 next month and feel I’m running out of time to take space and time to heal more. I feel like idk whether I’m too scared to get back out there in the dating world or not ready, I can’t tell the difference. Idk if I’m just avoiding it and people, or taking my time. I was nonstop dating for 8-9 years, I mean I always had a guy to talk to or go on dates or a bf, and never took more than a few days or few weeks off until this big relationship break up that changed me. So it’s good that I’m taking time to myself. I had a short kind of rebound relationship after him that only lasted a couple months but traumatized me some more, and it’s been a year since we broke up. It wasn’t right after the breakup, but I think it was before I was fully ready to date, that’s why I’m saying it was a rebound one. It helped me to delete my big relationship ex’s messages and kind of move on more. But after that break up I had unblocked my ex and reopened myself to have feelings for him which weren’t reciprocated. Even tho I knew it was toxic. But we haven’t spoken for almost a year anyhow, so idk why I still feel not fully moved on. Technically we broke up May of 2022.
I don’t feel emotionally or sexually that interested in people, I feel very repelled towards people, like I don’t feel what I used to feel. And it’s hard to figure it out, cuz I was a love addict for so many years, so who is to say I genuinely liked everyone I thought I liked vs being addicted and desperate and needing someone to fill the role of bf in my life.
Anyway, I’m confused completely about whether I’m ready to date or not and whether what I’m feeling or normal or means I’m not ready to date. And I feel like since I’m turning 28 and wanna someday be married and have kids, how long can I really take to myself and not date? I feel rushed by my age. And I see everyone else getting boyfriends, engaged, married, kids, etc.
On top of that, I have so many changes and hardships in other parts of my life, and I feel so emotional writing this. I went through a period of heavy depression, grief, and physical health issues. This caused me to not be able to work as much, and I went into massive credit card debt, causing me to now have to file for bankruptcy soon. I live at home currently. I am still figuring out my many health issues, and am finding the right medications and figuring out the correct illnesses that are happening to me, so it’s a long process with me and my doctors and being ill a lot of the time with chronic issues. This has caused me to not be able to work much, have much of a social life, get my simple and long term goals done, date, and just doing daily tasks. It’s made me basically put a hold on my life. On top of all that, some long term friendships have been broken last year and the year before, and it’s been massive grief that I’ve been dealing with from that, and my break ups with my exes. On top of that, we had to put my 16 year old dog down cuz he went downhill in July/August of last year, and that has put me through the emotional ringer. Not to mention I was taking care of many feral cats and kittens in 2022/23, and I experienced 4 of their deaths, and a few disappeared and didn’t come back-which is a huge possibility that they died cuz it’s common. I had to see the dead cats I cared for outside and have shelter and food and love to on the road, after being hit by cars. I was fortunate to be able to integrate 2 kittens inside with out indoor cat-which was a huge time consuming process to get them adjusted inside and used to our cat. On top of that, I have gained a ton of weight over the last couple years, and I don’t feel the best about myself looks wise and physical energy wise. That is one of my goals I wanna achieve-weight loss-along with many other goals that I’m hoping to reach over time as I’m getting on the right medications and such.
So saying all of that, I have been through the emotional ringer with losing friends in my life, break ups with serious partners, death of pets, weight gain, bankruptcy, feeling rushed, feeling like I’m a failure and all alone while everyone else is moving on with their lives, mental and physical health issues, etc. It’s been a fucking lot between everything during Covid, and then everything in my life the past couple years. And even in 2021, traveling to another country to stay for months with my bf, arguing severely, coming home, staying in bed all the time with depression, not eating, not taking care of myself, not eating, and just falling apart as a person in that relationship, followed by all of this stuff happening after.
All of this has been a lot to go through all at once and one thing after the other, and I know people would tell me to give myself a break, cuz it’s a lot. But I can’t help feel rushed by my age and confused and anxious about what to do. I know I need to get my own stuff together, but I feel like because of everything that’s happened, my life has been put on hold, and most of last year was spent in my house and in my bed, sick or emotionally rung out. I just don’t know what to do, idk how to feel, idk whether to take steps forward towards talking to people again on dating apps and take small steps or whether to not do it at all. Idk whether taking the appropriate time for myself to heal, or whether I’m closing off more and more and avoiding people and dating and wrapping myself in a cocoon to get away from everyone. Sometimes I’ve literally thought about going and seeing what’s out there on dating apps, and then decided to just play games on my phone. I don’t want more years of my life to be spent avoiding people and playing games. It would be different if I were in my early 20’s, but I’m not too far off from 30, and I’m getting worried about myself. On top of that, I can’t stop thinking of my younger self and crying about getting older and feeling like I’m aging year after year, and I’m still not ready to be the age I am. It’s like I’m having a quarter life crisis. I’m not ready for people to see me as 30, I still feel like a child who has no clue what they are doing with their lives. I have no career, no money, no husband, no kids, no apartment by myself, barely any friends, and I’m just and terrified. Yet, time keeps going by fast, and I feel frozen in fear. Idk what to do.

After my bankruptcy, I decided to rebuild my credit with Capital One. I opened my checking account with them, and my work direct deposits go there. I then applied for a Quicksilver card and got approved. However, before I received my card, they placed a hold on it and wanted me to verify my identity. I sent them everything they asked for, and they reopened my card, and everything is chill.
Well, last week I was pre-approved for a Venture X card, and I applied and got approved. They gave me a small $1000 credit limit, so I immediately requested a higher credit limit and did the same with my Quicksilver card. I did not get an answer right away, and today I checked my account to find they blocked both of my credit cards. I called, and now they want to verify my income and asked me to send them three bank statements. I was a bit confused since I also bank with them. The security person explained that the credit card department is completely separate from the banking side and they are not allowed to view my bank details. So I submitted everything today, and now I have to wait for a call that will happen in the next 3-14 days.
Has anyone been through this with them? It’s crazy; I have my banking with them, and even my car loan, and everything is in good standing.

The Kellstrophe Branch Line:
The Kellstrophe, nicknamed the “Hawin” Branch Line, was built by the Sodor & Mainland Railway in 1867 then opened around 1869 for the intention to reach the lakeside of Hawin to across the viaduct to Balladrine.
The line began as a success mostly for tourism during the summer months for those seeking to go to the lake of Hawin which proved popular for lakegoers for fishing spots & boating. However due to financial circumstances of the S&MR, the line was eventually shut down in 1901 after the railway’s bankruptcy.
Many years later around 1967, the line was restored to bring back services to the town stations while drawing back tourists to the line in the summer holidays.
Engines:
The branch line is now run by Bettie, an old well tank engine that first used to work on the Great Waterton & Valley Railway in the early days but now handles the passenger trains & rural goods.
Station Routes:
• After the overhead stone bridge is Kellstrophe Castle, a private railway station opened in 1869 for the Kellson Family for request stops until it closed when the S&M ended its services then reopened again once the line was opened again.
• Hawin is the popular lakeside station that first opened in 1869 once the railway reached by the village for tourism trade for lake-goers while serving small trains for people to pick-up goods from the farm.
The station was sadly closed for passenger services in 1897 but continued for goods-only til the railways closure in 1901. It is still a popular lake spot to this day.
• Ward Viaduct is an old viaduct after Hawin that runs across a foothill gorge near Ward Fell to Upper Balladrine.
When the branch line shut down, the viaduct was left to decay over the years that it was considered unsafe to cross due to the risk of collapsing & was re-maintained that it is safe to cross now.
• Upper Balladrine is the top station by the town of Balladrine miles after Hawin across the old viaduct til reaching the station.
Constructed during 1868 then opened around late 1869 for small local trains to Kellstrophe Road until the line closed all passenger traffic in 1897 then reopened later again to passenger trains.
• Ward Fell is a mountain station after Balladrine located at the foothills of Ward Fell built during the restoration as a spot for tourists to hike up the mountain footpaths with a view of the old mining site back in the early days of the SKR.
