2024.05.21 22:20 MrWillowBrooks [Landlord-US-IN] How do I help a Tenant get a non-Tenant to remove property from the rental unit

Tl;DR: at Bottom
I am a landlord in the state of Indiana.
*All names have been changed from their real names.
A handyman friend (after this referred to as Josh) rents only the garage at one of my properties so he can store his tools there. Technically, Josh has a signed lease with me 5 years ago to rent the garage each month but I have never made Josh pay as he is a struggling man and a friend rebuilding his life.
The problem is Josh at some point allowed his friend, (after this referred to as Anton) to store items in the garage. Anton's main form of income is a washing machine/refrigerato appliance etc. repair and buyeseller. These appliances are the items being stored in Josh's garage by Anton. This issue was brought to my attention about 2 years ago.
Josh has pleaded with Anton to remove the refrigerators/appliances from the garage as it takes up the majority of the space but Anton claims since Josh doesn't actually pay any rent, Anton refuses to remove the belongings.
I had thought this was resolved a few years ago but just learned it is still ongoing to the point that Josh is trying to pay Anton to move the appliances out. Anton is refusing.
***My question is this: how do I remove Anton's (non-tenant) property from the garage or take title to everything that is Anton's in my garage (but not Josh's) so i can remove it.
I was considering doing something similar to this:
  1. Send a certified mailed letter to Anton to cease and desist, giving him notice to remove all of his belongings in the garage within 30 days or legal action would be filed against him. (I would do this in hopes of "scaring" him into complying.) Hopefully solving the problem.
  2. After the cease and desist, and 30 days, I would do something similar to when a tenant vacates or abandons their unit but leaves behind personal property. The problem is Anton was never a real tenant, so i am not sure if this is how i would go about taking title to the property to legally remove it. I would de more research but would likely after 30 days, then send a second letter by certified mail giving notice that I am taking ownership over the appliances if not removed within the legally required amount of days. ( Something similar to a mechanics lien/ or something)
I need to do a little more research but I was hoping someone could help me with this situation as it is similar to when a tenant abandons a rental and leaves behind personal property. Have one of your tenants ever left behind a washer and dryer? its trickier because Anton is a non tenant. How do I get title to Anton's property or at least get a court order to have it removed. Is it possible to sue for back rent since he has refused to remove the items for such a long period but Anton is technically not on the lease. I am not sure if appliances are personal property or fit into a different category.
****One extra important thing to note:
When this problem started 2 years ago, when Josh asked Anton to remove the property, Anton threatened to burn the garage down if Josh attempted to remove the appliances (Josh filed this in a police report at that time around 2 years ago).
Tl;DR:
I rent a garage to a tenant. Tenant allowed a friend to store appliances there. Now Tenant cannot get the "friend" to remove the appliances. How do I go about getting the “friend's” appliances out of my tenants garage. I am unsure how long the appliances have been there (2 years?) or if they are consistently switched out over the 2 year period.

2024.05.21 22:00 whoisaname Fair Housing Act Question Regarding ESAs [USA]

I am an owner-occupant in a two-family. I live in one unit and rent out the other.
Based on my knowledge of the FHA, it does not apply to me because I live in one unit, and the building has four or fewer units. (side note: I don't use this in any way to discriminate, quite the opposite and am very accepting. I just don't pay much detailed attention to the FHA.) Also, my state has no greater restrictions or law than the Federal FHA.
That said, a situation has come up with current tenants. They are almost 10 months into a 12 month lease. They have two pets, a cat and a dog. As part of the lease agreement, they "paid" a pet security deposit and a very small pet fee. It should be noted that I am aware of damage that one of the animals has already done. As of today, I received a text with an image of a letter from an APRN stating the need for an ESA(s). The letter was not very detailed or thorough (about two sentences long, and I was under the impression that these sorts of letters need to be very detailed, from a doctor only, and be specific to the need as well as a separate letter for each ESA if there is more than one).
I have never been requested to accommodate an ESA or service animal so I am not familiar with the full legal requirements. If the FHA does not apply to me, do I need to accommodate this (i.e. give the pet security deposit back/stop charging a pet fee)? Or, are accommodations required (with no deposit, etc.) even if the FHA does not otherwise apply?
Then, if I do need to accommodate, is a single, non-descript letter from an APRN enough? Or am I allowed to request two separate, detailed letters from a doctor?
Lots of questions, I know. Just trying to get some clarity on the matter to make sure I handle it appropriately. Direct answers would be great, but even suggestions on who I might contact or where to get further info would help. I have already tried to call HUD, but not getting through.
Thanks in advance, and I will try to be responsive to questions if anyone has any.

2024.05.21 21:18 Own_Afternoon_6865 Private owners who accept disabled veteran with section-8

Hello everyone! I am a female disabled veteran. I was illegally evicted (from my townhome I had lived in for 7 years) during Covid and despite having section-8 I cannot find a place to live. The eviction results in an automatic denial of every application I have submitted. I am looking for a private landlord who will rent to me.
For some background information (I will try to make brevity my strong suit): I was in the USAF for 8 years. My husband and I went in together on the join-spouse program. We had our first child 2 years later, then the military did away with the program because there were so many married couples enlisted. We got out, had our 2nd child 8 months later and soon afterwards, bought a house. I obtained my bachelor's degree in nursing, then worked as an RN for 28 years. We sadly were divorced after 21 years, and I have been my sole means of support since that time. I moved into my townhome in 2015 and had no issues until 2021. I severely injured my back moving a very large (298lb) patient off of the OR table, following an emergency C-section. I struggled with back issues the rest of my career. In February of 2020 I was laid off from my job as a corrections nurse due to Covid. I was on unemployment but still paid my rent on time every month. In June of 2020 I allowed my oldest daughter to move in with the agreement that she would pay 1/2 of the rent and utilities. This turned out to be a disastrous decision. She had struggled with SA since she was 15, but swore to me she was clean. She was addicted to heroin, couldn't keep a job, created drama constantly, and never paid a penny's worth of her half. She was often rageful, as was her son who visited frequently. They did damage to the townhome in the form of her bedroom door, which my grandson made 2 large dents in with his fists, and the bottom of the staircase, which my grandson pulled the bottom of the handrail away from the wall. Those 2 items were the only damage.
In March 2021 I applied, on the 1st day it became available, to Biden's federal assistance program for tenants in danger of becoming homeless. I notified the property manager, and requested that he send in the required paperwork from management to complete the application. He came over to talk with us and he understood the program. I had applied for SSDI in March of 2020 due to back issues, major depressive disorder, and emphysema. I could no longer perform my duties well as a nurse. Everything was fine until June 2021 when he was replaced. The new property manager was a schoolteacher who was a longtime friend of the owner. She admittedly knew nothing about property management. I first met her on the day I had just been discharged from the VA hospital. I had been in the hospital for 12 days, so I came home and was resting in bed when my daughter came to get me saying, "The owner and a new lady are at the door screaming." They were indeed screaming at me because May's rent had not been paid. I tried to explain the program and the fact that the previous manager knew about it. The law protected residents who had applied from being evicted. I requested an appointment for the following day so we could talk civilly. At this point, TN had only released 6% of the millions of funds available. Finally, my funds were released in September. All arrears were paid, and 3 months into the future were paid, with the option of 3 more months being paid if the tenant was still struggling to pay. When the complex accepted the funds, they signed a federal agreement which stated they could not attempt an eviction based on non-payment of rent, could not create a new lease, and could not harass the tenants (my daughter was on the lease, too). They broke all of these conditions, starting with asking ONLY ME to sign a new lease 3 weeks after receiving the funds. They were requesting me to pay pet deposits for my 3 pets, a dog and 2 cats, in an amount $100 over the normal amount, then get rid of the pets immediately. The pets had not done any damage. The new lease increased the rent by $300. They had already been paid for the rent with the federal funds. Immediately following this "new lease" they sent a letter to both of us, saying that the new rent had not been paid on time and we were being evicted. They would not allow maintenance to come repair things. I had requested 6x that they repair both upstairs toilets, which were leaking at the base, to the point that their were stains and leaking on the living room ceiling! They filed for eviction in January 2022. They only named me, knowing that all of the rent payments were done by me. The case was dismissed because they had filed before it was legal, due to the agreement. I asked the judge if it would be necessary for me to appear in court on the next date if I moved out prior to the date, but he said, "That would be a moot point. You cannot be evicted if you have already moved out." We DID move out before the next court date, but their management went to court ANYWAY, saying we were still there and an eviction was granted!! I looked into filing an appeal, but the cost to file was $695, and I didn't have the money to appeal.
Luckily, a place opened in a VA sponsored home for homeless women. My time is up here and I have applied to a multitude of properties but my applications are always denied, based on the eviction. I am working with a lawyer who has written a letter on my behalf, as well as a letter of recommendation from the program director. Still, I have had flat denials from every property.
The assistance I am requesting is names of property owners who will work with me. If any of you kind Redditors know someone, or ARE someone who would work with me, please let me know. I am out of time at the VA home and I have nowhere to go. I never pictured myself at 64 years old being homeless. Thank you in advance to anyone who can help. I have SSDI, as well as VA compensation, so my income is secure and reliable. I am desperate for a safe place to live.

2024.05.21 21:13 Specific_Being_1116 Landlord Trying to Keep Security Deposit for Water Damage (FL)

Wanted a few opinions on this situation: moved out of a rental at the end of march and did a walkthrough where the landlord said everything looked great and we (my husband and I) were the best tenants he'd ever had. We only lived there 11 months (left 1 month early due to military orders). At the walkthrough, he said 'he didn't have the funds to return our security deposit because he thought he would have found a new tenant by then and would have given us their security deposit. We gave him nearly double the notice required to terminate a lease due to military orders. He said he had 30 days to get it to us. We moved away out of state.
31 days after we move out we receive a horrible letter accusing us of all sorts of things and saying we aren't allowed to break the lease so he's keeping the deposit. Unless he never hears of this again, he'll be charging us for various things (one is a retroactive increase in rent). The only thing fathomable that could actually be charged to us is he is claiming water damage from a wall ac unit and a months rent for not being able to rent the home due to repairs. The home was listed for rent and the listing updated every few days during the month it wasn't rented. He lowered the rent and the listing has been down now for about a week so I doubt he did any repairs but just couldn't find a tenant. 100% we had absolutely no knowledge of a leak from the ac unit. He is claiming the ac, wall, door, doorframe, and front porch light are all not repairable. The ac was above what should have been the front door but he lived in the garage of this house so we were basically not allowed in the front yard and used the back door as our front door and exited to the street behind the street this house was actually on. He put large plants and other of his items on the porch essentially blocking us from coming out as well. It's a very long story regarding our backwards house but essentially we did not use the front door at all, under 10 times in that year. We did clean the filter for all of the acs monthly (I have extremely severe asthma) and never noticed any water issues. There was no water on the floor or dripping. I have a picture from the day we moved out and in the picture there is no visible water damage. The ac was working on the day we moved out.
Before we moved in, he told us he was going to replace all 4 wall units. That didn't happen and he told us he was going to do it while we lived there and that didn't happen. All of the acs were horrible and we used to make passing remarks of how hot it was to the landlord. He eventually said he's not replacing them until the one above the door stops working completely. I also have texts from him saying that particular ac can't be turned down past 76 or it will break. He literally lived right below it and heard it running (it was on 76). Basically, I am certain there were problems with that ac and he was aware of it but I was not aware at all that it was causing water damage, if it actually was. I wish I had known because I would have insisted he replace it. I'm thinking he either did actually get around to replacing it and discovered it or is making it up.
I have contacted a lawyer to send him a demand letter but my husband is now worried about what if he does actually try to sue us? What if he decides to rip out the whole wall and sue us for tens of thousands? Doesn't he need to prove we were aware of this water damage? In his letter he stated he asked for entry into the house each month to service the ac but we denied him and broke the ac by never cleaning the filter in 12 months. He never asked us once to service the ac and entered the house on several other occasions, once to fix a plumbing issue and once to replace the dishwasher. Plus a few other times we invited him in. There is no clause in our lease saying anything regarding reporting damages, water damages, or we are responsible for maintaining the ac. My parents also came to stay with me for nearly 2 months while my husband was away and they are willing to write a statement that they never saw any water damage whatsoever. My husband doesn't want to send the demand letter at all because the letter we received we full of just bizarre untrue statements and he feels like he will make up a huge lawsuit. Even appearing for a lawsuit would cost us a ton in travel so we really don't want to get involved with that. I do want my deposit back but I feel like this water damage thing is totally made up or can't reasonably be blamed on us?

2024.05.21 20:56 lunaria7567 Should I report my roommate to the landlord and get her kicked out?

I am one of three roommates all 25F. I moved in here after my lease was up and I found it on an Facebook group looking for roommates. I messaged my one roommate on the forum, Sam (25F), and immediately clicked and after viewing, I decided to go ahead and agree to be the third roommate. We were all in a group chat with each other, me, Sam and the roommate in question, Lana. We all got along and I was very excited. My roommate Sam, texted me separately and said “I don’t want to poison you against her but she really struggles with follow through and cleaning”. I told her, between the two of us, we can have a roommate meeting and sort out what our expectations and boundaries. She liked that and I moved in on April 20th. The house was a disaster moving in. It reeked of cat piss and shit and smelled like weed. My family was very concerned but after I calmed them down, I got to work to clean. Before this, Lana said that she would clean her stuff and since I am paying for two rooms, she will clean the cat piss and shit and the smell will be gone. This was over a month before I moved in. She never did it and after me asking her, politely to clean the rooms I am paying for she said “I can’t clean it because the carpet cleaner is broken”. It is also probably important to mention she has two cats and a dog. I have a dog who has an ESA and is in training and is always attended or being crated trained. The whole two weeks I moved in, I felt sick with the smell and my dog and I were living in one room together and I finally had enough of her excuses and bought the supplies to clean the rooms. I cleaned the rooms and the bathroom (which also smelled like cat piss and weed) and I basically begged her and my other roommate to be respectful of the fact that I cleaned the whole upstairs. Sam lives on the top floor (attic) she has a cat but that cat does not leave the area. My dog is crated when I am not home or at doggie daycare. Lana’s animals roam around and cause havoc in the house. On top of all that, she leaves her stuff all over the house for days if not since I moved here (it’s been over a month at this point), smokes weed when we are a non-smoking household, loiters the house with stuff, doesn’t pay bills on time (we might get our electric shut off because she won’t send her part), complains about not having money but buys stuff online and DoorDashes all the time (none of my business but can’t pay bills?), absolutely refuses to meet with us about concerns, doesn’t control her dog so her dog comes at my dog and our landlord is coming to inspect. I wouldn’t be surprised if all the shit on our porch gets us a fine because it’s against neighborhood regulations. I am so exhausted and stressed and I can’t live like this. I feel horrible everyday and I don’t like eating here and I can’t stand her and her constant disrespect. I’ve tried to like her or talk to her but nothing gets done.
Side note: She broke our washer (landlord only provides hookups so we are screwed)
I don’t want to lose my deposit and I want to leave. She’s incompetent and probably stupid because she doesn’t understand how a lease works.
My pet fee is waived in my state because of ESA (I think that’s federal) but she owes money on her THREE pets and wants to fool the landlord, only having to pay for one.
Please give me advice and if this is enough to take to the landlord.
I HAVE TAKEN PICTURES AND I HAVE TEXTS, RECEIPTS AND MY ROOMMATE SAM AND I ARE ON THE SAME PAGE
thank you 🤍

2024.05.21 19:49 Moeman101 Notice of move out help

Hello everyone. I just wanted to ask what is the best way to document that you have handed your landlord a notice to leave letter more than two months out from the end of your lease. This is just the cover my ass in case they try to charge me an extra month of rent. Btw my lease ends july 31.

2024.05.21 19:43 Beautiful_Hold1879 Am I Wrong in My Understanding of This?

(CA) New landlords officially took charge of the 4-unit apartment building I live in. We just got a notice from the prior property management company that they are no longer serving our needs. But we also just got a letter in the mail from the new owners introducing themselves yet, at the same time, not really solidifying anything.
As a student of rhetoric, I understand this language is vague on purpose. They write, "...please rest assured that your lease agreement remains unchanged for the duration of its term." This is a legality they have to follow, of course, and our lease is up August 31st. Also, "While I do not anticipate any immediate changes, I understand that circumstances may arise in the future that necessitate adjustments. If any changes are to occur, I will ensure to communicate them to you well in advance and discuss them openly." Translation: "I can still give you a 60-day notice to vacate because we're not quite there yet, but I don't want you to know that's what I'm considering."
Overall, it's a very nice letter. Communications prior showed that they want very much to keep the current tenants as we have been here a long time and pay our rent.
Here's the crux of the problem: our rent is LOW compared to market value. I am perfectly willing to pay market value if it means we don't have to move. BUT, legally they can't raise the rent more than 10% if we stay. UNLESS - and I'll need help on this - there is a loophole for them to raise our rent to market value so we can stay? Otherwise it seems to me they're just going to kick us out and bring in tenants they can charge a higher number (we pay $1450/month in an area that is EASILY $2450/month). If they do, that's a 60-day notice, right? Or is it 90?
Thoughts?

2024.05.21 17:57 oemperador [Landlord US-CA] How to politely and kindly kick tenants out?

I have a 4b2b home and currently two tenants occupy the whole house. I'd like to rent the entire place to ONE single family or renter but current tenants' leases end in Feb and April of next year. I'd like to do this around Nov/Dec. They have been nice tenants and we've had a good relationship the entire time but not super close either. Just overall good.
Update: thank you for such great information that I wasn't aware of. I will let leases run out and will either use Just Cause to not renew or pay them out at that time in the spring. Advise for other new landlords like me, read about AB1482 and actual law extract text.

2024.05.21 17:32 ski--free Landlord using security deposit for cleaning

Is the landlord allow to keep a portion of my security deposit to pay for cleaning if it was written in the lease? I tried to have the section removed at signing but they wouldn't budge on it. I signed it anyways as I was willing to lose the $200 as we needed a place. Additionally, no move in inspection was ever performed.
Quote from the lease:
  1. $200 from the security deposit is non-refundable and will be used to professionaly clean the premises at the end of the termination of this tenancy. If at the end of the lease, upon occurrence of any permanent damage to the carpet, floor, wals, fixtures, not a result of normal weat and tear will be the tenant's responsibility to fix before vacating the premises otherwise the security deposit will be utilized to cover these expenses.

2024.05.21 17:03 Angry_Catto115 I hate the DMV

Last week I go in to get an ID that coincidentally expired two days after my job interview. I was hoping to start soon but my luck has been down the drain this year. To make it more difficult I moved in 13 days before that incident with the DMV meaning I have no pieces of mail, its too early get any bills of any kind. I rushed to get as much spam mail + other pieces but only made out with two. I go in with two pieces of proof of residence. She says she can’t accept online documents (Its my electric bill) but the apartment lease was fine. I wasted 20 minutes and went home angry. I come back calmed down today and present a letter from the landlord + the lease and she says she can’t accept the lease because I didn’t have my name on the water bill section. She then asks if I have a bill of any kind and I say no I haven’t been there long. The next part infuriated me to the point where social decency was no longer a concept to me, a quiet and understanding guy who respects everybody and is somewhat cautious not to be confused with shyness. This troglodyte asks me if I have my electric bill on my phone. I say “Why? you rejected me the last time.” And her excuse is thousands of people go through everyday. I tell her I came on the last day the DMV was open 20 minutes to closing and came early in the morning the moment the doors opened. So that was a complete lie. She starts nit picking at the authenticity of my citizenship (I’m literally Native American) and her co worker swoops in and finishes it while she tells her incompetent hobgoblin coworker to go in the break room because shes all flustered. Got my ID thankfully but seriously? Why do I go through these loop holes just for you to lie to me about the electric bill? I was late to my orientation by 10 minutes but at least next Tuesday I can come back and finish it and start working. Anybody else hate it or am I just a big hater?

2024.05.21 16:09 messy_nessy NY landlord saying we need to pay August rent when our lease is up July 31st.

Just like the title says.
My husband and I purchased a home and finally got the clear to close from the bank with a closing date of 6/6. We just gave our Landlord notice that we will not be renewing our lease. We were contracted from 8/1/23-7/31/24. Additionally, there is a clause in our lease that states we have to give 60 days notice if we were to break our lease early. So not only are we stating we aren't renewing, but we technically gave over 60 days notice.
We just got a text that said they will be scheduling showings for the apartment (which we of course expected), but also that we will be responsible for August 2024 rent if the apartment does not rent out. We reviewed our lease thoroughly, and nowhere does it state we would be responsible for a full months rent after our lease contract end date.
Just looking for opinions and insight here. We have never had any issues with our Landlords, so this was a bit unexpected for us. TIA.

2024.05.21 14:28 AnnualSquare714 Can a landlord restrict access to an outside water tap?

We recently got a new landlord, and they are now restricting our access to an external water tap.
There are 2 units in our house. The landlord on the ground + basement and us on floor 2 + 3.
In previous years, we had attached a hose from the external tap at the ground floor, and run the hose to the top floor patio where we live to water our plants. The hose has been taunt against the hose, doesn't leak and in general a non issue for the previous landlord. The hose is 99% empty and not pressurized. We use it to water and then turn off + empty. Landlord pays all water for the unit regardless of the source of where water is drawn.
Our lease makes no mention of the external tap, and simply says we must be provided water services.
Does the landlord have the right to restrict our access to the external water line?
To be clear. The hose is connected externally to be used externally to water plants on a patio. Hooking it up to another source is not an option.

2024.05.21 13:26 InTylerWeTrust24 Landlord selling the building - what should I do?

My landlord is selling the building and I’m wondering if anyone has advice on how to approach this. My understanding is that the new landlord will have to honor my lease (lease ends at the end of August). My rent is pretty great right now so I want to avoid a massive increase when the new landlord comes in. I’m thinking of asking the landlord to renew / extend my lease for another year to avoid this. Has anyone been in this situation before? How did you approach asking the landlord for the renewal?

2024.05.21 10:48 Apprehensive_Put_118 My landlord decided to sell…oh boy 😒

So this is a rant but also seeking advice. First a bit of the back story i moved into this property almost 3 years ago. Initially i had no contact with the actual owner only worked with property management team. Repairs were done timely and i never had an issue. Until about summer last year the actual owner began contacting me(mind you this was against the lease agreement it explicitly stats tenant and owner should never communicate or id be fined!). He then kept contacting me constantly demanding I call him back (even though id constantly ask for text and email) just odd questions about the properties condition, randomly most times while i was working. Then he finally said in November he wanted to sell the property. The realtor came out put a sign in the yard, a lockbox and started to reach out every time there was a prospective buyer wanting me to make everything look “show ready”, I always keep a clean home, but it was annoying that id have to rush and put up valuables, make sure the house was “show ready”. Then also take away from work to talk to these buyers because no realtor was there to show them around and they always had questions while i was at work (i work from home). Also they would always tell me 2 hrs or sometimes less in advance (even though the lease stats 24hrs would be given).
Eventually he finds an actual buyer, they send out an appraiser, nice man, who tells me a pipe has come loose in the basement that could be leaking co2 into the air.I have a daughter and I freak out and put in a ticket right away. This was back in March, they sent out a guy to tape the pipe and told me he’d come back with parts. Never did, so I just got a co2 monitor and will pay to get it fixed myself I guess🙄. The sale becomes official just a few weeks ago the for sale sign and lockbox gets taken away im happy its over. Or so i thought, my first contact with the new owner was a little over a week ago where the guy says he didnt know it was a tenant in the property and was under the impression i was on a month to month (very contradictory i know). I explained that a tenant being in the property was listed in the zillow ad, i also explained i was not month to month. He requested I send a copy of my lease and tried to tell me he wants me to sign a new lease with a background and credit check! I declined and explained legally he must honor the lease (id already spoken with a lawyer for advice). He said he’d look over the lease and get back to me, he didnt. I messaged him almost every other day looking for an update, I then asked where do i sent rent for June at least? Then miraculously a new management team contacted me sending over introductory information and a rent increase for an additional $400 a month! I contacted them and disputed this going over the lease with them, just for reference my lease has no clauses for early termination, the lease actually only allows a 60 day window to break the lease before the end of the lease term which is 6/30. After this the lease automatically renews for another year. This is for 5 year, after the fifth year it goes month to month with a 10% increase. Also my rent increase is controlled per my lease at 3.5% up to $50. Anywho after a few days they spoke with their “legal team” and removed the increase. I thought everything was over until my old landlord contacted me again and said when he sold the property our agreement was over and he’d forgotten to tell me. After i explained the lease it with the house not the owner he seemed to understand saying “gotcha” but later demanded I call him after calling twice, I requested text or email but he wouldnt he said to call him it was urgent. He starts the conversation with he doesn’t care if im recording (which i was, without his consent it would have been admissible in court) but proceeds to say the new owner was told i was month to month he explained how he didn’t know that i was under lease still and thought i was month to month, he blamed the old property management team he says they mixed things up.🙄 He then basically tried to guilt me into leaving saying he was always good to me and we never had issues. He also offered to pay my deposit for a new home which is nice. At the very end of the conversation he says he works for the secret service and explain call recording is admissible in court unless I other parties consent ( strange!). But anyway its such a pain to move and I truly have no interest in leaving until next year (i know they wont renew). But I dont have interest in that offer or dealing with either one of them except to pay rent be peaceful and upkeep the property as a decent tenant should. I feel like i should not be apart of their drama and negligence and i just want to save money this year use this time with a low rental amount to pay off debts then buy my own home next year. I definitely dont want to move into another rental. Am I wrong would you guys leave?

2024.05.21 08:46 galaxyd1x AITAH for not doing more to salvage our relationship? TW: abuse, alcoholism, suicidal ideation

I apologize that this is very long but I felt like I needed to get this off my chest.
My first long-term partner (K) and I were together for about 3.5 years. K was the first person I had ever gone on a Tinder date with. She was so stunning, my first word to her was an awe struck “wow.” Both of us said we weren’t looking for anything serious but we were immediately inseparable.
She was married (though they weren’t intimate) when we first started dating, so we kinda began as a poly relationship. Her husband was dating other people as well and we would go on double dates occasionally. I was happy with the arrangement, but the underlying issues in their relationship resulted in their divorce.
We decided to be monogamous for about 2 years. She was the first partner I had moved in with. Our apartment was shitty; the first one we were put in within this community literally had a pipe burst and flood the week we moved in, but we made it ours. We had arguments occasionally but we always talked things out and never went to bed angry. We adopted an elderly dog and a hydroponic garden in our kitchen table. We challenged each other to grow, supported each other, and were study partners while we worked towards our degrees. We were happy.
We decided to explore polyamory again because we felt like we had a solid foundation but had always preferred enm. We agreed to a non-hierarchical ktp dynamic and were entirely on the same page. She went on a few dates before I got a match (amab problems 😂) but I was consistent in my compursion; I was genuinely happy that she was going out and having fun.
Then she started dating him (S). S was an alcoholic living in an absolute shit hole, but we took him in like a stray cat. A few of the 🚩’s we ignored were that he unironically liked Joe Rogan, had extreme trauma and refused therapy, and he (claimed to have) killed people as a mercenary overseas. He lived in PA and was planning on taking a greyhound back to pick up a car. I suggested we drive him down instead. The trip went great and shortly after we got back, we invited him to move in. They had only been dating for 3 weeks and I expressed concerns about NRE, but K convinced me she would somehow not experience it.
At first, things were surprisingly good. There was a little bit of getting used to. They often had difficulty communicating with each other so I predominantly settled into a mediator role, but we were able to work through things together.
K finished her degree but couldn’t find work where we lived, so we began looking in PA. The plan was for K and S to work while I finished the last year of my degree and did the majority of the domestic labor. Once we got there, there arguments began spiraling out of control.
For the first 2 months, they argued almost every single day. S would become irrationally angry and then suddenly dismiss the topic. At the same time, K put all of her energy into her relationship with S. I told her repeatedly that I was feeling neglected and that I couldn’t keep acting as their mediator while getting no support myself. I was spent.
Then K got fired. I put my education on hold to work until she was able to find something else, and S took a job where he’d be traveling out of town for weeks at a time. I had hoped this might allow her the space to refocus on our relationship some. Every time he left, K would message S in the middle of every conversation we had, including when we went on the rare occasion we went on dates together.
Sex isn’t everything; what I craved was intimacy, but to try and keep things somewhat equal, K asked us to keep track of how long it had been since we had sex. We only had sex 5 times in all of 2023, while they had sex 5 times the first week we moved to PA. It was hard not to compare relationships when we weren’t even intimate on our 3rd anniversary.
S was completely self absorbed. Once he came home from work and I asked how he was doing. He talks all about his day, walks off to the bedroom and asks K about her day like he didn’t care about me at all. I decided to see how long it would take for him to initiate a conversation with me, and we basically just stopped talking entirely.
His alcoholism was also getting worse. He began drinking while arguing with K and got so drunk he could barely stand. My father was an abusive alcoholic and I was getting worried that things were going to become physically violent, and I know I wouldn’t just sit by if he became violent with K. One or both of us would have died. When he screamed at K on the balcony from 9:30-11:00pm because I ate some leftovers he wanted to eat (not even all of it), I knew something needed to change.
I had made it clear by this point that I wanted S to move out while he gets into therapy, but K refused to ever broach the topic with him together or alone. I suggested couples therapy since my therapist was familiar with enm, but they both refused. The only other option that I saw was for me to move back in with my family to protect myself. K and I agreed to try a long distance relationship while things settled down. All I asked of K was a single 30 minute phone call each week.
I left at the end of Nov, and for the first couple months things were going as well as could be expected. I enrolled in school, began working out, and had a good therapist. I gave K nearly my entire final paycheck to help cover rent while they found a roommate and they agreed to take me off the lease once they found one. In therapy, I came to realize I was still harboring some anger because the way our relationship dynamic changed once we moved was basically cheating. I eventually told her that we couldn’t have a real relationship while they were still together. She didn’t really seem phased by it; she sent me a sweet gift for my birthday in Jan, we talked about how much we missed our life together every time they fought. We even planned for her to come visit when she got her tax return, partly to bring the last of my belongings and partly to visit and feel normal again.
In Feb, K confided in me the verbal abuse had escalated, that S was threatening to kick her out unless she began working despite dealing with serious medical issues (not to mention we were all 3 on the lease together months after they found a roommate). I didn’t have enough money to keep going to therapy and the phone calls became less frequent. I was becoming extremely worried for K, constantly checking the shared location data to make sure she was still alive. I would spend days crying at a time, unable to get out of bed. I fell behind in school and even confided to K I was beginning to feel suicidal.
In mid-March, K affirms that we can’t have a real relationship, that she is going to try to make things work and was in couples therapy with S. K cancels her plan to visit without explanation, trying to gaslight me that we had discussed it but refusing to elaborate. I contacted K’s cousin because I was worried that S was manipulating her but I also wanted to respect her autonomy.
The lease was set to renew in April and I still hadn’t been taken off the lease (despite having a roommate move-in back in Jan) so I told them I wouldn’t pay my portion of the phone bill until they took me off as we had agreed. It felt callous, but it seemed like the only way to make sure I was off the lease. Of course, once I made it a problem for them they finally acted, but I hate that I had to strong arm them. Regardless, I upheld my end of the promise as soon as I got the change in writing from the office.
I was sick of seeing their faces in family sharing every time I opened my settings so I told them I was planning on getting my own phone plan. I tried to transfer my number, but the account was in S’s name. I told a csr that I wasn’t comfortable speaking with S. They told me they would attempt to contact him and get him to authorize the transfer for me, but he refused to answer their calls and messages.
For the last 6 months, they had continued using my dashpass so it notified me every time they ordered food in, and I would breakdown missing the life K and I had built together. I told K I wasn’t comfortable with them using my account anymore. K immediately pushed my boundary, telling me she’s just not feeling good that day and politely asked if she could use it. I relent, but the next day, I changed the password to reinforce my boundary.
The next day I get multiple failed login attempts, clearly from them trying to use my dashpass without asking. K asks if I changed the password, which I affirmed. Then S shut off my phone line without notice. I was forced to get a new number which messed with many of my digital accounts because of 2FA.
We’ve barely talked since then but today she changed her pfp to a picture of them smiling together with a bottle in front of S and I couldn’t stand it anymore. I deleted every picture of us together. I unfriended her, her friends, and her family. I deleted the messages, I threw out the stupid fucking “hold this until you can hold me” pillowcase, and everything else that makes me think of our life together.
They still have my late grandfather’s speakers and records, all of my power tools, and a couple paintings I’d had for a long time. As hard as it is to accept that I may never see any of those again, I’d rather have my peace.
Maybe I’ll find that peace one day, but honestly all I feel is hate. I hate that K wouldn’t choose me over S, that she gave up on our life together. I hate S for stealing my life from me. I hate the thought of them laying together in our bed. But most of all I hate myself. I hate that I was too cowardly to confront S, that I was too timid about affirming my boundaries, that I had so much hubris as to think K and I could withstand anything together. I hate that I still love K as much as ever.
There’s a good chance K sees this, and all I want to say to you is that I deserve someone who treats me like a priority. I deserve someone who doesn’t tell me I’m hard to love. I deserve better, and so do you.

2024.05.21 07:55 we-out-here404 Lease renewal question in Evanston Illinois

Not sure this is the best place for this question but I'll give it a try. My landlord in Evanston contacted me saying I have 2 weeks to let thwm know of I want to renew my lease which expires in a couple months. The date I need to let them know by is exactly 60 days from the end of my current lease.
2 weeks seems like a quick turnaround. I'm wondering if that's a standard thing and I'm wondering in terms of renters rights how early in required to agree to or decline a new lease. Anyone here know?

2024.05.21 07:23 Hefty-Appointment140 My lease said I need to pay for electricity, but when I moved in, my building manager said it’s covered.

Hi, I rent in a Montreal apartment, and have lived here for more than two years. I already had two automatic lease renewal, and was always under the impression that the electricity is covered until very recently. (Lease renewal document is shortened and only the initial lease mentioned who’s responsible for utility)
A few weeks ago, my current building manager emailed me to ask me to open a Hydro Quebec account. I was confused, because when I moved in, I double checked with my building manager at the time, and they said I don’t need it. Also, I have lived here for so long, and never got asked before or received any notice.
After some communication, I coed my current building manager with a past communication of past employee confirming that my electricity is covered, and the current manager told me I’m fine and I don’t need to pay.
However, I’m still worried because of several reasons:
First, the building manager seems also confused about the situation and would not remember our conversation a day ago. I asked for a email confirming I don’t need to pay, and while they sent me an email. Their wording is “I confirm that I have received the email where it says that the electricity is included in your apartment.” So I feel like it’s pretty vague, but at least it’s proof that I was responsive and they didn’t ask for further actions?
Second, the company seems to have record problems in general. The current manager said they technically should at least have a yearly review, but non of their predecessors did a review which is why my record was unnoticed for so long. What if the next manager asks me again?
Third, I don’t know why the lease and actual coverage doesn’t lineup. I feel lease has more legal bindings than an email. Also, what if it’s a previous manager’s decision that got automatically canceled when they left? What if my electricity coverage was a time-limited thing?
I want to get advice on if I need a next step and what’s the worst possible scenario. My current building manager says the worst scenario is I have to pay for previous electricity fees, but I won’t be fined and it won’t affect my credit score(in conversation, no record). Is that true? To be honest, I can afford payback those fees, but it feels awkward after they told me I don’t need to worry about it. And it feels like it would be a time-consuming and confusing procedure.
Last but not least, I am applying for permanent residency and aiming for eventual citizenship. Will this affect my application in anyway?
Thank you so much for any help! I might be overthinking things, but I’m really anxious.
TLDR: after 2.5 years, suddenly learnt/remembered my lease said I need to pay for electricity. My building manager changed their mind after I showed a past email and said I’m fine. I’m still really worried. What to learn about worst scenarios.
