2024.05.21 17:25 137thofhisname Topic - How do you guys keep yourself going?

Hi everyone,
Long read ahead.
I wanted to share a bit about myself and ask for your insights on a topic that's been on my mind.
I'm a 31-year-old guy, happily married for two years to an amazing woman I dated for two years before tying the knot. We share our home with a small, mischievous cat. Life has been kind to us, and I feel incredibly fortunate.
I come from a humble background. My father worked hard to support our family of four, ensuring that my brother and I could attend a good school in Bhayandar, a suburb near Mumbai in Maharashtra (though I'm never quite sure if it's in Thane or Palghar district). Despite the financial constraints, my father prioritized our education, and I was able to go to reputed colleges for my higher studies.
I was always a book smart kid, consistently scoring good grades. Thanks to my father's support, I managed to complete my MBA from a tier-2 B-School without needing any student loans. At 23, I landed a job in management consulting straight out of B-school, which has been a significant turning point in my life. Financially, things have been stable, allowing me to save a decent amount and enjoy a comfortable life with my wife.
However, despite these blessings, there are a few things that keep me wide awake at night, and I will try to put them down here in some sort of structure:
Will I Ever Have Enough Money?
I know no amount of money is ever enough, but I also know that no matter how hard I work, I will never be able to afford a swanky apartment in Mumbai without plunging myself into massive housing debt. As a college kid, I would visit my affluent friend's farmhouse and dream of owning one myself. But that dream keeps drifting further away the more I earn. It feels frustrating, like no matter what I do, I will never be able to own a home I like in a city I love.
Having Kids
Being 31 now means I need to start thinking about a family. But the thought of having kids absolutely petrifies me. Beyond the medical expenses, supporting a child in a rapidly deteriorating world and ensuring they are safe, cared for, and have all their needs met seems so daunting that I can barely comprehend it.
Medical Emergencies
My parents are pushing towards 60 now. Although we have medical insurance, I always worry we are not prepared for medical emergencies. I constantly fear that if a medical emergency strikes my family, all my savings will be drained, and that thought worries me immensely. Plus I don't think I am emotionally in a state where I can become a carer.
Society in General
No matter the political, religious, or caste affiliations I have, I feel the Indian society in general is deteriorating. People are angrier, both online and in real life. Corruption and bureaucratic red tape are stifling. I have never dealt with a government official without paying a bribe, except when getting my passport made. My family and I can easily become collateral damage in someone's conflict. Recently, during the Ram temple inauguration, Mira Road saw a flurry of violence, and that’s where my parents stay. The absolute apathy of the progressive governments towards us is ridiculous, making it difficult for a tax-paying citizen to feel righted by the state while getting the bare minimum in return.
I know complaining is also a privilege, and I am aware that many are much less fortunate than I am. But I don’t want to compare. I just want to know from people here, who come from different backgrounds, income levels, and age groups—how do you cope? How do you wake up every day and think, "I must keep going for 30 more years" (in my case, as I assume I will work till 60), and hope to have made something worthwhile of my life by then so that I can have a few years of quiet before my time on this planet is done?
Looking forward to hearing your thoughts on this and how do you cope. Maybe there are more things that keep you up, do share.

2024.05.21 17:01 Sir-Cadogan Update to BLVSH customers: Kindred services placed on indefinite suspension.

A notice to existing and potential kindred clients: the special services BLVSH provides for kindred are being suspended, effective immediately. Our public-facing operations will be unaffected by this change. Smuggling, transport, custom designs/builds and acquisitions services are no longer available.
Additionally, I would like to apologise to any kindred who requested a service of ours over the last month and a half and has not yet heard back. There were significant and unavoidable disruptions to operations. This does not excuse the lack of communication, however.
Q: I have a job that was accepted by BLVSH, but has not been completed yet. What will happen?
Accepted jobs will be completed as soon as possible. Slight delays may occur, but all jobs will be honoured.
Q: I have a job pending that was booked in the last 45 days, what will happen to my order?
Pending jobs will be handled on a case-by-case basis but, in general, you should expect your order to be accepted and completed if possible. BLVSH endeavors to fulfil all obligations and commitments. However, there may be significant delays. If this is unacceptable, orders can be cancelled at no cost with no strings attached. If you'd like, referrals to other service providers can be given where applicable.
Q: I am owed a debt/favour, can I still redeem it for BLVSH services?
Short answer: Yes. It is BLVSH policy that favours are considered to be pre-approved jobs, backdated to the time that the debt was incurred. As such, you will be unaffected by the service outage as the job is considered to have been approved prior to suspension of service.
Q: I have engaged BLVSH in a long-term contract for ongoing use of a service. Will my service be disrupted?
No, at this time we do not foresee any disruption to your service. This change is intended to apply to new orders.

2024.05.21 16:34 sportingpool A Decade of Cheating / How Real Madrid and UEFA have corrupted the Champions League

  1. Real Madrid is in financial trouble. The costs of the stadium renovation are spiraling out of control (€1.76bn and counting instead of €550m planned). Higher interest rates have made Real’s debt (€1.6bn) unsustainable. Real can not afford to be knocked out of the Champions League early.
  2. UEFA assigns referee crews from countries with a high probability of corruption to important Real Madrid knockout stage games. Over the last decade most commonly used were referee crews from Eastern Europe (20x), followed by Italy (10x). Both countries are at the low end of the corruption index. Scandinavian referee teams, from the other end of that ranking, have not been assigned (0x).
  3. The extreme skew in assigning referee crews to games starts with the UEFA Referee Committee itself: The Chair is from Italy (Roberto Rosetti), 3 of the 4 Officers are from Spain (Carlos Carballo) and Eastern Europe (Dagmar Damkova, Czechia and Vladimir Sajn, Slovenia). These UEFA referee crew pickers have ignored in excess of 80% of eligible referees all European Countries have put on the relevant FIFA list. Unsurprisingly 8 of the 14 most heavily used referee crews in this year’s Champions League are from Eastern Europe and Italy/Spain. UEFA selects referee crews Real Madrid got the best handle on. The weakest link are Eastern European Linesmen. It gets even better: Rosetti, Carballo, Damkova and Sajn will also pick referees for EURO 2024.
  4. For no good reason the referee crews are assigned weeks in advance by UEFA. This leaves enough time for Real to contact, influence and bribe referee crews.
  5. Due to the nature of the soccer game (few big moments decide games) and the vague and clumsy rulebook the impact of the referee crew is huge. Offside in particular is a complete mess: The Linesman might or might not wave the flag, the Referee might or might not stop play, the VaR might or might not overrule.
  6. The last 4 knockout stage duels featuring Real Madrid and German Teams (3x Bayern, 1x Leipzig) have all been manipulated. „Offside“ has been the main tool.
  7. The Linesmen situation is incomprehensible. They are not well known and not well paid. It is not even easy to figure out which side of the field they operated on. Yet these Linesmen, who in some cases may earn €50 a game working in their low level home league, regularly have been the difference maker with €50m or more on the line in early stage knockout games. Linesmen have misused their huge impact to swing at least 5 goals towards Real Madrid in the 4 duels men-tioned above (Lewandowski 2017, 2x Ronaldo 2017, Sesko 2024, De Ligt 2024). The probability of these events (skewed referee crew assignments, mistakes and rule violations in games) occuring randomly over the course of a decade is zero. It's cheating, and the data proves it.
  8. There is no UEFA mechanism to systematically and transparently analyze referee crew decisions after the game. Compare that to the NBA: Even though the impact of the referee team is multiple times lower than in soccer, the NBA doesn‘t post referee teams until gameday and issues a report to analyze critical decisions afterwards.
  9. The impact from all referee, linesman and VaR mistakes and rule violations on both sides over its last 50 knockout stage games has been worth a ~net~ 20 goals for Real Madrid. Mistakes and rule violations have made the difference in a net 8 of the 23 knockout stage duels Real Madrid „won“ from 2015-2024. With fair and proper refereeing, Real Madrid would not have won at least 2 of the CL titles awarded by UEFA over that time period. Financially, the Linesmen and Referees have swung close to 200 Million €uro towards Real.
  10. Referee crew for the Champions League Final 2024 (Real Madrid - Borussia Dortmund) Referee: Slavko Vinčić (Slovenia) Linesmen: Tomaž Klančnik and Andraž Kovačič (Slovenia). Slavko Vinčić was arrested at a Serb/Bosnian Mafia party in 2020.

2024.05.21 16:15 Open_Try_6725 Do I work too much to date?

I’ll work about 75 hours a week most of the time. I have a 9-5 in addition to running my own business, the business is profitable but I’m doing both for the foreseeable future because 1. I’m in a lot of debt and 2. I’m not willing to take the risk of diving fully into my business yet in case it falls apart.
In my last relationship this caused a lot of conflict. I would always carve out at least one night a week for the two of us and usually some daytime quality time together too. That was a big sacrifice because that was basically all the free time I had and it was difficult to even carve that time out.
Being single now, I’ve decided to try and start dating, and I just don’t know if this is going to be possible. I’m about to turn 30 so this is not the ideal time in life to just focus on being single, but I don’t want to give up on building my business either.
I don’t even really have time to make this Reddit post lol, responding to texts and calling women back and scheduling out dates feels impossible.
Any thoughts?

2024.05.21 16:10 OptimisticOptimist1 Uk girlfriend advice re prison

Hi all posted here a few timed majority of you know my story by now but will do a quick recap
Late 20's arrested in mid 2022 for Csam. Been on bail since and awaiting 2nd interview. Also facing charges on the lower scale of Sa of an u13. I'm prepared to accept the images charges, the Sa explicitly didn't happen and its a case of my ex chasing compensation. (Me and her were in a toxic relationship prior to my arrest, she gambled away all our money, ran debt up in my name and did fk all in caring for her own children). With all this, working through the pandemic as a key worker and her isolating me from my entire circle and family I felt alone.
My mental health was in an incredibly poor state and porn addiction got hold as an escape and it escalated.
Since arrest I'm back with parents who are supportive. Worked with safer lives. Got a formal adhd diagnosis now and on meds which has helped my impulsive behaviour, on anti depressants and dealt with the debt. Have a solicitor who specialises in these things too who's been great so far.
Anyways been seeing this girl for about a year now who knows all of this and knows I'm likely to face prison. Worst case scenario all in solicitor recons 4 years (2 inside) at the absolute worst.
My girlfriend wants to support me and has been my rock along with my mum for such a long time now and she can see the best in me and how I've changed and even prepared to go through the prison thing with me.
Am I being cruel to keep the relationship going. A bit part of me doesn't wanna out her through it even if she wants to help. Kinda think it would be kinder to let her go. I've always said i wouldn't wish this experience on anyone.
I'm stumped though. Any advice is wonderfully appreciated.

2024.05.21 15:49 Crockmann How did Ruthenian Knighthood develop in the Late Middle Ages?

Just for clarification, by “Ruthenian”, I specifically mean the people of what is now approximately Ukraine and Belarus, and who spoke a language which would form into modern Ukrainian and Belarusian.
I’m specifically focused on the development of the Ruthenian Orthodox nobility which increasingly adopted aspects of Western style knighthood as early as the Galician-Volhynian Wars (early to mid 14th century) onwards. By the period of the mid to late 14th century, and especially the 15th century, many Ukrainian, Belarusian, Lithuanian and Polish historians have noted the development of a kind of western style knight culture in Ruthenia at this time despite their Orthodox faith (similar developments had also occurred in Serbia, Wallachia, Moldova, etc.) In some case this was tied to certain princely states often led by Lithuanian-Ruthenian branch of the Gediminids (who were often of Orthodox extraction, yet still maintained ties to their Roman Catholic relatives) such as the Duchy of Podolia or the later Principality of Kiev, or on smaller scales such as the Lviv Banner of knights described by various Polish and Ruthenian recountings of the Battle of Grunwald in 1410. One such knight was even canonized during the Orthodox Church, Feodor Ostrogski. By the later 15th and 16th centuries, the knights of these regions managed to obtain more and more influence, such as the Hetman Konstantin Ostrogski and Roman Feodorovich Sanguszko, among others. Even the later (16th-17th centuries) Cossacks often found themselves portrayed or culturally influenced by such knightly legends, once knighthood had traditionally been understood to have faded.
Of course, the main issue is that many sources regarding this issue, be it in English, Ukrainian, Polish, etc., are incredibly difficult to track. If anyone would have access to any good sources or information, be it books, PDFS, papers, general informationor anything regarding this issue, particularly any in English, I would be in your debt.
Thank you for reading, and take care.

2024.05.21 15:27 Bosslayer9001 Getting a job sucks ass

For context, I'm a 16-year-old living in "socialist" Vietnam. For the uninitiated, you must think that we're a bunch of commies who're still singing praise about Mr. Ho Chi Minh whilst fighting off Agent Orange in guerilla warfare. If that's the case, then, oh boy, you couldn't be any further from the truth.
Last summer break, my dad offered me a position at a traditional Vietnamese food restaurant in the local AEON Mall branch for a month. He said that it would give me good work experience and color my CV, which I agreed with at the time. And so, like the 'pride of the family' that I was (yes, adults call all of their eldest/most academically adept children this in Vietnam), I decided to take him up on his offer. And, despite everything I've read about 9-5s on Reddit, nothing could've prepared me for actually experiencing it myself.
Firstly, the hours are actually 8:30-17:00, so that's 30 extra minutes compared to the average. Secondly, you're supposed to work 7 days a week. Yep, you heard that right. SEVEN. Their rationale was that since we worked in the service sector, we needed to work even on break days to maximize our output as that's when traffic is at its peak. And the best part? We weren't supposed to get ANY days off even on public holidays, because, guess what, that's when everybody goes out to eat. And, for as much as I hated it, I couldn't deny what they were saying. After all, I myself have been guilty of going to restaurants before on holidays with my family, so I am painfully aware of the fact that somebody still had to work their asses off to give us a good time. In this case, I got to place myself into one of these people's shoes for once.
And that's just the time factor. The people there were... well, let's just say that I had a better time just not interacting with any of them in the first place. Like, I get it, you're very worn down just like I am and I'm a rookie making mistakes and messing stuff up, but you don't have to be such a cunt about it. Even I manage to keep a poker face about me almost every day, and yet I'M supposed to be part of the demographic that was known for their erratic mood swings! I swear, only, like, 3 of the employees there had a shred of sympathy in their entire bodies, which didn't make it any easier for me to contort my face into a grin every time I served a customer. Honestly, it's one of the rare cases where the manager had a more likable and understanding personality than his subordinates, which, uh, isn't saying a whole lot, to be frank.
Not to mention the work itself. Somehow, serving there managed to require a lot of finesse to not topple over the tray stacked to the brim with wine glasses and constant physical labor while being mind-numbingly boring. The health and safety regulations there were practically non-existent, and it really showed when I got a nasty cut on my fingertip while skinning some of the hardest-to-peel fruits I'd ever encountered in my entire life. Normally, I'd expect to get at least a break to recover, but NOOO... they just told me to slap on a bandage and get on with it DESPITE the injury I had. Needless to say, I quickly excused myself and found better luck sweeping the floor instead, but that one experience really set in stone for me just how little people cared about each other when push came to shove.
Now, you must be thinking, "Well, at least you're getting paid for it." Yeah, at 24000 VND per hour, no less. For context, that is equivalent to just under a dollar an hour, which goes to show just how fantastic the economic circumstances are in Vietnam. The last saving grace is gone. Whoops.
And the worst part about all of this is... I am still extremely PRIVILEGED compared to the average person in Vietnam. My parents are both start-up owners, so I get to live quite comfortably without having to worry about food or electricity bills, unlike many others less fortunate than I. But knowing that I'm better off compared to so many people doesn't inspire gratitude or confidence in me. It only makes me feel ashamed to be living in such a world, where the only true winner is inevitable decay and the rest of us are playing the part of the fool. Even the ones at the top.
What I went through was like a bucket of ice water in my face, making me realize just how inconsequential my childhood joys truly are. "Remember the good times", huh? Kiss my ass. Good luck following your own advice while dealing with a seemingly endless horde of customers while trying to steady your shaking arms carrying a tray to the other fucking side of the restaurant. So many people keep telling me that I'm too cynical and negative, but you know what? I bet a majority of them have never actually worked a full-time job before. Seeing them get proven wrong only further reinforces my beliefs that adulthood is not an age of freedom for most like it is advertised in Vietnam, but rather one of monotony and frustration, watching as any semblance of a spark or flair in you gets slowly and methodically washed away until everything around you becomes white noise. And that's me just after ONE MONTH of that shit. I can't even imagine how much pain I'd be in if I had to do that for the rest of my life.
If this is the kind of stuff I had to go through just to get by, then I really don't see the appeal in the state of living over the state of being dead. Like, if I'm such a burden to society and this world to the point where I have to inflict torture upon myself daily just to repay my debts and earn the right to exist, then what reason do I have for sticking around in a world that clearly doesn't want me? What's so good about living when "treading water" is the best the average person like me can hope for? The fact that people have to convince themselves that life is worth living with motivational quotes and thought-ending cliches really rubs me the wrong way, and now I'm not even sure whether they're trying to help others or trying to convince themselves. Sorry if I'm being too "edgy" or whatever for you, by the way. You can always just NOT read this if it bothers you that much.
Anyway, that's enough rambling from me for now. This summer holiday, my dad wants me to do it all over again. And you know what? I will. Because it's the best shot I have at increasing my chances of making it in this twisted place we call reality. Maybe, if I'm lucky enough, I'll find a different place to work in with less bullshit hours and more acceptable working conditions. I'll take anything at this point. Oh, and before I go... sorry for wasting your time, but you brought this upon yourself.

2024.05.21 15:11 GreedyPersonality390 Effects of Ayat Karima Ka Wazifa for Hajat

Effects of Ayat Karima Ka Wazifa for Hajat
Ayat Karima ka Wazifa for Hajat
Ayat Karima Ka Wazifa for Hajat , The Ayat Karima is a very beautiful verse from Holy QURAN of the surah yaseen verse no 78. Indeed, the virtue and barakah of this verse encompasses the entire world and there is a tremendous amount of barakah when one recites it or plays it on the phonograph to seek Allah’s help in getting whatever one wants. If one starts a wazifa along with the Ayat Karima, that person can definitely gets rid out of the problems, gets all the things wanted from the life and can get rid out from any kind of problem in the life by the grace of Allah almighty.
The Ayat Karima is as follows:The Ayat Karima Ka Wazifa for Hajat, in the Holy Quran is the following Ayat:
Inna nahnu nuhyee al-mawtaa: وأنزلنا المOperators ال المنطوقةA) يستنهى بها* العتصم نامهhythwtitaIht1 نذير الستار من العهد empty و Ana ktabu maa qaddamaa wal-aathaarahum wa kull shay’ihin Ahshaynaa fii imamin mubeenlisThe antagon

Ayat Karima Ka Wazifa Method:Ayat Karima Ka Wazifa for Hajat,, Another way of solving the issues according to the Islam is Ayat which is also known as verses of Quran.
Actually this wazifa is very simple and all one has to do is perform two cycles of nafl prayers along with the supplication in the manner of the Ayat Karima. Here are step-by-step instructions:
  1. This means that one should wash their hands and face then do a new wudhu before saying the wazifa correctly. As one can probably think, the body and the garment need to be washed, and hair can be combed or maybe even styled. When offering the namaz, one should make sure that they put themselves in the right position especially to the direction of Qiblah.
  2. Namaz times: offer Nafl namaz as two units. But nevertheless there is Makruh that you should not to offer this namaz at these particular times , you can offer at any other time. Namaz which is to be offered to ful?ll this niyyah should be done with a grave intention and aim for the purpose of making Hajat from Allah.
    1. In the reckoning of a rakat, one has to recite Surah Fatiha and Surah Yasin in each rakat at the least. This is because Surah Yasin Is read only in a single rakaat And if one is in doubt how he can read Yasin then he may read any other short surah very well.
  3. After completing the 2 rakat nafl salah, raise your hands in dua and recite the Ayat Karima at least 100 times:Yurile, masculine and feminine gender Dziekaniecki. github. io/preprints/PolishDictionary/ Polish English PDF1 4 Гeating Lada Антон Бочаров 2 3 1 2018 Good evening, boys and girls!” Instead of the frequently used salutation “Hello,” boys and girls” has a different meaning depending on the gender. 1. Then pray and make your intentions with a repentant heart of faith and hope with a view of making the Hajat happen and meet necessities. Instead, we should turn towards Him by availing ourselves of the provisions of Ayat Karima. How you sinned lift your hands up in repentance, sin lifting your hands up.
  2. After dua and wazifa, end it by saying ‘Amen’ thrice and then ask for Allah’s pardon thrice.
When and How Long to Recite Ayat Karima Wazifa:Wazifa for Removing Obesity: Duration and Time Table
In case of an emergency and need (hajat), the following wazifa can be recited and for that at the convenience of seven days, the time should not be wasted. However, one goes on reading and carries on with his/her supplication to Allah, with patience to wait for the response or the answer to the dua.
If your hajat is not so urgent, then recite this wazifa once a week, weekly, preferably on fridays night or saturdays morning as they are considered good for this dua. Likewise for some weeks in reciting this, Allah will attend to your hajat insha’Allah.

2024.05.21 15:01 FelicitySmoak_ Tuesday, May 21, 2013 - Jackson v. AEG Live Day 15

Tuesday, May 21, 2013 - Jackson v. AEG Live Day 15
Trial Day 15
Katherine, Rebbie and Trent Jackson are at court.
LA Times reported that the Jacksons offered a settlement.
Kevin Boyle , a lawyer for Katherine Jackson and Michael's kids , said they offered to settle the lawsuit against AEG, but that they never got an answer. Kevin Boyle said the family made the offers in January & March. Boyle would not provide details but said AEG's insurance would have paid, which means they could have settled the case without them paying a dime of their money. He said AEG has never offered to settle & they haven't apologized.
Marvin Putnam, an attorney for AEG, said it was inappropriate to discuss settlement discussions:
"We don't settle matters that are utterly baseless. We believe that is the case in this matter. I can't see why we would consider a settlement as anything other than a shakedown"
CNN Reports there was a snack controversy during trial: AEG lawyers gave a bag of peppermint candy to the bailiff to hand out to the jury this week. Even Katherine Jackson enjoyed the treat but Jackson's lawyer raised an objection, suggesting jurors might be influenced if they realized the source of the sweets. A compromise was reached. Each side can provide snacks for jurors, but they'll be placed at the bailiff's desk before jurors enter court so they have no clue who brought it.
Shawn Trell Testimony
Jackson direct
AEG Live General Counsel, Shawn Trell, told jurors that he had forgotten that Kenny Ortega was working under a signed contract.
Trell said he met with his attorneys last night and reviewed one doc -- Kenny Ortega's contract.
"He had a written contract," Trell said. "I remember the email dynamic. I'm not too proud to admit that I didn't recall the cover contract," Trell said he was changing his previous testimony to add that Ortega had a written contract, not only emails between him and AEG
Next topic was Insurance: Cancellation/Non-Appearance/Sickness. Trell said he started working on insurance for the tour in November of 2008. Panish showed several chains of emails where the parties talked about the insurance for the tour
Email from Bob Taylor insurance broker to Trell on 1/7/09:
"Prior to speaking with carriers we ask the artist to attend medical with a doctor...A full medical with both blood/urine tests. The doctor also wants to review the medical records over the last 5 years to ensure full disclosure. Insurers require further medical examination to be carried out by their nominated doctor. They may restrict illness coverage or death from illness coverage until this examination has taken place"
Email from 4/30/09 - Wooley to Trell :
"We have no coverage against Michael sickness unless and until he submits to another medical in London
Email from 5/28/09 - Trell to Taylor:
"We really need to get that medical done"
Email from 6/23/09 - Trell to Taylor :
"Any update on the availability of Term insurance?" (life insurance)
Trell said if they secured life insurance, they would get money if Michael died.
"We would get the money owed to us, yes," Trell testified.
Trell also said he continued discussions with an insurance broker about additional coverage to recoup AEG Live's investment if the tour had to be canceled.
Email from 6/24/09 -Taylor to Trell :
"Insurers have refused to move on this. Huge amount of speculation in the media regarding artist's health. They feel if they're to consider providing illness to cover this particular artist, they must have very through medical report"
Email from 6/25/09 - Gongaware to Taylor :
"If we don't get sickness coverage, we are dropping this policy"
Email from 6/25/09 - Taylor to Gongaware :
"The consultation in London is critical. The doctor is holding the afternoon of the 6th July open at Harley St. But keep in mind the visit could take 2 hours plus"
Next topic: Budget/Costs. Panish showed an email from AEG's Rick Webking to Michael's estate with 1st report of artist advances/expenses. This was a letter sent to the estate containing the expenses incurred, Trell said.
"It seems to me we submitted this report for their review, I don't see any request for payment," Trell said.
Trell said he spoke with Randy Phillips and Paul Gongaware about Michael's physical condition prior to coming to testify.
"I had heard about rehearsals in which Mr. Jackson was fantastic," Trell said
Trell said he's aware of email from Ortega saying doctor was not allowing Michael to attend rehearsal on June 14, 2009.
"I was aware of the doctor not allowing him to attend rehearsal," Trell said
Email from 6/17/09 from Phillips:
"...Ortega, Gongaware, Dileo, and his doctor Conrad from Vegas and I have an intervention with him to get him to focus and come to rehearsal"
Email from 6/17/09 from Gongaware to Phillip's assistant:
"We need a physical therapist and a nutritionist"
Email from Production Manager - Gongaware/Phillips on 6/19/09 :
"Paul/Randy I'm not bring a drama queen here. Kenny asked me to notify you both Michael was sent home without stepping foot on stage. He was a basket case and Kenny was concerned he would embarrass himself on stage, or worse yet, be hurt. The company is rehearsing right now, but the DOUBT is pervasive"
Email from Randy Phillips to Tim Leiweke on 6/19/09 :
"We have a huge problem here."
"I think he recognized there was a problem on the 19th," Trell said. "I would take it seriously, as I believe Mr. Phillips did."
Trell agreed with a statement by plaintiff's attorney, Brian Panish, that company executives knew by then there was a "deep issue" with Jackson
Does Trell consider that exchange a "red flag" that AEG Live should have noticed, Panish asked.
"I would take it seriously, as I believe Mr. Phillips did," Trell answered. "I don't know I would use the word 'red flag'
One of the emails shown to the jury was from Jackson estate co-executor John Branca, sent 5 days before Jackson's death & marked 'confidential':
"I have the right therapist/spiritual advisosubstance abuse counselor who could help (recently helped Mike Tyson get sober and paroled) Do we know whether there is a substance issue involved (perhaps better discussed on the phone)
The email was sent the same day that a meeting was held at Jackson's home with Murray. No further info given to jury.
Trell said Mr. Phillips never told him about this email
Email from Ortega to Randy Phillips on 6/20/09: (chain of emails)
"I honestly don't think he is ready for this based on his continued physical weakening and deepening emotional state"
Trell said he didn't see these emails. He said he spoke with Randy Phillips about Phillips' perception of Michael, in order to prepare for testifying, but not about specific emails. Trell has been designated as the most qualified person to speak on behalf of AEG
Email from Phillips to Gongaware on 6/20/09 at 1:52 am :
"Tim and I are going to see him tomorrow, however, I'm not sure what the problem is Chemical or Physiological?"
From Gongaware to Phillips, on 6/20/09 at 5:59 am :
"Take the doctor with you. Why wasn't he there last night?"
From Phillips to Gongaware, on 6/20/09 at 2:01 pm :
"He is not a psychiatrist so I'm not sure how effective he can be at this point obviously, getting him there is not the issue. It is much deeper"
Trell said Randy Phillips went to a handful of rehearsals, three at the Forum and two at Staples Center. The head of the marketing department attended rehearsal on June 23, 2009.
"She was blown away by it," Trell testified.
He said he was unaware of issues with Jackson at rehearsals.
"I knew of no problems with Michael Jackson at all",Trell testified.
Trell said he never saw the emails from Phillips directing people to exclude images from This Is It of Michael looking "skeletal" while rehearsing.
"What were his observations of Michael's physical condition during rehearsal," Trell said. "I asked for his (Phillips) personal opinion."
Next line of questioning is about human resources and background checks. Trell said they can be valuable and useful tools when hiring. Background check costs around $40 to $125. Trell said AEG Live could afford this fee. "We don't do background checks on independent contractors," Trell said. Trell said he was involved in the hiring by AEG Live for the This Is It tour. His department was responsible for retaining independent contractors. Trell said he is not familiar with background check process for hiring.
"I am not familiar with the process of doing background checks," Trell said. "No training."

Panish: "There was no hiring criteria for the This Is It tour, correct?"
Trell: "Not to my knowledge"
Trell testified that when it comes to independent contractors, they have either worked with the artists, AEG or known in the industry. Trell agreed that no background check was done on anyone working on the This Is It tour. AEG Live General Counsel Shawn Trell told jurors that no legal or financial checks were done involving Conrad Murray or anyone else who worked as an independent contractor on the This Is It shows.
Depending on the nature of the position, a background could be done, Trell said, like for potential employees in the financial area. Trell said he thought a background check would be appropriate for people working in financial roles, but not tour personnel who weren't employees of AEG
As to independent contractors, Trell said there's no supervision and monitoring like there's for employees
Panish: "You don't do anything to check into background, supervise or protect the artist?"
Trell: "No, safety is a concern"
Trell said that AEG did not hire Murray, that the doctor was like many independent contractors,
"When they leave the environment, what they do on their own time is their own business"
Trell testified he doesn't believe the artist is more at risk because AEG Live doesn't do background checks
"We did nothing to monitor Dr. Murray," Trell said. "We did not monitor whatever it was that he was doing, no."
"It called for Michael Jackson being able to terminate Dr. Murray at will," Trell said about the contract. "If the concerts didn't go forward, and he was terminated under this provision, Dr. Murray would not be paid going forward," Trell explained
As to Dr Murray being under dire financial straits, Trell said that he doesn't know if he agrees with it, everyone's perception is different
Trell: "I certainly wasn't aware of it at the time"
Panish: "Because you didn't check, right?"
Trell: "That's right"
"I don't think conflict of interests are a good thing, and we would want to prevent it," Trell said
Email from Kathy Jorie to Shawn Trell on 6/24/09 at 12:54 am:
Subject: Revised agreement with GCA Holdings/Dr. MurrayIt had two attachments Attachments: Revised Michael Jackson -AEG GCA Holdings Murray Agreement 6-18-09 Final MJ -- AEG GCA Holdings Agreement (Dr. Murray) 6-23-09
Email chain from 6/23/09, 5:39pm from Jorrie to Wooley, Murray
Subject: RE: Michael Jackson - Revised Agreement with GCA Holdings/Dr. Murray Email:
"I have redlined the Word version so that you can see all of the revisions. In addition, I've attached clean PDF version for execution" (The email says that if Dr. Murray approved it, he was to print it, sign and send it back to Jorrie)

Panish: "Did Ms. Jorrie call this contract a draft?"
Trell: "She called it a Final Version"
"Every document is a draft until it is executed," Trell said.
Panish showed emails exchanged among AEG executives that contained drafts of Murray's contract. Although Murray had signed a contract with the company, neither Jackson nor anyone from AEG had added their signatures. Trell testified that a copy of the contract had never been sent to Jackson
With Trell on the stand, Panish played part of an interview that AEG Live President Randy Phillips gave to Sky News television soon after Michael's death.
"This guy was willing to leave his practice for a very large sum of money, so we hired him," Phillips said.
Panish also showed jurors an e-mail between AEG lawyers suggesting that Phillips told other interviewers AEG Live "hired" Murray.
Panish: "Isn't it true that Randy Phillips made numerous comments that AEG Live hired Dr. Murray?"
Trell: "I know he has made that statement"
Panish said AEG higher-ups became concerned after Phillips made such admission. Trell said he didn't know if that was true. Bruce Black is the General Counsel for parent company of AEG and AEG Live. Michael Roth is AEG's media relations
Email from Kathy Jorrie to Bruce Black and Michael Roth on 8/25/09:
Subject: AEG Live president says AEG Live hired Dr. Conrad Murray
Panish shows Trell a deposition, under oath, given by insurance broker Bob Taylor on another case. Trell said he has never seen or read it. Trell denied having a telephone conversation with Mr. Taylor where Trell asked him if a doctor's compensation was covered in the insurance.
Panish: "Does that refresh your recollection that AEG was employing Dr. Murray?"
Trell: "Mr. Taylor has this completely wrong"
After lunch break, Brian Panish asked if Shawn Trell wanted to change anything else in his testimony, to which he said "No"
Bruce Black, attorney for Anschutz, was present in the meeting with LAPD. Trell met with the police on 1/12/10. Trell told the police that day that Dr. Murray would receive $150,000 compensation per month. Trell also said that Dr. Murray requested and AEG would provide necessary medical equipment and a nurse. More than five months after Jackson's death, Trell said, he informed LAPD detectives that Murray initially requested $5 million to join the tour but eventually agreed to a salary of $150,000 a month for 10 months.
Panish: "As far as you know, all the agreements written for TII tour was done under AEG Live Productions, right?"
Trell: "Yes"
Panish: "Was Dr. Murray trying to help AEG get insurance?"
Trell: "The policy was in both names, so he was helping both parties"
Trell said Dennis Hawk, who represented Michael, was in touch with Taylor regarding the insurance
Panish: "As of June 2009, you don't even know whether Mr. Jackson had a personal manager
working for him, right?"
Trell: "Well, my understanding at the time there were a couple of people acting in that capacity"
Email on 6/2/09 from Randy Phillips to Jeff Wald:
"Jeff, remember getting Michael to focus is not the easiest thing in the world and we still have no lawyer, business manager, or, even real manager in place. It is a nightmare!"
Trell said the only time he saw an artist's signature required to retain an independent contractor was for Dr. Murray. Trell said his understanding was that Dr. Murray worked for Michael for 3 years; didn't know how many times MJ saw Dr. Murray.
"I've never spoken with Dr. Murray ever. And I met/spoke with Mr. Jackson once," Trell said.

"He was a significant expense," Trell testified about Dr. Murray.
Trell said AEG Live didn't do anything to check Dr. Murray's competency as doctor, other than checking his physician license. Trell said AEG didn't do anything to determine Dr. Murray's financial conditions in 2009.
Jury was shown an email that Phillips sent to Kenny Ortega on night of June 20, 2009. It was email urging Ortega to stand down.
Email on 6/20/09 Phillips to Ortega :
"Kenny it's critical that neither you, me, anyone around this show become amateur psychiatrist/physicians. I had a lengthy conversation with Dr. Murray, who I am gaining immense respect for as I get to deal with him more. He said that Michael is not only physically equipped to perform & discouraging him to will hasten his decline instead of stopping it. Dr. Murray also reiterated that he is mentally able to and was speaking to me from the house where he had spent the morning with Michael. This doctor is extremely successful (we check everyone out) and does not need this gig so he is totally unbiased and ethical"
Panish asked Trell whether Phillips "characterization to Ortega, given no background check was done, was a lie". Trell responded that he didn't know what Phillips knew or was thinking when he wrote that email to Ortega. Trell also said he expected Randy Phillips to testify at some point during the trial, so he could address the email himself
Panish then asked Trell, "Sir, you never checked out one single thing about Dr. Murray -- you've already told me that, correct?"
"As of the date of the email, that would've been correct",Trell said.
When pressed by Panish, Trell said that Phillips' statement that Murray had been checked out, along with the executive's claim that the doctor 'does not need this gig' were inaccurate.
"I don't know where Randy's understanding or impression comes from", Trell said.
Trell testified that Phillips might have been "misinformed" or simply was stating his impression of the Las Vegas cardiologist
Panish: "But no one at AEG checked Dr. Murray to see if he was successful or not, isn't that true?"
Trell: "Yes"
Panish then asked several pointed questions about whether Shawn Trell agreed with Phillips telling Ortega they'd checked Murray out. One of Panish's questions was whether Trell thought Phillips' email was 'acceptable conduct'
Panish called Phillips' statement "a flat out lie" and asked Trell whether he agreed with it or if it signified how AEG did business. Trell said he didn't know what Phillips thought he knew when he wrote the message.
"I know this statement is not accurate, but you'd have to speak with Mr. Phillips about what he thought or meant in saying it," Trell said.

Panish: "That's a flat out lie, isn't it sir?"
Trell: "I don't know what Mr. Phillips intended to say, this should be a question to him"
Panish: "You don't know if he was successful or facing bankruptcy, did you?"
Trell: "No"
Trell: "I know the statement is not accurate. You have to speak with Mr. Phillips about what he meant to say"
Panish: "Do you agree with the CEO of your company making untrue statements?"
Trell: "I don't know that he didn't know it wasn't true when he said it"
Trell said Phillips never told him that he checked Dr. Murray out. As to reference in Phillips' email about Dr. Murray being unbiased, ethical, not needing this gig, Trell said it was Phillips' impressions. He said AEG typically only runs background checks on candidates applying for full-time jobs with AEG, not independent contractors.
Panish: "Isn't it true AEG Live does not do background check on independent contractors?"
Trell: "That's true"
Trell said that no one from AEG interviewed Dr. Murray because he was an independent contractor.
"Did anyone from AEG ever at any time interview Dr. Murray", asked Brian Panish
"No", Trell replied.
Panish showed a document used by AEG entitled "Disclosure and Authorization to Conduct Background Check". Doc is used for employment, promotion, retention, contingent or the rate staffing, consulting, sub-contract work, or volunteer work. Panish asked if there was any reason why Dr. Murray was not given a background check.
"He wasn't an employee, he wasn't applying for a full time position with the company," Trell explained.
Trell said theoretically they could've asked to check Dr. Murray's background and credit.
AEG Cross
Jessica Bina began her examination by showing the letter submitted by AEG's CFO to the Estate of Michael Jackson for their review. She asked Shawn Trell about the estimate presented to Jackson's estate that included Murray's $300k fees. She asked why it was prepared. Shawn Trell said it was done at the request of the estate. He said Jackson's estate wanted to know state of tour finances when Jackson died. Trell said the report was requested by the Estate after a series of meetings after Michael's death.
"The purpose of the meeting was to wind up the business affairs of the tour due to Michael's death", Trell said. "It was my understating in June Tohme was back in the picture in some capacity. I'm not sure which, Mr. DiLeo was in it too," Trell said
Bina: "Is there any request for payment?"
Trell: "No, there's no demand for payment, it's for review"
Stebbins Bina asked about the inclusion of Murray's fee in the document. Bina showed the report that was attached to the letter. Murray's fee on the document had a footnote. Trell read what that footnote said, and explained why estate wasn't asked for Murray's fee. Next to "Management Medical" there's a reference to footnote 3.
Note 3: 'Contract is not signed by Michael Jackson and such signature was condition precedent to any payment obligation' - Footnote on Murray fee.
Trell testified Webking, the CFO for AEG, did not ask Michael's Estate for payment of Dr. Murray's salary
"You testified you were somewhat confused (by the inclusion of the $300,000)?", Bina asked Trell as she projected the list, dated July 17, 2009, on a screen for jurors.
"Do you see there's something in parentheses?', Stebbins Bina asked, zooming in to blow up a footnote from AEG CFO Frederick Webking that stated Michael Jackson never signed Murray's contract, so its terms were not enforceable.
"Is Mr. Webking asking the estate to pay?", Stebbins Bina asked Trell. "No", he replied, explaining that upon reflection he believed Mr. Webking was just being 'thorough' by including the $300,000 as a budgeted cost.
"Did Mr. Webking make a mistake as you thought yesterday?",she asked.
"No, he did not", Trell answered
Second report made to the Estate on 9/18/09, there was no amount next to management medical. Stebbins Bina then showed a Sept. 2009 report of This Is It's finances to Michael Jackson's estate. Murray's fee is not listed in that document
Trell went through his job description with AEG. He said he has five lawyers in his department and has worked on thousands of agreements. Trell explained what PMK is -- Person Most Knowledgeable, identified by the company to testify on its behalf. Trell said he didn't know about all the topics he was designated, so he had to do some studying and interviews with people
As to Ortega's contract, Trell said he was aware of a string of emails being at least a part of the original agreement with Kenny.
"When we were done here yesterday, I looked at Kenny Ortega's original agreement," Trell said.
Trell noted he hadn't looked at Ortega's agreement since it was entered into in 2009. Before the afternoon break, Trell and jury were shown Kenny Ortega's tour agreement. It was signed in April 2009. The agreement was three pages of legalese, with several pages of emails attached that confirmed the terms. The first three pages included some paragraphs that described who owned the rights to This Is It content. A large number of emails are part of the agreement as exhibits. Trell said he recalled the emails exchange and admitted again not being proud of forgetting the cover contract portion. Bina showed Ortega's executed contract with everyone's signature on it. Trell said Kenny Ortega was paid after his contract was signed.
Trell, Phillips and Kathy Jorrie were involved in drafting and negotiating the contract with Michael Jackson. For MJ, Trell said Dr. Tohme Tohme and attorneys Dennis Hawk and Peter Lopez represented him. He said there were multiple drafts.
"It's my understanding they were talking to, or at least receiving offers from, a competitive of ours, Live Nation," Trell said.
Trell also said that before signing an agreement with AEG, Jackson had been considering a tour offer from its main competitor, Live Nation.
Bina showed the jury the final tour agreement. Trell said he went to MJ's home at Carolwood to sign it. Upon arrival, Trell said Mr. Jackson got up from where he was seated, and said 'Hi, welcome, I'm Michael." Trell said it was pretty funny, since he was a very distinct person. Trell said they shook hands, he had a good firm handshake and his voice was not what people think
"He popped up, came over, introduced himself, was very cordial, there was a real positive energy, good vibe in the room," Trell said. "He seemed genuinely enthused," Trell added. "He had the contract in front of him, said he read every page, seemed very enthused." Trell said they all signed it and Mr. Jackson was really keen on the 3-D stuff, that he was already down the road in his mind. "I was probably there just a little less than an hour. And that was the only time I met him," Trell recalled.
Bina discussed the contract for the tour agreement:
A first class performance by Artist at each show on each of the approved itineraries. Contract:
Artist shall perform no less than 80 minutes at each show, and the maximum show length for each show shall be 3.5 hours. Artist shall approve a sufficient number of shows on itineraries proposed by promoter or producer as to recoup the advances made.
Trell said compensation was agreed on 90-10 split. Artist received 90% of what's defined contingent compensation.
Trell explained to jury how concerts get paid for. One scenario is artist pays for production up front. A second scenario is that the promoter gives artist an advance, and then they use the money to put together the show. The third option, Trell said, is the artist pays someone like AEG Live to produce and promote the show, with costs to come out of their pay. Trell called the second and third option like an interest-free loan. In Jackson's case, AEG agreed to a 90/10 split of show's proceeds. Jackson would have received the 90% portion, Trell said. Jackson was also on the hook for a 5% production fee
AEG Live was promoter & producer.
"We advanced the money necessary to mount the tour," Trell explained. "It's interest free money".
Trell testified that Jackson's advance, which covered his $100,000-a-month rent on his mansion and a $3-million payment to settle a lawsuit that would free up his performance rights, was considered a loan to be paid back to AEG.
Part of the advance was to pay off the settlement agreement of $3 million in London court. The underlying dispute was that a company owned the rights for Jackson's live performance.
"The rights needed to be freed up," Trell said.
The advances were to be paid back to AEG Live before the split of revenue. Production Advances were capped to $7.5 million. Contract:
Artist was responsible for all the production costs in excess of the cap and had to reimburse promoter.
"Michael Jackson was known to have very elaborate productions," Trell said. "Production values can get significant, for lack of a better word, it really depends on how many bells and whistles they want," Trell said.
Trell said AEG would not advance money without the artist requesting it.
Trell said it's not only typical and customary, but standard and artist needs to secure either non-appearance or cancellation insurance. Their interest in the policy, Trell said, was to cover the advances and production costs incurred with the production of the show.
"If the were no obligations to AEG, the payout would go back to the artist", Trell explained, "It just recoups our loan made to the artist."
Trell was also asked about elements of tour insurance policies and an agreement with former manager Tohme Tohme. Jackson's contract called for him to represent to AEG that he didn't have any health conditions that would keep him from performing.
Contract:
Artistco hereby represents and warrants that artist does not possess any known health conditions, injuries or ailments that would reasonable be expected to interfere with Artist's first class performance at each of the shows during the term
Oh Tohme's $100k per month agreement, Trell was shown a January contract that Jackson signed to pay that amount. However, Trell said Tohme's agreement was predicated on Jackson getting tour cancellation insurance by a certain date. Deadline passed and by that point Tohme was no longer Jackson's manager, so he wasn't entitled to be paid his monthly fee.
January 24, 2009 -- agreement entered with Dr. Tohme Tohme. Trell said Michael was involved and signed this agreement. "This agreement was entered into January 26, Trell testified.
"There are conditions that needed to be met before any payment could be made."
One of the the conditions was placement of non-appearance insurance, Trell said. That placement was done in late April, early May. In May, AEG received letter from MJ saying Tohme didn't rep him anymore.
"No payments were ever made under this agreement," Trell explained.

2024.05.21 14:37 Professional-Jump891 Can piracy come up in a secret clearance investigation and can dual citizenship play a role in a possible clearance denial?

Hey Guys,
I just got an offer for a Job requiring a secret clearance which I just submitted an SF-86 (with a little mistake, which is the wrong court address from where my siblings became naturalized citizens), other than that I have no criminal history or any history involving drugs or mental health problems, Excellent credit score and less than 3% credit card debt. I am a dual citizen but my travel info shows I haven't been out of the country for more than 4 months combined within the last 7 years and no foreign influence or foreign contacts.
I do have quite a history with film piracy (personal use and never commercial) with multiple strikes from my previous internet service and my current one. Could this somehow come up as a question in the investigation and can my dual-citizenship affect my clearance possibility in my case?
Thank You ahead of time!

2024.05.21 14:29 Jacks_Lack_of_Sleep Is it worth trying to sue this collector?

Is this worth hiring a lawyer to sue a debt collector and make complaints against the credit bureaus? [USA-MO]
Could someone let me know if this is a potential case or if I'd be wasting both my and the attorney's time talking to them?
I had a collection show up on a credit report and disputed through that bureau before ever getting contacted by the collector. The collector sent a packet of papers "verifying the debt." The packet included generic credit card terms and other generic papers that could be for anyone for any credit card. They also included several CC statements with my name and address. These statements had a few payments made to the account by cash. Nothing showing a purchase or a signature.
Having lost that battle, I left it alone for a few months. After a while, I started getting emails with terms to settle the debt. I responded to an email asking for my signature agreeing to the original debt, a statement showing a purchase on the card, and proof that they own the debt. I also requested that not to contact me until proof is provided and that all communication must be in writing. The email address clearly implies it is checked frequently and they would expect to be contacted on it and there was no disclaimer it was an unmonitored inbox.
Over 30 days passed and I did not receive the info requested. I did receive new settlement offers from the same email address though, despite asking not to be contacted before proof was given. I sent a copy of the emails to the credit bureaus to reopen the disputes. They left the collection on my credit reports.
About two months after my email asking for my signature and proof they own the debt, I received another packet. It was mostly the same as the first but included an affidavit (not notarized) saying the credit card company sold the debt to this collector. There was still nothing with my signature or showing a purchase made on the card
Now I've been declined auto loans, gotten higher interest when I did find a lender, and it is slowing my on-boarding process at a higher paying job. I want this off my credit report, if possible collect damages, and report them and the bureaus for keeping it on my report when it wasn't verified withing 30 days

2024.05.21 14:10 zytukin Is bankruptcy my only option? Self employed and went out of business

I was a self employed truck driver, my own truck, my own company. Was doing great for several years, paid off all my previous debts, and at the beginning of 2022 I bought a house for my mother. She couldn't get approved for the mortgage but I did due to my income, so I bought the house and she is the one paying the mortgage.
Halfway through the year things took a turn for me. Income dropped, I was having trouble staying profitable. Then near the start of 2023 my semi had a major breakdown costing me $13k and I had to take out a loan with Vader Mountain Capital to pay most of it. Then it broke down again, and again, and again, costing me over $40,000 between tows, repairs, and hotel stays. Not to mention lost income.
Ended up having to give up and close my company around this time last year after spending so much trying to keep the truck running and simply not being able to afford it. Final breakdown was around 250 mil;es from home and after a week of trying to secure yet more funding ended up calling my mother to come pick me up. Truck got repossessed in September (I called the finance company and voluntarily surrendered it), lost my CDL in August because the financial issues had been preventing me from affording my diabetes pills, and I'm almost $100k in debt between credit cards (19k, 8k, 1k), line of credit with my former bank (18k), the loan with Vader (14k), and whatever else I might still owe towards my truck (was 34k but the finance company finally picked it up last month and hasn't gotten back to me yet). I also owe 9k to my brother who took out a loan to pay for one of the repairs because I was considering abandoning the truck and trying to walk 1200 miles home (and at the time I honestly thought suicide was a better option, just leap off the highway overpass outside the repair shop I was at).
Now I'm working full time for $15 an hour at a local department store, bringing home maybe $20k a year after taxes. The only bills I'm paying monthly are for my cell phone and satellite TV (combined under $200 a month), and food. I have started the bankruptcy filing with a lawyer who charged me $1,800, but I'm really putting it off because the bankruptcy lawyer said the house would be taken. But my mother is also on the title and both her and brother are the ones who have paid most of the mortgage so far so if the house is taken it would be stealing equity from them and making them homeless, not just me.
So far everybody has been basically ignoring me except Vader who keeps threatening to sue and demanding payments that I simply can't afford (over $400 per week, unless I argue with them for 20-30 mins and they finally settle for much less).
Annoying thing about all this is that although my truck was repossessed, I still own the trailer that I could possibly sell for for 20 thousand or more to at least pay off Vader, but it's still sitting 250 miles away where my truck broke down last. It'll cost close to $4,000 to have it towed close to my home to sell easily, which I almost have the money for after saving for 6 months. Selling it where it sits is of course a cheaper option, except I also don't have easy access to a vehicle to go there and potentially sell it if somebody is interested.

2024.05.21 13:35 raresanevoice Eth is in the green and approaching ATH; ETFs are coming in the USA. Great time to remember, what does 'Have A Plan Look Like'

What Does 'Have a Plan' look like?
We hear it often enough in the sub. "Have a plan" or "DCA" or even "DYOR" but what does that look like. For me, this is what, 'have a plan' looks like. Feel free to add any extra wisdom or lessons learned as well.
1- First step was the DYOR phase or determine what project to invest in. For fairly safe and sure price growth, Eth and BTC are two good bets. They're essentially the 'blue chips' of the crypto space and if you get confused or overwhelmed by all of the projects and the terminology, they're a good starting point. White papers are a great read though they can be technically daunting. Development plans or cycles help as well, like the bitcoin halving cycle / calendar or Eth development plan.
2- Second step is determine how much you can afford to invest that wouldn't break you if you lost it. This is the 'don't invest more than you can afford to lose' phase. Be honest and serious about your budget. For me, it's 250$ every two weeks out of each paycheck, with an additional bump whenever I get unexpected stuff, like a tax return or a small bonus this year, making sure not to stretch out or expand debt to be able to invest.
2.5 - We are here. You might still be DCA in or you might be holding to DCA but either way, both steps 2 and 3 are important.
3- Third step is determine your exit price. This will be the price at which you start to DCA out or phase out your profits. By DCA out, you ensure you're not just taking whatever the price is at the time of exit but averaging it near your exit price. For example, for me, I have a few Eth that will be DCA out ~10k. I'll take my profit on them in that range.
Having that price target in mind really helps with FOMO because knowing that i'm not selling til 10k means that right now, in the crab bear market, the day to day actions of the price chart, don't mean much because I'm DCAing in until I hit that exit price.
4- Fourth step is expand that plan. By that I mean, like above, I've got a few ETH set aside to be sold at 10k. The rest will keep staking for longer term with an exit price of ~25k. That might be 2030 or 2035, but knowing that exit point again helps me ignore the daily charts.
Step 5 for me is HUGE in fighting FOMO or worry about missed potential profits
5- Step 5 is plan where those profits are gonna go. I know I'll set ~1/3 to taxes (overplanning in case), a good chunk to pay off debt, and we're planning a small add-on to the house that those profits will take care of. Having that plan made out helps you hold firm until that exit price as well. If I know I need to be around 10k to sell, it reinforces that I don't care if the price point is 3000 or 2000, because I'm not selling anytime soon.
6- Step 6 is plan for a small powder bag. One way I do this is keeping some USDC on one of the CEXs, nominally staked or yielding and earning a bit. Usually at a higher rate than a savings account. This is the gambling bag or moonshot bag or secondary portfolio, however you want to call it. This is the money you set aside for when things catch your interest. Whether it's legitimate like Donuts or a pump and dump like Pepe that you want to throw some money in on a gamble. Plan for where those $$ come from and limit yourself to what you set aside for it and know your exit price as well.
7 - Step 7 is determine if there's anything you can do to grow passively. I mentioned that I have some Eth and I have it staked or earning passively to grow my bags. There are options to grow your bags that don't take $$ but might take some time. If there's a hobby you enjoy that might earn some crypto or something passive like using BAT browser or something along those lines that help you get a fix during a prolonged and incredibly BORING crab-bear market.
That's what I got so far. What would you add? What have you learned in this market cycle or in this prolonged bear?

2024.05.21 12:38 fire4dayzz WWYD - Big decisions incoming!

Hey all, here is my scenario and current plan would love people to question my thought process.
Goal = Get off the treadmill, although still happy to work / consult but slow the pace down a bit enjoy more family time, Get a meaningful positive cashflow from investments.
38, Married with 1 kid (no more incoming).
PPOR = $1.8M (owe $0.69 cents (just cos) on $700k mortgage which can be redrawn. )
Shares = $1.4-1.5M after CGT in my company (way too high risk for me).
HHI = $200-220k pre tax (lower than alot of you, but partner has started new business which is starting to grow)
Yearly Expenses = $70k (can save around 50k per year after expenses). Potential for private school in 4 years, maybe..........
Plan
Sell $750k'ish of shares (after CGT) invest in commercial property ($2-$2.5M range, a good long lease,) with a net yield estimate 6%. Net cashflow around $30k-38k per year (not included capital growth). This will be purchased in a Discr. Trust with Corporate trustee to divy out the income.
Take $500k-600k of the last of the shares and sell down over the next 6 months place into some ETF's. Then add the extra 50k per year into the ETFs. Lets say $24k per year at a 4% withdrawal rate.
Leave 100k in High interest for commercial property issues and life things.
Whilst I'm working, the net income from the commercial property pays off it's mortgage.
Worst case, the above would provide me with $55k per year in income, with $70k expenses. Meaning I have the flexibility to take a lower paying role, and still save and still have growth in my investments.
I'm not really touching the equity in my house at all as it's a safety net, but I could potentially look at using against another investment down the road and debt recycle. I could potentially leverage more tbh.
The above plan spreads my NW risk across, my house, commercial property, and the Market (ETFs), and gives me flexibility and cashflow over the coming years to find a job that aligns more, figure out my next steps and reduce any major stresses.
What are people's thoughts?

2024.05.21 12:36 orishasinc2 $FFIE is junk, don't play with fire.

$FFIE is junk, don't play with fire.
A new era of meme frenzy is upon us with the rise and collapse of stocks like $GME, $AMC, and other popular Wallstreetbets stocks. However, investing is not a game, and "sticking it to the Man" is not a compelling enough investment thesis to justify the purchase of a given equity.
Securities are inherently " overvalued" due to their FIAT construct. They are issued out of thin air by banks and corporations for a multitude of reasons unrelated to their business operations. There are therefore very few cases when securities are justifiably overvalued relative to cash conservative cash savings.
For the average investor, speculating in questionable, unprofitable, and clearly bankrupt meme stocks is a dangerous endeavor that must be avoided at all costs. It is gambling.
$FFIE is a case proving my point.
Faraday Future Intelligent Electric is a bankrupt EV manufacturer! That ought to be the end of the story. Interestingly, 96% of its float is being shorted, which might compel many to take a chance at playing the squeeze game.
It received a notice of delisting from the Nasdaq for not filling its 10k, and its stock has collapsed by 99% since going public.
On a balance sheet overview, the company has incinerated more than $3.5 billion worth of investment capital since its founding, and is currently showing $-185M working capital with little recourse but to file for bankruptcy or take advantage of the current meme frenzy to issue securities and dilute naive meme riders out of their investments.

Please stay away from this junk!
Given the current dynamic " squeezing" equities prices, especially zombified meme stocks; the higher $FFIE stock rises, the more compelling the reason to short it. I would advise those interested to wait on the sideline until the excitement wears off before jumping in.
Proceed cautiously, and protect your capital at all costs.
Wall Street is the most sophisticated wealth-extracting mafia ever designed in all of man's history. And, you and I are mere suckers feeding the banking and corporate cartels.
The best way to win, most of the time, is NOT TO PLAY AT ALL.
