2024.05.14 11:40 AromaticPitch3075 Gifts of joint assets/transfer to sole name for IHT

Hi all - I wanted to get some views on this please. I am a tax adviser but I don’t really want to talk about this with my colleagues.
H&W have only had joint accounts for close to 40 years and all assets are in joint names. Their joint estate is worth close to £2m.
One of H&W has a terminal cancer diagnosis (maybe 2 years) but has recently deposited approx £230k into the joint account (mixture of inheritance and pension lump sum). The intention was for this cash to be given to children for investment but doing so now would take her over the NRB. Per Wills, assets pass to surviving spouse then to children equally.
What would be the view if the spouse gave the c£230k to the other spouse (documented by letter), who then gave it on to the kids (again documenting by letter)? I assume it should be put into a bank account in a sole name first?
Also if the not-dying spouse wanted to offload other cash/assets, I assume it’s ok to transfer assets into their sole name then gift on? Should the assets sit in the sole name for a period of time before gifting on?
TIA ☺️

2024.05.14 10:48 ManufacturerTight715 I was fired today for taking photos during a public event I was running in the lobby of a museum that was open and had the public in attendance.

After 13 months of exemplary service and constant praise and even a promotion during my tenure, I was given the boot at 10 a.m. today after a 3 day weekend. I was told I was being let go because I took photos at this public event- which I was managing and running- and because I had inserted myself in areas where I was not needed during the event. This was apparently something that they claim was mentioned by the visiting group. The event happened 4/24/24. Today is 5/14/24. Weeks later. I don’t know how that is possible when I was only there to assist and help as needed and received a Challenge Coin from the staff of the visiting cabinet member at the cultural museum o was working at. I also received a glowing email thanking me for all my help and for making the event run so smoothly by his assistant and the one who I was next to the entire time to ensure everything went smoothly.
But, because there is a member of the Tribal PR team at the Indian Tribe I worked at who was threatened by my 25+ years of experience and because I caught her making mistakes constantly, she had me eliminated with this gem of a reason.
I have an audio recording of the firing and even listening to it twice now, I am bewildered at how they thought that’s a good reason to fire a person.
I have 25+ years experience. I came highly recommended. I was hired and promoted within 6 months of service. I got glowing feedback from my boss, colleagues and from clients. Everyone loved the work I was doing and I was a dedicated and tireless professional. I never took a vacation, I was always there. I worked long hours and went to networking events to expand the business.
But, because I made the head of PR look bad at the Tribe, or so she thought, she had me fired. This was a public event in the lobby of the cultural museum with members of the public present. I took a few candid pictures from the background just to document this historic event.
A cabinet level member of the administration was there for a lunch I helped organize with the tribe and visiting tribal leaders. There was no written or verbal communication given to not take photos. I did not post or share these photos anywhere until now.
They were taken for posterity. No evidence or any other material evidence was provided about my poor performance or any complaints from any one about that day. All year I got glowing reviews and feedback from staff, our protective services and the visiting delegation… in writing. Of course my computer and phone were all taken from me and I was not allowed back to my desk to retrieve my personal items. As if I had committed a serious crime!!! I have several projects in the pipeline and have been doing a lot outreach for events in the fall. Suddenly I’m not there. That’s going to be so hard to explain to all my clients.
So my question is this: Is there a case for wrongful termination? I am a 55 year old gay Jew working as a member of the management team in an office with no other Jews in the administration side of a cultural museum owned and run by a Native American tribe.
From what I understand my chances of getting anything is slim to none because they are sovereign and do not have to follow any federal, state or local employment laws. Basically I’m SOL.
So do I just post the photos I took and say SEE THE PHOTOS THAT GOT ME FIRED!!! Members of the public were snapping away as well because it was a very cool moment in cultural history to have the Secretary of health and human services at a brand new cultural museum in Palm Springs, CA.
Any thoughts or feedback are welcome. Also, I got zero severance. Only being paid through today. And they will have my final paycheck on 05/23/24. I thought I’d need to be paid out today? I signed no agreement or separation papers.
Thank you for reading and appreciate your input or suggestions. I am pretty sure that there is nothing to be done but I wanted a second opinion.

2024.05.14 09:45 Confident-optimist I got a address verification letter

Like the tittle says, I got a address verification letter in the mail from child support in the state of Illinois (where I reside). Back story my kids mom tried to put me on CS in the state of Oregon, but they closed it due to her not moving forward with it and her just agreeing to give them to me.
Second situation, which is in the state of Wisconsin, old fling claims I got her pregnant but funny thing is I got served in Wisconsin through a call in which I showed up to take paternity and we didn't have sex in the window of conception. That was all handled through Kenosh county courthouse.
My big Question is why would Illinois be contacting me asking for address verification and employer info? Could it be Wisonconsin passed it over?
Thanks in advance

2024.05.14 09:41 devilsofparadiss Do I have to repay Student Loans abroad, should my employment situation change from not-earning to earning, if I have been told I am not eligible to repay up until my next OSA form submission.

My question is, When the time comes around to re-submit my OSA, will they backdate payments based on earnings I have acquired?
Long story short. I moved to the US last year and I made the decision to let the SLC know I had move abroad. As I didn't have a job and was living off of savings my official letter stated I am not eligible to repay for a 12 month period and that I did not have to submit a OSA form again until that 12 months was up.
However now I am about to start a new job as of June.
Every time I asked someone at SLC the question above via Twitter DM's, or whoever those DM's get routed to, they would just give me some vague wording about how I would need to update my employment details should my circumstances change. But never actually answer my question lol
My official correspondence simply says I will not be expected to pay during the 12 month period mentioned, or until I return to the UK. It Mentions nothing of updating my employment details should I start earning again.
I basically just want to know if they are going to try to gouge some more money out of me when the time comes?
My guess is that the people working there were not allowed to essentially tell me I can go the next however many months earning without making any repayments. Which feels like a bit of a loophole.

2024.05.14 09:35 sai799 Should I get another undergraduate degree at 25?

I want to immigrate to either canada or the netherlands by studying there and because the degree i hold right now isn’t very in demand i can’t apply for jobs so I thought of getting masters program but mostly they will ask for letter of recommendation which idk if i can provide since only two professors reply and they just asked to sent them the form and sign it nothing more i emailed two others and put effort to provide them with some works that I’ve done in their courses and my cv it has been 6 months no reply. Also I honestly feel like most master’s programs for my undergraduate major is very limited or not in demand i have English language degree btw so if you have any advice I would appreciate it -
This’s just a vent maybe idk : I got two programs offer that end with employment rn in my home country which is great cuz i can maybe ask for professional references but they are not related to my undergraduate program also they’re all do urine tests and well… I may start to take medication for my anxiety and probably hopefully not antidepressants soon :( I’m kinda very excited for these two programs

2024.05.14 09:12 ForceExpert3299 Sick leave & PTO Questions

So I work for a school in California. I've been there now for 2½ years. This week, I put in a request for 7 hrs of my PTO, which is out of my 40 hours I have. The only time off was 12 hours out of 40 hours sick leave for a medical emergency when I had to leave after 2 hrs of working. After I put in the request for the 7 hours of PTO I received the approval email it was accompanied by a very stern and in my opinion threatening message that stated because of my attendance and the amount of absences the next request will result in the hours taken off my pay would be deducted accordingly and a letter of reprimand will be placed in my file. What I'm wondering is that even legal if I have the sick leave and PTO I know they can deduct the hours from me for not notifying them of my intention to use pto or not notifying them that I would be out sick but threatening to deduct my pay? While I have all those hours and my attendance has been exemplary, I even skipped family members' funerals and doctors/dental appointments to be at work. So my thinking is because of recent budget cuts many of my colleagues are being pink slipped luckily I was not but feel they might be looking for a reason to terminate me instead of going the pink slip route where I would be able to bid for an opening based on seniority or laid off allowing me to collect unemployment. Any and all assistance, advice and comment would be greatly appreciated. TY

good morning folks :)
My husband and I moved to Belgium 6 months ago, still trying to figure out how do the health insurances work :D I am an independent worker with a company here in Belgium, we both benefited from private insurance offered by his employer. Yesterday my husband decided he will also become independent and gave his resignation letter, which means in few weeks he will no longer be part of current company.

2024.05.14 08:37 sleepyazriel help I think my mum is in denial that I’m autistic

IDK WHAT TO SAY HONESTLY every time i mention im autistic or its brought up in conversation she keeps saying “you’re not, the doctor just said you show symptoms” like lady that same doctor sent me home a letter that literally reads “a diagnosis of autism spectrum disorder has been confirmed”
Also she keeps saying “the doctor says you were just borderline autistic” (im quite sure she did not because genuinely what??)
she also doesn’t want to tell my family because of my close cousins would look at me differently and one of my aunts works with “severely” autistic children and would also look down on me (I’d like to hope she wouldn’t if she works with autistic kids??) She also keeps trying to tell me about how this was my decision when literally all I wanted to do when I got my diagnosis was talk mad shit about my past teachers that completely ignored so many of my autistic traits and the mad waiting list times
And if she ever admits that yes I am autistic she pulls the “but it’s only level one though so it’s very very little autism and doesn’t affect you” like im pretty sure a disability is going to alter my life in some shape or form and those levels are supposed to describe different support needs of autism and not one general diagnosis (correct me if I’m wrong of course)
Also throughout my 2 years of waiting for an assessment EVERY time it was mentioned I got hit with the “are you sure you want to ruin your life like that with a diagnosis?” Like the only people that are gonna know are me and my gp, my employers are not gonna go digging through my assessment looking for reasons not to hire me
she’s also completely unwilling to learn anything about autism which Is… really unhelpful but not surprising
I feel like the answer is kinda obvious at this point but what the actual fuck do I do is the real question now 😭 like I understand the whole people looking at me differently thing but I also could care less so maybe I should make a big fat Facebook post saying “fun fact - I’m autistic, and i was pretty good at hiding it all from you until I got bored!” And then just post a pic of the little “autism diagnosis has been confirmed” image
IDK it’s kind of funny but also really frustrating please help me Reddit you’ve never let me down before 🙏

2024.05.14 08:36 Legitimate-Tip-1734 Work injury leads to my termination and they didn't expect me to have evidence.

I have recently sustained an injury at my place of employment back in December of 2023 and found out I was terminated. I worked at a place that specializes in selling chicken wings and worked forty plus hours every week. I pulled something in my neck and back trying to pull out the flat top grill and refrigeration unit combo to spray down the floors and clean underneath the units as it was a daily task. I felt a discomfort that first night and thought nothing of it. As the week progress I was having tingling, burning, pin like, and numbness in my right arm and shoulder. I mentioned the discomfort and the night I starting feeling it to my manager which he wrote up the incident report. I was referred to their primary care doctor to submit an urine analysis and a check up. Once I arrived at the clinic and waited to be seen I told the clinic several times I was here for workman comp claim and needed to pee. They took me back to a room to see a doctor. I explained the problem and issues I was experiencing which she wrote me a work note for work restrictions believing it was my elbow and called it tennis elbow. I was out a week due to the restriction and rested. Once a week had passed I asked to be placed back on the work schedule and was told I never submitted the urine analysis and I stated I told the clinic I was there for a workman comp claim and was there to pee and be checked out by a doctor. My manager said I couldn't return to work until I submit the urine analysis. I returned to the clinic and told them I needed to submit the urine analysis and was seen that day to be tested. I dropped off the paperwork from the clinic and went home. I had to wait another week til I was allowed to return to work. I work for about two and a half weeks of working doubles before the pain returned but was much more intense. I mentioned the pains I was getting again and asked to be moved to a different station because I had been working the same station for the last couple of weeks and would like to work in a different station in the kitchen and the manager ignored my request. One night during my shift I left work to go to the E.R. because if felt like someone was taking a dull blade and digging it into my shoulder blade and my right hand had swelled up. After sitting in the E.R. bed for a couple of hours I was released from the hospital with another work restrictions stating not to use my right arm as much. I returned to work to drop off the note and see if my employer could accommodate my restrictions such as a different position within the business and was told no they couldn't. immediately they deleted my login to all platforms such as schedules, pay stubs, employee clock in number. I have several pictures of my trying to log into my payroll site and scheduling site and text box telling me to contact management. I have an audio recording of one the managers telling me I was fired immediately after the incident. I believe they terminated me as a retaliation for the workman comp claim and didn't expect me to follow through. I have mediation on the 28th of this month and not sure was I should ask for. Sorry for the awful grammar and spelling this is my first time posting anything

Helena - Courtlady of Lannisport

Part 1

Reddit Account: SunstriderAlar
Discord Tag: u/SunstriderAlar
Name and House: Helena
Age: 22
Cultural Group: Westerman
Appearance: Helena is a young woman with soft doe-eyes, and unmistakable curling, golden hair. Raised by smallfolk, and Septa’s she wears her hair up and away from her face to ensure she does not let it get wet while cleaning or in her mouth while singing. She has delicate, porcelain, pale skin and cloudy soft blue eyes. No taller than 5’5” and is most often dressed in conservative simple fashions gathered by herself, or more elegant options gifted to her by a doting patron for formal events. Never shy to present her opinion, Helena has seen the world change, and her place in it numerous times. She is unafraid to do what she must, but knows the role of a woman.
Helena prefers to wear blue and yellow, the colours of Lord Swyft’s old sigil even though she has not lived in Cornfield for many years, and has no personal attachment to the house. Her real love though is unique broaches, and hairpins, different pins reveal different favours or stylings for different lords. She does enjoy crafting dresses as well, when the rare bolt of fabric comes her way she enjoys sewing and tailoring. She is often seen carrying a unique wooden six stringed lyre, or a three stringed lute; the former the cause for her name the Six Eyed Singer. She daps herself with lavender water most mornings, and cleans her teeth with mint, and rose now that she is employed by the Lannisters of Lannisport. Clean teeth are the hallmark of a charming, easy smile to make hearts of men and women alike flutter.

Part 2: Biography

Swyft Sept (3AC - 15AC)
Helena’s early life began in the Sept of Cornfield where her mother begged the Septa’s to take her. Dutifully, though reluctantly, they agreed, for what else were they to do, and where else was the girl to go. To the Governess of Cornfield, under the sanctity of the confessional, the woman, aching from the pain of birth and shame, confessed that the little girl was the bastard of Lord Swyft. The Governess, doubtful but knowing the man was not without vice, kept the secret to herself and allowed the girl to remain. The woman, who’s name was never revealed even to the Septa's, fled into the night shortly after never to be seen again. Helena was then, as promised, raised by the septas and the Governess of House Swyft. She learns basic literacy from the Seven Pointed Star with the Sisters and numbers from the Governess. Alongside her studies, she was put to work on chores like maid work, baking, cooking, cleaning, and serving Lord Swyft.
In 11AC, a travelling minstrel named The Lying Lyre arrived at Cornfield. A dashing young man with a shock of blonde curls that tumbled down his back like a mullet captivated Helena with his songs of far-off lands and noble families. In particular he sang of the Maiden’s Bay Tourney, the feats of House Targaryen, and after some time the Field of Fire and the failings of House Lannister. House Swyft was wealthy, and the Liar’s talents earned him much and more coin from the silver mines.
Helena of an age where curiosity ruled a child’s mind was enamoured with the man and his songs. She took up practising the lyre with him, and discovered that while no maestro, she had deft fingers and a mind for lyrics. Impressed by her interest and talent, the Liar gifted her a lyre before he left for future profits in far off lands. Some years of practice though, and a natural storyteller and rumourmonger Helena combined tales of the Seven Pointed Star and was invited to sing in the sept and even twice for Lord Swyft.
Six Eyed Singer (15AC - 20AC)
It was not to last though and following the slaughter in the Kingswood, the line of House Swyft was extinguished. Not wanting to test the new residents of Cornfield, the Warriors Sons and Poor Fellows, after all, all men have vice, she left Cornfield, and took to singing on the road. Going under the name Lyrebird, Helena played and sang for her coin and lodgings, a young girl protected only by being seen when she wanted and an elusive shadow when she did not.
Times on the road were not easy and The Lyrebird drew much attention. This necessitated the need for another alter ego and after a year on the road and towns and villages through the West were soon visited by the travelling Septa Morgan. The Septa heard confessions and sins, gave forgiveness and offered small advice to the poor and needy. She spared coins where she could and allowed Helena to remain covert. It did not matter to most that she was no real septa, she wore the robes, knew the words, and offered as a good moral compass to children. For most in the far flung reaches of the West she was enough.
Being raised in the faith though telling a perpetual lie about being a sister of the cloth was a little too much to bear for Helena. After a year with the reputation of Septa Morgan growing through the small folks of small villages, the Septa soon faded away. Instead Jinny of Aegon’s Rest started coming to smaller castles; Turnbury, Redbramble, Parren Hall, Oldstars and the like. She took on odd jobs cleaning, cooking, teaching a daughter to read or a son to do his numbers. She was after all no threat, knew her letters and numbers herself, and was capable of scheming many a septa or fatherly gatesman to let her in.
Jinny of Aegon’s Rest became a traveller through the keeps of the Westerlands. She heard the tales from children and small folk alike. She had never meant to undertake espionage, but her place inside various courts across the land, and her talent for being in the right place at the right time meant she was an unfortunate witness to many a courtly intrigue. As her small gifts earned her again a broad reputation she would be traded between greater lords. Soon she was playing for the elite, and earning the rewards that came with it. Helena of Cornfield once again took a new name, the Six Eyed Singer, which she quickly used to escape her courtly life and take again to the road as a travelling minstrel.
The Strawberry Tourney and Ball (20AC - Current)
The Six Eyed Singer formed a little bard troupe, nothing extravagant, she wasn’t playing for the Lannisters or the Targaryen’s yet, but enough to provide several shows across the Westerlands, Reach, and former Kingdom of the Trident. Her troupe, much like she had been accidentally, was devious, and while she or they sang, pockets were pinched, and many houses were looted. Her troupe when apart played for all the minor and middle nobles of the Trident and of the Reach too now. She and they were as much a part of the debauchery of the West as any of the wealthy merchants. There was no party too scandalous, no whorehouse unsung, no court too far flung for the right price and the West had gold burning through pockets.
The Six Eyed Singer was not the only bard with a troupe though and soon through the Kingdoms after Aegon’s conquest artisans, bards, and mummers alike filled the world with talent. In 20AC the Songbird made its mark, and with a little bit of fun, a lot of resentment for nobility, and an ingrained childlike sense of chaos, the first of the Songbirds’ letters sang. The voice of the little people flooded across the western coast of the Iron Throne. Lord Belaerys’ dragon had eaten several children whilst growing fat and hungry. Lancel Lannister had claimed the maidenhood of his chambermaid, and sired a bastard all at the age of just fifteen. Lord Frey schemed against his overlord for a free and independent Trident once again. Was all of it true? Impossible to say, but there were enough truths to turn heads, and the songs of the Songbird began to cause chaos in the Westerlands most of all. The Six Eyed Singer and her troupe played through it all, they were bards, but the Songbird was the most famous one of all; not their little merry band.
The Six Eyed Singer though continued her good work, and with her reputation came an invite to participate at the Strawberry Tourney and Ball alongside the other bardic troupes of the West and Reach. She was not so famous as to be alone, merely enough to earn an invite, and a paid job. The planning was years long, and with new songs and tunes came new rumours. While the Six-Eyed Singer played songs such as Fleece-eye, Dornish Sour Grapes, and Lion of the West, the Songbird worked their chaos.
A ripple pulsed through the tourney, first a cheater in the joust was revealed, Ser Byron who was disqualified as a result. Then a second cheater, this time in the melee, then a third cheater again in the joust Lord Payne had accepted a bribe from Lord Reyne to fall early. Cheating in the tourney was just the start, cheating in the bedroom of the ball was the main affair. Here the Songbird revealed three affairs; Lords Serret and Lyden were both fathers to children on women , not their wives. While Lady Serret and Lady Ruskin were bedfriends behind their husbands’ backs. There was one final scandal though, which was revealed to all at the tourney. Septon Karron was no true anointed Septon, and worse there was legitimacy to foulness surrounding young boys who served him.
The chaos broke over the tourney and all the artisans in attendance were forced to flee. Yet, all was not lost, for Lord Gerold Lannister of Lannisport had taken his eye to Helena and her playing. He offered her a job, for he wished to be a great sponsor of art in the new Seven Kingdoms. So it was she came to a courtly position, advising the Lord Lannister on matters of fine art, musicians, mummery, and all manner of artisanal dealings.
Timeline
3AC - Helena is born in the Sept of Cornfield, her mother a woman from Silverhill who begs the septa’s to take the girl in. She reveals her identity to the Governess of House Swyft, and claims the child is Lord Swyft’s bastard. She leaves shortly after giving birth and recovering.
4-10AC - She is raised in the cloister with the sisters, her Septa mothers raising her lessons on reading from the Seven Pointed Star, and numbers from the Governess to ensure that she can do basic arithmetic. She takes basic lessons in scullery maid work, baking, and general service work for old Lord Swyft.
11AC - A travelling minstrel, The Lying Lyre, comes through Cornfield to sing songs of the tourney of Maiden’s Bay, House Targaryen, and the Field of Fire. He takes a liking to the young Helena, and gifts her a lyre. He stays in Cornfield for some time, both because it is lucrative and because he enjoys teaching the young girl.
12-14AC - The Lying Lyre departs Cornfield but leaves a talented and hardworking Helena with the sisters once more. She takes to singing sections of the Seven Pointed Star, and even performs for Lord Swyft a few times.
15AC - The House of Swyft dies out and Helena, unaware of her claimed parentage but with a talent for song leaves the cloister and takes to the road, not trusting the new Warriors Sons or Poor Fellows. She uses the name Lyrebird and sings and plays her lyre for coin to survive.
16AC - After a year on the road Helena takes up the name Septa Morgan and takes to hearing confessions of the poor and needy across the Westerlands. Many of them need guidance and wearing her septa robes she is the perfect person to hear them. She is no real Septa but no amount of explaining the technicality of that stops people asking her to forgive them.
17AC - Her reputation as Septa Morgan grows a little too heavy on her shoulders, and Helena takes to wearing more common clothes, moving from keep to keep and working as a barmaid, scullery girl, and baker amongst other professions. She goes by the name Jinny of Aegon’s Rest.
18AC - Chance takes its favour on her, and Helena with her simple lyre is invited to play at a feast in Lannisport. Dressed now as a travelling minstrel she performs for the gathered nobles and earns herself invitations to other keeps. With her generous benefactors she hires a small troupe to perform her songs across the West.
19AC - Travelling the Westerlands, Helena under the moniker The Six Eyed Singer, takes her talents for being present at feasts and gatherings of all sorts.
20AC - Rumour of The Songbird takes hold, and the West is awash in the voice of the little people.
21AC - The Strawberry Tourney and Ball unfolds and Helena’s skills earn her favour with Lord Gerold Lannister.

2024.05.14 07:32 Own_Detective7626 I (21M) want to quit my job, but I'm not sure if it's a good idea.

Currently, I'm on a LOA (leave of absence) from my job due to my mental health. I've been receiving treatment for depression even before I started here, but this job is making it worse.
I'm in retail sales and I get amazing benefits, plus I get paid well. The dress code is also very tame and I get the option to have colored hair and piercings. I've never faced any discrimination from my coworkers, I'm in the middle upper rankings for the store/company, and my coworkers/customers generally speak highly of me. All this is to say that I like a lot about my job, but I really can't stand sales.
Sales and the amount of hours worked really has been what's taking a toll on my mental health (I'm scheduled 8.5hrs at a time, and I'm going overtime nearly every week). I've been wanting to go back to school for a while now as well, but it just wont be in the cards for me as long as I'm working this job. I feel like I'm just hitting a wall right now and I'm not able to move forward. I already know that I can't stay at this job since my health has just gotten worse since being there, but I'm unsure of how to go about quitting.
If I give my two weeks now, it would mean that I quit when my LOA ends, and I would owe part of an insurance premium to my work. I'm getting short-term disability benefits, and had to sign a document that mentioned owing an insurance premium to the company if I decide not to return to work. I tried looking more into that, and everything I found was pretty vague. From what I understand though, is that if employment is terminated for any reason within 30 days of my LOA, I owe that premium. I'm not sure how much it is, but I'm guessing around $400. (I'm in Colorado if anyone knows more than me about that.)
Additionally, I have about 3 months worth of savings to live on. There's the possibility that I may find a job quickly, but I'm not sure how long it would take. It makes me nervous that I've been hearing about some people going unemployed for 6 months or more. My parents offered to help me out as well, but that's much more of a last resort to me.
Of course, another option is returning to work and searching for a job. I'm a little more hesitant about this idea because I know that my mental health would get worse again. It is the safer option financially, but probably not safer for me.
If anyone has advice, it'd be greatly appreciated, thank you.

2024.05.14 07:30 Infamousunicornsocks Lawyer messed up and I lost a job offer…

I had a lawyer 3 years ago who took my felony grand theft case and assisted me in successfully completing pre-trial diversion and I received a Nolle Prosequi. I the asked my lawyer seal and expunge the arrest from my record. I was told sealing and expunging was essentialy the same thing and my attorney would get it processed. Attorney filed a petition to seal since I met the requirements and it was approved.
Fast forward to a year later and I applied for a new job that did a background check and come to find out the record was never sealed because it popped right up!! After some digging and calling around/visiting the court house, apparently the clerk of court failed to forward the signed judgment to the State’s Attorney office. I assumed that since I paid my lawyer to handle this process, they would follow up and ensure it was completed. Unfortunately the job offer for the position was rescinded as their legal team didn’t like the fact that they saw something that they essentially shouldn’t have and I only had a sealing to show for it and not a full expungement. I provided proof of the sealing and details to show it was the Clerk of Court’s fault/my lawyer and my attorney’s paralegal even wrote a letter on my behalf stating that the clerk of court messed up but not admitting to any fault of their own for not checking that the process was completed.
My lawyer confirmed I was eligible for both however because she deemed it essentially the same as sealing the record, she used her judgement and went that route.
Calling several other lawyers who said sealing is NOT the same as expunging, they didn’t understand why my attorney didn’t just expunge it as I was eligible for both. In order to expunge it now, they would need a copy of the original order to seal that was sent to Tallahassee , but of course my lawyer no longer had a copy and didn’t provide me one. And the only way to get a copy is to unseal it I was told!!
I don’t want it unsealed as I’m worried that it would show up on a new background check. What the heck can I do to hold my former attorney accountable for literally not following through with what I paid her for!?! It’s like if I hired a construction crew to build something and it was complete but didn’t pass inspection, they would be held liable for fixing it, right?? I lost a $75k job over this (a $15k increase and haven’t gotten a position since that pays as much as that offer of employment). Like, can I sue my own attorney???

2024.05.14 07:29 Grennydalo HIPPA laws no longer apply to the letter agencies

It used to be that HIPPA a privacy law that applied specifically to health records were absolute including mental health records and could only be violated in the case someone specifically threatened someone else. Now this is being reinterpreted to include "could potentially pose a threat" to themselves and the broader community.
This has lead to HIPPA laws being weakened and no longer appling to the letter agencies who make it accessible by local law enforcement. This has allowed the NSA and FBI to gather all of our healthcare records in particular mental health records and share them with local law enforcement. Any diagnosis you've ever had, the meds you were prescribed and whether you keep up with the refills are being tracked in order to keep us all "safe".
To be clear the above is only a partial conspiracy with conjecture based on known facts that have quitely been agreed upon by the biggest players in the healthcare industry. I don't want to discourage anyone from seeking professional help but the governments penchant for violating privacy laws showed be cause for concern.
My full conspiracy is that this mental health awareness month feels more like a psyop to encourage and nudge more people to talk with a professional and volunteer all your internal mind data to the state. By aggregating all your financial records, social media likes, education and employment history, along with data scraped from sessions with shrinks about your childhood or parents, the government will be able to build a complete and more predictive model of us all. They will be able to speak to our individual wants and needs enabling them to motivate us whenever need be.
Recently there have been dozens of commercials with odd tones directed specifically at minorities to seek counseling. And while this may have initiated by people from that community the state has piggy backed on it in order to close the data gap for the algorithms.
We in the United States live in the most prevasive surveillance state in all of human history. Not the Chinese nor the Russians, but us in the US. But never fear its all to protect you. Maybe....

2024.05.14 07:12 actionjerryxyz I failed history my last semester

Hey everyone,
So, I'm an Electrical Engineering student, and I was supposed to graduate this semester. I even walked the stage and celebrated with my family and friends, thinking I had everything in the bag. But I just got my final grades back and... I failed History.
The worst part is, History is the only class standing between me and my degree. My job offer starts on 7/28, and the offer letter clearly states that I must complete my degree by 5/31. If I retake the class, it wouldn't end until 6/28.
I feel like such an idiot. Everyone already congratulated me, my parents are so proud, and now I have to tell them that I didn't actually graduate. I'm terrified of disappointing them and facing my friends who think I have everything figured out.
I'm not sure what to do. Should I talk to my employer about the situation? Try to retake the class and hope they give me some leeway? I'm really lost here and could use some advice or similar experiences if anyone has gone through something like this.
Thanks for reading.

2024.05.14 07:09 SpoofamanGo Boss Didn't Pay Taxes For 2 Years

I went to get my tax refund today. The tax office says my taxes are not registered. I have been at this academy for 2 years. They gave me a letter to give to my boss. She said she will pay by the end of this month. She guilt tripped me over it. I went to the retirement pension after and verified she is paying for that.
What happens when the employer doesn't pay foreigners taxes?

2024.05.14 07:06 alansijo_007 Is ANU Engineering that Bad?

I've been researching the engineering programs at ANU, The University of Adelaide, and UQ, as I've received offer letters from all three. ANU was my first choice, but I've come across a ton of people trasing on ANU. ( At ANU I'll be pursuing B.Eng (Honours) R&D, majoring in Mechatronic Systems )
  1. ANU only has a couple of majors and don't go into much depth as other Go8 unis as they are introduced only in the 3rd year.
  2. Secondly, it appears that ANU's program may lean more towards Systems Engineering rather than the specific majors I'm interested in.
  3. Thirdly, there are doubts about the employability of ANU engineering graduates.
  4. There are comments about the quality of faculty and lectures at ANU, with some finding them average at best.
ANU was my my No.1 priority but these comments have made me much more critical and doubting of my choices. Now, I think Adelaide is a better choice.

2024.05.14 07:01 Heathcliffismysoul My Insurance Company transferred my Title to themselves, paid my nothing, refuse to rectify

I live in California. I paid cash for a 2021 Nissan Versa on December 8, 2022. My car was stolen on June 6, 2023. I was devastated. My insurance company tried to lowball me. I refused offers until they told me ,"This claim has gone on for too long, we are closing it out" This happened on July 8, 2023. I agreed to take $1948,000 on a vehicle I had paid $23,000 with only 12 thousand miles on it. They demanded my Certificate of Title and my Fob Keys, which I mailed, overnite. No money was ever received because within 3 hours after I mailed keys and Pink Slip (Certificate of Title), the police called me to tell me car recovered, looks fine, come pick it up. I was so happy. I did not want the money. I had put so much money into my car in 4 months, and I owned it outright, and had worked 2 jobs for years. So I called insurance company, so happy, let them know My car had been recovered. It took two weeks before they mailed the keys back, but car was in mint condition, had been driven only 9 miles (joyride?) parked in a huge, Walmart, parking lot. I asked for the title to please be mailed back as well. They kept ignoring me. I went to register my car this past December. Only to be denied due to DMV looking at me like a criminal and telling me I had already been paid $19000.00 and vehicle is now owned by my insurance company . I tried explaining , asked for help...they told me Esurance must fix this, you cannot do anything as they legally own the vehicle. I call my claims adjustor, hysterical, and asked him why is my vehicle registered to my insurance company and why does the DMV believe I have been paid $19000,00. He literally told me, "Oh now your just making this up." I tried to ask him to investigate please, he told me, "since you have raised your voice I am hanging up now.' Im downplaying just how rude he was. He basically called me a liar and hung up on me. I was crying but I was not mean, I was almost pleading. He refused to answer my calls and no one else at the office would speak to me, they just forwarded my calls to him. I was in perfect health up until this point. But as each day passed, I begaan to shake from stress, burst into tears, became incredibly depressed, became unable to sleep, spent all my non working hours trying to find a solution. I was unable to concentrate at work. This finally went from beginning to have panic attacks but ended with me waking up after being in a coma, on a ventilator, for 14 days/ I had no idea where I was, was unable to remember how I got to the hosptal or why. I had two Myocardial infarctions, the Doctor explained that I went into full cardiac arrest and a co-worker gave me CPR for 16 minutes until the ambulance arrived. i had a second Cardiac arrest The Doctor told me, shortly after they had settled my into ICU. That one, He told me, they almost were unable to bring me back from. Thank God for The Doctors refusal to stop working on me, my wonderful coworker and The inventor of the Defribulator! Before my release, The Cardiologist told me they could find absolutely no reason for my Heart attack, i have low blood pressure, have no heart or health problems, no family history. They were dumbfounded. i gave him a brief synopsis of my car insurance situation, He told me, ;Stress, it was the stress" "That stress will kill you, you must work on your stress". They referred me to a social worker and a psychologist. When I finally began to regain stress and began to try and demand that my insurance company fix this because they were literally killing me, I felt. I sent a letter, pointing out every single thing that happened, all correspondence, how rudely I was being treated and I sent over my final Diagnosis from the hospital. They never acknowledged my letter. It is now May 13, 2024. have seen attorneys I cannot afford. I was told by DMV Investigations that I definitely need an attorney. Ive been put on Temporary Disability and since I am unable to register my car, I cannot drive it. I am unable to survive on what disability pays. I am losing all hope. I will probably lose my apartment, and may have to live in my car, but my greatest fear now is that my kitty and myself will be on the street, because if they take my car (its illegal to even park an unregistered car on a public street ( is what I was told by the Van Nuys supervisor of the DMV. ) Yet I have asked the Dmv to tell me if there is anyway we can resolve this. I just want them to know i was paid nothing and was finally sent a letter admitting that I wasnt paid anything and it was not my insurance company who made the mistake, it was Copart, and I should take it up with Copart. Okay, this is so beyond absurd. Copart who? Why do I pay full coverage insurance/ when I should pay almost nothing, as this is totally "Do it yourself-Figure it out yourself" insurance. The Claims adjuster told me last week, that they were not going to help me due to my 'Refusal to Communicate with us in January". I got so angry and told him, "So now , You say that I refused to communicate with you?" He said, "Yes, we do." I said," I know for a fact, you never made a single attempt to contact me, while I was in the hospital , after having a heart attack, because phones and emails keep records, and you know, there is no record of anything coming from you or my insurance company . The records I am looking forward to hearing will be all the calls between you and myself. my insurance company claims that every phone call will be taped, and I look forward to the day your employers listen to just how unprofessional, rude and outright sadistic you have treated me. Because you forgot who you work for, sir, and if you did not have policyholders, you would not have a job. You seemed to really enjoy mocking my illness, calling me a liar, hanging up on me. in fact I think we will hear that you threatened to hang up, not look into my claim, and said you were done with my problems and would no longer take my calls.. I have never been treated so cruelly, so rudely, and all I wanted was for my vehicle, which your company never paid a cent to me for, would be transferred back into my name, because I did not make this mistake and I cannot fix this mistake. All I ever wanted from you to fix the mistake that was made by your company You lost nothing in this claim, I only ask that you right a wrong. I have a car that cannot be registered or driven. I oay for your company to ;make me whole' but i would have been better off if i had no insurance at all. My car was found, my car would still be in my name and I could have registered it. Obviously, your never going to help me or make things right' he said, 'i have done all I needed to do, i mailed you the Certificate of Title, so your claim is Closed.' So I have an unsigned Certificate of Title in the name of my insurance company . Which does nothing to help me. Any ideas? So far beyond hopeless, i have lost faith, have lost all joy, no longer leave my apartment. I will do anything, but i just have no clue and no hope. Thank you so much.

2024.05.14 06:47 GoldenO2024 TJO Rescinded -- Is It Worth It to ask for Reconsideration? (Long Post)

Hello guys.... just looking for any helpful advice or suggestions. This is a secondary throwaway account. I will put as much details w/o oversharing since you never know who reads these post.
So, I had received a TJO a few weeks ago. Did the required preliminary steps and was waiting hopefully for the FJO.
Today I got an email stating the offer was rescinded. This is the edited version of the email:
This is definitely sad news, since this agency where I had wanted to start and end my career.
BACK STORY - Part 1
I had worked for this agency 10-15 years ago, not to long after I finished my Masters. It was my first government job.
I started off in Unit A and about two months in was interviewed for Unit B (which had been my 1st preference). A few weeks after, I got the position and started in Unit B soon after.
I ended my position in Unit A in good standing and my manager for that Unit was happy for me and have given the manager I was going to be assigned to in Unit B great reviews about my general work performance. These two Units were in the same POD and working in Unit A was generally a stepping stone to get into Unit B if so desired.
Now, the full training period for this agency for this Unit B is quite long and is broken up in parts over a period of time. There were several of us new employees for this Unit B Manager.

BACK STORY - Part 2
After the first training session, we were back to our POD and assigned OJI's. The first few weeks was about trying to put what we learned in the training to now real life application. For the most part, during the first 2 months we dealt mostly with the OJI's. Now, my feedback from the OJI was positive and constructive. The OJI would always tell our group that it takes a while to really learn the job and that the agency wasn't expecting us to get it even in our first few years. This echoed what was told to us repeatedly during training.
Now enter the Manager (MB) - Not long after MB starts to review our cases, one of my teammates (T1) starts to complain to me about feeling targeted and not receiving proper assistance. T1 stated that the MB seemed to be trying to create a negative paper trail with the performance reviews. Not to long after this started, T1 informed me about being given 30 days to resign or they would receive a termination letter. To say I was shocked would be an understatement. I mean, we literally hadn't even been out of training for 2 months when this happened to T1.
T1 was told he could go to the Union Rep. to talk about options, but that UR was not helpful (as I would also later find out) and basically said, probationary employees could be terminated for various reasons (similar to being At-Will in the private sector). He resigned because he didn't want any negative remarks on his records, especially for future government options.

Back Story (Part 3)
Not long after T1 left, I started getting the same treatments in terms of overly negative remarks about my work. The manager even started to tell me that the job was not for everybody. Due to what happened with T1, I kind off had an idea where this was heading so MB basically gave me a similar ultimatum of termination or resign within a set period of time, I wasn't fully surprised but still broke down in tears asking for the full training period before such a drastic determination could be made. The manager would not budge. I was offered the same option of speaking with the Union Rep. It was the same UR (worked in the same POD) and while they expressed surprised and some outrage and hinted at a PATTERN (details later) in that POD, they basically gave me the same spiel as was given to T2 and I took the option of resigning.
Back Story (Part 4)
Fast Forward about 6 years after leaving that agency. I had gone through various life events and working private sector.
T1 whom I kept in touch with occasionally, reached out and asked if I was willing to talk a friend. They explained that this person (S1) has been hired a few months before our group in the agency, Unit B. They had been under a different manager for about 5-6 years before their manager retired and S1's team was merged with MB's team.
Long story short - S1 who was a Highly Successful rated employee with a prior manager, was within less than a year placed on a performance improvement plan within a year of joining MB team.
However, since S1 had past the probationary period and was a permanent employee with a good performance record, they were able to file an EEOC complaint and after a long battle SI won the case. T1, myself and another employee (we discovered during this process) that was forced out in the same manner testified during S1 hearing.
There was much more but ......As for the Pattern, T1, myself, S1 and plus another employee were all from the same or had family background from a certain region.
Back to Present Day
S1 wants me to ask for a reconsideration and explain my situation. She feels that MB must have put something on my internal records to make me unemployable to this particular agency. I did get hired a few years back to a different agency and this issue never came up. I resigned during Covid period and went back to Private.
So... Anyone ever been in a similar situation? If so, what was the results?
