This is a weekly reminder post of this sub's stance on potential copyright infringement. This is a serious issue that needs to be kept in mind when creating and listing NFTs.

Now that that's out of the way. My credentials are: MBA, with a bit of business law classes under my belt.
I want to give a quick explanation of how copyright works - and I'll do so through quick blurbs n some myth/reality bullets.

- Reality: No. Not true at all.
- Myth: Well they never said it's copyrighted.
- Reality: Upon publication (and even while a work in progress) a work is automatically protected via copyright under US Law.
- Myth: Well they never sold it.
- Reality: It doesn't have to be commercialized to be protected.
- Myth: Well it was a long time ago
- Reality: Possibly true...as long as the creator is deceased (or if multiple creators, the last living one is deceased) and the required time has passed...although this gets tricky with "estates."
(d) Duration of Rights.—(1) With respect to works of visual art created on or after the effective date set forth in section 610(a) of the Visual Artists Rights Act of 1990, the rights conferred by subsection (a) shall endure for a term consisting of the life of the author.
So what's this thing I hear called "Fair Use?"
Straight from the source:
- Myth: Well this is paid for in Algos, not USD so it's not "commercial"
- Reality: IT IS commercial. You could even barter for bacon and it'd be commercial. It's an exchange of one good/service for another good/service.
- Myth: My piece with Batman inside a card is "transformative"
- Reality: No, unfortunately, more-than-likely the courts would say it's not. A good litmus test is..."If Warner Bros Entertainment (owner of Batman) wanted to make an NFT/ASA "Batman card" would yours compete with it or be possibly mistaken (by a reasonable person - so in America think 8th grade education) for real merchandise? Probably...thus it's not transformative enough.
"nature" gets a little tougher. This looks at protecting the "creative process." Thus, using other works of art is less-likely to be protected than using factual sources - like historical photographs since it's easier to "create art" and thus "transform" factual pieces than other art pieces. This is also talking to things like "parody." Satire is NOT protected. "Parody" is. What's the difference? LegalZoomputs it well: While a parody targets and mimics the original work to make a point, a satire uses the original work to criticize something else entirely. Another way to look at it is that satire uses another work as a way to comment on something happening in the world that has nothing to do with the original work.
- Myth: I added a different border, extra planets, and some blur effect to MTZ's World of Light - it's a new piece of art.
- Reality: Not likely the courts will see it that way.
- Myth: This guy added a filter, some burn effects, and collaged a bunch of newspaper headlines together - isn't that a violation!
- Reality: Probably not...the courts would probably see this as a creation of art out of factual sources.
amount/substantiality in relation to the whole...this is where using clips of songs that are only like 5 seconds long works! But using more than that...runs into problems. This is tough to decipher too...as some songs are EASILY identifiable from just 5 seconds (Ice, ice, baby) - and thus NOT fair use. But some aren't. Usually you're safe using a very small clip of a song or video - especially if you're adding more to it. But this is a dangerous game to play - and there's places to get free audio (some sources below)
effect of the use - this is probably the biggest one. Courts will look at simply...does YOUR work affect the sales or potential for sales of the copyright owner. Of note...this is looked at at the time of the issue being brought to the court, not at the time of sale. For example, let's say my batman card sells for 10 Algos today, but Algorand BLOWS UP and soon every NFT is on Algorand. And now my OG Batman NFT is seen as one of the first Batman ones and official. Warner Bros gonna sue the shit outta whoever owns it at the time they sue to get the rights to all sales of that NFT. So that person is left holding an empty bag when Warner Bros wins in court.

- Reality: Technically, yea Warner Bros probably won't spend the money to go after the OG artist and the hands the asset passed through...HOWEVER, they may. That's their right. Who knows - the Napster days showed us the lengths companies will go to. EVEN BIGGER HOWEVER, the last person holding it when Warner Bros DOES decide to go after that Batman NFT...uh oh for them - they just lost their asset.
- Myth: Well it's been like a year, and no one has brought up copyright. So I'm good.
- Reality: If this was in a normal market...maybe this argument would work. If McDonald's let you sell a Ronald McDonald poster for like a year on Amazon with no issues, some court may say "bro, you took too long to bring this to us." HOWEVER, with cryptocurrency being so new (and Algorand being so little known/discussed), most courts would see it as "reasonable" that a copyright owner failed to exercise their rights within a year - possibly even a decade. (Updated because I realized last example dealt with trademark not copyright :o)
So what am I safe to use?
US Government works (mostly)...any deemed free to use by creator...and any a copyright lawyer says they have your backs on (cuz now they're liable).

 | i’m having trouble choosing which career path to pursue. these options have their pros and cons and i know it comes down to personal preference but i ultimately cannot decide between the two. submitted by pludye to college [link] [comments] for background information i am 19 yrs old and this would be my first year as a college student. for healthcare i would go into radiography for IT i would go into web development but open to other IT programs (as pictured) i’ve applied to an accelerated radiography program (18months). the application process is very competitive and lengthy (application process: may-november. start date is in january). they are only accepting 20 students. the program is also super expensive at 45k but i’ll be applying for financial aid and grants to lower the cost. to proceed with applying you need to achieve a wonderlic score of 26+ within 3 attempts by august. i have failed the first attempt and currently studying for my 2nd. i’m not too worried about it because i went into the test without any research but of course i dont want to have high expectations. you also need to do a math assessment that is held in september which im a bit nervous for as math isn’t my strongest subject. i believe you also need to do 3 interviews with the school. with IT i’ve applied to a community college and the start date would be in August of this year. before radiography i was really set going into data analytics but the college that i would be attending didn’t offer that program which made me ultimately to turn away and the reason i found out about radiography. however knowing they offer web development, it made me gain interest in the tech industry again. i think my biggest concern is timing. with being 19 and starting as a first year i feel behind. i know it’s only a year difference but with radiography my start date would be in january 2025, the year i turn 20. if i miss the august start date for community college, the next start date would also be in january 2025. i would hate knowing i wasted all that time during the application process just to be rejected when i could’ve completed a semester by then. i just don’t want to delay my education timeline more than necessary. like i mentioned, each career path has its pros and cons but i just can’t seem to outweigh one another which is the reason i’m writing this. any advice would be appreciated!!! |

If you're on Boo and come across this profile, I suggest staying away from it. It all started with me browsing profiles. I came across this one and thought to myself, "oh she's verified so it must be legit right?" Yeah, right. I was already suspicious enough at the early stages of the conversation. All I did was give her profile a heart them moved on. Not even 10 seconds pass by and we instantly match. That's the first red flag.
Fast forward about 24 hours since our first message was exchanged on Boo, the conversation was flowing pretty well. There were a lot of spelling mistakes on her part and grammar wasn't the best so that raised an eyebrow. From my knowledge, AI or scammers from different countries always seem to misspell things. As yall can see, this profile invited me to WhatsApp but I don't have one. (I couldn't get a screenshot of when this profile gave me their IG because the conversation was gone shortly after)
So before you know it, we get unmatched from Boo and the conversation is gone. This was not before me sending a follow request and message on IG. At first the profile on IG seemed legit. You know... pretty girl, more followers than people she follows, so I'm like ok this must be legit I guess and I was skeptical for no reason. Again, I was wrong. From introducing herself as Sophie on Boo, now it turns out her full name is Ava Sophie (Ava was added to go along with her IG profile) This person has told me earlier in the day, they were planning to go back to the UK from HOUSTON. Mind you this was at around 5pm Central time. So they send this generic picture of them supposedly watching Nemo. I instantly recognized the background from different pictures I've seen online with people posting while on an airplane. The biggest giveaway was the window. How is it pitch black outside on a long summer night in Houston at 5pm?? Lol So I knew it was time to just move on and go ahead and block the profile.
What their endgame is? I don't know, but I'm pretty sure if I kept talking to them, they would have eventually asked for some sort of money or personal info from me. You can search up the profile for yourself on Boo, and you will notice this profile is constantly changing their location to different places around the globe as I provided in the screenshots.
In conclusion: always trust your gut and be extra careful online my friends.

You know... pretty girl, more followers than people she follows, so I'm like ok this must be legit I guess and I was skeptical for no reason. Again, I was wrong. From introducing herself as Sophie on Boo, now it turns out her full name is Ava Sophie (Ava was added to go along with her IG profile) This person has told me earlier in the day, they were planning to go back to the UK from HOUSTON. Mind you this was at around 5pm Central time. So they send this generic picture of them supposedly watching Nemo. I instantly recognized the background from different pictures I've seen online with people posting while on an airplane. The biggest giveaway was the window. How is it pitch black outside on a long summer night in Houston at 5pm?? Lol So I knew it was time to just move on and go ahead and block the profile.
What their endgame is? I don't know, but I'm pretty sure if I kept talking to them, they would have eventually asked for some sort of money or personal info from me. You can search up the profile for yourself on Boo, and you will notice this profile is constantly changing their location to different places around the globe as I provided in the screenshots.
In conclusion: always trust your gut and be extra careful online my friends.

I just wanted to update everyone because all the advice and well wishes I got really helped me. It's just been a crazy couple of months but I wanted to give an update.
About two weeks after my OG post, they did one of my biweekly ultrasounds and saw the presence of reverse flow in baby boy's umbilical cord. The scan was in the morning and I saw results on MyChart before they talked to me so my husband was able to get to the hospital before rounds. (Thankfully someone donated an apartment to us for the entirety of our stay and it was only 5 minutes from the hospital). Doctors came in at 1 pm and told me I'd be delivering that day, at 27 weeks and 3 days. And by 2:20 pm my baby boy was delivered via C-section and came out crying and weighed 1 pound 9 ounces. He was initially intubated and whisked off to the NICU. After 2 hours post op for the both of us, we got to go see him. It was the most bittersweet moment of my life but my nurse who was with us made sure to get pictures and videos for us. The biggest struggle we faced with him was that he didn't pass his own bowel movement for three weeks straight. We were potentially looking at surgery, but they were doing daily enemas that produced stool so they waited. And finally, he pooped! And then he started to take breast milk. After that, it was relatively smooth sailing. He was discharged after 70 days in the NICU, about 3 weeks before his due date, so discharged early by NICU standards. We've been home for almost a month and he's acting like I'd expect for a newborn essentially (he is technically three months, but adjusted for preemies he's only a newborn). He weighs around 6 pounds now. He does have inguinal hernia repair surgery on the 20th but the surgeon who was following him with the enemas is performing the surgery so I feel as comfortable as I can about it. Baby boy is the light of our lives.
I healed pretty quick from my C-section. I still have some numbness around my scar but I was told that's normal. I will have C-sections with any baby after him since they did a vertical incision on my uterus and not a horizontal. And I'll have to deliver at 36 weeks to avoid uterine rupture. So I was out with a buddy at one of those small town China buffets and he got a fortune cookie without any paper fortune in it. And I went home and made this. While listening to the album Wasteland to Wonderland by Paddy and the Rats.
It takes place in a world where science and magic coexist. Poorly. (Think S.T.A.L.K.E.R. but with wizards) The city and the countryside are ruled by a being known as the fateweaver. She rules with an iron fist, her command over sorcery absolute. Deep within the city her scientists are working on something. Something insidious. One of these decides that they wont be a part of it anymore. They are exiled from the city with a terrible curse and nowhere to go. There are rumors however of another sorcerer, who lives in an old estate far on the other side of the wastelands.
Bereft of any other ideas, they go. Ready to challenge fate.

You’re lucky that my roses judged you to be a good person at heart or their enchantments would have made you into a rat as soon as you pricked yourself on them. Then my cats would have probably eaten you.

Ok I’m starting to get a little bit angry now. You know you woke me up from a really wonderful dream?
I was driving down the coast roads in a long silver convertible. I think it was a thunderbird like from that Marc Cohn song.
I had the top down and the radio on. The sea breeze was tossing my hair just so and I had that lovely salty fresh taste in my mouth. You have no idea how much I long to return to the coast. To feel that breeze for real just one more time.
The sun was going down and the sky was a million radiant colors. Just exploding up from the ocean. I had my arm draped around the shoulder of some lounge singer. It was one of the nicest dreams I’ve had in a long long time.
And right in the middle of it, as my favorite song came on over the radio and that good looking singer started to sing along to it, so softly I could barely even hear. I leaned in for the kiss and what happened instead?
I woke up- alerted to a trespasser into my little sanctum. My hair is a mess and my mouth tastes like morning breath. And instead of some gorgeous singer, I get to spend this cloudy damp little night with you.
So you can see how I might be a little unamused right now. Clearly you’re not going to take the off ramp I so generously provided to you so explain why you’re here. It had better be a really good reason.
Listener stammers again
You know what shut up. Let me see that curse mark. The whole thing.

Ohhh you had some “concerns”? Didn't like the implications of what you were being told to research did you?

Well why would I lift the curse even if I could? What's in it for me? Me and the fateweaver have an understanding. She gets the city and the mountains. And I get the wasteland. Sure we're enemies, but frankly she's beaten me. And I'm tired, so why Should I rock the boat for some no name labcoat like you? Why risk another confrontation?
So no, I don't think I’ll be helping you.

My estate is built around the well of eternity. It is the bedrock of everything I am. The little seed that became the core of my power, and the link that became the chains that bind me. I wasn't always what I am now. I used to be a dental hygienist, but I had a curse of my own I needed to break. I’ll spare you the gritty details but it led me here from my home dimension.
A great man once compared the world to an optometrist trapped on a rail car with one little hole in the wall. Forced to watch the world pass by but being unable to see where the train was going or where it had been, only where it was at that moment.
That is what it is to be bound by fate, but what if I told you there was a way out of the boxcar?
That great hole in the center of the brick plaza? That's the well of eternity.
We'll have to descend the staircase around it. Watch your step, the stairs are slippery and thin.

A magical fire burning a brilliant shade of [whatever your favorite color is] it will guide our way.
This world of yours and mine is one of many. All that happens here is one way or another driven by a conflict between those who serve the princess of the tower, the goddess of order. And the Witch of the plains. The goddess of chaos.
The fateweaver serves the former, although she doesn't know it. And I served the latter, even though I despised it. All that happens in every universe on the most fundamental level, is driven by their eternal hatred. So if you ever felt like the gods were fools, well you weren't far off from the truth.
Or in any case that's how it has been explained to me. I'll freely admit I don't understand most things as much as I'd like to. I’m a lot less than I appear to be. Most sorcerers are. We’re all smoke and mirrors. Shadows on the wall. Ghost boxes and card tricks.
They are deep in the well. There's a quiet watery ambience.
The well of eternity may look like water, but in truth it is the stuff that makes up the void between universes. If you submerge yourself into the water you will cease to be a part of this world and the forces that command your destiny will have no power over you. Your life will be your own.

And if things go poorly you will have no one you can blame save for yourself. Are you certain you want this? I won't blame you if you turn back. There are worse fates than being stone. Becoming like me for example.

This world of yours and mine is one of many. All that happens here is one way or another driven by a conflict between those who serve the princess of the tower, the goddess of order. And the Witch of the plains. The goddess of chaos.
The fateweaver serves the former, although she doesn't know it. And I served the latter, even though I despised it. All that happens in every universe on the most fundamental level, is driven by their eternal hatred. So if you ever felt like the gods were fools, well you weren't far off from the truth.
Or in any case that's how it has been explained to me. I'll freely admit I don't understand most things as much as I'd like to. I’m a lot less than I appear to be. Most sorcerers are. We’re all smoke and mirrors. Shadows on the wall. Ghost boxes and card tricks.

Hello everyone, i need some guidance from folks who are well versed in scripture. I have been having a gnarly existential crisis for the past 2 weeks, like boom out of nowhere. Ive had them before. About mortality, the universe, existence and reality itself. I was raised a christian, and i slowly drifted as i grew older but came back to it. Even though i denounced it HEAVILY, having arguments with random people in LA, debating people who just believed, any sort of thing that involved christianity i just rejected. Earlier this year i decided i did not want to just be arrogant and i decided to humble myself and start reading the bible so i could really make an educated opinion on christ/god. It all clicked, all of my morals all of the things i believed would make the earth a better place, jesus spoke about, treating others fairly, even acknowledging the ugly of the world yet accepting it for how it is through the act of love alone. I felt good. But then i started realizing, im going to die someday, My family will die someday. There must be a bigger picture, something to back whatever there is after this world up. I started researching EVERYTHING, from the origins of Jesus (historical evidence) to Near death experience, quantum physics, Scientific theories, a lot of interesting information yet nothing that could ease my discomfort. Death is unavoidable and we will all go through it. However i still want to believe in Christianity, and please dont take this as an attack or anything as i am fully writing this as a person that could use some advice or words, even a prayer. One of the biggest things that did bother me was for example: archeological findings of “Yahweh” dating back to 800BC, claiming that yahweh was once a “storm god” yet at some point in the OT he became the god we know as jehova, and reading that really tested my faith. I know jesus was in fact a real person, historically, however i cannot shake the fact that the god in the old testament dates back and is inferred to as a lesser god, can anyone please give any information as to how that came to be? I clearly dont know enough to be certain and thats why im humbling myself to ask to be educated so i can understand further, i really hope i dont offend anyone im just trying to learn and back my faith up, its hard in the world we live in today, so much information its hard to take just one side at all.

Chris was standing at the water cooler, and a discussion with Jimmy about last night’s basketball game took precedence over their laundry list of liabilities. They worked in healthcare, troubleshooting their organization’s medical records system, and a tedious day of programming preceded them.
“Tatum’s not going to win MVP. They’re not even gonna win the series,” conveyed Chris. He was a passionate spectator of sports, much to the dismay of his pregnant wife. He had devoted hours to watching games, and the dishes were dirty; their tasks were not tackled while she was growing resentful of his viewership.
Jimmy disagreed. “Whatever dude. Boston has it in the bag.”
“All I’m saying is that it’s a long series and Luka’s gonna go off. Everybody acts tough when they’re up,” remarked Chris with a sly smile.
The conversation dissipated and Chris quietly returned to his cubicle, a lone island in a metaphorical sea of swordfish. Having previously worked in retail, Chris had recently started work at the administrative office of Holy Hills Medical Center, and he was still a stranger to the culture that had been created in such a drab dwelling.
His job was feast or famine. There were two possibilities for his daily itinerary. He was either so busy that he couldn’t concentrate on each task, or he was so bored that he couldn’t stay awake. He spent his downtime utilizing AI chatbots for a variety of purposes; some for fun, some for work, and he sat idly while his coworkers tried to chat with him from afar. He was not one for conversation, and his colleagues had picked up on that.
Jimmy was an ordinary man. A stereotypical Chad, in Internet terms. Jimmy was taller than average, and he spent his free time drinking protein shakes and pumping gym weights. A childless bachelor at thirty-one, Jimmy’s charm was evident in every interaction. His study of seduction and charismatic nature created a perfect storm of a downpouring douchebag, but under the surface Jimmy was a caring man with a heart of gold. Ignorant to his own insecurities, which he hid like a married man hides his mistress, there was a teddy bear of a man inside of him. He saw the good in people and wanted to bring that out.
Jimmy was feeling chipper, having already taken a multi-mile run that morning, along with a hearty breakfast of egg yolks and chewy bacon. He glanced across the room at Chris. He was ready to strike.
“Hey Chris,” exclaimed Jimmy from afar.
Chris reluctantly walked to Jimmy’s cubicle, surrounded by their other coworkers. They all knew that something was coming from Jimmy’s loose cannon of a mouth.
“You know, I got fired from my job at the keyboard factory,” uttered Jimmy with a devious grin. “They told me I wasn’t putting in enough shifts.”
A loud chorus of laughter erupted from the silence, their voices echoing throughout the ominous office. An unusual volume, their amusement was amazing, and Chris cracked a timid smile before heading back to his cubicle, afraid to let out a real laugh for the fear of succumbing to his perception of Jimmy’s aura.
Chris returned to his work. He surveyed the room, and as he was coding a couple of lines, the decibels rose higher than a red-eye flight. The laughter had become contagious, infecting passersby like a pandemic virus. The cluster’s cackles were a weed growing tall and strong, a parasitic phenomenon becoming worrisome without an end in sight.
Breathing became a luxury for a growing group of jesters, including Jill, a young coder fresh out of college. She was a bright student with a brighter appearance, and Jimmy had his sights set on her. In between bouts of laughter, Jill said “That’s a good one, Jimmy.”
The laughter was swelling into something more sinister. Jill, hunched over with her guttural guffaw, grabbed her stomach tightly. Tears streamed down her aesthetically arresting face, and her smile was wide like a white polar bear.
As she gasped for air, Chris grew concerned, and her face turned blue. Panicking, she peeked around the corner while her coworkers continued to crack up. She looked Chris directly in the eye, and for a moment, they shared an elegant embrace as Chris pulled out his phone to call his wife.
Jill fell to the ground, and her body began to violently shake something fierce. Despite their worried words, her peers proceeded to chortle, and their chilling fates became untimely and unusual deaths. One by one, the lungs of the wheezing workers stopped, and twenty-one people died from laughter on that menacing morning.
Chris emerged among the carnage and called the emergency services, who cleaned up the scene and left Chris unable to finish his work. Under the circumstances, Chris left work for the day and headed home to greet his wife. He walked through the door with his shoulders hunched and his head down.
“Honey, I’m home,” yelled Chris, as he dropped his backpack on the ground and untucked his blue-and-green-checkered shirt. He received no response.
“Honey?”
Nothing.
He walked down the hallway, which was adorned with pictures of family and friends. His stomach churned. He sensed that something was wrong.
Chris turned the corner to enter their bedroom, and his wife stared at him in silence, her grin widening and her eyes piercing his soul. She let out a wail, and then a worrisome laughter.
Chris was shocked to find that the contagion had spread to his wife as well. She fell over, grabbing her stomach and rolling on the floor, before a seizure snapped her neck and killed her instantly.
Chris sat down on the bed and spoke to himself.
“Sometimes laughter really is the best medicine.”

AMD Ryzen 3600: PC was overclocked for about 1 month (just long enough for me to get through BG3 third act). Been running stock 99% of it's life. PC used just for casual gaming and web browsing. Temps are good, and stays below 80 when gaming but might need a thermal paste change or change in the fan curve
Coolermaster hyper 212 rgb black: Took the rgb fan off because it was too loud for my taste, can include if wanted
MSI B450 A Pro ATX mobo: BIOS updated about 6 months ago
T force Vulcan Z DDR4 3200 16GB: Standard ram, no problems

Acer VG270 27" 1080p IPS 144hz monitor: No dead pixels, however monitor will randomly turn on when the pc is powered off. I believe it is from a faulty power cable from acer that is causing this issue. Never bothered fixing

Corsair K55 harpoon mouse+keyboard: Has all keys, might need some lube for the switches

I remember one of my favorite childhood summer visits; it was to my grandmother's farmhouse. The place was a hodgepodge of smells, chickens clucking, old creaky furniture and never-ending adventures for a ten-year-old city kid like me. One day, grandma told me a secret - there was an old hidden treasure in the farmhouse, and if I could discover it, it would be mine. Oh boy, was I thrilled!
I spent the entire day scavenging through every nook and cranny of the farmhouse, building mental images of the possible treasure, "gold coins, a precious jewel, or maybe an ancient relic!", I thought excitedly. This was my mental representation; an image based on the minimal input from granny, but shaped by my own personal beliefs, biases, and experiences.
After hours of search, I finally found a shabby old box; inside was granny's beautiful handmade quilt. I was puzzled, "This? A treasure?". Granny then explained how it was a symbol of love, patience, and hard work, which she believed were the real treasures. My initial disappointment wore off when I realized she was right.
What I learned that day is our mental construct, formed by our experiences, values, and beliefs, often differs from the actual reality or mental representation. It's fascinating how our brain paints a picture based on limited information, making us perceive things differently.
P.S. Before you rush off to your grandma's searching for treasure, remember this is just an illustrative story, although if you find an old box, do check it out! But if it's just a quilt, don't be surprised...and don't say I didn't warn you!

Academically, I hold a Bachelor of Science degree in Computer Science and Information Systems. I'm a laid-back individual who doesn't partake in drugs or party scenes (yes, I even abstain from coffee!). I don't drink alcohol either but I don't mind if you do, my friends have beers while I'm around. I apparently have a INTJ personality type, I have a positive and lighthearted atmosphere, constantly cracking jokes with my close-knit group of friends.
