My younger brother was arrested in Oklahoma 2 years ago for DUI. He told me he failed his field sobriety test and let them take his blood. His blood test came back a few weeks later showing he was under the legal limit. The DA changed the charges from DUI to DWI because his blood alcohol was supposedly .079 which is below the legal limit. This change was recently, with in the last few months.
My question is this. Is this typical for a da to change the charges to fit his case or is it more likely my brother’s attorney is trying to get him to take a plea deal to a lesser charge of DWI?

Hey guys! Sooo… I got a dui LESS SAFE in Ga back in October 2023,my BAC was .13, I had my first court date in January and I spoke to the DA about what options I had , he had a plea deal already written up for me but I didn’t accept it and told them I wanted a public defender, I’m a college student barley making it by so I couldn’t afford a lawyer.. my second court date was in February and I saw my public defender but he also had 10 other people with the same dui as me… he gathered us up in a group and said your next court date is may 9 (which is tomorrow) he also said the longer we drag out the cases the better, well I have court tomorrow and I have been trying to contact my public defender for the past 2 months and I haven’t heard nothing from him… I get he is super busy but a call or a simple text would of been nice…I’m just trying to get an idea of what I’m looking at for this court date, but do you guys think he will probably end up just getting a continuance and resetting for a later date? I just wanna know what imma be looking at for court tomorrow! Thanks!

2yrs ago arrested for dui at a stop light. I was pouring out tobacco from a bottle and the officer “suspected” it was a beer bottle and I blew .09. I was from out of state (GA) and did not lose my driving privileges in my home state likely because they are not a compact state.
Hired an Alaska attorney in Kenai ($4500) and he basically did nothing but attend hearings, defer, etc and supposedly negotiating with the DA and then advise that I was going to plea to the minimums and get off easy with a small amount of house arrest, fines, etc.
When the next, any likely final court date was approaching I decided to contact another attorney in Anchorage to get another opinion. He mentioned that my attorney had not filed any motions, requested any video evidence, etc. He requested all of that, filed a motion for dismissal based on an unlawful stop noting that from the dash cam there was no way the officer could ascertain what type of bottle was being poured and citing a number of similar case dismissals with similar circumstances.
After 2yrs of hell, case was dismissed and DMV revocation was rescinded.
Not all attorneys are the same. Some just walk you into guilt pleas.

Got a dui in January, hired an attorney and today I had my first actual court date. First couple were continued due to awaiting the BAC results. Took just under 2 months for blood. .273
My attorney has been in talks with the DA and today we got an official preliminary offer.
Colorado has a mandatory 10 day jail sentence for a BAC over .15. They wouldn’t/cant put it on paper, but they said the judge would likely agree to 15-20 days home detention.
They’re dropping the careless driving citation I received with the DUI
48 hours community service
1 year unmonitored probation with UA’s, possible to end early after 9months
MADD Victim impact panel, alcohol education classes and therapy, alcohol use evaluation - all are standard requirements for DUIs in Colorado. I started that early and am done with all but therapy, it’s 26 weeks 🫠
Driving restrictions are handled separately by the DMV and that hearing is the 22nd. I’ll certainly have an interlock for 2 years, likely a 30-45 day hard license suspension but with the option to get a restricted license for traveling to work.
We didn’t accept that yet, but likely will-considering how rough CO punishments can be, especially in this conservative county with a tough judge-it’s a pretty good deal. We continued it for a month so we can complete the DMV hearing.
First DUI, last DUI.

Hello everyone, my husband was arrested for his first ever DUI this past Friday. His BAC was .09, the cops pulled him over becuase he was swirving in his line. He didn't hit anyone and he wasn't speeding. This happened on the 5 north freeway in Santa Fe Springs, L.A.. He complied with officers and spoke clearly. The officer called me to pick him up, so he was able to come home. The officer told him that there is a good chance the DA will drop his case because his BAC is really low, which we are hoping for but we are not banking on that. I have now firgured out, through looking at other posts, that we need to worry about court and the DMV. I've been trying to find posts that are similiar to my husbands case, the reason being is he drives for his company. He's a tech and drives to different locations to work on machinery. How will this DUI affect his job? It was a supid mistake on his part, and he knows that now. He stopped drinking around 9 and was stopped around 12. I know this will pass, it's the unknown that is driving us crazy. Any help would be greatly appreciated. As of right now we are not looking into getting a lawyer, we don't have the funds for it.

Hello to all,
TIA to any kind soul who answers my question. Infinite thanks and appreciation.
So, here goes:
My husband is currently in the Veterans Treatment Diversion Program, he was put in this god given last ditch program due to him having 2 DUI's and the DA's leniency to try and wrap them both up into one, which upon completion of this program, would've been reduced and/or dismissed I think.
So, he also has another Dui in the neighboring city/suburb that's awaiting his completion to move forward in the legal process. (Yes, he has a fucking problem with alcohol) - Anyhow, the DA gave him the opportunity to enter into this program, he has relapsed quite a few times during the duration that he has been in the program, which is about 8 months, but he would get community service whenever he failed a UA (I kept warning him, but this disease is a bitch, me being an addict myself)
So, fast forward to about 2 weeks ago and I get the dreaded call, he has gotten picked up for another dui (I am so tired at this point) the arrest happens on a thursday, with him having to see the judge for his weekly check-in on tuesday, we go to court and the DA lays it on him that this new arrest gives them the option to either; throw him out of the program (where he faces 3-5 years for the charges) or they can give him one more chance but he has to do 6 months in a detention boot camp in DOC, but will still be in the program. We're praying that they give him the 6 months, with that being said: He works on the Airforce Base as an Airplane mechanic and lord knows that this job is everything to him (To us really)
What I am asking is if the judge chooses the 6 months, can my husband get this covered by FMLA since its a sanction ordered in his treatment?

I got a DUI in March. I am a working nursing student. I had only had about 2hrs of sleep and I went out with friends and had a few drinks. I got driven back to my brother's house where I was resting for an hour maybe more when I got a call from a friend who said she was stuck outside in the rain and asked if I could go get her. We were visiting in Oakland so neither of us were familiar with the areas. On route to to her I didn't realize how tired I was, I ended up dozing off and hitting the guard rail. The ambulance came and then the police. I was not near my vehicle when they arrived. The officer decided to do a FST (in the cold and rain) and give me a breathalyzer. He had me blow 3 times and then never told me what I blew. I was extremely cooperative and gave no attitude whatsoever. I just got the police report and it stated I blew a .163. I also gave blood and that came back as .22. I thought i had let enough time go by to allow myself time to sober up but apparently I was wrong and made a horribly wrong decision that could potentially ruin my career. I have never had a DUI before. My DMV hearing is next month. My court date was in April but the DA hasn't filed charges yet. I have gotten an attorney to handle the case for me. So I guess I'm just wondering what to expect next. Is my my life completely over because of this 1 stupid mistake? I realize my judgement was very poor on this day and I have been beating myself up about it every since. I feel like such a a failure and an idiot.

So I blew a .20 back in February after a full day on the mountain driving back from snowboarding. I did not realize how messed up I was but I got on the road anyways. My lawyer appeared in court for me today and sent this:
“I appeared in your criminal case today, pleaded not guilty, and continued the matter to 5/22. The DA provided discovery and an offer. The offer is a standard DUI with a high BAC with 5 days jail (which is more like 2-3 days jail actual time). Other standard terms of the statutory 3 years of informal probation would be a DUI class (3-9 months long), payment of a roughly $2k fine, no BAC while driving (and subject to search/test for alcohol if stopped), license suspension (6-9 months depending on final BAC), and obey all laws.
As discussed, I'll will continue collecting evidence and seek to leverage any mistakes or favorable evidence to your advantage.
As for DMV, I am trying to continue the 5/9 hearing, but there is a good chance it will be denied, in which case your license will likely be suspended around 5/20/24. You will be immediately eligible for an IID-restricted license, which we can discuss if you'd like.”
I’m a little shaken up an out the jail time. I spent the night in jail and I was extremely compliant the entire time. It’s my first offense and I’m extremely ashamed of it all but with this it just feels so much worse. after browsing this subreddit a bit more it seems like most people do not have to actually serve jail time such as for 1st offenses but i’m terrified nonetheless. is that really something i should expect? even the IID?

I DONT HAVE A DUI NOW - REJECTED
I got into a DUI in December and am having my court date tomorrow.
I was driving me and a buddy home and hit a moving car in an intersection, no one was injured and everyone was fine. The other driver did report soreness of the neck and back but my insurance covers all medical bills so I think I’m fine for now. The police showed up, I failed my sobriety test and was asked to breathalyze. I refused at first, but once being told it’s an additional charge if I refuse and they have to get a warrant for blood I agreed. So they cuffed me and took me to a sheriff’s department where I blew 0.05 BAC. The legal limit for a 21 year old is 0.08 but I am unfortunately 20 years old….
I spent the night in jail. I felt like shit and at still embarrassed. I hope it all ends tomorrow and doesn’t get delayed.
I am going to go the public defender route and was wondering if anyone had any advice or something to calm my nerves as I head into this tomorrow?
What should I expect tomorrow?
UPDATE
went into the clerk today and they told me my dui hasn’t been filed so I have to call the DA and see if it’s be filed. Decided to call today and guess what! My dui was rejected for lack of evidence! Whatta know
I am now not being charged with dui nor will it see that I was ever charged with dui.
Does anyone know how I can get my license back? Can I just get it back if I goto the dmv? I technically never got a dui so how’s that work?

My partner, our dog, and I were hit from behind while we were stopped at a red light. We gave a statement to the police (basically that we were stopped at a red light and then felt a huge impact from side/behind, we didn't see anything) and they told us they suspected the other driver was impaired. She was taken away in the back of the police car, and we later got their report stating that she had been cited with criminal charges of DUI (BAC 0.16 at 2.5 hours after the collision) and Reckless Driving as well as violation citations for Operating a Motor Vehicle While Using a Mobile Electronic Device, Failure to wear seatbelt, and failure to drive within lane. (The officer on the scene told us she said something like "I want to take a Breathalyzer because the last time this happened they thought i was drunk and I wasn't" so she may have prior traffic violations). Her arraignment date is in about a month and the DA may apparently reach out to us after that.
Both our car and the car that hit us were medium size SUVs, had airbag deployment, and will definitely be totaled. Both cars have up to date insurance. The incident was apparently recorded on dashcam by a bus that was entering the intersection from the other direction and the bus driver stayed on the scene and provided his info to us and the police but we have not seen the footage. We are all ok although I did take the dog to an emergency vet to get checked out ($350 bill). Neither of the humans went to the ED, and 2 days later we both have some neck/back/hip soreness but nothing I would normally seek medical attention for.
Our car was a 3 year old plug in hybrid SUV that has only had minimal depreciation because they are limited in supply and very popular in our area. We are concerned that insurance won't cover the true replacement cost and obviously won't cover the vet bill. Financially none of this will make or break us. If it was a true "accident" I would stop at feeling grateful but it's hard to not be angry at the other driver who was apparently drunk, on her phone, AND driving recklessly and very easily could have killed someone (us in a smaller car, any pedestrian, all of us if she hit a fuel truck that are common in this area, etc etc). We were going to wait until the insurance payout information was available then reach out to her directly to ask for reimbursement for the vet bill and any difference between insurance payout and true replacement cost of the car, but I was wondering if we need to get a lawyer involved sooner and/or need to go to urgent care to document our symptoms.
We live and this occurred in Oregon if that makes a difference. Thank you in advance!

I love Terre Nere, and jumped on ~a full case when I recently got an email from Italian Wine Merchants in union square NYC. Alas, the most expensive bottle shows up as pictured here and I’m worried the peeling could be due to heat (or some other factor), notwithstanding the banged up front label (in all fairness I’m less concerned with the scratches on the front as I’ve seen that on a number of bottles, albeit not advertised as SLC from the retailer).
I’ve never purchased from the retailer but they do come highly regarded. Equally interested if anyone have had experience with Italian Wine Merchants and again, I’m less concerned with the retailer than the individual bottle.

Wanted to share my story here before I delete my username because I am never going through this again.
In May of 2022 on a Friday, I went to a work happy hour in SF and had 3.5 beers before taking Bart to Oakland to meet my wife and son and father in law at her uncle’s house.
Was offered wine upon immediate arrival and talked with my wife about who was driving. Looking back the convo was vague but I assumed it was her since I already had started drinking.
Proceeded to drink a good amount of wine. Family was watching a warriors game and I am not into basketball and wanted to leave and was getting impatient. Finally left between 8-9 pm and by then my son was tired and crying and we all just wanted to go home.
I asked my father in law to drive and he said “hell no” kid was crying and I just wanted to go home so I drove everyone. I left the parking garage and stopped quickly at a red light and felt in my gut I shouldn’t drive but didn’t say anything.
Right before our exit is an annoying on ramp where all cars merge immediately, despite having 1 mile to do so, so I sped up passed 3 cars and exited. Turns out CHP was behind me and the CHP office is right there off the same exit. I’m an idiot.
Got pulled over and immediately knew I was going to go to jail as soon as I saw the lights. I’ve been pulled over once before in my MIL’s car for a high beam bulb out, which she got a fix it ticket for.
It was a Friday after a sports game and they immediately asked how much I had to drink, I said wine with dinner and was asked to exit the car. I thought I did ok on the sobriety tests. The report says I started the steps on the wrong foot, in seeing the MVARS footage I was just instructed to do it “exactly like I showed you.” Police report also said I swayed on the one foot test. I counted to 23 one thousand on one foot. Every police report will state you smelled like alcohol, had an unsteady gait, and had bloodshot eyes.
I blew a .16 and went to jail. My wife was able to drive the car home because she blew under the limit. I was released from jail the same night around 2am.
I was charged with child endangerment and dui. I am lucky that CPS never came to my house despite this charge. hired a lawyer for 5k which was incredibly worth it for me personally. I can afford it and it was extremely helpful to have a lawyer to navigate everything with.
I stopped drinking throughout the whole ordeal and started going to AA on my own. I was and felt like a fuck up parent and felt compelled to do something while the slow court process went on.
Court and everything took over a year. The child endangerment charge was dropped, I logged 55 AA meetings which no one asked me to do amd I plead no contest to 1 count of DUI, with standard penalties; 3 month class, 2K fees, MADD panel, 3 years probation. I opted for a restricted license via the dmv because I share a vehicle with my wife and didn’t want to make her have to use an IID as well. I’m lucky that I live in an area and have a commute that a car isn’t needed. I was going to have to do 10 hours of parenting class, but that was dropped by the DA because CHP literally took a year to send MVARS footage (negotiated by my lawyer). I get my unrestricted license back in August.
Personal takeaways; I knew I was drinking too much and this was the reality check that straightened me out. I’m lucky I had my wife’s support and the money for all of this. Don’t drive after drinking at all, don’t get arrested in front of your kids. You’re not defined by the fact you were arrested and charged but by how to respond to it. I don’t drive for work and my job never found out. I haven’t told many people about this, I just ate the charges and consequences and am moving on in life.
This has all been an expensive and hard lesson to learn and now that I am on the other side I’m never coming back here again. Thank you all for your perspective.

Got a friend who was pulled over on St Patts night at 3am. Reason was obstruction hanging from the rear view. It was a thin gold chain and the cop says he saw it. Cop did the whole “I smell alcohol, you been drinking?” skit. She refused to blow or do FST. Of course that’s an arrest. In his report that she saw cop even says that the her driving was fine and not in question.
Now I’m not lawyer but I thought there was established case law from a local county that says that’s not an obstruction and you can’t be pulled over for that. In the local county case it was an air freshener and it got tossed out. Also, it should be noted that the stop netted 3 bricks of cocaine which was deemed inadmissible due to the stop being invalid. My question is “why is this lawyer taking $8k for a DUI case like this and letting this draw out?” Seems shiesty af. Shouldn’t this not be a DUI case but a case to fight the stop? Her left is in a spiral due to this but it seems cut and dry. Fine, take the $8k but cite the case law to the DA and end it ASAP. Am I wrong?

So I was arrested for a DUI in Texas and had gotten an original offer for a one year deferred adjudication probation sentence with some added bonus fees. After my lawyer met with a DA he had given a better deal of dropping the charge to obstruction of highway with a year and a half probation (added six months) deferred probation as well. My question is my understanding of deferred is you’re never guilty and after completing probation it’s then dismissed. Why would it matter which sentence I went with if both are dismissed in the end?
