Professional conduct regulation cases do not support the constitutionality of this rulemaking

The existing broker disclosure obligations as applied to customer agents and principals, though never explicitly validated in the courts, may alternatively be found constitutional as a reasonable regulation of professional conduct that incidentally burdens some speech activities of the persons engaged in that regulated conduct. In that interpretation, the conduct being regulated is that of entering into an agency relationship with a customer or else acting as the principal in a sale to the customer. While a written contract is speech, the assumption of a legal relationship that it embodies is doubtlessly conduct and can be the subject of regulation.
As the Court held in United States v. O’Brien, laws affecting speech that are aimed at the regulation of non-expressive conduct are still analyzed under First Amendment jurisprudence, but face a lower level of constitutional scrutiny than laws aimed directly at the regulation of expressive conduct or at speech activities themselves: “a sufficiently important governmental interest in regulating the nonspeech element [of the regulated conduct] can justify incidental limitations on First Amendment freedoms.”⁴⁷ The compulsion to merely report privately to the IRS and to the taxpayer certain “purely factual and uncontroversial information” about the regulated non-expressive conduct may rightly be framed as an “incidental” limitation on traditional brokers’ otherwise unabridged First Amendment rights.
The O’Brien standard, however, is only applicable if the rule is targeted at regulating non-expressive conduct. Things become more complicated when the rule is targeted at regulating expressive conduct or at speech itself. There is a long though underappreciated line of cases stemming from O’Brien that points toward a reasonably straightforward series of tests for when regulation of professional conduct that burdens speech activities is constitutional. That line has been best illuminated by attorney Robert Kry in his article, “The ‘Watchman for Truth’: Professional Licensing and the First Amendment.”⁴⁸ Kry, summarizing and synthesizing many cases, finds that

In the case of a broker who is, in fact, an agent of a customer or a principal in a sale to a customer, the regulation is plausibly aimed at the non-expressive component of the professional’s activity. An agent under common law principles is acting on behalf of her customer. When a broker agrees to a sale, she binds the customer to that sale. The reporting requirement, therefore, is merely a requirement to disclose certain facts about one’s sales, i.e. one’s conduct as an agent. As a principal in a sale to a customer, the broker is, once again, engaged in conduct, a sale, and the reporting requirement merely discloses facts about that conduct. Additionally, brokers of this type are in most cases already subject to a licensing or registration requirement under other statutes.⁵⁰ Those forms of professional conduct are traditionally regulated and the tax laws merely provide for an additional recordkeeping and reporting requirement associated with that conduct. Altogether, the reporting requirement, though compelled speech, appears to be a regulation aimed at the non-expressive component of a professional’s activity. It is therefore likely constitutional.
As described earlier however, the Treasury Department’s proposed rule inappropriately departs from that customer agent or principal standard and seeks to compel speech from persons who are engaged in no such regulated conduct. A mere publisher or maintainer of software, websites, or smart contracts is not in an agency relationship with any customer, nor is she selling anything to any customer apart from, potentially, a license to use her tools or a fee charged for relaying or publishing the user’s data on a communications network or blockchain. Additionally, unlike typical brokerage, these activities do not trigger any licensing or registration requirements under other state or federal statutory schemes.
Indeed, even when such person is relaying actual cryptocurrency transaction messages that, once recorded in the blockchain, will effect a sale of some cryptocurrency, these entities typically have no actual ability to act on behalf of the user and no actual or apparent authority under agency law to act on their behalf. At most, they can choose whether or not to relay the signed transaction message (but so too can an internet service provider); they cannot alter the contents of that message such that the terms of the sale would change. They cannot and do not act as an agent of any customer nor are they a principal in a digital asset sale to any customer.⁵¹
These persons may be involved in conduct in other ways, such as paying for web hosting services, paying fees on cryptocurrency networks to record software or data in the blockchain, taking fees from users to relay their messages, or simply paying rent or otherwise maintaining facilities wherein they or their employees do the work of developing software or maintaining communications tools, but all of those activities are aimed at engaging in speech, the publication of software and data, and none of those activities give rise to the type of fiduciary or agency-like financial relationship, i.e. conduct, that justifies third-party tax reporting obligations.
Moreover, these persons have deliberately designed their software, websites, and smart contract tooling such that it can be useful to a trader and capable of facilitating their trades or other desires without the need for any agency relationship or for any legal or trust-based relationship with the publisher or any other party whatsoever. The user can and does do it all themselves. That is the point of cryptocurrency and “decentralized finance.” We can debate the merit of such a design goal,⁵² but what is not debatable is that this is how these tools are presently designed.⁵³ By demanding that these publishers rewrite their tools such that an agency relationship is established between the author of the tool and its user, such that the name, Social Security number, and other intimate details of the user are entrusted to the alleged “broker,” the regulation is squarely aimed at compelling not merely the disclosure of trading data and taxable gains, but also the compelled creation of significant expressive software and tooling to solicit and collect data in a manner that would otherwise be antithetical to the goals of the software developer. Such an order is so unprecedented that it is difficult to find appropriate metaphors or past examples. It is as if a state—frustrated that it cannot determine who is reading which books—ordered that novelists shall hold in-person book readings during which they must collect and report information about their audience.
Accordingly, when applied to mere publishers and maintainers of software, websites, and smart contracts, these regulations target the expressive activity of the alleged broker. That does not mean, however, that such rules will automatically be unconstitutional. The Court has dealt with several regulatory schemes aimed at expressive professional conduct, such as a lawyer giving legal advice to a client. Throughout these cases the Court has developed a robust series of standards for constitutionality that are focused primarily on “which kinds of advice are licensable based on how closely they resemble forms of communication associated with fiduciary relationships.”⁵⁴ This leads us to the second question in Kry’s analysis of the First Amendment limits to regulating professional conduct, what he calls the “value neutral test” because it applies irrespective of whether the speech affected is a matter of public concern and irrespective of the motives of the speaker:

Given the in-person and client-specific nature of legal services, there should be no surprise that under these cases the professional regulation of attorneys, including licensing, limits on solicitation and advertising, and—as in this rulemaking—compelled disclosures, typically withstands constitutional scrutiny. In the context of developers of cryptocurrency systems, however, the answer to Kry’s twin questions of characteristic-dependence and person-to-person context is an unqualified “no.” It is taken as written that software, websites, and smart contracts in the cryptocurrency space are built such that they are generic, serving the needs of whoever wants to use them irrespective of the characteristics of that user. It is also a given that these tools are shared widely over the internet and used freely by whoever happens to download them or (in some cases) whoever pays to license the software or pays to have their transactions relayed by the software. As such, they are never “delivered in the context of a person- to-person relationship.”⁵⁶ Accordingly, regulation of the speech activities of these developers, including compulsions to report and develop expressive software that enables that reporting, would face strict scrutiny by the Court and be found unconstitutional.
While these standards are general principles that are equally applicable to any kind of expressive conduct regulation, it is nonetheless worth noting that several of the cases that first articulated these standards dealt explicitly with speech, including software, that advised and facilitated sales of valuable assets. As such, the speech in question in these cases was very similar factually to the speech that would be burdened under the Treasury Department’s proposed rule. The value-neutral test was developed in Lowe v. SEC, a case involving the unconstitutional application of the Investment Advisers Act to a person merely publishing a public newsletter,⁵⁷ and it was further reinforced in Taucher v. Born⁵⁸ and two similar cases⁵⁹ dealing with the unconstitutional application of the Commodities Exchange Act to the developers of commodities trading software.⁶⁰

So, by the end of episode 2, right after Gummigoo ends up destroyed by Caine, we hear him say “I know you guys love your NPCs, but if I start losing track of who's a human and who's an NPC, who knows... what could happen...”
This irks me, because it implies two things. A: Caine can’t tell the difference between his Npc’s and the real humans. And B: at some point in the past, he did allow an Npc into the circus and something bad occurred.
Now, let me pose a question. If the AI’s Caine makes are indistinguishable from the humans, how do we know each character is human to begin with?
Well, each character remembers being human, right? Sure, but bear in mind that Caine also created memories for Gummigoo and the rest of the speaking roles for the Candy Canyon Kingdom.
Now, we are told by Caine that the Ai used in the Candy Canyon Kingdom is “57 times more immersive” and this would have explained why Gummigoo feels so realistic and alive, if not for the fact that an earlier Npc did get into the circus, and did cause problems, and Caine forgot who was and wasn’t an Npc before.
Now, lets talk about abstraction. We know characters abstract, supposedly after losing their mind and “giving up”. But what if that’s not actually the case?
Let’s look at Kaufmo. He locked himself in his room and went insane, which led to his abstraction. But i don’t think it’s insanity that leads to abstraction, I think it’s Caine learning that they know the truth about their existence.
Let’s talk about Caine, he tells us he is omnipotent, but does have limits, such as being unable to affect their minds. And he isn’t all-knowing either, given he learns of (or pretends to) Kaufmo’s abstraction, and is initially unaware of Gummigoo entering the Circus.
But then we see something strange, when he handles Kaufmo’s abstraction what he does is put him into the “cellar” with the other abstractions rather than fixing them. Is it because he can’t affect their minds? Or is it because they knew too much?
Let’s look at Gummigoo. He learns that he is an Npc and Caine kills him. That’s because he isn’t as attached to him, instead of safely putting them away elsewhere, he simply deletes him not because he’s an Npc, but because he knows. Ragatha mentions he reuses Npc’s, but why would he do that unless there is a finite amount. That’s why Pomni was made as soon as Kaufmo Abstracted
I mean, with this assumption Caine’s actions are less mysterious. Caine says the void is dangerous because he doesn’t know what’s out there, but I think it’s dangerous because he knows. In the same way a copy of Gummigoo was out of bounds, so too is Pomni and the rest.
In conclusion this is my believed set of events: Caine (perhaps the only human) loves to make stories, and so he created actors with varying personalities to act out the stories, and to make it authentic, he programmed them to think they were human. When they figured out they weren’t human he had to deal with them, but due to his attachment he took away their ability to speak, made them dangerous to touch, and then locked them away.
Thoughts? I think there is alot more that this theory explains but I don’t wanna take up too much time.

I was thinking about how this show is all about perspective. Bear with me cause I probably won’t get everything accurate here but hopefully the gist will make sense. Ruby talks about the elephant being the strongest animal but is tied down with chains staked into the ground. It could pull up the stakes but doesn’t because of how it sees itself, it doesn’t believe it’s strong. The whole idea is the perspective of the one inside the chains. At the beginning Ruby thinks she’s being chained by those at Maxton and so she says she won’t let anyone else keep her staked down. By the end of the series though she says she’s realized she was keeping herself chained there and had to break free from her own limitations. She says that’s true of others too, meaning James. I think that perspective really comes into play with him.
When he and Ruby first interact he comes at everything with the perspective of him being “James Beaufort”, this well-liked, super athlete, son of the school’s wealthiest contributor. She’s some nobody who he expects to fall at his feet. When she doesn’t it throws him off because that’s not the perspective he’s used to. Now we won’t go into whether this is realistic or not because in truth most of these bad guy goes good for the good girl stories are not realistic but that’s not the point. The point here is we like characters that broaden their perspectives when presented with a worldview that’s different from theirs. Characters that change as they’re presented with the opportunity to. That’s James. When Ruby doesn’t cave over and over to James and she presents him with the reality of how he comes across and the pretentious, hollowness of his life when they fight during the prep class, he’s forced to decide if he wants to keep seeing things only from his perspective or through someone else’s eyes. The best example of that was the pool scene.
That was the best sequence in the series but for me it’s not just because of Ruby’s vulnerability or James’s protectiveness. It’s also because it’s when James realizes that Ruby was right about the world he’s been living in. She told him she didn’t want to go to the party because that’s not her world but she went because she wanted to be with James. Him having to see her in that environment, from getting the drink thrown on her, to being tossed in the pool and his friends reactions I think shifted James perspective to seeing his world how Ruby sees it. Judgmental, frightening and shallow. He couldn’t go back to seeing it the way he had before, as fun parties with his friends without being emotionally devoid.
After that I think is why we see James questioning a lot with who he is and everything related to his father, his place in Beaufort and his place among his friends. His perspective changed. He could no longer look at that world the same after seeing it from another person’s point of view. I know it’s just a show but I think it’s fun to see what we can get out of it and for me the whole elephant metaphor was pointing in that direction. Both James and Ruby realizing that it wasn’t their worlds keeping them staked to the ground but themselves and needing to see things from different perspectives. Once James was able to free himself from only seeing things from his father’s manipulative, power means control perspective, it freed him up to dream of a different life and if we get a season 2 I’ll be curious where it goes.

These sisters put out the laziest content. Their videos could have been better edited by my 10 year old brother. They literally put zero effort into anything they create.
Leena became a mom and hasn’t shown a single mom content that I can honestly say has improved my knowledge of motherhood or recommended an item that had any benefits.

How the hell did you three even get rich?

I am planning on buying a 2015 Q50s 50k miles for 17.2k from a private seller in Jersey. I am from NY and I'm not sure how it would work buying the car if the owner still has to pay the car off? I'm thinking of going to my bank and ask about it and see what procedures I should go with but l wanna come to you guys first about it. How would I go on to do this with a private sell? Write a check to the private sellers bank? Let my bank do the work? Also once I have done the payment when and how would I be receiving the title? Would I be able to receive the title online or am I gonna have to wait for a physical copy of the title from Jersey so I can register the vehicle as a NY vehicle. Sorry for amount of questions, i'm new to this.

My question is in regards to protestantism in general in a sense that no one denomination sees themselves as the one true church. I extend that argument to belief in the sense that there is no "one" true christian belief. I find this belief difficult to balance with the motivation of going to church, or for fighting for the Christian faith. If there is no one true denomination, why even care that much about which one you go to?
Another way to explain it is, imagine you are catholic, then you have one unified thing you are fighting for, the catholic church, which is supposed to be the kingdom of God on earth. On the other hand suppose you are presbyterian, why even care about that if reformed baptists are okay, if lutherans are okay, if dutch reformed are okay, if baptists are okay, if non-denominationals are okay, if some catholics are okay. Why even care to stand up for your beliefs, if you cannot say that it is the true belief or that it is the truth. Why stand up for something you don't know to be true. Why should I invest myself in theology if I cannot possibly make a decisive conclusion in terms of what is false and what is true?

The question is do women in range close to that (5'6-5'10) consider a dating average height guys? Or maybe should I ask the better question,do women in general consider dating men around their height?

Her lily was recovering well, though they had to start wearing their mask again to aid with their breathing. She spent a lot more time in the garden with them, even more than she used to. The two would garden, and she would accept their help controlling her newfound psyker powers. Perhaps it was because it was her lily that was helping her made it more bearable, maybe it was because she knew that this was the only way to prevent her from being a pawn of beings that did not care for her. Regardless of why, she knew it was necessary, and dare she say; nice. It felt nice to be able to rely on someone else. She only hoped that it would last.
She had started to control her psychic powers to some degree, and grown incredibly strong psychically, though that fact often concerned her. She didnt want to lose control and create the same system that she had destroyed on her home world. But gardening helped ease her worries. Spending time with her lily helped ease her worries, calm her spirit. It was nice. Her sons questioned the amount of time she spent away from them, but they also knew not to mess with her. Maybe she would teach them to take care of their own garden, one day.
Unfortunately, that day would not come. As they traveled through the Immaterium, she shot awake from a terrible nightmare, only to see her garden withering and decaying once more, the petals of her flowers falling lifelessly to the floor, and her herbs turning brown and wilting. She saw daemons tearing into her plants and dragging her Lily into the Immaterium through a gap in the gellar field. She had to CALM down. She needed to CONTROL it. Breathe in. BREATHE out. She. had. To. focus. She. had. To. kill. Them. all. She had to save her lily. SHE NEEDED to send those DAEMONS BACK WHERE THEY CAME FROM.
Through cold tears, and a pain that shook her to her core, Morrigan could no longer control her psychic powers. She just couldn’t DO IT ANY longer. The daemons turned to see the Primarch shaking, and a psychic force hit them so hard that they were forced into the warp, without lily. Morrigan rushed to her lily’s side as they lay in the withering garden, torn and dying. She used her psychic powers to try and heal the garden, to heal her lily. But she went too far. The sheer psychic power she wielded, the uncontrolled emotion, the uncontrolled rage and the pain was too much. She found her garden lithe and green once again, and her lily was standing once more before, pale but healthy. But as she wiped the tears from her eyes, she could see that not all was well. Her lily had become part of the garden, they had become one with the plants that they had taken care of for so long. Morrigan broke down. What had she done? WHAT HAD SHE DONE.
She wept and tried her best to ease her mind by gardening, as she had always done since she had met her lily. But this only made things worse. As her tears wet the ground and dirt caked her hands, the psychic energy further transformed the budding seedling that was her lily. The garden began to grow and spread, mutating under the strain of psychic energy. The budding seedling grew at a rampant pace, growing around the body of the former apothecary. When the growth was finished, a tree of enormous stature had grown from the budding seedling, reaching every corner of the room, with lily at the center of its trunk.
Morrigan spent a long-time gardening. She didn't know how long it was, she didn't want to know, she didn't care. She didn't eat, she didn't drink. She hadn't worn her mask or her armor since the incident. All she could focus on was the garden and the tree that was her lily. She pruned the leaves often, doing everything she could to give her lily what she could. She started to talk to her lily as she lay gestating inside the tree. She would talk about her past, talk about what she had wanted to accomplish. She apologized for what she had done, how sorcery was a trap that she had willingly stepped into, how it had cost her lily their freedom. Her lily would always try to console her by raising a flower to her, but Morrigan didn't want to hurt her lily any further and would always refuse.
Even as they exited the warp and returned to Barbarus, the uncontrolled psychic energy continued to affect her garden as it expanded, taking over the ship layer by layer, system by system. Her sons became rooted to their stations as the garden became the ship, as vines bound marines to their posts, trapping others in bulbous flowering pods. The air became thick with a haze not unlike Barbarus, but was filled with sweet smells of flowers, and the sickly smell of flesh consumed by plants. Her sons began to transform, vines began to enter their armor, mushrooms growing from inside them, and flowers budding from their helmets. Organs were held in place by cracking armor and vines, muscles replaced by roots, and all sorts of vegetative replacements. Yet others would be consumed by bulbous pods, their gene-seed being sent through runners, the psychic energy fostering new bulbous pods to grow, gestating new marines.
And at the center of the grand mass of plants and space marines was a huge tree, growing from inside the Primarch’s quarters. Morrigan was a mess. Their clothes had long been tattered, covered in dirt and grime as she wandered the halls in psychic delirium. She seemed to talk to no one, ranting about that she was sorry, that she would fix it. The ship seemed to almost reach out in reply, the plants embracing her as if they were trying to console her. Morrigan accepted their embrace, having long lost any ability to differentiate her lily from the ship-wide garden. She pruned the vines throughout the ship, watering her sons as they still sat rooted to their stations. She made sure to put extra care to the new, small bulbs that held the gestating seeds of her new sons. She would continue this for long stretches of time, talking to the ship as if it were a living thing, pruning painful growth to give some relief to her lily, to the person she cared for but couldn’t quite accept that she loved.
However, her isolation would soon be broken as her sister Alakhai Khan. Having returned from her fight against the Greenskins in the Chondrax system, she had been searching for answers as to what had happened during her absence. Finding no sign of her sister Magnolia, she went searching for her sister Morrigan. Upon her arrival to the outskirts of Barbarus, she could see the hulk of the Endurance in orbit, floating listlessly in space. Sensing something was wrong, she approached the ship, sending a vox to her sister's ship in order to identify the problem. Hearing no answer, she decided to investigate the disturbance in person.
Her stormhawk landed inside the hangar of the Endurance, and immediately she could see something horrible had happened. Every inch of the ship had been claimed by a massive growth of plant life. As Alakhai ventured further into the ship, she decided to investigate some of the plant growth, to see if there were any signs of daemonic corruption. Instead, she was startled as the plant reached out, as if to greet her. Hands made of vines, eyes made of flowers, kept together by Space Marine armor that had been long since neglected. This was one of her sister’s marine’s, consumed by plants but very much alive. As she prepared to end the marine’s suffering, she heard a voice, and a psychic pressure that gave her a splitting headache.
“Sister, please let my sons rest. They need to sleep if they wish to grow and revitalize.”
Alakhai looked towards the origin of the voice, and saw something that resembled her sister, but surely was not. “Morrigan? What has become of you? What has happened to your ship?”
Morrigan smiled, caressing the walls of the ship, running her hands through the petals and flowers. “My lily requires a lot of work to keep healthy. I’m afraid I haven't found time for myself these days.” The ship seemed to groan, almost as if it were talking to Morrigan. The plants reach out, as if to console her, wrapping her in their embrace.
Alakhai now understood. The ship was alive, a living plant that her sister was cultivating. What warp entity had caused such growth and transformation. “Sister, what has done this to you? What warp entity has corrupted your ship?”
Morrigan began to cry, tears streaming down her face, watering the plants at her feet. “I have cursed them sister, and now I must forever make up for my failures.”

Hello everyone, I am a 15 year old high schooler with A LOT OF QUESTIONS about religion and theories and I need answers...
So I have made 3 possible conclusions on the anunnaki and have some questions about it:
I summed up pagans and ancient messopotamian gods into one but I put the emphasis on anunnaki and sumerian tablets...
1ST THEORY: GODS, man is made to farm gold or just be slaves or just toys to be played around with... Is there a connection to enki and enlil with yahweh...In the Sumerian ''genesis'' we find out that enki actually saves humanity in the garden and is basically satan but portrayed as good, he wants humans to be free and explore the godly nature, on th other hand enlil wants humans to be enslaved and wage war etc... For example seen that Yahweh CHOSE the Israelites as the chosen people who waged war for example(numbers 31). Is YHWH enki enlil or anu(the highest God who had a wife and all 3 characters share attributes to yahweh, could it be the trinity in sumerian mythology??)Is he the MOST POWERFUL with literal genetical SONS?(Anunnaki described as sons of God) made with his wife?
Another question of mine arises is why does God NEED dust to create man if he is all powerful all knowing, why create satan and all of this? Why us? Why did he need any sort of material to create us, perhaps he is not all powerful to just make man instantly, why did he need rest?Why is genesis in plural and also, ''they have become like one of us''
There are also many theories circulating that yahweh is not the same in the old and new testament, new testament is much more peaceful, I get that because of the messianic ideas, but why a change ALL OF A SUDDEN?? Was the bible corrupted perhaps, the new testament by Constantine and the old are taken stories from sumerian tablets(genesis, flood, etc...) Is the gospel of the holy twelve true?? Where are all the non forged new testament gospels and all the lost gospels? Is the peshitta bible true in claims for eg Jesus saying I am the living God? Is he also YHWH?
2ND THEORY: ALIENS, again the story goes the same about man and the questions of our existence, are these just aliens from planet Nibiru? are there other aliens? Who are the Anunnakis Gods??This theory is unlikely but if so what are the alien anunnaki position of yahweh or other World religions?
3RD THEORY: FALLEN ANGELS, perhaps the theory I would like to be true haha...As we know Enoch describes them as the watchers and fallen angels, the question is did they temper with our DNA?Is this theory perhaps true?

Question: What is going on with Megalopolis?
Megalopolis is just days away from being shown in Cannes and some people hope it will succeed and some people hope it will be terrible. I saw the teaser that was released Yesterday, and I must say, it really does look interesting and has gotten me intrigued with the project.
However, also yesterday The Guardian release an article titled, “Has this guy ever made a movie before?’ Francis Ford Coppola’s 40-year battle to film Megalopolis”. It details how long Coppola tired to get Megalopolis, but it also had many accusations from many sources that are anonymous. They didn't like Coppola old school approach to filmmaking and how they will wait on end for Coppola to decide something to shoot and apparently Coppola did some In-Camera Effect that took a while to shoot that could of as they say, “Could of took 10 Minutes to shoot”. Coppola also smoked Pot.
Another thing that was alleged, and got the internet turning was the fact that apparently, according to sources, that he pulled women to sit on his lap and tried to kiss female extras to "get them in the mood".
Now on this Article, I don't how truthful it is. In my opinion, these sources could be disgruntled employees who probably got fired or they think they know better and heard it from someone who they heard it someone else. I am not saying It can be true, but I find it convenient that The Guardian would publish this article when the teaser was released and the film is reaching cannes.
And yes I know about his connection and Victor Salva, and yes, what Coppola did was shady and he did help Salva out with Jeepers Creepers. It just proves that Coppola is probably a dick producer.

I'm a 24 year old guy 25 in about 3 weeks and currently single. I split with my ex partner at the end of last year on good terms as we kinda just realized our futures looked really different from one an others despite caring for eachother. Since the split I've gotten back into shape and coaching, started volunteering again and working with kids which I missed, spending good times with mates and overall just living good.
I've said to people that I don't mind if I have a relationship or not but truthfully I do. I wanna take a girl dancing under the stars on the beach, someone to snuggle up and watch movies with my cat with and argue with over dumb things with. But I'm scared I won't find that again. I know I'm happy and I know I'm OK but and doing all the right things it just feels like a piece is missing from the puzzle and I don't really know how to wrap my brain around it.
Like it's so weird and difficult to reconcile with the fact that for the first time ever I don't see taking my life as a way out anymore which means addressing all the emotions and things I never fully had to contend with before because we'll if it all really got to bad I could just not live where as now it's like nah gotta actually deal with it all.

I've been seeing a lot of UNICEF /UNESCO people on roads, pvr, malls literally everywhere trying to sign you up.
The money they collect all go into their salaries and their management. Very sure most of the money you donate isnt reaching the needy.
These people are hired by a few small organization One such is Focus organization which I've seen in coimbatore.
Here is my experience. They once sent me an email for a walk in interview as a business associate in coimbatore.
When i arrived, it was a run down building and on the third floor there was a small room and a dirty, office chair where I saw many of the people working there was taking photos wearing a suit that was passed around.
After the interview they were boasting that they were working with American express, Mercedes etc and you can choose whatever they want.
Then they made us learn a script in Tamil by heart and practice it. Before that they played loud music and made people dance to bring them to ease.
After the script you have to repeat it back to the leaders and they correct you in how to adjust the tone to manipulate and get the sympathy of the people.
Then they make these new hires go with one of their guys into the streets and then started going into shops malls, even colleges and reiterate the script.
Most funny thing was that they were showing a list of names with performers and there was a guy with the last name Bajaj. The owner of this place Dandu Dinesh said that this guy is from the Bajaj family and has a ton of money, but wanted to do his own business so he came to work with their begging scam.
They still lie and hire people with fancy names like business associate and that after 2 years they'll help you start your own business and all.
At the time they were collecting money for SOS organization. But I'm sure a large chunks of the money collected is going into their own pockets as I contacted SOS directly and they confirmed that these guys are taking out huge commissions.
Focus management was the name of this scam organization.
Person acting as HR was Divya
Owner was some Dandu Dinesh.
I quit in the same day and was pissed off. This Dandu even had the nerve to tell me if I'm looking for other jobs, he had contacts with AMEX and all and that he can refer me.
They are scammers. They make money in the name of charity. Nothing less that frauds.
Oh and one more thing. Majority of the staff I saw there were females. Hello guys, i am quite new into EPP / EDR / XDR subject, still learning so my question might be questionable.
I want to test an EDR solution on my VMs for school, and choosed Sophos central but the problem is that i can't understand if i need to install Sophos Central on a VM which would be the VM that manages all the endpoints (i guess) OR if sophos central is only a cloud thing and all i have to do is install enpoint protection on all my endpoints.
Are all EDR solutions like that ? I think i know Trend micro for example works with a central server that manages all endpoint. If you guys can explain this to me.

Professional conduct regulation cases do not support the constitutionality of this rulemaking

The existing broker disclosure obligations as applied to customer agents and principals, though never explicitly validated in the courts, may alternatively be found constitutional as a reasonable regulation of professional conduct that incidentally burdens some speech activities of the persons engaged in that regulated conduct. In that interpretation, the conduct being regulated is that of entering into an agency relationship with a customer or else acting as the principal in a sale to the customer. While a written contract is speech, the assumption of a legal relationship that it embodies is doubtlessly conduct and can be the subject of regulation.
As the Court held in United States v. O’Brien, laws affecting speech that are aimed at the regulation of non-expressive conduct are still analyzed under First Amendment jurisprudence, but face a lower level of constitutional scrutiny than laws aimed directly at the regulation of expressive conduct or at speech activities themselves: “a sufficiently important governmental interest in regulating the nonspeech element [of the regulated conduct] can justify incidental limitations on First Amendment freedoms.”⁴⁷ The compulsion to merely report privately to the IRS and to the taxpayer certain “purely factual and uncontroversial information” about the regulated non-expressive conduct may rightly be framed as an “incidental” limitation on traditional brokers’ otherwise unabridged First Amendment rights.
The O’Brien standard, however, is only applicable if the rule is targeted at regulating non-expressive conduct. Things become more complicated when the rule is targeted at regulating expressive conduct or at speech itself. There is a long though underappreciated line of cases stemming from O’Brien that points toward a reasonably straightforward series of tests for when regulation of professional conduct that burdens speech activities is constitutional. That line has been best illuminated by attorney Robert Kry in his article, “The ‘Watchman for Truth’: Professional Licensing and the First Amendment.”⁴⁸ Kry, summarizing and synthesizing many cases, finds that

In the case of a broker who is, in fact, an agent of a customer or a principal in a sale to a customer, the regulation is plausibly aimed at the non-expressive component of the professional’s activity. An agent under common law principles is acting on behalf of her customer. When a broker agrees to a sale, she binds the customer to that sale. The reporting requirement, therefore, is merely a requirement to disclose certain facts about one’s sales, i.e. one’s conduct as an agent. As a principal in a sale to a customer, the broker is, once again, engaged in conduct, a sale, and the reporting requirement merely discloses facts about that conduct. Additionally, brokers of this type are in most cases already subject to a licensing or registration requirement under other statutes.⁵⁰ Those forms of professional conduct are traditionally regulated and the tax laws merely provide for an additional recordkeeping and reporting requirement associated with that conduct. Altogether, the reporting requirement, though compelled speech, appears to be a regulation aimed at the non-expressive component of a professional’s activity. It is therefore likely constitutional.
As described earlier however, the Treasury Department’s proposed rule inappropriately departs from that customer agent or principal standard and seeks to compel speech from persons who are engaged in no such regulated conduct. A mere publisher or maintainer of software, websites, or smart contracts is not in an agency relationship with any customer, nor is she selling anything to any customer apart from, potentially, a license to use her tools or a fee charged for relaying or publishing the user’s data on a communications network or blockchain. Additionally, unlike typical brokerage, these activities do not trigger any licensing or registration requirements under other state or federal statutory schemes.
Indeed, even when such person is relaying actual cryptocurrency transaction messages that, once recorded in the blockchain, will effect a sale of some cryptocurrency, these entities typically have no actual ability to act on behalf of the user and no actual or apparent authority under agency law to act on their behalf. At most, they can choose whether or not to relay the signed transaction message (but so too can an internet service provider); they cannot alter the contents of that message such that the terms of the sale would change. They cannot and do not act as an agent of any customer nor are they a principal in a digital asset sale to any customer.⁵¹
These persons may be involved in conduct in other ways, such as paying for web hosting services, paying fees on cryptocurrency networks to record software or data in the blockchain, taking fees from users to relay their messages, or simply paying rent or otherwise maintaining facilities wherein they or their employees do the work of developing software or maintaining communications tools, but all of those activities are aimed at engaging in speech, the publication of software and data, and none of those activities give rise to the type of fiduciary or agency-like financial relationship, i.e. conduct, that justifies third-party tax reporting obligations.
Moreover, these persons have deliberately designed their software, websites, and smart contract tooling such that it can be useful to a trader and capable of facilitating their trades or other desires without the need for any agency relationship or for any legal or trust-based relationship with the publisher or any other party whatsoever. The user can and does do it all themselves. That is the point of cryptocurrency and “decentralized finance.” We can debate the merit of such a design goal,⁵² but what is not debatable is that this is how these tools are presently designed.⁵³ By demanding that these publishers rewrite their tools such that an agency relationship is established between the author of the tool and its user, such that the name, Social Security number, and other intimate details of the user are entrusted to the alleged “broker,” the regulation is squarely aimed at compelling not merely the disclosure of trading data and taxable gains, but also the compelled creation of significant expressive software and tooling to solicit and collect data in a manner that would otherwise be antithetical to the goals of the software developer. Such an order is so unprecedented that it is difficult to find appropriate metaphors or past examples. It is as if a state—frustrated that it cannot determine who is reading which books—ordered that novelists shall hold in-person book readings during which they must collect and report information about their audience.
Accordingly, when applied to mere publishers and maintainers of software, websites, and smart contracts, these regulations target the expressive activity of the alleged broker. That does not mean, however, that such rules will automatically be unconstitutional. The Court has dealt with several regulatory schemes aimed at expressive professional conduct, such as a lawyer giving legal advice to a client. Throughout these cases the Court has developed a robust series of standards for constitutionality that are focused primarily on “which kinds of advice are licensable based on how closely they resemble forms of communication associated with fiduciary relationships.”⁵⁴ This leads us to the second question in Kry’s analysis of the First Amendment limits to regulating professional conduct, what he calls the “value neutral test” because it applies irrespective of whether the speech affected is a matter of public concern and irrespective of the motives of the speaker:

Given the in-person and client-specific nature of legal services, there should be no surprise that under these cases the professional regulation of attorneys, including licensing, limits on solicitation and advertising, and—as in this rulemaking—compelled disclosures, typically withstands constitutional scrutiny. In the context of developers of cryptocurrency systems, however, the answer to Kry’s twin questions of characteristic-dependence and person-to-person context is an unqualified “no.” It is taken as written that software, websites, and smart contracts in the cryptocurrency space are built such that they are generic, serving the needs of whoever wants to use them irrespective of the characteristics of that user. It is also a given that these tools are shared widely over the internet and used freely by whoever happens to download them or (in some cases) whoever pays to license the software or pays to have their transactions relayed by the software. As such, they are never “delivered in the context of a person- to-person relationship.”⁵⁶ Accordingly, regulation of the speech activities of these developers, including compulsions to report and develop expressive software that enables that reporting, would face strict scrutiny by the Court and be found unconstitutional.
While these standards are general principles that are equally applicable to any kind of expressive conduct regulation, it is nonetheless worth noting that several of the cases that first articulated these standards dealt explicitly with speech, including software, that advised and facilitated sales of valuable assets. As such, the speech in question in these cases was very similar factually to the speech that would be burdened under the Treasury Department’s proposed rule. The value-neutral test was developed in Lowe v. SEC, a case involving the unconstitutional application of the Investment Advisers Act to a person merely publishing a public newsletter,⁵⁷ and it was further reinforced in Taucher v. Born⁵⁸ and two similar cases⁵⁹ dealing with the unconstitutional application of the Commodities Exchange Act to the developers of commodities trading software.⁶⁰

My sister has what we think is onset schizophrenia, or some mental disorder. She started having delusions and hallucinations since 2019 since her relationship with her extremely abusive boyfriend. It seemed to click a light switch in her. Some of the current delusions have to do with my family and how we are evil pedophiles and evil demonic people. Her delusions and coherency got better during her pregnancies but a year after her last pregnancy she ran away from our house last year with my niece and nephew.
She lived with us with her babies for two years where we helped raise them because she was struggling. I have a lot of sympathy for my sister because I know a good amount of what she went through with the guy but feel a lot of anger at this point. I am angry she never decided to go into treatment and let it get this bad, I am angry the courts think it’s safe for her kids to stay with her even though it constantly feels like she’s having some sort of break and on the edge of doing something stupid, I am angry my relationship with my niece and nephew are severed and being replaced with a fake memory of what is actually was.
But most of all it hurts me how it feels like I will never get my little sister back and the relationship we had. She was bright, witty, smart, and one of my favorite people. I love my sister. I always envisioned us accomplishing our big dreams and growing old together and causing mischief. She would have been the bridesmaid at my wedding and I wanted all of those stupid experiences with her.
It seems, up to now, she truly believes everything she deludes and it just becomes part of her fake memories. So I just have to live with the fact that my niece and nephew will grow up thinking that I am a evil pedophile and that our family is evil when it couldn’t be further from the truth.
It hurts because I truly feel confident in saying that I tried my best to be the best sister and auntie to those kids and those experiences seem like they disappeared into the abyss and feel like just a dream to me. I want to just shake my sister and tell her to wake up and come back. I’m angry at mental illness, I’m angry that she continued doing weed because it made everything worse for her, I’m angry at myself that I stopped living my life the past years to help her in any way, I’m angry at the kids father for hurting her that bad that she felt she needed to numb herself to that extent.
At this point my entire family has to move on and continue living their lives. How do you move on knowing your sibling is still alive and they believe you are evil? Also with the fear that anything could happen and she could kill herself or her kids and there’s absolutely nothing you can do about it?
My fiancé thinks it’s extreme in a way but my brain has started to think of them as deceased at this point. I want to grieve this in a healthy way and I don’t know how. It’s such a wild, complicated situation. I just need to put this aside, being as we’ve been told there is nothing we can do, and start living my life for myself again.
I also wanted to know if there was anyone out there who dealt with anything similar with the mental health of a family member and what your journey was with processing all of it. I’ll talk to my therapist tomorrow about all of this but just wanted to vent and maybe talk to people in a similar situation in the meantime. Life is freaking hard and I can’t stop crying.
