2024.05.21 16:42 sillysky1 Looking for Advice

Hello... I'm a 25F, recently laid off from my position as a Program Supervisor for a Care Management agency. I have my Associate's in Human Services, my Bachelor's in Human Services Management, experience as NYS Office of Mental Health trained Crisis Counselor and a Substance Abuse Counselor. I have applied for over 65+ jobs in the last month and a half in my field. I've gone to dozens of interviews. I feel as though I am crushing the interviews. The main thing holding me back is my lack of a driver's license due to having a medical condition that makes it difficult to hold a driver's license (unmanaged epilepsy). I feel so fucking worthless... I can't seem to find any place willing to take me or they find a better applicant. Is there something I should be doing in the meantime to be improving myself? I've been doing online trainings regarding trauma-informed care, providing services to LGBTQIA+ clients, etc. to better myself, but there seems to be nothing that is working and I can't land a job. I need something to pay the bills and I don't really want to resort to McDonald's or Dollar General if I can avoid it. Please, any advice, would be greatly appreciated.

2024.05.21 16:36 Thewanderer63 Titans of war

Chapter 1: The Awakening
The year was 2145, and humanity was at the brink of collapse. Nations had crumbled, and the world was now divided into warring factions. The discovery of ancient titans-massive, biomechanical war machines buried deep within the Earth's crust-had set the stage for a new era of warfare. These titans, remnants of a forgotten civilization, were the ultimate weapons, capable of leveling entire cities with a single strike.
In the heart of the desolate wasteland that was once Europe, the Northern Alliance fought fiercely against the Red Dominion. Tanks rumbled across the battlefield, their treads crushing the scorched earth beneath them. Soldiers, armed with advanced pulse rifles, exchanged relentless gunfire. But amidst the chaos, the true titans of war lay dormant, waiting to be awakened.
Captain Elena Drakovich of the Northern Alliance stood atop a hill, her keen eyes scanning the horizon through the scope of her rifle. Her unit had been tasked with locating and securing one of these legendary titans, rumored to be hidden in an ancient bunker deep within enemy territory. It was a mission that could turn the tide of the war, but the risks were unimaginable.
"Captain, we have visual confirmation of the bunker entrance," Sergeant Liam Hayes reported, his voice crackling through the comms. He pointed to a partially collapsed structure barely visible through the smoke and debris.
"Good work, Sergeant," Elena replied. "Squad, prepare to move out. This is our chance to make history."
As they approached the bunker, the ground trembled beneath their feet, and the air was filled with the scent of burning metal. The sound of artillery fire echoed in the distance, a constant reminder of the ever-present danger. Elena's team moved with precision, their training and discipline evident in every step.
Inside the bunker, the air was thick with dust and the stale scent of decay. The walls were adorned with ancient symbols, glowing faintly in the dim light. At the center of the vast chamber lay the titan, its colossal form covered in a thick layer of dust and cobwebs. It was a sight to behold-a towering behemoth of metal and flesh, a fusion of technology and organic matter.
"Captain, this is incredible," Liam whispered, awe evident in his voice. "We need to get this thing operational."
Elena nodded, her eyes never leaving the titan. "Get to work, everyone. We don't have much time."
As the engineers began their work, the ground above them shook violently. The Red Dominion had discovered their presence and was closing in fast. Tanks and troops were converging on their location, intent on stopping the Northern Alliance from securing their prize.
"Hayes, secure the perimeter. We need to buy some time," Elena ordered, her voice steady despite the growing tension.
Outside the bunker, the battle raged on. Northern Alliance soldiers dug in, using the terrain to their advantage as they repelled wave after wave of Dominion forces. Tanks roared across the battlefield, their cannons thundering as they exchanged fire with the enemy. The air was filled with the deafening sounds of war.
Inside, the titan's eyes flickered to life, a deep, resonating hum filling the chamber. The ancient war machine began to stir, its massive limbs creaking as it slowly came online.
"We've done it, Captain!" an engineer shouted, his voice filled with triumph. "The titan is operational!"
Elena's heart pounded in her chest. "Excellent. Now let's show the Dominion what happens when you awaken a sleeping giant."
The titan rose to its full height, towering over the battlefield. With a deafening roar, it unleashed its fury upon the enemy. Plasma cannons blazed, and missiles streaked through the sky, leaving trails of fire in their wake. The ground shook as the titan's massive feet crushed tanks and fortifications beneath them.
The Red Dominion forces, caught off guard by the sudden appearance of the titan, scrambled to regroup. But it was too late. The titan, driven by a relentless, ancient rage, tore through their ranks with unstoppable force. Soldiers fled in terror, and the once imposing Dominion tanks were reduced to smoldering wrecks.
As the dust settled, the battlefield fell eerily silent. The titan stood amidst the ruins, a testament to the Northern Alliance's newfound power. Elena climbed to the top of the titan, looking out over the devastation. She knew this was just the beginning. With the titan at their side, they had a fighting chance to reclaim their world from the brink of destruction.
"We've awakened the titan," Elena said, her voice resolute. "Now, let's finish this war and rebuild our future."
The journey ahead would be fraught with danger, and the cost of victory would be high. But with the titans of war on their side, the Northern Alliance was ready to face whatever challenges lay ahead. Together, they would forge a new era, one where the titans roamed the earth once more, and humanity rose from the ashes of its past.
Chapter 2: The Reclamation
(To be continued...)

2024.05.21 15:01 FelicitySmoak_ Tuesday, May 21, 2013 - Jackson v. AEG Live Day 15

Tuesday, May 21, 2013 - Jackson v. AEG Live Day 15
Trial Day 15
Katherine, Rebbie and Trent Jackson are at court.
LA Times reported that the Jacksons offered a settlement.
Kevin Boyle , a lawyer for Katherine Jackson and Michael's kids , said they offered to settle the lawsuit against AEG, but that they never got an answer. Kevin Boyle said the family made the offers in January & March. Boyle would not provide details but said AEG's insurance would have paid, which means they could have settled the case without them paying a dime of their money. He said AEG has never offered to settle & they haven't apologized.
Marvin Putnam, an attorney for AEG, said it was inappropriate to discuss settlement discussions:
"We don't settle matters that are utterly baseless. We believe that is the case in this matter. I can't see why we would consider a settlement as anything other than a shakedown"
CNN Reports there was a snack controversy during trial: AEG lawyers gave a bag of peppermint candy to the bailiff to hand out to the jury this week. Even Katherine Jackson enjoyed the treat but Jackson's lawyer raised an objection, suggesting jurors might be influenced if they realized the source of the sweets. A compromise was reached. Each side can provide snacks for jurors, but they'll be placed at the bailiff's desk before jurors enter court so they have no clue who brought it.
Shawn Trell Testimony
Jackson direct
AEG Live General Counsel, Shawn Trell, told jurors that he had forgotten that Kenny Ortega was working under a signed contract.
Trell said he met with his attorneys last night and reviewed one doc -- Kenny Ortega's contract.
"He had a written contract," Trell said. "I remember the email dynamic. I'm not too proud to admit that I didn't recall the cover contract," Trell said he was changing his previous testimony to add that Ortega had a written contract, not only emails between him and AEG
Next topic was Insurance: Cancellation/Non-Appearance/Sickness. Trell said he started working on insurance for the tour in November of 2008. Panish showed several chains of emails where the parties talked about the insurance for the tour
Email from Bob Taylor insurance broker to Trell on 1/7/09:
"Prior to speaking with carriers we ask the artist to attend medical with a doctor...A full medical with both blood/urine tests. The doctor also wants to review the medical records over the last 5 years to ensure full disclosure. Insurers require further medical examination to be carried out by their nominated doctor. They may restrict illness coverage or death from illness coverage until this examination has taken place"
Email from 4/30/09 - Wooley to Trell :
"We have no coverage against Michael sickness unless and until he submits to another medical in London
Email from 5/28/09 - Trell to Taylor:
"We really need to get that medical done"
Email from 6/23/09 - Trell to Taylor :
"Any update on the availability of Term insurance?" (life insurance)
Trell said if they secured life insurance, they would get money if Michael died.
"We would get the money owed to us, yes," Trell testified.
Trell also said he continued discussions with an insurance broker about additional coverage to recoup AEG Live's investment if the tour had to be canceled.
Email from 6/24/09 -Taylor to Trell :
"Insurers have refused to move on this. Huge amount of speculation in the media regarding artist's health. They feel if they're to consider providing illness to cover this particular artist, they must have very through medical report"
Email from 6/25/09 - Gongaware to Taylor :
"If we don't get sickness coverage, we are dropping this policy"
Email from 6/25/09 - Taylor to Gongaware :
"The consultation in London is critical. The doctor is holding the afternoon of the 6th July open at Harley St. But keep in mind the visit could take 2 hours plus"
Next topic: Budget/Costs. Panish showed an email from AEG's Rick Webking to Michael's estate with 1st report of artist advances/expenses. This was a letter sent to the estate containing the expenses incurred, Trell said.
"It seems to me we submitted this report for their review, I don't see any request for payment," Trell said.
Trell said he spoke with Randy Phillips and Paul Gongaware about Michael's physical condition prior to coming to testify.
"I had heard about rehearsals in which Mr. Jackson was fantastic," Trell said
Trell said he's aware of email from Ortega saying doctor was not allowing Michael to attend rehearsal on June 14, 2009.
"I was aware of the doctor not allowing him to attend rehearsal," Trell said
Email from 6/17/09 from Phillips:
"...Ortega, Gongaware, Dileo, and his doctor Conrad from Vegas and I have an intervention with him to get him to focus and come to rehearsal"
Email from 6/17/09 from Gongaware to Phillip's assistant:
"We need a physical therapist and a nutritionist"
Email from Production Manager - Gongaware/Phillips on 6/19/09 :
"Paul/Randy I'm not bring a drama queen here. Kenny asked me to notify you both Michael was sent home without stepping foot on stage. He was a basket case and Kenny was concerned he would embarrass himself on stage, or worse yet, be hurt. The company is rehearsing right now, but the DOUBT is pervasive"
Email from Randy Phillips to Tim Leiweke on 6/19/09 :
"We have a huge problem here."
"I think he recognized there was a problem on the 19th," Trell said. "I would take it seriously, as I believe Mr. Phillips did."
Trell agreed with a statement by plaintiff's attorney, Brian Panish, that company executives knew by then there was a "deep issue" with Jackson
Does Trell consider that exchange a "red flag" that AEG Live should have noticed, Panish asked.
"I would take it seriously, as I believe Mr. Phillips did," Trell answered. "I don't know I would use the word 'red flag'
One of the emails shown to the jury was from Jackson estate co-executor John Branca, sent 5 days before Jackson's death & marked 'confidential':
"I have the right therapist/spiritual advisosubstance abuse counselor who could help (recently helped Mike Tyson get sober and paroled) Do we know whether there is a substance issue involved (perhaps better discussed on the phone)
The email was sent the same day that a meeting was held at Jackson's home with Murray. No further info given to jury.
Trell said Mr. Phillips never told him about this email
Email from Ortega to Randy Phillips on 6/20/09: (chain of emails)
"I honestly don't think he is ready for this based on his continued physical weakening and deepening emotional state"
Trell said he didn't see these emails. He said he spoke with Randy Phillips about Phillips' perception of Michael, in order to prepare for testifying, but not about specific emails. Trell has been designated as the most qualified person to speak on behalf of AEG
Email from Phillips to Gongaware on 6/20/09 at 1:52 am :
"Tim and I are going to see him tomorrow, however, I'm not sure what the problem is Chemical or Physiological?"
From Gongaware to Phillips, on 6/20/09 at 5:59 am :
"Take the doctor with you. Why wasn't he there last night?"
From Phillips to Gongaware, on 6/20/09 at 2:01 pm :
"He is not a psychiatrist so I'm not sure how effective he can be at this point obviously, getting him there is not the issue. It is much deeper"
Trell said Randy Phillips went to a handful of rehearsals, three at the Forum and two at Staples Center. The head of the marketing department attended rehearsal on June 23, 2009.
"She was blown away by it," Trell testified.
He said he was unaware of issues with Jackson at rehearsals.
"I knew of no problems with Michael Jackson at all",Trell testified.
Trell said he never saw the emails from Phillips directing people to exclude images from This Is It of Michael looking "skeletal" while rehearsing.
"What were his observations of Michael's physical condition during rehearsal," Trell said. "I asked for his (Phillips) personal opinion."
Next line of questioning is about human resources and background checks. Trell said they can be valuable and useful tools when hiring. Background check costs around $40 to $125. Trell said AEG Live could afford this fee. "We don't do background checks on independent contractors," Trell said. Trell said he was involved in the hiring by AEG Live for the This Is It tour. His department was responsible for retaining independent contractors. Trell said he is not familiar with background check process for hiring.
"I am not familiar with the process of doing background checks," Trell said. "No training."

Panish: "There was no hiring criteria for the This Is It tour, correct?"
Trell: "Not to my knowledge"
Trell testified that when it comes to independent contractors, they have either worked with the artists, AEG or known in the industry. Trell agreed that no background check was done on anyone working on the This Is It tour. AEG Live General Counsel Shawn Trell told jurors that no legal or financial checks were done involving Conrad Murray or anyone else who worked as an independent contractor on the This Is It shows.
Depending on the nature of the position, a background could be done, Trell said, like for potential employees in the financial area. Trell said he thought a background check would be appropriate for people working in financial roles, but not tour personnel who weren't employees of AEG
As to independent contractors, Trell said there's no supervision and monitoring like there's for employees
Panish: "You don't do anything to check into background, supervise or protect the artist?"
Trell: "No, safety is a concern"
Trell said that AEG did not hire Murray, that the doctor was like many independent contractors,
"When they leave the environment, what they do on their own time is their own business"
Trell testified he doesn't believe the artist is more at risk because AEG Live doesn't do background checks
"We did nothing to monitor Dr. Murray," Trell said. "We did not monitor whatever it was that he was doing, no."
"It called for Michael Jackson being able to terminate Dr. Murray at will," Trell said about the contract. "If the concerts didn't go forward, and he was terminated under this provision, Dr. Murray would not be paid going forward," Trell explained
As to Dr Murray being under dire financial straits, Trell said that he doesn't know if he agrees with it, everyone's perception is different
Trell: "I certainly wasn't aware of it at the time"
Panish: "Because you didn't check, right?"
Trell: "That's right"
"I don't think conflict of interests are a good thing, and we would want to prevent it," Trell said
Email from Kathy Jorie to Shawn Trell on 6/24/09 at 12:54 am:
Subject: Revised agreement with GCA Holdings/Dr. MurrayIt had two attachments Attachments: Revised Michael Jackson -AEG GCA Holdings Murray Agreement 6-18-09 Final MJ -- AEG GCA Holdings Agreement (Dr. Murray) 6-23-09
Email chain from 6/23/09, 5:39pm from Jorrie to Wooley, Murray
Subject: RE: Michael Jackson - Revised Agreement with GCA Holdings/Dr. Murray Email:
"I have redlined the Word version so that you can see all of the revisions. In addition, I've attached clean PDF version for execution" (The email says that if Dr. Murray approved it, he was to print it, sign and send it back to Jorrie)

Panish: "Did Ms. Jorrie call this contract a draft?"
Trell: "She called it a Final Version"
"Every document is a draft until it is executed," Trell said.
Panish showed emails exchanged among AEG executives that contained drafts of Murray's contract. Although Murray had signed a contract with the company, neither Jackson nor anyone from AEG had added their signatures. Trell testified that a copy of the contract had never been sent to Jackson
With Trell on the stand, Panish played part of an interview that AEG Live President Randy Phillips gave to Sky News television soon after Michael's death.
"This guy was willing to leave his practice for a very large sum of money, so we hired him," Phillips said.
Panish also showed jurors an e-mail between AEG lawyers suggesting that Phillips told other interviewers AEG Live "hired" Murray.
Panish: "Isn't it true that Randy Phillips made numerous comments that AEG Live hired Dr. Murray?"
Trell: "I know he has made that statement"
Panish said AEG higher-ups became concerned after Phillips made such admission. Trell said he didn't know if that was true. Bruce Black is the General Counsel for parent company of AEG and AEG Live. Michael Roth is AEG's media relations
Email from Kathy Jorrie to Bruce Black and Michael Roth on 8/25/09:
Subject: AEG Live president says AEG Live hired Dr. Conrad Murray
Panish shows Trell a deposition, under oath, given by insurance broker Bob Taylor on another case. Trell said he has never seen or read it. Trell denied having a telephone conversation with Mr. Taylor where Trell asked him if a doctor's compensation was covered in the insurance.
Panish: "Does that refresh your recollection that AEG was employing Dr. Murray?"
Trell: "Mr. Taylor has this completely wrong"
After lunch break, Brian Panish asked if Shawn Trell wanted to change anything else in his testimony, to which he said "No"
Bruce Black, attorney for Anschutz, was present in the meeting with LAPD. Trell met with the police on 1/12/10. Trell told the police that day that Dr. Murray would receive $150,000 compensation per month. Trell also said that Dr. Murray requested and AEG would provide necessary medical equipment and a nurse. More than five months after Jackson's death, Trell said, he informed LAPD detectives that Murray initially requested $5 million to join the tour but eventually agreed to a salary of $150,000 a month for 10 months.
Panish: "As far as you know, all the agreements written for TII tour was done under AEG Live Productions, right?"
Trell: "Yes"
Panish: "Was Dr. Murray trying to help AEG get insurance?"
Trell: "The policy was in both names, so he was helping both parties"
Trell said Dennis Hawk, who represented Michael, was in touch with Taylor regarding the insurance
Panish: "As of June 2009, you don't even know whether Mr. Jackson had a personal manager
working for him, right?"
Trell: "Well, my understanding at the time there were a couple of people acting in that capacity"
Email on 6/2/09 from Randy Phillips to Jeff Wald:
"Jeff, remember getting Michael to focus is not the easiest thing in the world and we still have no lawyer, business manager, or, even real manager in place. It is a nightmare!"
Trell said the only time he saw an artist's signature required to retain an independent contractor was for Dr. Murray. Trell said his understanding was that Dr. Murray worked for Michael for 3 years; didn't know how many times MJ saw Dr. Murray.
"I've never spoken with Dr. Murray ever. And I met/spoke with Mr. Jackson once," Trell said.

"He was a significant expense," Trell testified about Dr. Murray.
Trell said AEG Live didn't do anything to check Dr. Murray's competency as doctor, other than checking his physician license. Trell said AEG didn't do anything to determine Dr. Murray's financial conditions in 2009.
Jury was shown an email that Phillips sent to Kenny Ortega on night of June 20, 2009. It was email urging Ortega to stand down.
Email on 6/20/09 Phillips to Ortega :
"Kenny it's critical that neither you, me, anyone around this show become amateur psychiatrist/physicians. I had a lengthy conversation with Dr. Murray, who I am gaining immense respect for as I get to deal with him more. He said that Michael is not only physically equipped to perform & discouraging him to will hasten his decline instead of stopping it. Dr. Murray also reiterated that he is mentally able to and was speaking to me from the house where he had spent the morning with Michael. This doctor is extremely successful (we check everyone out) and does not need this gig so he is totally unbiased and ethical"
Panish asked Trell whether Phillips "characterization to Ortega, given no background check was done, was a lie". Trell responded that he didn't know what Phillips knew or was thinking when he wrote that email to Ortega. Trell also said he expected Randy Phillips to testify at some point during the trial, so he could address the email himself
Panish then asked Trell, "Sir, you never checked out one single thing about Dr. Murray -- you've already told me that, correct?"
"As of the date of the email, that would've been correct",Trell said.
When pressed by Panish, Trell said that Phillips' statement that Murray had been checked out, along with the executive's claim that the doctor 'does not need this gig' were inaccurate.
"I don't know where Randy's understanding or impression comes from", Trell said.
Trell testified that Phillips might have been "misinformed" or simply was stating his impression of the Las Vegas cardiologist
Panish: "But no one at AEG checked Dr. Murray to see if he was successful or not, isn't that true?"
Trell: "Yes"
Panish then asked several pointed questions about whether Shawn Trell agreed with Phillips telling Ortega they'd checked Murray out. One of Panish's questions was whether Trell thought Phillips' email was 'acceptable conduct'
Panish called Phillips' statement "a flat out lie" and asked Trell whether he agreed with it or if it signified how AEG did business. Trell said he didn't know what Phillips thought he knew when he wrote the message.
"I know this statement is not accurate, but you'd have to speak with Mr. Phillips about what he thought or meant in saying it," Trell said.

Panish: "That's a flat out lie, isn't it sir?"
Trell: "I don't know what Mr. Phillips intended to say, this should be a question to him"
Panish: "You don't know if he was successful or facing bankruptcy, did you?"
Trell: "No"
Trell: "I know the statement is not accurate. You have to speak with Mr. Phillips about what he meant to say"
Panish: "Do you agree with the CEO of your company making untrue statements?"
Trell: "I don't know that he didn't know it wasn't true when he said it"
Trell said Phillips never told him that he checked Dr. Murray out. As to reference in Phillips' email about Dr. Murray being unbiased, ethical, not needing this gig, Trell said it was Phillips' impressions. He said AEG typically only runs background checks on candidates applying for full-time jobs with AEG, not independent contractors.
Panish: "Isn't it true AEG Live does not do background check on independent contractors?"
Trell: "That's true"
Trell said that no one from AEG interviewed Dr. Murray because he was an independent contractor.
"Did anyone from AEG ever at any time interview Dr. Murray", asked Brian Panish
"No", Trell replied.
Panish showed a document used by AEG entitled "Disclosure and Authorization to Conduct Background Check". Doc is used for employment, promotion, retention, contingent or the rate staffing, consulting, sub-contract work, or volunteer work. Panish asked if there was any reason why Dr. Murray was not given a background check.
"He wasn't an employee, he wasn't applying for a full time position with the company," Trell explained.
Trell said theoretically they could've asked to check Dr. Murray's background and credit.
AEG Cross
Jessica Bina began her examination by showing the letter submitted by AEG's CFO to the Estate of Michael Jackson for their review. She asked Shawn Trell about the estimate presented to Jackson's estate that included Murray's $300k fees. She asked why it was prepared. Shawn Trell said it was done at the request of the estate. He said Jackson's estate wanted to know state of tour finances when Jackson died. Trell said the report was requested by the Estate after a series of meetings after Michael's death.
"The purpose of the meeting was to wind up the business affairs of the tour due to Michael's death", Trell said. "It was my understating in June Tohme was back in the picture in some capacity. I'm not sure which, Mr. DiLeo was in it too," Trell said
Bina: "Is there any request for payment?"
Trell: "No, there's no demand for payment, it's for review"
Stebbins Bina asked about the inclusion of Murray's fee in the document. Bina showed the report that was attached to the letter. Murray's fee on the document had a footnote. Trell read what that footnote said, and explained why estate wasn't asked for Murray's fee. Next to "Management Medical" there's a reference to footnote 3.
Note 3: 'Contract is not signed by Michael Jackson and such signature was condition precedent to any payment obligation' - Footnote on Murray fee.
Trell testified Webking, the CFO for AEG, did not ask Michael's Estate for payment of Dr. Murray's salary
"You testified you were somewhat confused (by the inclusion of the $300,000)?", Bina asked Trell as she projected the list, dated July 17, 2009, on a screen for jurors.
"Do you see there's something in parentheses?', Stebbins Bina asked, zooming in to blow up a footnote from AEG CFO Frederick Webking that stated Michael Jackson never signed Murray's contract, so its terms were not enforceable.
"Is Mr. Webking asking the estate to pay?", Stebbins Bina asked Trell. "No", he replied, explaining that upon reflection he believed Mr. Webking was just being 'thorough' by including the $300,000 as a budgeted cost.
"Did Mr. Webking make a mistake as you thought yesterday?",she asked.
"No, he did not", Trell answered
Second report made to the Estate on 9/18/09, there was no amount next to management medical. Stebbins Bina then showed a Sept. 2009 report of This Is It's finances to Michael Jackson's estate. Murray's fee is not listed in that document
Trell went through his job description with AEG. He said he has five lawyers in his department and has worked on thousands of agreements. Trell explained what PMK is -- Person Most Knowledgeable, identified by the company to testify on its behalf. Trell said he didn't know about all the topics he was designated, so he had to do some studying and interviews with people
As to Ortega's contract, Trell said he was aware of a string of emails being at least a part of the original agreement with Kenny.
"When we were done here yesterday, I looked at Kenny Ortega's original agreement," Trell said.
Trell noted he hadn't looked at Ortega's agreement since it was entered into in 2009. Before the afternoon break, Trell and jury were shown Kenny Ortega's tour agreement. It was signed in April 2009. The agreement was three pages of legalese, with several pages of emails attached that confirmed the terms. The first three pages included some paragraphs that described who owned the rights to This Is It content. A large number of emails are part of the agreement as exhibits. Trell said he recalled the emails exchange and admitted again not being proud of forgetting the cover contract portion. Bina showed Ortega's executed contract with everyone's signature on it. Trell said Kenny Ortega was paid after his contract was signed.
Trell, Phillips and Kathy Jorrie were involved in drafting and negotiating the contract with Michael Jackson. For MJ, Trell said Dr. Tohme Tohme and attorneys Dennis Hawk and Peter Lopez represented him. He said there were multiple drafts.
"It's my understanding they were talking to, or at least receiving offers from, a competitive of ours, Live Nation," Trell said.
Trell also said that before signing an agreement with AEG, Jackson had been considering a tour offer from its main competitor, Live Nation.
Bina showed the jury the final tour agreement. Trell said he went to MJ's home at Carolwood to sign it. Upon arrival, Trell said Mr. Jackson got up from where he was seated, and said 'Hi, welcome, I'm Michael." Trell said it was pretty funny, since he was a very distinct person. Trell said they shook hands, he had a good firm handshake and his voice was not what people think
"He popped up, came over, introduced himself, was very cordial, there was a real positive energy, good vibe in the room," Trell said. "He seemed genuinely enthused," Trell added. "He had the contract in front of him, said he read every page, seemed very enthused." Trell said they all signed it and Mr. Jackson was really keen on the 3-D stuff, that he was already down the road in his mind. "I was probably there just a little less than an hour. And that was the only time I met him," Trell recalled.
Bina discussed the contract for the tour agreement:
A first class performance by Artist at each show on each of the approved itineraries. Contract:
Artist shall perform no less than 80 minutes at each show, and the maximum show length for each show shall be 3.5 hours. Artist shall approve a sufficient number of shows on itineraries proposed by promoter or producer as to recoup the advances made.
Trell said compensation was agreed on 90-10 split. Artist received 90% of what's defined contingent compensation.
Trell explained to jury how concerts get paid for. One scenario is artist pays for production up front. A second scenario is that the promoter gives artist an advance, and then they use the money to put together the show. The third option, Trell said, is the artist pays someone like AEG Live to produce and promote the show, with costs to come out of their pay. Trell called the second and third option like an interest-free loan. In Jackson's case, AEG agreed to a 90/10 split of show's proceeds. Jackson would have received the 90% portion, Trell said. Jackson was also on the hook for a 5% production fee
AEG Live was promoter & producer.
"We advanced the money necessary to mount the tour," Trell explained. "It's interest free money".
Trell testified that Jackson's advance, which covered his $100,000-a-month rent on his mansion and a $3-million payment to settle a lawsuit that would free up his performance rights, was considered a loan to be paid back to AEG.
Part of the advance was to pay off the settlement agreement of $3 million in London court. The underlying dispute was that a company owned the rights for Jackson's live performance.
"The rights needed to be freed up," Trell said.
The advances were to be paid back to AEG Live before the split of revenue. Production Advances were capped to $7.5 million. Contract:
Artist was responsible for all the production costs in excess of the cap and had to reimburse promoter.
"Michael Jackson was known to have very elaborate productions," Trell said. "Production values can get significant, for lack of a better word, it really depends on how many bells and whistles they want," Trell said.
Trell said AEG would not advance money without the artist requesting it.
Trell said it's not only typical and customary, but standard and artist needs to secure either non-appearance or cancellation insurance. Their interest in the policy, Trell said, was to cover the advances and production costs incurred with the production of the show.
"If the were no obligations to AEG, the payout would go back to the artist", Trell explained, "It just recoups our loan made to the artist."
Trell was also asked about elements of tour insurance policies and an agreement with former manager Tohme Tohme. Jackson's contract called for him to represent to AEG that he didn't have any health conditions that would keep him from performing.
Contract:
Artistco hereby represents and warrants that artist does not possess any known health conditions, injuries or ailments that would reasonable be expected to interfere with Artist's first class performance at each of the shows during the term
Oh Tohme's $100k per month agreement, Trell was shown a January contract that Jackson signed to pay that amount. However, Trell said Tohme's agreement was predicated on Jackson getting tour cancellation insurance by a certain date. Deadline passed and by that point Tohme was no longer Jackson's manager, so he wasn't entitled to be paid his monthly fee.
January 24, 2009 -- agreement entered with Dr. Tohme Tohme. Trell said Michael was involved and signed this agreement. "This agreement was entered into January 26, Trell testified.
"There are conditions that needed to be met before any payment could be made."
One of the the conditions was placement of non-appearance insurance, Trell said. That placement was done in late April, early May. In May, AEG received letter from MJ saying Tohme didn't rep him anymore.
"No payments were ever made under this agreement," Trell explained.

2024.05.21 14:53 spyonno Dichiarazione redditi da azienda estera

Salve a tutti!

2024.05.21 14:13 OpiumBaron Inducing altered states of consciousness

Hi! I was reading about the various brain waves such as alpha, gamma etc.
This reminded me of the times I've been able to induce altered states in myself, I thought I'll do a little summary of what I have experienced.
Obvious nr 1 altered states induced trough plants, mushrooms and synthetic alkaloids, exogenous means. Psychedelics no doubt can be tools to reach very deep states of the subconscious and even a bridge to the "mind of the cosmos itsel.
Endogenous means. Dreams. During sleeping, drifting in a creative matrix with various levels of lucidity. Lucid dreaming being the peak state here. I've had dreams of such HD quality, able to steer the dream according to my whim. Flying, creating things trough pure thought. Surprised how I felt the wind and similar phenomenon. Always amazed at the intelligence of the dream as well, I've seen entire landscape arranged in extremely genius and artistic ways within seconds, reminds me a bit of AI and how it creates things I've u seen the ai pics online.
Hypnagogic state before falling asleep. If I for various reasons try to sleep, but have just a little to active mind or concentrate, eventually will feel the shift to deeper brainwaves. This state of like "liberating" the mind from its shackles. I'm able to visualize at extreme efficiency, make very profound realizations and also create music, feeling etc. it's like being in a 4D studio.
Trance state which I believe is common in African tribal dance, shamanic ceremony etc, often induced trough more energetic violent means such as dance, drums etc, it's also a letting go while doing these activities, similar to the hypnagogic state, but if hypnagogic state is like being in a sea on a clear sunny day a trance feels like being in a stormy ocean. Dynamic breathing can bring me here too, here things and experiences reveal themselves to me and I def get the "possession" aspect, u get possessed by archetypes.
Meditation is for me the state which being a luminous very clear state when practiced right, that can bring experience of non duality, bliss, merging with light and feeling clear and merged/non dual experience.
Daydream: a very light state somewhere just below the awake state, but really cought up in some sort of thought
These come to mind now and I've experienced all these states personally. I believe for true knowledge you cannot simply rely on the waking everyday consciousness but must learn to truly control the mind. I was somehow born with high intuition, existential/inner ability, and high empathy, whereas some of my family members where great with math but not so much existential intelligence and so on.

2024.05.21 14:13 -She-Beast- Our VOICE, a local nonprofit, addresses sexual harassment in the food and beverage industry.

Our VOICE, a local nonprofit, addresses sexual harassment in the food and beverage industry.
That’s just what it’s like working in a bar,’ some say.
Others might push it aside for financial reasons — ‘Don’t you want more tips?’
But local advocates say addressing sexual harassment and sexual violence is key to preventing it from continuing. Especially in the hospitality industry, where it is prevalent.
A 2018 Harvard Business Review study of 76 female college students working in food and beverage service jobs found that more than two-thirds reported experiencing sexual harassment each month of the three-month study. The most frequent behaviors described included being told suggestive sexual stories, offensive remarks and crude, sexual comments.
On a Monday afternoon in April, a small group gathered at Avenue M, a restaurant on Merrimon Avenue, to learn strategies to prevent and address sexual harassment in the service industry. The “86 It” training, held by Our VOICE, an Asheville-based nonprofit serving survivors of sexual violence and human trafficking, was organized by Asheville Food and Beverage United, a trade group for service workers.
“Harassment can include … unwelcome sexual advances, requests for sexual favors and other verbal or physical harassment of a sexual nature,” according to the U.S. Equal Employment Opportunity Commission. However, “harassment does not have to be of a sexual nature and can include offensive remarks about a person’s sex.” Perpetrators and victims can be of any gender.
Our VOICE prevention educator Mercy Sosa elucidates the many forms harassment can take in the service industry: female staff encouraged to wear makeup and form-fitting clothing; LGBTQ staff pressed to conform to gender norms in grooming and dress; sexist or homophobic jokes; letting unwanted behavior from guests continue due to the mentality that “the customer is always right.”
“We all know [sexual harassment] is something that’s kind of culturally accepted,” says Miranda Escalante, manager and bar lead for Avenue M and a member of AFBU, in an interview with Xpress. “So I think it is important for workers to have the tools and feel safe to say ‘Hey, this is not OK.’”
She continues, “There are owners with reputations in our city, unfortunately, and there are places in our city that have these reputations for not being completely safe for their workers.”
Protecting each other
“86 It” is one of several community trainings offered by Our VOICE. Others include preventing drug-facilitated sexual assault, bystander intervention and preventing sexual harassment in the workplace.
Themes of the trainings overlap, and April’s “86 It” session addressed drug-facilitated sexual assault and how to intervene or interrupt potential harassment or violence. The former can look like drugging, or “roofie-ing,” a person’s beverage, pushing a person to drink more or targeting someone who is already intoxicated, Sosa explains. She notes that assault can still occur if someone has consumed substances consensually.
Our VOICE adult prevention educator Allie Stec addresses the “4 Ds” of bystander intervention: address the behavior directly, distract the parties, delegate or ask for help from someone else and document the behavior. Interrupting behavior can be as simple as telling a worker, “Hey, they need you in the back” to separate the individual from a harasser, Stec says.
TIME TO INTERVENE
Our VOICE prevention educator Allie Stec explains several bystander intervention tactics to interrupt sexual harassment occurring in the food and beverage industry. It can be as simple as one worker saying to another, “Hey, they need you in the back” to separate the worker from a harasser, Stec said. Photo by Jessica Wakeman Asheville City Council member Kim Roney, a former food and beverage worker who attended the “86 It” training in April, encourages people in positions of power to speak up when they see or hear inappropriate behavior.
Cultural setting is an important aspect of addressing sexual harassment in the service industry, Sosa tells the group. Our VOICE suggests a “strong, well-known policy that covers more than the law” and established procedures for how to respond to harassment complaints. Sosa also advises frequent discussions about the policy, as well as trainings like “86 It.”
Unwanted attention
Sexual harassment in the form of unwanted attention can come from customers or co-workers, explains Sosa. Either way, unwanted attention needs to be addressed before the perpetrator escalates the behavior to sexual violence.
Morgan Persky of Woodfin experienced a lot of unwanted attention and touching when she worked in hospitality at a restaurant for a year. She tells Xpress the harassment began after a few months on the job.
The kitchen manager “would kind of corner” the female employees and ask them for hugs, which were “tight” and “lingered,” Persky says. His “hands would be around an arm or back,” and the women agreed that his hugs felt “creepy.” They would try to pivot their bodies to “go in for a side hug,” Persky explains.
Yet this kitchen manager’s lingering hugs were only half the harassment Persky endured. He and some cooks would make comments about her body, both to her directly and talking among themselves. And she says when the kitchen manager hugged her, he would ask, “Why don’t we hang out? You never want to hang out with me!” Persky says she never acquiesced. “I’m sure I made some kind of excuse, like ‘I’m tired,’” she explains. “I didn’t want to be outright rude, because I was afraid of any consequences. I didn’t know if there would be any.”
The owner of that restaurant was regularly on-site. Persky told him how she was being harassed, and he replied, “You need to have thicker skin,” she says. Persky adds that she knew a co-worker came to the owner about sexual harassment by the kitchen manager, too. At that, Persky says, the owner “panicked.”
“He was like, ‘Don’t say sexual harassment! I don’t want to hear that!’” Persky recalls. “‘You can’t go around saying that.’” The owner’s reaction felt as if “he basically told me to shut up and deal with it,” she explains. Angry, disappointed and feeling “trapped,” she quit the job three weeks later.
“I knew it was never going to get better,” she says.
Getting physical
There’s a crucial difference between flirting and sexual harassment, Sosa tells the group convened at Avenue M. Generally speaking, flirting is consensual, and it feels good. Sexual harassment feels uncomfortable or bad, and it happens without the victim’s consent.
Heather Gressett worked in the service industry from ages 13-30, beginning in Chicago. She says sexual harassment wasn’t discussed in her workplace or in school. As a result, she didn’t recognize sexual violence when it was happening to her. “It was just so normalized that even I didn’t know it was wrong,” Gressett explains, adding that so many years in the industry and so many violent experiences may have “desensitized [me] to a lot of stuff.”
In retrospect, Gressett sees more clearly how co-workers violated her, including when she was a minor. “I was sexually assaulted by so many men,” she tells Xpress. At 16 years old, a co-worker in his 30s, who was married with kids, pushed her against a wall and kissed her, she says. And at another restaurant, a co-worker followed her into a walk-in refrigerator, turned the lights off and groped her.
Gressett says she also engaged in sexual harassment in restaurants by grabbing guys’ butts. “We would all just do it to each other — it was like a thing.” Gressett says she cringes when she thinks about her actions now, referring to them as “a trauma response” or coping mechanism. “It was almost a way to normalize my own assaults,” she explains. “If I’m doing this to other people, it’s not so big of a deal, right?”
Seven years ago, Gressett moved to Western North Carolina and worked at several restaurants and breweries here. While she says she saw some problematic behavior — such as brewery owners who would not call a transgendered worker by their correct name — sexual harassment wasn’t as extreme in the service industry here as it was in Chicago. “Maybe there’s a shift in me where I was, like, I’m not going to accept this anymore,” she muses.
Gressett also sees younger people in the service industry demanding to be treated with respect and advocating for their rights. As Escalante from AFBU puts it, young folks are no longer tacitly accepting sexual harassment as part of the job that must be endured. And people like Gressett, who experienced sexual violence in the service industry themselves, are motivated to be more responsible bosses than the ones they had.
Gressett now runs her own business, Lily Mae’s Desserts. She’s currently the only employee, but she’s dedicated to fostering dignity and respect.
“When I do have a staff, I want to set an example for how my work culture is,” she says. “It starts with me, right?”

Am I cooked?

The Advantages of AI-Powered Predictive Modelling Tools

Introduction

Financial forecasting has always been crucial for businesses, investors, and financial institutions. With the advent of AI-powered predictive modelling tools, the accuracy and efficiency of these forecasts have seen a significant boost. In this article, we'll explore the benefits these advanced tools bring to financial forecasting and how they are revolutionizing the industry.

Understanding Predictive Modelling in Finance

Predictive modelling involves using statistical techniques and algorithms to predict future outcomes based on historical data. In finance, this means forecasting market trends, investment risks, and financial performance, among other metrics. AI-powered predictive models leverage machine learning and big data to enhance these predictions.

The Evolution of Financial Forecasting

Traditionally, financial forecasting relied heavily on manual data analysis and expert judgment. However, the integration of AI and machine learning has automated much of this process, allowing for more precise and timely predictions. This evolution has transformed financial planning, risk management, and investment strategies.

Benefits of AI-Powered Predictive Modelling Tools

Enhanced Accuracy and Precision

AI-powered predictive models analyze vast amounts of data quickly and accurately. They identify patterns and correlations that might be missed by human analysts, leading to more accurate forecasts. This precision helps businesses make informed decisions, reducing the margin for error.

Real-Time Data Analysis

One of the standout features of AI-driven tools is their ability to process and analyze data in real-time. This capability allows financial analysts to adjust their strategies promptly based on the latest market trends and economic indicators, ensuring that decisions are always based on the most current information.

Improved Risk Management

Predictive modelling tools can identify potential risks and vulnerabilities in financial plans and investments. By assessing historical data and predicting future trends, these tools help in developing robust risk management strategies, minimizing potential losses.

Cost Efficiency

Automating data analysis and forecasting processes reduces the need for extensive manual labor, cutting down operational costs. Businesses can allocate resources more efficiently, focusing on strategic initiatives rather than routine data crunching.

Better Decision Making

With accurate and timely data at their disposal, financial professionals can make better-informed decisions. Predictive models provide insights that guide investment choices, budget allocations, and financial planning, enhancing overall decision-making processes.

Identification of Market Trends

AI-powered tools can analyze market data to identify emerging trends and patterns. This foresight allows businesses to capitalize on new opportunities, stay ahead of competitors, and adapt to market changes swiftly.

Personalized Financial Advice

For financial advisors and firms, predictive modelling tools offer the ability to provide personalized advice to clients. By analyzing individual financial data, these tools can suggest tailored investment strategies and financial plans that align with each client's goals and risk tolerance.

Fraud Detection and Prevention

Predictive models are also effective in detecting fraudulent activities. By analyzing transaction patterns and identifying anomalies, these tools can flag suspicious behavior, helping prevent fraud before it causes significant damage.

How Predictive Modelling Works

Data Collection and Integration

The first step in predictive modelling is gathering data from various sources. This data can include historical financial records, market data, customer information, and more. The integration of diverse data sources enriches the predictive model's accuracy.

Machine Learning Algorithms

Machine learning algorithms form the core of predictive modelling. These algorithms analyze the data to identify patterns and relationships. Common techniques include regression analysis, decision trees, and neural networks, each suited for different types of predictions.

Model Training and Validation

Once the algorithms are set, the model is trained using historical data. This training phase involves adjusting the model's parameters to optimize its predictive accuracy. Validation is crucial to ensure the model performs well on new, unseen data, avoiding overfitting.

Deployment and Monitoring

After training and validation, the predictive model is deployed in a real-world environment. Continuous monitoring and periodic updates are essential to maintain its accuracy and relevance as new data becomes available.

Challenges and Considerations

While AI-powered predictive modelling offers numerous benefits, it also comes with challenges:

2024.05.21 13:00 Neowza Weekly Advocacy Post

Below you'll find information and links to help advocate for Reproductive Freedoms and Abortion care in Canada and emerging policy issues with the Reddit platform. This is a recurring post and will be periodically updated as needed. Feel free to post additional information and discussions in the comments.
Advocating for Abortion Care in Canada:
Reference: Policy Options, via the Institute for Research on Public Policy and Action Canada for Sexual Health & Rights
What can you do to improve access to abortion care in Canada?
  1. Listen, research and learn. This is always the first step to understand any problem.
  2. Send a letter to your MP and MPP. Tell them that access to abortion care is important and how difficult it can be to access it in your province. Urge them to prevent anti-choice groups and CPCs from receiving charitable status, and to revoke the charitable status from CPCs that already have it. Encourage them to include reasonable reimbursement for travel costs related to receiving medical care when it is not available in your community. And push them to pass Safe Access Zone Legislation to protect patients, practitioners and their staff from anti-choice harassment and intimidation.
  3. Give a donation to a pro-choice charitable organization of your choice. Remember, if you give a total of $201 CDN or more to Canadian charitable organizations, you'll get a credit of 29% of your total annual donations on your income taxes (for those that file Canadian Income Taxes, only).
  4. Sign up for the Abortion Rights Coalition of Canada Newsletter. https://www.arcc-cdac.ca/
  5. Participate in local marches and rallys in support of access to abortion care.
  6. Spread the Word. Tell your friends and family. Encourage them to research, listen and learn. Encourage them to contact their MPP and MPs.
  7. If you work in a Doctor's office or as a family physician, consider incorporating Mifegymiso into your practice to ensure patients have timely access to this essential service. If you are a Doctor, or studying to be one, consider opening an Abortion Care practice when you are licensed and qualified to do so, especially in rural areas where there are a lack of options.
  8. If you work in politics, consider proposing legislation that will ensure safe access zones for abortion care providers and their clients and covering reasonable travel costs for constituents when medical care is not available in their community.
  9. If you are a journalist or work in media, consider preparing pieces sharing the difficulty Canadians can have accessing medical care such as abortions.
  10. If you work in the area of Not For Profit/Advocacy, consider partnering with a Pro-choice organization and helping them spread information and lobby for improving access to abortion care for Canadians.
  11. If you know someone who needs abortion care, consider giving them a ride to a clinic, helping them access the advice and care they need, and provide non-judgemental support.
  12. Ensure persons of First Nations, Metis and Inuit heritage know about Jordan's Principle, which ensures that First Nations children (which includes people who can become pregnant under the age of 18) can access the products, services and supports they need, when they need them. https://www.sac-isc.gc.ca/eng/1568396042341/1568396159824

Emerging Policy Issues with Reddit
On July 1, 2023, Reddit raised the price to make calls to their API from being free to a level that killed every third party app on Reddit, from Apollo to Reddit is Fun to Narwhal to BaconReader. This policy change meant that mobile users would have a lesser experience browsing Reddit, users with visual difficulties could not browse reddit as screenreaders are not compatible with the official Reddit app, and mods lost tools that they depend on to keep communities on-topic and spam-free. Many subreddits protested this change in June 2023, and the Reddit admins enforced draconian measures such as removing and replacing mods who privatized their subreddits in protest of this policy change.
On September 12, 2023, Reddit will eliminate reddit coins, including removing all accumulated coins, a perk that Reddit Premium users pay for every month. Coins are used to reward comments and posts by showing your appreciation for the effort. Some reddit coins offer the ability to use reddit without ads.
In March 2024, Reddit had an IPO (Initial Public Offering), and the founder and current CEO, as well as the COO have sold $500,000 of their shares. How does this effect you? Reddit may face pressure to increase revenues to attract investors. This could lead to more ads or new monetization features. There could also be changes to the platform to attract a wider user base, such as bans and censorship on certain topics or words and control over content to appease more conservative shareholders or users.
What can you do to protest policy changes at Reddit?
  1. Listen, research and learn. Check /modcoord for updates
  2. Cancel your Reddit Premium membership
  3. Participate in subreddit led protests
  4. Look for other forums to patronize. We have a forum on Discord called Auntie Network Canada. Message the mods here for an invite link to the Discord group.
  5. Complain. Message the mods of reddit.com, who are the admins of the site: message reddit: submit a support request: comment in relevant threads on reddit. Leave a negative review on their official iOS or Android app.

2024.05.21 12:45 ThatsWhatThe The cup apology makes me sad ngl

I have been a Greg for years, since like 2016, I have loved that Danny has always been so unproblematic all this time, outlasted so many ngl. He doesn't cover political topics yet still displays positive, non-offensive values.
And I want to clarify, I stand with Palestine, the ethnic genocide that has been happening there is horrendous in every way. But I think a commentary YouTuber is the wrong place to direct that energy and expect thorough knowledge of every single thing going on in the world from. Buying Starbucks does not make you evil.
Starbucks does not fund the war, Starbucks does not contribute to the war financially, they also do not operate in Israel. The company higher-ups have made an unethical and politically bad move (who is shocked, this is a billion-dollar company), but the money from your frappuccino will not kill someone. People who want to boycott can boycott, but you can't expect everyone to do the same.
Danny has been unproblematic throughout his career on YouTube, and he has recently become a father, meaning he has a BABY now. That is a lot of work for anyone, he is a dad now and should be given the space to prioritise his family. He is likely spending less time online these days.
Starbucks sued the Union in October of last year. his kid was one MONTH old, he probably just missed it, as many, many people did.
And because he left a Starbucks cup out in the background of a video of him in his home, in a clip where he is recording a TikTok where he is begging Jake Paul to fight him, I do think that that is a leap to presume that is him voicing his support of a mass murder.
It upsets me so much that the backlash was obviously so immediate and harsh that Danny obviously felt the need to write an apology about it, because Danny has literally seen this happen to people alongside him on YouTube (severity of actual harm done ranging from Shane Dawson to Ned Fulmer, to Jenna Marbles), and like two videos he had a whole segment talking about how much he loved his job and hoped he'd be able to do it for much longer, but he has to be careful because he doesn't know how long the career span is. Oh my god I would actually die, the dread and worry and the foreshadowing would kill me. I pray there is no actual impact on him getting sponsorships or how his channel does online
I'm sad that this is the point this has gotten to. If you care about the current Israel war on Gaza, go actually support that idea. Go protest, or donate to aid or relief. Help the Palestinians, or go pressure people who can actually do something about it.

2024.05.21 12:29 Artsysap Any guidance would be very much appreciated (resources, advice, coping mechanisms)

‼️TW (CP, CSA, DA, DV, EA, ED, PA, RA, SA, SH, SI, WC)‼️
Sorry I know that’s a lot of TW’s there’s just brief mention of some of this stuff so I don’t wanna catch anyone off guard.
This is also a bit of a vent post.
I have absolutely no idea what I have, I had no idea I could potentially have a personality disorder until a few months ago, I am not meaning to rely on social media for help, though where I’m from there is such a lack in psychiatrists in my area so I feel stuck/lost. I will be venting/explaining my situation in full, I just would like to hear thoughts and opinions, I’m not trying to say I have anything specific, but the different personalities have made themselves apparent over the past 5 months. Whether it’s OSDD, BPD, DID, i don’t know.
There’s so much that I don’t really know where to start, so I guess I’ll just start with when I realized something wasn’t right. (TMI) I was having an intimate moment with my partner, it’s a long distance relationship (new relationship((known each other for about 6-7 months now)) so it was an over the phone moment. (FaceTime). I’ve had issues in the past because of sexual trauma, where immediately after sex/intimate moments i get sent into a huge derealization/panic attack due to feeling vulnerable. Now at this point, i haven’t had sex in about 4 years, and any time prior, it always ended in panic attacks. Me being vulnerable over the phone is not entirely new, but the level of vulnerability in the sense of allowing myself to fully enjoy it, that was new. I started hyperventilating, I couldn’t talk, I was crying, I was fighting with a blanket trying to cover myself all while my partner was trying to console me. I wasn’t really fully there and before this moment, any show of mania, dissociation, stuff like that, it went unnoticed. During this panic attack, I was absolutely in distress at one moment, and all of the sudden, I felt a shift. I didn’t really understand it when it happened but all of the sudden I stopped crying, the pain was still there but it wasn’t present, it felt deeper inside. It felt very different; I felt very different. All I could think and feel in that moment was this protectiveness and thought process of “I need to clean up everything before she comes back.” Now at the time I wasn’t thinking she, but I knew it was before something. Before a feeling came back was more how it resonated at the time before I could understand it better. Anyways, my whole persona shifted and I went into clean up mode and I was very confused. I felt “her” crying inside. My partner works in mental health, so he danced around delicately as I asked him questions about what he thought was going on so I could get a better picture of what I’m going through since everything felt so blinded. At one point, I just asked him. “Do you think I’m manic?” Which was the only question he responded to confidently. “Yes”. At that point, like this may seem so over exaggerated but it seriously felt like the curtains on my whole life, everything, had been pulled back and I could see myself and my actions for what they were. I saw every manic moment as mania rather than just the original gaslighting myself for my very real and terrifying experiences. After that, I was aware of me being manic for the first time and I haven’t felt such fear in a long time. I mean I don’t think I’ve ever felt fear like that before but like the level of intensity was very hard to deal with. I was terrified. I was finally seeing my hyper vigilance as hyper vigilance. I was seeing the symptoms clearly, my excessive sweating, my depleted eating habits, my sleep schedule insanely messed up. Which all before this, just seemed like “my life”. I started doing research, and I ended up needing to write something down. I can’t remember what it was but I will find it and add it.
“I’ve been doing a lot of research and thinking a lot, there’s been a lot of confusion with my identity or identities. I also need to preface that my entire life whenever I expressed how I felt, I was instead told what to do and how to feel. I know this is going to sound concerning, and people will be quick to dismiss it in an attempt to be supportive. But please just allow it to be what it is. Growing up I was always in great distress, constantly. My head was absolutely filled to the brim with worried and fears and as the years went on it only got worse. I’m highschool I transitioned into Blake; I thought it “felt” like me, but after research and certain situations/symptoms since delving back into that, I realized this was a traumatic disorder, even though I don’t know which one. Blakes feelings were 100% valid, but that’s because they were Blakes. What caused the de-transition was this. Beginning of highschool I was in crisis and distress, my brain created another personality to keep lily safe and keep her locked away. Since then I haven’t seen her, none of us have. Once Blake started receiving micro-aggressions and transphobia we went into even more distress. In 2017 my brain was absolutely stressed out from everything during the drug era and how much trauma and how burdened my mind was, I split again. My brain created Bella. Fast forward to now, Bella was breaking, and Blake had already been poking his head out, he’s been seeing the distress she’s been in and came back to take over. I never thought I was capable of having something like this l, but please bear with me as I explain how I came to this realization. This may be TMI but my partner and I were having an intimate moment and instantly afterwards I had the worst panic attack, something I’ve been trying to protect myself from for years. As I’m writing this down I’m starting to realize that those panic attacks after sexual situations are probably lily, but still valid as panic attacks. I have a lump in my throat while writing this, I promise I am not making it up or exaggerating. During the panic attack my partner was trying to console me but I completely switched in that moment to Blake and all he could feel was sorrow and was trying to give her a break. Blake came out to keep her safe. all I could do was clean up and prepare for when she came back so she wasn’t triggered, I don’t know what this is and gender fluid still feels valid and right, but in that moment of switching genders, I realized I am not switching genders, I am switching personalities. One personality could not carry the burden of it all. I am not concerned about this though, I feel with the very realization I am understanding myself better as a while.”
I was very manic when writing this. I believe I mainly wrote it for my parents. I was fearful of being dismissed.
My cousin had joined the call since I was spiraling and the both of them worked really hard to try and get me to stop writing and go to bed, which was really hard for me because I was super hyper vigilant in the moment and when it comes to my independence, I was told I have to deal with everything myself and I can’t rely on people so sometimes listening to help can be hard, accepting that help can be hard. I ended up being able to put stuff down and go to bed, more because I didn’t want to make things more difficult for them but I also could partly recognize that my actions were not helping the state I was in.
Ever since this moment it’s been realization after realization. This is so far what resonates.
I believe I have 3, possibly 4 alters. One I will name lily, she is who I originally was. Main host I guess? But doesn’t feel like it anymore. What I think happened, is that I’ve been exposed to countless amounts of different forms of abuse. When I was 12, is when I believe I split for the first time. I’ve been looking back at photos to see my mannerisms, expressions, I’ve also been expressing alter emotions through art which was another realization I had a month or two ago. This realization came from looking back at my art, and at one piece I had made just before the main breakdown/realization. It was of a face, and my art has mainly been faces. This one I remember making, I was so frustrated; and I remember looking at it and being like, why am I so frustrated, this doesn’t reflect how I feel at all. Since the realization, my cousin had pointed out that it kind of resembled a sense of splitting, which then resonated deeply. It was like I saw my painting clearly, and then I looked at all my art and was like, oh my god. My alters have been here this whole god damn time. The painting I am talking about; is the one attached to this post.
When I was a child, I hated art with a passion. I remember never picking up a pencil crayon or anything because I just didn’t like it. I wasnt good at it, I had no intention of doing art. When I was 12/13 is when I actually started doing art. I remember I did a bridesmaids dress and was like, cool. Didn’t hate it, (yes I know that this is how most artists start) but then it was just eyes. I only drew eyes, eyes and faces. Faces with third eyes, faces with hardened expressions. Now I have said countless times to my family and friends when they ask about my art, that when I paint or draw, it doesn’t feel like it’s me doing it. I once chalked it up to, artists ghosts were using me to express their art. That thought came during a particularly distressing year that when I look back I was def manic. I lost 100 lbs in like a month-a month and a half, could not eat, could barely leave my bed, was not doing well at all. This was 2019 I believe. I looked through all my art recently and during a sketchbook in 2019, during a really hard time, I had wrote down the wrong year when signing my art. Twice. The year I wrote was 2012, when I was 11/12.(2000 baby). Which then led me to look back on my life and look at photos around 2012 which had me thinking it was 1 of 2 things. 2012 was the year I split for the first time, or it was the year something really traumatic happened. I think it was the first one though. Reason being, yeah everything had started changing when I was 12. I mean I was always changing prior, my life has been very tumultuous. An undiagnosed autistic afab kid who had a very manipulative narcissistic father, and a very sweet mother, surrounded by a huge family of cousins who were like siblings. My mom divorced my dad after lots of abuse, he emotionally manipulated me into always feeling sorry for men when they show emotion and I developed Stockholm syndrome towards him which had me defending his every actions, including when he was a drug dealer, and sold enough drugs to an 18 year old to have her overdose, or the child pornography on his computer, or anything really because I was a child and he was my dad he manipulated me at a very young age. My mom married again a year or two after, which prompted her to need to get away from the abuse of my bio dad, and the abuse of religion we had been pushed upon us since birth. Pentecostal. We moved across country, and suddenly she became very emotionally distant as we now had moved away from my entire family, and had a new man in our life who was stable in every aspect besides the emotional unavailability. He tried, they both did. But they were dealing with traumas. He had just gotten back from Afghanistan. We moved because he was stationed somewhere else in the country. I ended up developing a binge eating disorder, had a lot of other intense traumas in between, did not know how to cope. When I was 10, my parents put me in therapy, my sister and I both. To deal with my bio dad trauma. I’ve been in therapy ever since. I’m 23 now.
I realize I am getting off track but I’m tryna lay everything out and not forget anything.
When I was 12/13, a lot had happened with my bio dad and a restraining order was put in place. He also had a kid with another woman and she(my sister) had passed away, a lot had happened on top of many other traumas, and I think lily broke. She didn’t really wanna be present anymore but we had no idea what was happening, but I felt myself changing. I started combating this with hyper-femininity, because who had split was me, who is currently hosting, Blake. (Also I know I use I/me as a whole sometimes, still tryna understand that. The only thing that resonates with what I mean when I say I is higher self. Not in a spiritual sense but like a higher version or a whole version? I don’t know)
Had no idea wtf was happening. All I knew was I started having dysphoria that I didn’t understand was dysphoria, so I combated it with hyperfeminity. Extra make up; always dressing up extra “girly” trying to act “girlier” or more feminine. Until I turned 14/15, and I ended up coming to terms with the fact that I was not who I thought I was, so I started changing to align with who I was. I came out as a trans man, and started the process of transitioning. Cue micro-aggressions, internalized transphobia, as well as a shit ton of transphobia from my family back home which caused me to panic. I ended up becoming really suicidal and made the decision to go hang out with a friend who was hanging with friends I had never met before, which triggered my next traumatic event. I ended up hanging with the wrong people, went down a drug path, was exposed to some very difficult and dangerous moments, felt a feeling of distress I have never felt nor would ever wish upon my worst enemy. I put it on myself as well, to help the friend I went in there with, get off a coke addiction. He went into psychosis and became violent at one point so I had to tell his mom everything and she sent him to rehab which worked but didn’t. He OD’d one night(survived) it was bad. I only ever went as far as psychedelics. But acid was my drug of choice. I was so done with everyone and everything that I just spent like 2-3 months straight, every day, tripping. I was 16 at the time. I also was exposed to the father of the household who had a weird thing for me, he tried sneaking into my bedroom one night when my bf wasn’t home (I ended up moving in with my at the time bf) but I was awake so he left real quick but it terrified me. All of this was such intense distress and I believe around this time was the second split, because it felt like for the entirety of me in that traumatic era, it was Blake and Bella fighting to host and take over. Bella was the host for the past 6 years. She took over around 2017, after like a year of fighting. I(Blake) tend to self destruct, even though I’m overprotective, trying to accept this about myself at the time was impossible because I was dealing with so much anger that was affecting the rest of the system. I also was done. Idk if alters “go to sleep” but Blake went away for a while. But what I’ve come to realize is I don’t think they’re ever went away, like lily has always been here, and I realized that the night of the intimate moment, because me having that panic attack after the intimate moment, and every panic attack prior, I believe that it’s lily. I haven’t touched that too much though because she is so to herself and shy and never comes out and she’s just traumatized, plus the amount of anger coming from Blake, and the amount of sadness coming from Bella, it’s all very overwhelming. But I do think it’s her, I don’t think she understands what’s happening but she like pokes her head out during it because maybe it’s so to with the sexual trauma we went through as a kid? I know something happened to me as a kid but I don’t know what. But I’m not ready for that yet, the anger is a more pressing issue.
Bella is very maternal, she took over and spent the past 6 years working her ass off to develop the coping mechanisms we need, and creating a safe space in our mind. The manic moments have been cushioned without us even knowing it’s manic moments; all she knew was we’re in distress so she found what helped best and worked real hard to keep us afloat. She got us out of the drugs, out of the abuse, out of the toxic relationship, out of anything that did not serve us. But not without giving up too much of herself and being beaten down. Like I know we’ve all gone through it but she took hit after hit after hit and everyone just used her as a projection batting cage. Within the past few months has been her stepping down. 5 months is us fighting, because she doesn’t want to, but she needs to, because she needs a break. And I need a break from the break. I need to deal with my anger and learn to live this world as a man. It’s been really hard to deal with, because I’ve cut off our hair which was a lot for Bella, and I’m trying to give her grace because it’s a huge change for everyone; but I’m so eager to be out. To my friends and family I’ve come out as gender fluid, a safe way for us to just be, even though gender fluid is still accurate to us, but me(Blake) I want to be on T, I want top surgery; the dysphoria has been very intense but I am not making any decisions while untreated in whatever this is. Bella doesn’t want any of that, but a hypothetical compromise that we’ve been thinking about is a breast reduction to start, to ease the mind.
Now when I look back at the past 11-12 years, I see all three of them out and about disguised as each other without realizing. There’s this one song I remember listening to on repeat non stop and idk why it just felt right it sounded right I loved it I needed to listen to it. Now, go listen to Satellites by Sleeping with sirens, think about alters waking up/trying to be known or whatever, like Jesus fuck it’s so obvious to me everything just makes sense (ik that sounds like a stretch but there’s more in my head that relates to that feeling I just can’t put it into words)
I’ve also been dealing with breaking down the walls of expectations. I have never allowed myself to be upset or have quarrels due to feeling like an inconvenience, I believe this has a lot to do with it as well.
Oh and the 4th potential alter is either someone just chillin in the background observing, or the “higher self” version of myself I was talking about. I really can’t tell.
I know there’s so much more I didn’t add but I’m deffo not doing the best rn so my brain can’t remember everything. Anyways, I’m not looking for a diagnosis obviously, but I just wanna hear what it sounds like. Because it feels like a personality disorder of some sort even tho idk wtf that’s supposed to feel like lol, so does it sound like one? I guess is what I’m really asking. Anyways, thanks for reading. Regardless of a response it is nice to get this off my chest aha. It also might be all over the place if so I apologize I think I’m currently manic? Yes I have been talking with my therapist about this, she’s not specialized in this stuff so she can only help so much, I’ve been tryna push my doctor to get me a psych referral to which he says there’s no psychiatrist in my area that are really taking any clients rn. He also sat there and told me I wasn’t dealing with mania and started listening of symptoms that I deal with that he had yet to even ask me about. I was already heated going in there because I knew I was going to have to fight for what I needed. Well the funny part is, the psychiatrist I went in there wanting a referral to; that I thought my therapist recommended me, was not an actual recommendation of a psychiatrist, but of a book of resources for me to look at, but I was manic and not there and I was literally so bent on needing help and needing a psych referral that my brain heard the authors name and was like “okay time to go to the doctor”. And then I had to admit to the doctors receptionist that I was indeed manic when I came in and that i didn’t know what I was talking about which was embarrassing and then I actually heard concern in her voice, rather than dismissal, which should’ve been comforting, but it just pissed me off lol. Anyways, sorry I’m done now lol 😂
