The Nation of Yuan

The Nation of Yuan
The Far East Empire of Yuan (ancient Yuanese: 優庵) is a nation encompassing the northeastern continent in Seidak.

History

Following the aftermath of The Great Cataclysm, the people of Yuan were mostly chaotic, scattered tribes. Their resources were drained and many were poor and starving. In 12NC, a nobleman by the name of Xiong Fang gathered up his men on a quest to lead Yuan to prosperity. He was a charismatic leader who quickly gained followers. By 15NC, he had officially claimed the title of Emperor and ruled over the continent, setting up capital in the southwestern city of Qimen.
Yuan gradually began to flourish under Emperor Fang’s rule as he gathered up workers to cultivate the land’s unique crops and focused heavily on fishing to have a wealth of food resources to trade. Fang’s family continued to rule each generation until 200NC with the death of Duan Yang. Emperor Yang did not have any male children and thus the new emperor was largely up for dispute. Later that same year, Chancellor Xian Bo declared himself the new emperor, taking over in Qimen.
In 201, General Liao Yu took over all of northern Yuan, setting up a capital in Rangawa and declaring himself the emperor. In 210, the leader of the southeastern territories of Yuan, Sun An, decided he was best suited as emperor. Southwestern Yuan became known as Imomushi, Southeast Yuan as the Gu territories, and Northern Yuan as Takai. These three areas quickly engaged in a heated power struggle, ruining much of the prosperity that was previously built up.
Sun An’s Gu army eventually forced the others into submission in 220, giving his family a brief rule over Yuan, though there was still resistance in many parts of the continent.
It was rumored that Sun An was backed by the Scion of the time, helping lead him to victory. However, it is also said that this Scion grew tired of the conflicts still present following the war and betrayed the people. This lead to Sun An’s untimely death, throwing the people into a period of chaos even greater than the previous one. It was at this point people of Yuan became mistrusting of the goddess. They began to believe that either the goddess did not exist at all, or if she did, she was no benefactor to them. As a result, all imagery worshipping her was torn down and burned. The people of Yuan began to put their trust in the Spirit Lord of Water, Arethia instead. They attributed the abundant sources of freshwater as the only reason they were able to survive the war-torn times.
In 260, Hiromasa Koide rose to power, taking over the Gu capital of Hao-Lin. He then went to work in properly unifying Yuan. Ever since then, the entire continent has officially been under the rule of a single monarch.

Architecture

Yuanese cities are fully paved except for very rural or poor areas. Stone is used for walkways and buildings alike with bamboo being common for roofs. Architecture is very elaborate and ornate as well as colorful. Bamboo shingles are often red or gold, symbols of power and wealth in Yuan. Indoor plumbing is common in cities with irrigation systems used for farmland.

Travel & Communication

They tend to use animal-drawn carriages for land travel. Mail is delivered through a postal network of nearly 2000 offices amongst the continent with relays every ten kilometers.

Magic & Technology

While the mage population of Yuan is relatively low, they have begun importing magitech devices from Ostley over the past decade to help in conveniences such as heating, cooling, refrigeration, and lighting.

Drinking Culture

Yuan produces a variety of rice wines, mostly used for celebrations and holidays. It's not uncommon for even children to be given small amounts of the weaker ones during certain events. Hard-working citizens will often indulge in alcohol after a day's work is done.

Government

Following its unification, Yuan became an Imperial Monarchy with absolute rule by a monarch. Power is passed by birth to the eldest eligible descent. Females are only eligible if there are no male descendants capable of taking the throne. In its history, only four empresses have ever ruled. The most recently of which is the current ruler, Noriko Tokugawa, whose husband was assassinated before they could have children.

Education

There are many types of schooling available in Yuan. In the capital city, Hao-Lin, there exists five national academies. All except for one are exclusive to aristocrats and nobility, charging high tuitions to be enrolled. In the center of the city, there is an imperial academy that accepts any children who test high enough and does not charge a fee for entry. These academies enroll children aged 12 through 17. Children of both genders are taught music, dance, calligraphy, and mathematics initially and later on, boys are taught archery and chariot driving while girls are taught silk production and weaving.
In other cities, smaller free public schools (as well as some tuition-based schools for nobles) are prevalent, enrolling children beginning age 7. These schools focused on basic skills of reading, writing, and calculation.

New Daith Piercing!!
I got my daith pierced on Tuesday (May 7th). I was sooooo nervous going in reading about how so many people say it was their most painful. I was so shocked at how little mine hurt. It was easily my least painful piercing of all 15 I have had. Does it look ok? I'm in love!! All I've been using is the Neilmed spray to clean it.

2024.05.11 06:05 miffy_the_destroyer Crush on Duane Reade pharmacist

I don’t know what’s wrong with me, but I am Down Bad for my local Duane Reade pharmacist.
I am a resident, so I can recklessly call in scripts for myself whenever I am not feeling well (no controls unfortunately.)
About a month ago, I ended up going to the pharmacy three nights in a row to get prescriptions.
By the third night, the overnight pharmacist recognized me and made a joke about seeing me tomorrow.
Now I can’t stop thinking about him. Clearly I have been single for far too long.
I go to that Duane Reade pretty often but I haven’t seen him since. I don’t know his name.
I love funny masochists. I’m about to go full Joe Goldberg on the guy. Please advise.

2024.05.07 18:37 percyhiggenbottom Recommendation for manga readers looking for something like Dungeon Meshi - the webcomic Unsounded

We're all enjoying the Trigger adaptation, but for manga readers who may be looking for their next read, I'd like to recommend the webcomic Unsounded. It is, like Dungeon Meshi, a fantasy comic written and drawn by a female author, with very high quality artwork and storytelling. Ashley Cope shares Ryoko Kui's eye for characterization and plot and the two stories share many of the same themes (Characters with varying lifespans, death and resurrection, immortal monsters who manipulate or prey on humanity, a well thought out approach to magic and a carefully constructed world). Unsounded has also been going on for over a decade, updating like clockwork, so there is a serious archive of hundreds of pages to catch up, all free to read on the website (Around 1700 pages, I believe).
Parallels can be drawn between some of the characters. Sette, the protagonist, is a feral street urchin with beast features (Sharp teeth, a tail and a powerful sense of smell) a bit like Isutzumi. Duane, the other protagonist is currently an undead zombie, but in life he was a handsome but socially awkward young man like Laios, as well as being a talented mage like Marcille. The senet beasts Lady Ilganyag and Ruckmearka are creatures older than time who have interfered with humans throughout history. Then there are Mathis Quigley and his son who belong to a silver haired caste who is exceptionally good at magic but in exchange are very short lived (Sort of like inverse elves) and Elka and captain Toma who are a sort of Paladin/FBI inspectors tasked with hunting down the protagonists after mistaking them for slavers in the second chapter. And many others.
Now, two warnings - first although they're similar in they ways I've described, Unsounded is a little more grimdark than Dungeon Meshi - there are plenty of moments of levity but also some very dark and gory events (Including children dying). Also, the website links to the latest page which is quite advanced in the story, sort of like starting Dungeon Meshi by reading the page where the demon is breaking open the sky and plucking people off the ground -not really where you want to hop onto the story! So I'd recommend starting at the beginning
Enjoy!

2024.05.06 04:13 MrBameron What do you think of Morgan in the comics?

I’ve read through the full comic story a couple times. I don’t dislike Morgan but I feel like his story was cut a little short. Once he is reunited with Rick he’s in pretty bad shape. He loses Duane and then loses his mind a little bit. He begins to have a relationship with Michonne in Alexandria but as the herd breaks in, he’s bitten and dies soon after. I don’t hate how his story ends but part of me was anticipating more for him the first time I read through it all. I had watched the twd tv show first so I was expecting him to be like reformed and I was surprised when he just died. I also understand that it’s twd so it’s understandable that a character just dies unexpectedly.

2024.05.02 22:17 SeraphinaSphinx Romantic Fantasy recommendations? (NOT fantasy romance)

When I was a kid, I wound up reading Tamora Pierce's book Wild Magic. It left a strong impression on me but I was never able to read the other books in the series. Now that I'm returning to reading as an adult with a better grasp of the internet, I thought I would learn more about it. I found out that Tamora Pierce's works are part of the romantic fantasy genre that emerged in the 1980's. I set off to find more authors and one-off books that fit into this genre only to slam into a wall.
No search engine I've encountered yet can tell the difference between "romantic fantasy" and "fantasy romance", and fans of the latter frequency misapply the former's name to it. When double checking my sources to make sure I was describing the genre correctly in this post, I was very disheartened to see that Wikipedia has ruined their page on romantic fantasy by merging it with their page for romantasy. They are not the same genre! A fantasy romance is a romance story that takes place in a fantasy setting, usually a secondary world. A romantic fantasy is a fantasy story that is pulling from the themes of the Romantic movement of the 1800's.
The best description I have yet comes from the introduction of the romantic fantasy TTRBG Blue Rose, who describes it like this:
In the mid-1980s, a generation of new fantasy authors—Diane Duane, Mercedes Lackey, Tamora Pierce, and many others—wrote fantasy novels different from any that had come before. The main characters in their novels occasionally started out as loners and outcasts before finding their place in society. Generally they become members of some prominent group or official organization that goes on exciting adventures to protect ordinary people from danger. Developing a sense of belonging and finding comrades are central features of these stories. Most of these novels are in series. By the end of the first book, the main character usually discovers a community where they belong. Many of the character’s subsequent adventures involve either becoming a more fully integrated member of this group or protecting the group from harm.
Few of these novels contain elves, dwarves, or similar fantasy races, and many contain few or no other humanoid species at all. Instead, humans share their world with one or more types of intelligent or semi-intelligent animals, sometimes with a few magical human subspecies. Some of the intelligent animals are simply bright psychic pets, while others are free-willed, powerful spirits with animal bodies.
Romantic fantasy novels are often set in highly egalitarian societies, where people’s occupations and aspirations are not limited by fixed gender roles. In these books, sexist or homophobic cultures and individuals are either ignorant and see the error of their ways somewhere in the series, or they are enemies who the heroes eventually vanquish.
The heroes of romantic fantasy novels are usually environmentally conscious. Protecting wilderness areas and animals from depredation is a common plot element. In all romantic fantasy worlds, nature is a positive magical force, and anyone who protects it is on the side of good.
Attitudes about magic also differ from other fantasy novels. Instead of the scholastic magic of some stories—magic as a rare and powerful discipline involving complex rituals and arcane lore—many characters have innate psychic or arcane powers as natural to them as sight and hearing. Heroic characters can often manipulate the natural elements and use their powers with nothing more than concentration and intent. These powers are an innate and positive part of someone’s nature, and are only feared by the ignorant or evil.
More traditional magic does occasionally appear in these novels, but it’s usually only practiced by villains to bind others to their will, or to summon horrific creatures and spirits from other planes of existence. The only motives given for performing such magic are a hunger for power or a desire for revenge. This type of magic is unnatural, dangerous, and often corrupting.
Some other attributes I've noticed in romantic fantasy novels are:
I know the most enduring authors of this genre are Mercedes Lackey and Tamora Pierce. (Valdemar is the quintessential romantic fantasy.) I think Lynn Flewelling's Tamir Triad qualifies despite being published in the 2000's. I'm not in far enough to tell but I believe Summers at Castle Auburn by Sharon Shinn is one, and so is the Green Rider series by Kristen Britain and the works of Juliet Marillier.
Who am I missing? What other series, standalones, or authors fit in this genre?

2024.05.01 14:05 Spatmuk New to the Allman Brothers

Ok, so like the title states I am new to the Allman Brothers. In my mid 30s and kind of wrote a lot of “classic rock” off as the music my dad had playing on the radio while I mowed the lawn in HS and I listened to punk on my discman lol
I’ve been going back and filling in the gaps with a lot of 60s/70s stuff as I get older. I’ve seen some posts here about Grateful Dead fans entry point, but I’m more of a blues riffy guy (Really got into Cream last year, always loved the Doors, big Muddy Waters fan, love Hendrix, and early Stones). I never really got into the Dead, but that’s for another Reddit and another day…
I started out At Filmore East and really dug it! Listened to The Allman Brothers Band next and it’s just a great blues album!! Wondering where to go next.
I read somewhere that after Duane died they went more in a “southern rock” direction. Not super sure what that means, but for example I’ve never been a big Skynard fan…

2024.04.30 02:00 JesusIsKewl what do NM’s latest citations say?

  1. Any comments about Counsel for the State that constitutes a personal attack on the attorney for the State or comments on the role of the State’s attorney. Johnson v. State, 453 N.E.2d 365 (Ind.Ct.App. 1983); Craig v. State, 267 Ind. 359, 370 N.E.2d 880 (1977); Bardonner v. State, 587 N.E.2d 1353 (Ind.Ct.App. 1992); Flynn v. State, 379 N.E.2d 548 (Ind.Ct.App. 1978).
“Thus, by implying that he had additional inculpatory evidence and by playing on the jurors' individual fears, the prosecutor impermissibly tipped the scales in his favor. Because the court did not admonish the jury to disregard these improper statements, leaving the damage uncorrected, Johnson was placed in a position of grave peril as to the Attempted Rape charge. The trial court erred in denying Johnson's motion for a mistrial.” https://casetext.com/case/johnson-v-state-5717 (NM cited as Craig v State?)
“Thus it is unprofessional conduct for an attorney to simply assert that a witness is untruthful, although he may argue that for reasons arising from the evidence the witness [6, 7] should be disbelieved. The prosecutor's unexplained references to defense perjury was improper.” “The prosecutor was correct in assuming that his duty is to the whole of society, including the accused. Code of Professional Responsibility, EC 7-13; ABA STANDARDS FOR CRIMINAL JUSTICE, THE PROSECUTION FUNCTION § 1.1 (Approved 1971 Draft). It does not follow, however, that the prosecutor is entitled to play upon his position as public servant to obtain unfair advantage in a criminal trial. Moreover, his assertion that the prosecution has a duty to present to the jury evidence favorable to the accused is incorrect and misleading.” https://casetext.com/case/craig-v-state-206
I particularly l love this one and I hope that NM read it carefully!
“Furthermore, we find no redeeming legal value in the prosecutor's comments as far as the purposes of selecting an impartial jury are concerned. First, we think these comments could be viewed as improper comments on the guilt of the defendant. "The danger of prejudice to the defendant by such statements is they may imply that the prosecutor has independent personal knowledge of facts other than those introduced at trial." Garrett v. State (1973), 157 Ind. App. 426, 300 N.E.2d 696, 700. A defendant is entitled to the presumption of innocence — a conclusion drawn by law in favor of the defendant, whereby his innocence is established until sufficient evidence is introduced to overcome the proof which the law has created. Coffin v. United States (1895), 156 U.S. 432, 15 S.Ct. 394, 39 L.Ed. 481. It is the principle that no person may be convicted of a crime unless the government carries the burden of proving his guilt beyond a reasonable doubt. United States v. Friday (E.D.Mich. 1975), 404 F. Supp. 1343. Moreover, our constitution guarantees a defendant a right to cross-exam the witnesses against him. U.S. Const. amend. VI; Ind. Const. art. I §§ 12 13. There is no rule of law or presumption — nor should there be — that the prosecutor, in presenting the State's case, may only ask questions which elicit honest and truthful answers, but defense counsel's examination and cross-examination are for the purpose of obstructing the truth. If there were such a rule, we believe it would negate the defendant's presumption of innocence and shift the burden of proof to the defendant. When a defense counsel vigorously pursues cross-examination to bring out discrepancies in the State's case, is he not pursuing the truth — which, in a criminal case, is whether the defendant committed the crime beyond a reasonable doubt?Secondly, the prosecutor's conduct impinged on defendant's right to effective assistance of counsel. U.S. Const. amend. VI, XIV and Ind. Const., art. I, § 13. Once the right to counsel has attached and been asserted, the prosecution and the police have an affirmative obligation not to act in a manner that circumvents or dilutes that protection. 22 C.J.S. Criminal Law § 277 (1989), citing Maine v. Moulton (1985), 474 U.S. 159, 106 S.Ct. 477, 88 L.Ed.2d 481; DeAngelo v. Wainwright (11th Cir. 1986), 781 F.2d 1516, cert. denied (1986), 479 U.S. 953, 107 S.Ct. 444, 93 L.Ed.2d 392. "The government violates the right to effective assistance of counsel when it interferes in certain ways with the ability of counsel to make independent decisions about how to conduct the defense." 22 C.J.S. Criminal Law § 310 (1989), citing Strickland v. Washington (1984), 466 U.S. 668, 104 S.Ct. 2052, 80 L.Ed.2d 674. The government may not establish detailed rules which prescribe conduct for defense counsel or limit the range of decisions about how to best represent a criminal defendant because such rules would interfere with the
"constitutionally protected independence of counsel and restrict the wide latitude counsel must have in making tactical decisions. Indeed, the existence of detailed guidelines for representation could distract counsel from the overriding mission of vigorous advocacy of the defendant's cause." Strickland, at 689, 104 S.Ct. at 2065.
Ineffectiveness of counsel resulting in prejudice to the defendant is reversible error. Id. Defense counsel can be rendered ineffective by his own actions or omissions or by the conduct of the prosecutor in making harassing or unfair comments (not disapproved by the trial court) which prevent the defense counsel from vigorously battling on his client's behalf. The defense counsel may be the sole barrier between his client and incarceration and, thus, should be able to focus his full attention to defending his client and not himself. Certainly, a defense counsel has a difficult enough time defending his client — his resources are generally less than those of the state — and his burden grows heavier if he must defend his own honor as well as his client's innocence. Here, as the evidence was presented during the course of the trial, the defense counsel had to be aware of his own demeanor, the phrasing of each question, and the fact that he was suspect if he vigorously cross-examined a State's witness. There is no question that the defense counsel was placed at a severe disadvantage.
We go on record here stating that criminal defense attorneys and public defenders perform a valuable and highly respected service to the judicial process.” https://casetext.com/case/bardonner-v-state
“It is, of course, proper for an attorney to argue for any position or conclusion based on his analysis of the evidence. Code of Professional Responsibility, D.R. 7-106(C)(4). [2] Conversely, the attorney may not assert his personal opinion as to the guilt of a defendant. Id. These rules play no small role in the administration of justice. Flynn was entitled to be tried on the evidence presented in court. The deputy prosecutor's completely unfounded charge that the defendant is a "drug dealer" may suggest to the jury that the deputy prosecutor possessed undisclosed evidence bearing upon other possible crimes by the defendant.” Reversed for new trial over such comments. https://casetext.com/case/flynn-v-state-50
None of these cases cited by NM are about a defense attorney making statements about a state’s attorney.
  1. Any attempt to introduce evidence of 3rd party motive that is not relevant and/or the probative value is outweighed by unfair prejudice, confusion of the issues or has the potential to mislead the jury in violation of Rule 401. Lashbrook v. State, 762 N.E.2d 756 (Ind. 2002); Pelley v. State, 901 N.E.2d 494 (2009). Before any such evidence may be permitted the Defense must show some connection between the 3rd party and the crime. Holmes v. South Carolina, 547 U.S. 319 (2006). Further it must be a direct connection based on admissible evidence and not founded in hearsay, speculation, rumors, conjecture or theory. Mcintyre v. State, 717 N.E.2d 114 (1999); McGaha v. State, 926 N.E.2d 1050 (Ind. Ct. App. 2010); Tibbs v. State, 59 N.E.3d 1005 (Ind. Ct. App. 2016).
“In stark contrast to Joyner, the defendant presents no material evidence that Perez was connected to the crime. The phrase allegedly uttered by Perez that Morton "was gonna die" does not tend to show that Perez committed the murder.
As to the defendant's claim that the excluded evidence should have been admitted because it tends to show an incomplete police investigation, we observe that other evidence of the same fact had been previously admitted. During the presentation of the State's case, the defense cross-examined West Lafayette Police detective Brian Lowe, and the officer stated that his investigative report reflected that some women gave him a lead that Nicholas Perez said that Duane Morton was going to die, and that the officer did not follow up by having the women interviewed. Thus the jury had already received the evidentiary facts excluded by the court's ruling now challenged. Furthermore, one of the defense witnesses later testified at trial that she was interviewed by Detective Lowe and gave him information about Perez. The defendant utilized these evidentiary facts during his closing statement to argue the presence of reasonable doubt after stating that "Detective [Lowe] testified that Detaria Goings told him that Nick [Perez] had said Duane's gonna die." Record at 1934. Thus the admission of further testimony establishing the Perez utterance would have been cumulative, and its exclusion did not prevent the defendant from making the same argument to the jury.” https://casetext.com/case/lashbrook-v-state
Joyner, important IN caselaw re: 3rd party guilt: “Evidence is relevant when it has "any tendency to make the existence of any fact that is of consequence to the determination of the action more probable or less probable than it would be without the evidence." Ind.Evidence Rule 401. Evidence which tends to show that someone else committed the crime logically makes it less probable that the defendant committed the crime, and thus meets the definition of relevance in Rule 401.” https://casetext.com/case/joyner-v-state-77#p389
“In the context of third-party motive evidence, these rules are grounded in the widely-accepted principle that before evidence of a third party is admissible, the defendant must show some connection between the third party and the crime. See Holmes v. South Carolina, 547 U.S. 319, 327 n. *, 126 S.Ct. 1727, 164 L.Ed.2d 503 (2006) (listing jurisdictions and quoting 41 C.J.S., Homicide § 216, at 56-58 (1991) ("Evidence tending to show the commission by another person of the crime charged may be introduced by accused when it is inconsistent with, and raises a reasonable doubt of, his own guilt; but frequently matters offered in evidence for this purpose are so remote and lack such connection with the crime that they are excluded.”)).” https://casetext.com/case/pelley-v-state-1
I find this one to be the most interesting of all, as it is a SCOTUS ruling. In this case the ruling was remanded because the state supreme court did not sufficiently compare the strength of the evidence against the defendant to the strength of the defendant's third party evidence.
“While the Constitution thus prohibits the exclusion of defense evidence under rules that serve no legitimate purpose or that are disproportionate to the ends that they are asserted to promote, well-established rules of evidence permit trial judges to exclude evidence if its probative value is outweighed by certain other factors such as unfair prejudice, confusion of the issues, or potential to mislead the jury. See, e.g., Fed. Rule Evid. 403; Uniform Rule of Evid. 45 (1953); ALI, Model Code of Evidence Rule 303 (1942); 3 J. Wigmore, Evidence §§1863, 1904 (1904). Plainly referring to rules of this type, we have stated that the Constitution permits judges “to exclude evidence that is ‘repetitive … , only marginally relevant’ or poses an undue risk of ‘harassment, prejudice, [or] confusion of the issues.’ ” Crane, supra, at 689–690 (quoting Delaware v. Van Arsdall, 475 U. S. 673, 679 (1986); ellipsis and brackets in original). See also Montana v. Egelhoff, 518 U. S. 37, 42 (1996) (plurality opinion) (terming such rules “familiar and unquestionably constitutional”).
A specific application of this principle is found in rules regulating the admission of evidence proffered by criminal defendants to show that someone else committed the crime with which they are charged. See, e.g., 41 C. J. S., Homicide §216, pp. 56–58 (1991) (“Evidence tending to show the commission by another person of the crime charged may be introduced by accused when it is inconsistent with, and raises a reasonable doubt of, his own guilt; but frequently matters offered in evidence for this purpose are so remote and lack such connection with the crime that they are excluded”); 40A Am. Jur. 2d, Homicide §286, pp. 136–138 (1999) (“[T]he accused may introduce any legal evidence tending to prove that another person may have committed the crime with which the defendant is charged … . [Such evidence] may be excluded where it does not sufficiently connect the other person to the crime, as, for example, where the evidence is speculative or remote, or does not tend to prove or disprove a material fact in issue at the defendant’s trial” (footnotes omitted)). Such rules are widely accepted,* and neither petitioner nor his amici challenge them here.”
“The point is that, by evaluating the strength of only one party’s evidence, no logical conclusion can be reached regarding the strength of contrary evidence offered by the other side to rebut or cast doubt. Because the rule applied by the State Supreme Court in this case did not heed this point, the rule is “arbitrary” in the sense that it does not rationally serve the end that the Gregory rule and other similar third-party guilt rules were designed to further. Nor has the State identified any other legitimate end that the rule serves. It follows that the rule applied in this case by the State Supreme Court violates a criminal defendant’s right to have “ ‘a meaningful opportunity to present a complete defense.’ ” Crane, 476 U. S., at 690 (quoting Trombetta, 467 U. S., at 485).” https://supreme.justia.com/cases/federal/us/547/319/
“To be admissible in a criminal prosecution, evidence that a third party has committed the crime with which the defendant is charged need not show substantial proof of a probability that the third person has committed the act; it need only be capable of raising a reasonable doubt of the defendant's guilt.....
.... While a criminal defendant may present alternative perpetrator evidence at trial in order to cast doubt on the defendant's guilt, the defendant must first lay an evidentiary foundation to establish that the alternative perpetrator evidence has an inherent tendency to connect the alternative perpetrator to the actual commission of the charged crime.”
“29 Am.Jur. 2d Evidence § 598 (2008). Even if evidence that a third party committed the charged offense is found to be relevant, the evidence may be excluded pursuant to Indiana Evidence Rule 403 if its probative value is outweighed by unfair prejudice, confusion of the issues, or the potential to mislead the jury. Pelley v. State, 901 N.E.2d 494, 504 (Ind.2009).” https://casetext.com/case/robertson-v-state-348
“[25] We conclude the evidence Tibbs sought to introduce—that McCarty was indicted for Rison's murder; that in 1989 Rison reported McCarty threatened to kill her if she disclosed he sexually molested her; that McCarty allegedly asked Lori to clean out his car; and the details of McCarty's conflicting statements related to his whereabouts around the time Rison disappeared—was neither sufficiently exculpatory nor relevant evidence of a third-party perpetrator. None of the excluded evidence made it less probable that Tibbs murdered Rison or that McCarty was responsible for her murder as required under Rule of Evidence 401.” https://casetext.com/case/tibbs-v-state-45
Cited in Tibbs: “In our view, the record supports a conclusion that Bethel's testimony was exculpatory, unique, and critical to Allen's defense. There was no other source for Allen to rely upon to present this part of his defense that another individual had committed the crimes. Under these circumstances, we must conclude that Allen had the right to present evidence that Crenshaw was involved in the commission of the crimes. Such evidence goes to the very heart of this fundamental right, and the trial court's exclusion of Bethel's testimony made outside the presence of the jury impinged upon Allen's right to present a complete defense. Hence, we reverse Allen's convictions on this basis.” https://casetext.com/case/allen-v-state-1329
  1. Any reference to an investigation conducted by Todd Click, along with any reports or investigative materials from Todd Click that is not relevant or is used for the purpose of confusing the issues or has the potential to mislead the jury in violation of Rule401. IRE 401. Burden is on the opponent to show why it is relevant. Mullins v. State, 646 N.E.2d 40 (Ind. 1995). Relevant evidence may be excluded if its probative value is substantially outweighed by its prejudicial effect. Rolston v. State, 81 N.E.3d 1097 (Ind. Ct. App. 2017). Evidence may be excluded if it confuses the issues. Lee v. Hamilton, 841 N.E.2d 223 (Ind. Ct. App. 2006)
Points 9, 11, 12 all cite these same cases as 8.
“Generally, if evidence is relevant, it is admissible and should be admitted. Boots v. Canine (1884), 94 Ind. 408, 411; Harbor v. Morgan (1853), 4 Ind. 158, 159; McMahan v. Snap On Tool Corp. (1985), Ind. App., 478 N.E.2d 116, 123; Indiana State Highway Comm'n v. Vanderbur (1982), Ind. App., 432 N.E.2d 418, 422, reh'g denied (1982), 434 N.E.2d 575, trans. denied.”
“It is the responsibility of the opponent of evidence to show why relevant evidence is inadmissible. Williams v. State (1986), Ind. App., 489 N.E.2d 594, 603 n. 8; Hughes v. State (1985), Ind. App., 481 N.E.2d 135, 138.” https://casetext.com/case/mullins-v-state-170
this is about showing autopsy photos and living photos of a victim during a trial https://casetext.com/case/rolston-v-state-5
“Our own examination of Exhibit 6 leads us to conclude it was not an abuse of discretion for the trial court to determine the document was illegible for the purposes of impeaching Hamilton's testimony regarding prior neck and shoulder problems. The document is not wholly illegible but, as the trial court noted, it "is not the most legible thing in the world. It's obviously written by a doctor." (Tr. at 349.) The relevant portion of the document is one of the least legible portions. The trial court, having determined the document was illegible, did not abuse its discretion in declining to admit Exhibit 6.”
“Because Exhibit 24's potential to confuse the issues and mislead the jury substantially outweighs its probative value, the trial court's decision to exclude Exhibit 24 was not an abuse of discretion.” This exhibit was a previous court complaint against the other party, basically an allegation not a finding. https://casetext.com/case/lee-v-hamilton-4

2024.04.26 05:34 mr-weaselpops [SPOILER] How "Hidden Love" Reminded Me What Falling In Love Felt Like Again

I don't usually write in many forums, but I felt like I needed to write this and maybe come back to it in the future.
Similar to others nine or less months ago, I am also in a Hidden Love withdrawal. I am genuinely struggling to "get over" this series and move on from Sang Zhi and Duan Jiaxu. I wanted to write why this C-Drama is so incredibly powerful in its writing and cinematic storytelling.
For context, I don't watch many Chinese or Asian dramas. In fact, you could make the argument that my perspective is invalid since I'm not wholeheartedly engaged with the most popular dramas or community. If that's the case, that's OK and I understand, but I am writing this from a personal POV and not from a "let's compare XYZ" standpoint.
Sang Zhi, while I wasn't fond entirely of Zhao Lusi's acting, the portrayal of a school girl transitioning to a young adult hits the mark perfectly. Yes, I've read the arguments for the age differences and see why viewers would not feel at ease.
But if I must admit, Sang Zhi and I had a similar experience. I knew my partner when I was 17 and he was 22. We didn't talk again until I was 18 and he was 23. At this time, he had no idea I liked him. It was only until I was 19 and he was 24 when we began dating.
In Hidden Love, we can all absolutely admit that Sang Zhi's character is realistic and not unimaginable at all. Her character embodies any young girl's admiration for someone handsomely older and is ultimately a "green flag" in Asian-drama terms.
But, let's stop calling it a drama. The reason why this story is such a success is because you, as the viewer, actually feels like you're falling in love (or again). Whether this be with Chen Zheyuan as an actor, Duan Jiaxu as a fictional character — or in general, Hidden Love encapsulates how a woman would actually feel falling in love for the first time and why love is simply a beautiful experience that many don't get to relive or experience.
And how did Hidden Love achieve this? By avoiding the classic "CEO and assistant," "bad boy and quiet girl," or "clingy and intelligent teens" tropes. Not only that, no fantasy, ridiculous twists, or notable unnecessary conflicts.
Instead, Hidden Love puts all of its energy into telling an authentic love story of how two people met, befriended one another, and fell in love in a very innocent and heartwarming way. Because that's why we're watching it, right?
For example, a scene that I cannot get out of my head is when Sang Zhi and Duan Jiaxu both arrive at the airport to fly back to Yihe. Sang Zhi found out that Duan Jiaxu didn't break their promise. And Duan Jiaxu's reaction to Sang Zhi's embarrassment is incredibly genuine. Chen Zheyuan's acting is impeccable in Hidden Love. His facial expressions, timing, and overall gestures made me understand the "she fell first, but he fell harder" phrase every person kept reciting. Out of any scene, I'll never forget this genuine scene that made me personally remember again what falling in love felt like — butterflies and happiness to be next to the person you admire most.
Hidden Love E14
Another example, which happens to be at an airport again, is Duan Jiaxu's response to Sang Zhi thinking that he would break up with her due to her parents protesting against his family's history and disapproval of him.
Hidden Love E24
Anyways, I think that if you come across this story and ever question why this series was incredibly popular — all I hope is I can get at least one person to agree with me that they also reminisced and had a sense of nostalgia watching Hidden Love. Being with my partner for 5+ years, while still in love and comfortable, I almost forgot what it felt like to "fall in love" and have those major first-time butterflies in your stomach feeling. But I have Hidden Love to say thanks to and I also fell in love with my partner all over again. I mean, come on, my story is pretty identical to Sang Zhi and Duan Jiaxu (:

2024.04.23 09:59 NoLimitRolling My First (re)Haul

My First (re)Haul
It’s been a little under two weeks and these are everything i’ve got so far and i’m loving it.
I was super into comics when I was younger but fell off once I was in high school. Unfortunately all of my old collection was lost to time but now i’m 23 and been looking for more hobbies and thought i’d get back in.
The department of truth was my first pickup, i’m about halfway through, loving it so far. I’ve been reading it a chapter or two at a time and I love how easy it is to read yet it’s still so entertaining and in depth in that little time. The rest I haven’t touched yet though, except for tonight and that’s partly what this post is about.
The Walking Dead came in today and after I got off work I couldn’t put it down. Finished it all tonight in one sitting and it was spectacular, so good I ordered the second book and it’s coming tomorrow. (The story with Morgan and Duane was an amazing addition too)
My worry though is the next one I get into though I won’t be reallyyy able to get into. Out of what I have right now anyone have any suggestions on what to start reading first?
Hellboy Complete Box Set, From Hell, or Berserk?
Should I finish DoT before I start something else?
Also any suggestions on what else to pick-up(horror, thriller, or drama specifically) would always be awesome.

2024.04.22 22:23 wontcompleteit Unique Situation, can use advice. Diagnosed Nose Infection, was just about to start Rifaximin for SIBO..

Hey there,
I just saw an Ears, Nose, Throat (ENT) specialist who put a camera up my nose. He said I have a nose infection, and wanted to prescribe me arithomycin, which I really was resistant about. I read posts about people getting sibo from that antibiotic alone. On the flip side, I was going to REDO my sibo test tomorrow (I already know it's hydrogen but want to double check), and was going to start rifaximin really soon. Do you have any advice on what I should do here?
The ENT consultant said we could try neilmed sinus rinse, with Steroid drops in, and antibiotics drops in, so he gave me that stuff, but I also am not sure what to do. I could monitor it and try his solution?
I got burnt so bad by antibiotics previously and I am really confused how to approach this, I also just paid for a gut map test and submitted it yesterday, which would be completely ruined I imagine if I use the antibiotics of arithomycin today right? Could really use some pointers here and some advice on a smart approach, on not worsening sibo, and yeah. Should I just do his drops and approach, or maybe drink oregano oil in ginger tea?
Thanks, any ideas appreciated.

2024.04.19 03:31 General_Rock3365 Ongoing Sinus issues after FESS and rounds and rounds of Antibiotics and steroids

I’ve had excessive white mucus for years, but it never really bothered me that much. I’ve had progressively worse post nasal drip for about 4 years as well. I’ve never had chest pain or trouble breathing, just fatigued easier than i should in sports, but I managed. I was told in High school I have excersize induced asthma, and had no allergies. I was also told i have GERD but my burning sensation and reflux slowly eased and i no longer get symptoms of that, and haven’t for about 2 years. I smoked weed and vaped for probably 2-3 years starting around 18 - 21 years old. Last september (21 years 3 months) I was smoking and started getting a horrible pain in my cheeks and forehead, and my mucus quickly became thicker and green. I also had horrible post nasal drip (worse than usual). I immediately knew this was a sinus infection. I went to the doctor and they gave me an antibiotic, which didn’t work. The steroid helped for about 2 days then the symptoms would just come back. I decided to go to a different clinic and the doctor gave me a different antibiotic and steroid, which did the exact same thing as the first treatment. it was after this i tried to quit smoking, as i was using a thc cart maybe twice a week because my anxiety was so horrible throughout this(which i now regret) I then had an endoscopy with mayo, and they referred me to Mayo Rochester ENT (MN). I live about an hour away. My first appointment they did and endoscopy again and decided to try an antibiotic and steroid AGAIN. With the same outcome as the last two. This was all in the span of about 4 months. I was then prescribed a budesonide capsule with each of my neilmed sinus rinses, twice a day. I have been doing those every single day since then. My doctor at Mayo Rochester then decided FESS would be the best option. The doctor told me there was an opening 4 days after he said we should schedule, and i had used my THC cart the day before(it was the only thing i could think of to ease my anxiety). I still scheduled that surgery although i know you shouldn’t smoke that soon before a surgery. I have not smoked any substance whatsoever since then. I had that surgery on February 22 of this year. I was not prescribed an antibiotic during surgery or post op. About 10 days after surgery, I was till producing thick brown/red/yellow mucus and huge clumps of debris. My inflammation was severe and the doctor left my nasal packing in for 3 weeks after surgery, because i was too inflamed for him to get back far enough in my sinuses to see it at my 1 week post op appointment. My symptoms continued through those 3 weeks, but the pain was substantially better, but still noticeable. The excessive mucus and inflammation was worrisome though. The doctor did say i was looking better 1 months post op, but was still far more inflamed then he had hoped. I was also forming scars in my sinuses which he would cut back open to heal. I could now breathe out of both of my nostrils though. At about a month and half post op, I woke up one morning with one nostril being completely shut, and pain in my left cheek. I blew my nose and tried to open it up but my nose started bleeding excessively, and it felt as if something inside my face/nose shifted. I started to panic and immediately scheduled with my doctor. I got in shortly after, and after a culture, he said I had a Staph infection in my sinuses. I did a round of antibiotics + steroid once more. I also started an antibiotic in my nasal rinse. It helped, but again did not fix the issue. I just went in 2 days ago, and the doctor said he didn’t really see signs of infection. But instead just saw excessive amount of scarring and inflammation. I also now have polyps, which i did not have before surgery. lucky me. My pain isn’t that bad and comes in and out throughout the day, but i can usually only breathe out of one nostril at a time and feel so stuffed up. My voice is also nasally and hoarse. I also have thick gold-ish yellow mucus and sometimes white sticky mucus. Post nasal drip is bad as well. The doctor decided it’s time to do blood and urine tests to check for immunodeficiency issues and to test for other underlying causes. I’m now waiting for a response. This has been the hardest thing i’ve ever had to go through and i’m losing hope every day. I sit and think myself into a hole anytime i’m alone with my thoughts, and i know i can’t do this forever. i make myself think about how many people have much worse situations than me, and that makes me feel better. sometimes i get really depressed about it tbough and i think my light inside is fading, and i hope someone out there can help me with some ideas. If you read all of this, thank you. I hope anybody dealing with this finds the light at the end of their tunnel.
