WHOLE STORY WITH SIMPLIFIED CONVO
Good day, I was an employee in a small firm, itago nalang natin sa pangalang XXX. It has been a year past before I resigned.
Timeline:
March 21, 2024,
I filed my resignation, and it took 3 processing days before they agreed on my resignation. There is no policy regarding the clearance but only a final instruction via conversation in microsoft (I still have the evidence)
March 26, 2024
is my last day, I already settled all the company assets (like Devices, documents, Company ID's)_ in our office where I reside. The following days, there are no further instructions, so I have assumed that I settled everything to them and at the same time, they terminated my microsoft account.
April 23, 2024.
almost 30 days, I emailed them a short notice regarding my remaining collectibles using my personal Microsoft account since they already terminated my company account. I also texted them on their phone number, but I haven't received any reply text.

I try to follow up my demand, but they still insist because of the similar reason which has been a case on my whole year of working in my company. On my perspective, since I am no longer working for them, there is no reason to continue withholding my collectibles they should have think this thru since madami ng beses ako pinangakuan hinid lang after ko mag resign, noong december pa sila ganyan, at satingin ko hindi na tama ang action nila, kung hindi man stable ang cashflow satingin ko may iba pa naman paraan ayoko lang sabihin kasi it is not my legal right. After that case, I went to DOLE and inquire before I file a report.

is it legal for the EMPLOYER to be aggressive whenever a EMPLOYEE demand for their final payment, I feel like I am being disrespected by my employer with them being unreasonable with their words since I only want a confirmation and answers. If yes, is there a labor act I can file against them?
what if I nag comply saakin yung company, pwede ko ba i pa cancel yung conference, may consequence ba?
Also, ano ang advice nyo if ever na dumating sa point na both parties are agreed to attend in conference. with arbitrary?Ano po ba ang process ng conference, and if ever may debate, if manalo ako, ano po ang mga consequence ng opposite party?

Referring to my previous post
I just left this job. Why?
My boss accused me of sleeping at work because once when he called me at 1am I had a sleepy voice (I was awake), so he made me work in the office, in addition he changed my working hours. Previously, I worked from 9pm to 5am, but now I would have to work from midnight to 8am.
I worked one night in the office during which I looked at the monitor most of the time because I had nothing to do.
The next day I terminated my contract without notice.
Despite the fact that it was my boss who changed my working conditions from remote to stationary and changed my working hours to my disadvantage, I still feel like an asshole.

2024.05.15 10:22 SkilledNigiriEater A neighbour has stolen my parcel and now I'm in a months long dispute with the sender. Who is liable?

Hi all,
I'm in a dispute with Three and could really use some external help to make sure my argument in the dispute is watertight.
Context:
I ordered some broadband from Three around 2 months ago, the router was delivered to a neighbour in my block of flats. It was "signed for" under my name and a proof of delivery photograph featuring a headless woman was the evidence. All the doors and carpets in my building look the same so there was no distinguishing features to give an indication of who it was.
I asked around the neighbours over the next few days and everyone said they hadn't received a parcel. I also sent a letter around giving whoever had the parcel an ultimatum to leave it in front of my door before I opened an investigation and no one came forward - so clearly someone was lying.
I contacted Three about this and they said they'd look into it, a week later they said they looked into it and the device was confirmed delivered - to which I said that it was delivered ot the wrong address - their reply was that there was GPS evidence, to which I replied that the GPS evidence could represent any one of the 25 flats in this building and that the photographic evidence of someone recieving the parcel was someone who was not me.
I offered to give further evidnce, via proof of signature, a picture of myself to show that it was not me who had signed for the parcel which Three refused to accept reiterating that their position was that the parcel had been delivered.
At this point I escalated the case to the Ombudsman.
After closing heir internal complaint Three then began to aggressively pursue payment from me, despite me contacting them numerous times to tell them that the issue is with the Ombudsman and I wouldn't be paying for anything as the contract terms hadn't been met.
Three's argument:
Now in the Ombudsman investigation Three's claims are:

The GPS info and delivery photo is evidence that confirms that the router was delivered
None of the neighbours have said they have the device
This needs to be disputed with DPD directly for them to complete an investigation with the driver
I am liable for paying for the service until I can give evidence that the device was not received -They've confirmed that there's no useage on the device or the mobile number

My counter argument:
My counter argument would be:

Three has a responsibility as the sender to ensure the goods I undertook a contract for were delivered, any issues between DPD and Three before the item was delivered to me have nothing to do with me and are a seperate issue between Three and DPD, which Three is currently using as an excuse to not fulfill the contract.
Three has repeatedly refused to give any avenue to prove that the individual represented in the claimed photographic evidence is not me, including any photographs of myself and my signature
The notion of "giving evidence that the device has not been recieved" does not make any sense as I'm being asked to prove a negative - what could this evidence even look like if the device is not in my possession? The only evidence is already possesed by Three, which is an image of the device being delivered to someone who clearly isn't me, and they've confirmed that the device hasn't been used, neither has the mobile number.
Three has repeatedly harrassed me for payments and given complaint updates on my account, even if I had wanted to manage the payments or read these notes I wouldn't be able to as to log into the Three customer portal one needs the mobile number of the account, which I don't have.
I cannot identify any possible motive that Three could think I have. If I had any intentions of cancelling the contract after recieving the device, I could have done so within the cooling off period, but I called Three about the undelivered item well before this period ended. The device itself has little to no monetary value and is useless without a Three broadband contract which Three themselves have confirmed has not been made use of. -I've repeatedly given Three the opportunity to remedy the situation to no avail
The terms and conditions state that Three is responsible for supplying me the equipment, which they have failed to do so, hence holding me liable whilst failing to uphold their own terms makes no sense.

I've been on probation for 1 year, I'm scheduled for early release next month sentence to 2years6months Parole probation, In this one year I've completed everything they ask me to do, stayed out of trouble,found and kept a job, checked inn with my PO, found and kept a therapy sessions going up til the beginning of April when it all started crumbling down...it started with my baby mama starting drama by threatening to put me on child support( I'm no deadbeat nor do I not not want to see my daughter)and she knows that and threatened to tell dhs otherwise if she didn't receive money whenever she ask for it so, I did as she ask me to do but this time I stood up to her and refused to send her money ($300)(last week of March) so she threatened me again and blocked me which naturally build up stress in me so much it lead to me making a bad decision on this I decided to pop a adderall pill because I know it would calm me down(adhd) so I took the pill so the next day at work "Fuck ME sideways surprised surprised "everyone surprised UA obviously I failed and nothing happened came of it til mid April I received a phone call from my boss telling me that she was terminating my contract for my position for a non conclusive ua result, wtf does that mean, anyways I got fired had time to tell my po, I didn't now at the end of April my therapist drops me as a client for missing one day with her because I was sick with covid ! WTF Right!! Had time to tell my po I didn't, I knew my po was pushing for my early release of probation(which is why I kept everything secret) so, now at my latest PO appointment May6th Surprised surprised HE ASK FOR A DNA TEST like FML right so I gave him my dna test mouth swab(note i popped another adderall literally right before my appointment with him so My question is IM I FUCKED OR IM I FUCKED? I mind is thinking hes going to see traces of meth in my system and now hes going to think what else have I been lying to him about ? Hes going to check my work,therapist and find out all of that was BS theres no way hes going to ask the judge for my early release now right? I'm probably going to have to serve 30days for the drugs now right ? Drug counseling classes? Fuck !! What do y'all think?

Also, how would I go about it? Should I contact the building management or start by leaving a friendly letter in my neighbor’s mailbox? Unfortunately, my Japanese is not good enough to bring this up verbally and directly with the neighbor. Before coming at me with hostility, I would ask you to please read the post take the caveats listed at the end into consideration.
Every morning around 8:30, a kid living in the apartment above mine starts running. I know 8:30 isn’t super early which is the main reason why I’m uncertain about this but with my work schedule, by that time I have only gotten a few hours of sleep. I don’t know their situation, but this kid doesn’t go to school and keeps running for hours until my alarm goes off, after which I must get ready for work. This has been going on for weeks and I’m a wreck. It baffles me just how loud the noise is. I’ve tried to sleep through it but I don’t think most people, me included, would ever be able to. It sounds like a heavyset adult running on his heels only but with the gait of a fast ten year old from one room to another. Also, the thing is that just outside the building (no need to cross a road or anything) there’s a massive park that is safe, nice and have lots of kids playing, so I don’t get why the child can’t play there if it’s not cold or raining. Maybe special needs are involved but again, I’m not sure. Are negative consequences likely to follow if I do make the complaint?
As for the caveats:

I’m not the grumpy neighbor that keeps bothering people – I understand people can’t live on eggshells and that children need to run and make noise to develop, but in the nights and mornings, isn’t this beyond the limit of noise that you should subject your neighbors to? Maybe not at 8:30 A.M.?
I am concerned about my health and my life in general because like most people, I don’t really function when being sleep deprived for weeks and chronic sleep deprivation is pretty serious.
I have signed a two-year contract for the apartment and have been living there for a few months and this started a few weeks ago, so I can’t just switch apartments.

Well, it might be because you lack the time, resources, or both. But I asked myself: Do I really need to cross out each OR, add "invoice," ensure the "not valid for input tax" message is visible, and then report to the BIR? Why not just replace my ORs with invoices? That’s exactly what I did. Here’s the scoop
Every platform, accounting firm, and tax guru was clamouring to spread the news about RR 7-2024. I released an article about this even before the regulation was officially announced—check it out here.
The Revenue Regulation informs taxpayers that Official Receipts (ORs) are now demoted to secondary status. You can use your current ORs until the end of the year, after which you’ll need to submit an inventory of all unused ORs to the BIR. Efficiency, thy name is not RR 7-2024.
I promptly swapped all my ORs for Service Invoices, cheerfully ignoring RR 7-2024. Freelancers and professionals, gather 'round—let me save you from the black hole of searching, fact-checking, and prepping for a BIR visit.
Step 1: Reconnect with Your Printer:
Remember your trusty, accredited printer? Give them a call and let them know you’re switching from ORs to invoices. Send them a template (There's a copy below) to ensure all the necessary components appear on your new invoice. Ask them to whip up a sample template for you to bring to the BIR.
Step 2: Apply for a New Authority to Print (ATP)
Armed with your printer’s template and a photocopy of your previous ATP certificate, head to your Revenue District Office (RDO). Declare your intention to switch from ORs to invoices under the EOPT law. Here’s what you’ll need:

BIR Form 1906 (2 originals)
Clear sample of your new invoice (the template from your printer)
Photocopy of your last ATP certificate

Step 3: Send the New ATP Certificate to Your Printer
Once you’ve got your new ATP, hand it over to your printer so they can start churning out your shiny new invoices. That's actually it... It will take you about a day or two depending how fast your RDO or how many people the office is servicing that day.
I know you have some questions here are some answers:
What happens to the unused ORs?
According to the BIR, you can keep them as secondary receipts. They don't expire, so hang onto them for acknowledging payments. Just remember, they can’t be used for VAT transactions. Personally, I’m sticking them in a drawer for the next decade. Who needs two receipts anyway?
Do I need to pay to replace my receipts?
The BIR won’t charge you for the ATP application, but your printer will certainly charge for the new invoice printing.
What type of invoice should I use?
Reddit and social media are abuzz with confusion over Service Invoices, Charge Invoices, Billing Invoices, etc. My tip? Let the BIR and your printer sort it out. They’ll determine the best invoice type based on your activities. Typically, Service or Billing Invoices are the go-to options. Visit your RDO for clarity.
There you have it! If you have the resources and a couple of days to spare, go ahead and replace your ORs with invoices instead of following RR 7-2024 to the letter. Remember, the regulation’s suggestion is a temporary fix, so you’ll be visiting the BIR eventually. Good luck!

Hello and Good day all,
**Background**
I am an expat. Renting a house for one year. One year payment have been made. I have EJAR contract (all online, absher verifiable). All rental process went through in one real estate agency (lets call it 'Snail'). Few weeks ago, I found Eviction notice pasted outside the main door. Picture attached. I never receive any court notice or any sms regarding any court proceeding. I have conducted some due diligence.
**Due Diligence/What transpired within +- 2 weeks** in chronological order.
• *Snail's Director* : I texted him. According to him, owner have a problem and he is trying to solve the eviction notice. Told me not to worry.
• *Officemate A's cousin* : He is in the real estate industry. He confronted (by phone) Snail's director because he noticed that Snail the company and its director was name as Lessor and Lessor representative respectively. He also asked what happen with the eviction notice because I have valid Ejar contract.
Shocked by the call, snail's director mentioned that he needed to sell the house because his father needed money for treatment. After been pressed futher, Snail director folded and said I can remain until the tenancy end.
• *Officemate B's father* : Hes in the government (unknown department). According to him, aslong Ejar contract is valid. I cannot be evicted.
• *EJAR's office* : Show them the eviction notice. They said its fake. And that my Ejar contract is valid. If i want to lodge a report, go to REGA (real estate general authority).
• *REGA* : Went to the office Rega told me the notice is fake and to lodge complaint online. Complaint file and later the ticket status is 'Closed'. Received call from Rega asking me to lodge police report.
• *Enforcement Officer ('Repoman') : Texted him asking about the notice. I send him my Ejar contract. But he insisted i get out in a week. He also mention I need to talk to court if Im not happy.
• *ETC lawyer friends/district neighbors* : Reiterated, aslong Ejar contract is valid. Cannot be evicted.
**Fast forward to Yesterday**
A man claiming to be real owner (never met him before) said hello and ask me to wait 10 minutes. Later a police sergeant came along with a guy claiming to be officer from the court (his number appear at the bottom of the eviction notice). Three of them threathens me to give vacant possession to them immediately.
I called a local neighbour (lets call him 'Hat' for now) to assist me to speak Arabic with them.
The owner keeps on screaming that my Ejar contract is fake. The police took a hold of my Iqama and keep it with him, he stayed in the car. Repoman kept saying I acknowledged him because Ive texted him before. Hat argued back and forth with them. Hat managed to calm the owner down saying if anything I was a victim too and to give me time to vacate the house.
• *Hat* : Owner said he rented the house to Snail at 20 coins but he never received any rent for 2 years. He then find out that Snail has rented the house to me for 50 coins.
Further, Repoman took copy of my Ejar contract. According to him, he will bring my Ejar to the judge to see if he should proceed with the Eviction notice or seek further instruction.
Hat manage to get the owner to agree in principle after he gotten vacant possession, I could rent it back, at a lower rate. [Safe to say I have my doubt].
• *Snail's Team Member* : Received a call from unknown man claiming to be Snail's team member. According to him, Snail is a broker and owner trying to raise the rental. They had disagreement and hence the eviction notice. He also said that if i leave, Snail will reimburse balance of my rent by this week. I told him, I need time to think of the conpensation because this has caused inconvenience for me and I need to look for a new house. Also, ig we agree he must start the termination process in Ejar because the one who started the termination have to reimburse the other.
**Present**
• *REGA* : Trying to ask rega to verify the eviction notice again because I was ambushed by 3 guys prior. And if what the owner claiming is legit. Is my Ejar contract valid?.
Rega asked me to file new complaint to investigate the Ejar contract. They told me not to worry. I am very worried because I am in a foreign country without family support. Rega ask me to check the validity with the court.
• *Court* : Went to the counter. Was told that the eviction notice is with a judge now. I am not sure if my Ejar contract was attached to the notice or not. Ask me to come back in a week.
**TLDR :** I rent a house through real estate agent. I never known/met the owner. Owner and agent had disagreement. Owner obtained an eviction notice on the house. I was told that I have valid rental agreement and cannot be evicted. Owner bring police and repoman to threathens and evict me. I am clueless and in despair, not sure who to trust. Still not solve. Still finding the truth/answer. Waiting for court solution (if any).
**My question**

Can a property be rented twice using Ejar system?
Can agent rent a house as a broker against the will of the owner? If yes how? He have to fraudulently/knowingly fill the online form wrongly?
How does Ejar verify if the property can be was rented by a rightful Landlord?
Are my right as tenant protected if Snail comitted fraud? (Where i am a 'bona fide' tenant/victims/bystander).

Any advice/suggestions/share similar experience?

TW: brief mentions of depression, suicidal ideation, and attempted suicide
When I (28F) was growing up, I was the golden child of the family. I didn't know it back then. Up until I was in high school I had a younger sister and an older half sister I only saw a few times a year. It wasn't like I never got in trouble or got yelled at, in fact I have a very vivid and hurtful memory where I was called a liar by my parents when I was being 100% truthful (they just didn't want to hear it and wanted someone to be mad at I guess), and then I was told to just "suck it up and get over it". But compared to my younger sister, who was compared to me in every way, I always had the perfect grades, perfect attitude, perfect behavior, etc. Our parents, especially our mother, who was the main parent taking care of us during the week, pretty much pitted us against each other constantly. My little sister was being told she needed to be more like me, and I was told my sister was a bad kid. I would try to help her stay out of trouble as a kid and would get mad when she didn't listen to me because i didnt understand she was just being herself and didn't need to be exactly like me. Up until college, I didn't understand that my sister didn't need to change, she needed her parents to love her as she was and help her instead of trying to mold her into some ideal of perfection. We were picked apart constantly about every little thing we did, and I was expected to always somehow know everything even if I'd never learned it before. My house was full of constant yelling due to the extremely high expectations and my mother's terrible temper, and it became a very stressful place to be starting when i was around 10. We went through a lot of financial hardships as well since I was very young, so I dont want to dismiss how hard things were for my parents and how much they went through. But I have always been hyper aware of how much it costs for me to exist as my mom stressed so many times over the years that she couldn't afford to buy even a new shirt because she had to buy stuff for us, as if that was at all our fault.
When i was in high school, my baby brother was born. He pretty much instantly became the new golden child, not only because he was the youngest and the only boy, but because it became clear at a very young age how intelligent he is. I was a straight A honors kid and he was blowing me out of the water since he learned to read. I didn't mind at all because 1) I was going to be going to college in a couple years, and 2) with our age difference, he was as much my son as my brother, and I took on a very loving parental role with him of my own volition. I also saw the promise in him and I wanted him to live a happy life. My little sister and him are very close to this day, at least to my knowledge. During this time they were still coming down really hard on my little sister, treating her as well as they always had - meaning they still yelled at her constantly and were overly critical of her and everything she even thought about doing. They talked about sending her to military school more than once, and pretty much resigned themselves to the idea my sister would never be able to live on her own before she even got to high school, let alone graduated.
Flash forward to when I was in college, I started coming home and noticing things about how my parents treated my sister, and for the first time I saw it for how terrible it was for her. The distance and time I spent away from the house helped my little sister and I completely change our relationship by my second or third year. What really solidified it was a series of events that happened my junior and senior years of college.
My sister moved to our town with her husband with their 2 very young boys, and we soon found out she was pregnant with twins. That is kind of where it all began to fall apart. Time showed not only that her husband is a massive pos, but also potentially abusive, although we never got concrete proof. As my sister's pregnancy progressed and they struggled to get on their feet, my parents started watching my nephews for hours at a time, sometimes the whole day. And if my parents had to babysit out of nowhere and put their lives on hold, me and my younger siblings were expected to do the same. No toys, no books, no games - nothing. Essentially, the entire house was expected to babysit in a way that i have been told wasn't normal. Even my little brother was expected to take on this role in caring for kids who were only a couple years younger than him. I spent my entire childhood taking care of my little sister and then my baby brother, and I hated seeing how they were doing the same to him when me and my little sister were at the age where it shouldve been left up to us. I started really butting heads with my parents as the situation progressed because they started yelling at my baby brother when the boys would even bump their heads even though it wasnt his fault. He never mistreated them, hit them, pushed them , or anything, so my parents justified it by saying he wasn't being a "good uncle" by "letting them" bump their heads on the tv stand, for example. He was expected to let them play with all of his toys, and my mom tried letting the boys use things that were very important to my brother, which would've ended up with the boys taking those things home. Saying it that way makes it sound a lot more mild that it was, but I'm trying to save time and not give out too many personal details. I guess you could say in short, my parents began expecting my elementary school age brother to give up his time, his space, his toys, his gifts - anything that meant anything to him, to help care for children when he was still a child not much older than them. I ended up giving my baby brother my room to not only keep his stuff in, but to sleep in.
In the end, my sister had the twins and then moved back to her home state about 6 months later. We think her no good husband lied to her about us and she cut contact with all of us, and we haven't heard from her since. In our house, the damage was done. I had long conversations with my little sister when our parents weren't around about how she needed to get out because of how they were treating her, and how I would eventually graduate and move to a city where I could find a job. But neither of us wanted to leave our little brother in that house because we were worried how they would treat him when we both left. Our parents had already proven they would throw any of us to the side at any second, even their golden child baby boy, and blame even him for anything that went wrong. Our parents have a history of spilling all our business at any holiday meal and badmouthing any little mistake. They would talk shit about us in front of us and shame us in front of family our entire lives, and if my sister and i weren't there to take the brunt of it, how long until they turned on my baby brother. Would they even wait until he wasn't "perfect" anymore?
Throughout all of this, I was struggling a lot in college, and starting around junior year i became very depressed and suicidal, which resulted in a major attempt in my 5th year of college, which to this day i don't like talking about. Before that, however, I went to my mom about feeling depressed and told her i thought i needed to talk to someone. She brushed me off. I was dumb enough to think that maybe she thought i was exaggerating, so i tried a second time to ask her for help about a year later, and she brushed me off again. Part of me blames her almost entirely for my attempts, because i came to her before any of them because i knew thats where it was headed if i didnt get help. All she had to do was make a couple phone calls to find me someone to talk to and she couldn't even do that for me. I was a scared girl who needed her mom's help because i didnt know who to turn to, and she turned her back on me. After my final attempt, I pulled myself up and got help, but my financial aid ran out and I was unable to return to school and finish my degree, so I went back to my parents house and was absolutely miserable for the next 6 months. I felt like a failure, like I wasn't "perfect" like i was supposed to be. I felt suffocated every single day and like the only ones who wanted me there were my siblings. One day I tried a little experiment and sat in the living room with my mom for the entire day and she didn't say one single word to me, didnt even acknowledge my existence. Ever since the stuff with my nephews happened, I had doubled my efforts to protect my siblings and take the brunt of my mom's anger, so I pushed back a lot when they tried to get onto my siblings for ridiculous things. I ended up ghosting my friends for 3 months because I was so depressed, and it really scared them. It was then I knew i had to get out of that house or it would kill me, so I moved into my grandparents' house a town over.
Things at my grandparents' house started okay, and i was even able to confide in them what had been going on at my parents' house, which in the end turned out to be a big mistake. I got a job working overnight at a retail store and met the guy who is now my boyfriend of 3 years. Unfortunately, the longer i spent at my grandparents' house the more i saw where my mom got it from, and they ended up treating me just as bad as what was going on at my parents' house. The only difference was that my sister wasn't there so i was taking the brunt of all of it. When things started getting tough for them after my grandpa retired, instead of sitting down with me like an adult and asking if it would contribute financially, my grandpa cornered me in the car when he was driving me back from work and guilted money out of me with a sob story. And guilted me at the dinner table the second time when they needed more money. One time i walked in the house after work and before i had even taken my shoes off or put my purse down to get my wallet out, he blocked the door to my room with his hand out like a loan shark to give him the money. I payed for all my own expenses, took short showers and kept as many lights off as i could, and told them not to buy me anything, even food. And in the end, even though they guilted me for money, then more money, and promised they wouldnt kick me out, they sold the house out from under me when they knew i was still trying to save for an apartment with what little money i had left a month. I ended up having to live with my best friend and her husband or i wouldve been homeless. I still helped them move even when they f-ed me over. And even after all that, I still went to holidays and visited my parents from time to time.
The last time i saw my grandparents they ran into me and my best friend in a store. My grandpa saw me first (he and my grandma were in different parts of the store), and starting yelling at me for pretty much cutting them off since i hadn't been to see them for months, and then when he started realizing he looked like the bad guy tried to make the reason i stopped talking to them about politics (i live in a conservative area) as if that would justify it. When my friend and i were trying to grab one last thing before we left because i was humiliated and trying not to cry, my grandma cornered me at the deli counter, had me pinned between the counter and a cart so i couldn't leave, and started yelling at me too. I was so broken back then, but i tried to tell both of them i would talk to them but not in the store. They just wanted to scream so we left. I haven't spoken to them since and have no plans to.
Eventually i moved 2 hours away back to the city i had went to college in. During that time, my grandparents drove the 3 hours to try to find where i lived, and then called trying to get me to come downstairs. I was asleep for work at the time but it made me feel so uncomfortable that they would do that. And after living there a year and my bf and i commuting to visit each other every other week, it came to the point where if i wanted our relationship to continue i had to move back. This is not something he ever brought up to me, this was a decision I came to on my own. So two years ago I moved back to the area I grew up in. We live an hour away from my hometown and 30 minutes away from the town i met my boyfriend in. And although he has family in both areas that we visit, I haven't seen or really talked to my parents or siblings since i initially moved out of the area.
A year ago, after a year of silence from me and from my parents, I dropped a box off at my parents' house when they weren't home with souvenirs i got them on vacation when i first moved back, short letters to each of them about the gifts, and a long video letter on a flash drive explaining everything I felt because i knew i couldn't go on without being honest and i knew if i tried to have a conversation in person, they wouldn't listen to me. I told them i wanted to keep them in my life but i couldn't ignore everything that had happened and the ways they treated me and my younger siblings. I told them i had no interest in continuing a relationship with my grandparents and that anything they have told them probably wasnt true. I sent them scans of my diaries as "proof" that i wasn't lying because that's the kind of house i grew up in - if you couldnt prove it, it didnt happen. I laid myself completely bare so that i could heal, knowing the whole time they may never want to speak to me again. I gave them pictures of me and my boyfriend and my new phone number anyway. The only thing i didn't give them was my address because we live on his family's land and his family, knowing a bit about my family and also about my grandparents essentially stalking me, don't want anyone from my family nosing around on the property. I don't want that either so i agreed not to give it out. The people in my life who knew about the box and the letter turned video letter were supportive of the idea given all i had been through, and I thought dropping it off would be the end of things.
Since then, I have healed from everything that has happened. I'm still angry and sad and i feel like I'm grieving every day, but I'm not the spineless, scared girl i used to be. My boyfriend has helped me become a better person in so many ways. But i still miss my family, especially my dad. I feel like he didnt deserve what i've done for reasons i cant go into, because the reality is he depends a lot on what my mom tells him because he works, and he trusts her deeply. I feel like in some regards he depended too much on her word, although he isnt completely innocent. There's obviously a lot more to my story that what I have here or else I'd be writing an autobiography, but just know if this all sounds like it isn't a big deal, I have so many stories and so much more detail that isn't safe to give out here.
The reality is my parents and i pushed each other away until we all became strangers long before everything blew up. I felt like a stranger from the time i left for college. I was made to feel like if i wasn't at home, i was a second thought, and a lot of very serious issues happened while i was away that i didnt find out about until i came home. My last year of college i was physically starving and could only afford to eat one meal a day if that. When i had left for school at the beginning of that school year my mother made it clear i had to figure it all out myself because they had no money to give me, but then i came home for Christmas and everyone but me had all new electronics. I cried asking for money to buy my uniform to start my campus job but they bought all new computers and tablets. And that stung.
Last Christmas, my parents and siblings messaged me. It was the first time I had heard from them since before i dropped off the box. It was just a Merry Christmas, but it absolutely shocked me. And then they all messaged again on my birthday. Same thing, just little pleasantries, but it makes me feel like maybe that door isn't closed. However, I have absolutely no idea if we can move forward, if they want to, or even if its a good idea to try. I have struggled a lot since college about whether or not all of this and everything I wasn't able to share here is or is not a big deal. I've had people close to me listen to my whole story and call it emotional neglect and abuse, but I just don't know. I feel crazy most of the time, and I'm afraid I'm exaggerating or making it up for attention or something, which also doesn't make sense. I struggle a lot in my day to day. I am ruled by the emotions of those around me and i cower like a kicked puppy when people around me are upset, even if its not my fault. I get ashamed when i make a mistake or i'm not "perfect", and if my feelings are valid I have no idea if it would be a good idea to get back in touch. But i think about if/when my boyfriend and i get married, and how i have no family to sit on my side. It sometimes feels like it's my fault because i wasn't strong enough to just shut up and deal with it anymore. At this point I dont know what is the right answer, what's going to finally give me peace. For now, I just keep moving forward trying to build a better life with my boyfriend and hope all the pieces will fall into place later.

2024.05.15 09:30 Euain_son_of_ Ellis v. Corvallis Update 2

TL;DR: Remember when the City said that Ellis had violated the Charter by "attempting to discuss directly with the City Manager the matter of specific appointment to City employment."? They're now saying they didn't say that.
As many are aware, the City Manager, abetted by a weak City Council and an incompetent former City Attorney have been pursuing the removal of Charlyn Ellis from the City Council. Here's an earlier update from the case. There are more from the G-T.
Most recently, the City submitted a response in opposition to the Ellis' motion for summary judgement. You might wonder, "If the City can file a motion in opposition, can Ellis likewise submit an opposition to their motion for summary judgement, separate from her own motion for summary judgement? Could she submit a response in opposition to the City's response in opposition to her motion for summary judgement."
I would respond by saying, "How the hell should I know? I'm not some expert lawyer man. I'm just some guy--and also probably the number one customer of Block 15's in-store IPA sales, which is not a qualification for this exercise."
With that said, here are some totally non-expert and questionably sober thoughts on the response in opposition from the City, which you can find here.
The first argument focuses on standing. On its face, this is much less interesting for lay people like us, because it doesn't get to the core of the political power struggle that is affecting the governance of our town. I figured these details were trivial when I read through it a week ago. But when I read through this a second time, I realized that the City was walking back a pretty significant part of its beef. For example, our $1,000 per hour attorneys write that,

Here, Councilor Ellis has not demonstrated a credible threat of prosecution of any provision of Section 23(f)—other than the Influence or Coercion Clause—at the time her legal counsel filed this lawsuit on January 22, 2024, after 9 pm. The City’s Due Process Hearing Memorandum—filed before noon earlier that same day (see Shepherd Decl at ¶¶ 2-3)—made this abundantly clear. And, as described above, the City does not contend that Councilor Ellis violated either of the remaining provisions of Section 23(f) (or, in Councilor Ellis’s alternative grammatical framework, subsection ii). The City specifically elected not to proceed under the Specific Appointments Clause because, consistent with its other allegations, the City does not view Councilor Ellis’ conduct as “discussing”—or attempting to “discuss”—anything with the City Manager.

So, there's a lot to unpack here. They're saying that at the time her complaint was made, ^{specifically at 9 PM}, the City's due process hearing memo ^{which was edited at 12 PM that same day} didn't say that Ellis violated the Specific Appointments Clause.
"What the fuck is the specific appointments clause" you ask? The City has previously made the argument that there are actually multiple separate clauses to Section 23(f), and that to violate any one clause is to violate the charter. That is, they should not be read as being interdependent:

As relevant to these proceedings, Section 23(f) applies to City Councilors and reads as follows. For convenience, we have separated the independent clauses in the correct grammatical form: (f) Interference in administration and elections. Neither the Mayor nor any member of the Council shall [i] in any manner, directly or indirectly, by suggestion or otherwise, attempt to influence or coerce the Manager in the making of any appointment or removal of any officer or employee or in the purchase of supplies; or . . . . 1 [iii] discuss, directly or indirectly, with the Manager the matter of specific appointments to any City office or employment. A violation of the foregoing provisions of this section shall forfeit the office of the offender. Nothing in this section shall be construed, however, as prohibiting the Council, while in open session, from discussing with or suggesting to the Manager, fully and freely, anything pertaining to the City affairs or the interests of the City.

I realized it seemed weird to read that the City did not believe Ellis violated the Specific Appointments Clause because that's how the complaint about Ellis' actions was originally framed. From the GT

"By adding a level of specificity that you want the city manager to appoint a particular officer or employee, I think that’s exactly what the charter says you can’t do," Brewer said at the meeting.

Then there's the unsigned due process hearing letter dated December 6th, which states (my emphasis):

"WHEREAS the actions of Councilor Ellis at the City of Corvallis City Council meeting were a direct attempt to influence the City Manager in the appointment of an employee and an attempt to discuss directly with the City Manager the matter of specific appointment to City employment."

It sure makes it seem like the City did accuse Ellis of violating that clause because that's how they understood her actions to be a violation of the charter. Odd that now that apparently wasn't the case. It makes me wonder just what the hell the Mayor, City Council President (Yee), Vice President (Lytle), City Manager, and City Attorney thought they were putting their names to on December 5th when they signed a document stating that they "received concerns from Corvallis City staff, City Manager, City Councilor, and community members about the conduct of Councilor Ellis during a September 12, 2023 Corvallis Climate Action Board [sic] and during a September 18, 2023 City Council Meeting." Maybe an actual journalist could ask them that question.
Were those concerns related to the Specific Appointments Clause or the Influence or Coercion Clause? And when they say that "Each of the undersigned observed in person or through video recordings, the respective meetings and concluded that the video recordings were substantial evidence sufficient to place this matter on the agenda for the attention of the City Council for consideration" did they foresee that their new attorneys, replacing the demonstrably incompetent Jim Brewer, would decide that Ellis hadn't violated the Specific Appointments Clause at all?
Why is this relevant? Because the City is now arguing that, because they aren't actually alleging a violation of the Specific Appointments Clause--never mind that's exactly what they did, and what the Council would honestly still admit they thought they were doing since they're totally asleep at the wheel while the City Manager drives this process (^{remember that} ^{he's the only one whose even allowed to talk to the new City attorney})--Ellis doesn't have standing to have the whole of 23(f) thrown out. Just the part she is accused of violating. It makes this standing argument start to read like the City attempting to save a portion of 23(f) from judicial scrutiny by claiming it's not ripe for litigation, even though they were very clearly poised to wield that clause as a cudgel to have Ellis ousted from the Council. If putting it in a charging memo and having other Councilors pressure you to resign on the basis of that memo before you hold a kangaroo court hearing to kick out an elected official wouldn't make it ripe for litigation from a judicial standpoint, I think any layperson can see the implications here: Mark Shepard will use this clause as a political weapon again.
Beyond that, there seems to be a bunch of nonsense arguing about categories of speech suppression. The whole thing concludes with this statement:

"As described in the City’s Motion, if a Council member does not intend to “influence or coerce” the City Manager, then they have not violated the Influence or Coercion Clause. (Def.’s Mot. for Summ. J. (Dkt. 10) at 21.) And she fails to acknowledge another important purpose of the Influence or Coercion Clause: effectuating and maintaining the separation of powers between the City Manager and the City Council."

So, obviously, Ellis has contended that she didn't intend to violate the motion, which at the time didn't seem like a worthy defense, since the City was not alleging that the only "clause" of 23(f) that was violated required intent. And then the last sentence is just presented as an afterthought, when, in fact, that's the core issue of importance to this case: is the City Manager an all-powerful dictator whose behavior can be controlled only through the threat or actual enactment of his termination, imposing significant costs on the City, or can he be specifically directed to enact the Council's political agenda? Are Councilors able to speak freely about his operational decisions if they don't feel those comport with the policies they've adopted? Why do our new City attorneys spend so few words in support of this position that Mark and Jim have supported so emphatically?
Only time will tell. Kind of feels like the City is positioning to limit the damage here, but, again, I'm just some guy, so I might be full of shit. Either way, this latest motion definitely cost us all a lot of money.

2024.05.15 09:08 Winter-Ad-8701 Apex hidden rules

Hi, I'm interested to hear experiences people have had, and are currently having with Apex Trader Funding PA accounts. Specifically if they've been paid out ok, or if they've had any "unqualified trades" removed.
My issue is that Apex have a TON of extra rules on the PA accounts. They can seemingly deny us a payout for literally any reason they choose. Things like not "chasing the market" - what even is that? If it's going up, I'm going to buy! I trade price action, and if I think that going long is going to make me money, why wouldn't I buy?
I understand that they have to protect themselves from people throwing 10 contracts on the NQ and making $5000 on day 1, then flipping 1 contract on the MNQ for the next few days. That's fine, and is covered by the 30% consistency rule(although I'd prefer that to be 30% per trade, not per day).
What I don't like is the unnecessary threats of removing trades and funds from my account if I slip up and don't follow their rigid, draconian set of rules. They have rules about always using a stop loss, yet allow group trading on Tradovate, which does not allow bracket orders on group trades! It's literally the most requested feature on the Tradovate forum.
They have rules about not changing sizes. I change sizes depending on a few things, volatility, how sure I am about a trade, what my balance/drawdown is etc.
They have rules about having a clearly explainable system, yet I am a discretionary trader and use price action.
They have a no news trading rule, yet it doesn't state what news trading is. Is it a major economic release, and you have to be flat 1 minute before and after? 2 minutes before and after? It doesn't say!
There's a no dollar cost averaging rule, does that mean we can't scale? Scaling is essential for some people, and absolutely makes sense if the market is in a trading range, as your first entry may not be optimal if you tried to buy the bottom and it pulls back further, so why not add a second contract?
I could go on, but I think I've made my point. Trading is hard enough without these artificial rules being enforced. If I make money on my personal account, that's it, I have profit. I don't have to explain anything to anyone, it's money that I have made. All I need to focus on is trading and making profit. Yet with Apex, I would need to be thinking "does this trade meet their criteria, is my stop enough ticks away, have I waited long enough after news, how many contracts did I use yesterday" etc.

My friend has worked for this place for 3 years and it has been the bane of her existence since she has started. Ill spare you the details but to summarize they treat their people like crap and I believe take advantage of new grads that can't really fight back. Also just want to mention that the company categorizes her as a 1099 but my mom (who works for unemployment tax for 20 years) believes she is categorized incorrectly and should be a W-2 employee based on the details of the day to day responsibilities.
She was told she needed to give a 30 day notice so she did 2 days ago and today was sent an email that she will have to pay back her signing bonus and all the quarterly bonuses from a year prior. The signing bonus she expected since she knew she was going to leave this year so that was planned for but the quarterly bonuses were not expected. The quarterly and end of year bonuses add up to 3k.
This year I guess they added this last sentence to the portion talking about bonuses:

"Any Contractor with less than one year tenure will return all bonuses and re-imbursements upon resignation or termination, payable on final paycheck. Any balances will be payable directly to Company. Special bonuses and/or incentives will also be recouped should therapist resign or terminate within one year of receiving the bonus."

The way this is phrased sounds to me like if you have been working for them for over a year this should not apply but they are saying that she will owe everything from a year prior. Also if that last line of this was added in this years contract (2024), can they retroactively get money from before this was in the contract (prior 2024)? I am unsure because there is another part of the contract that says they can but I don't know if something like this would actually stand when it comes to taking back wages. I read that employers can not retroactively reduce pay but right now she is considered a 1099 not a W-2 so I'm guessing that would be the first fight.
"This contract issued January 22, 2024 and is binding for a period of 1 year from the date of signature. This contract is between Company and Contractor. This contract replaces and supersedes all other contracts between Company and Contractor. Company and Contractor agree as follows:"

ANY advice is greatly appreciated!
We close on a new build Lennar home in July-Northern NV. This will be our very first home! When us and our realtor agent went in office to sign contract and give Ernest money, we asked about a 3rd party inspector. Our agent and the Lennar sales rep both said it’s our choice to pay for our own inspection. They also both said it’s a waste of money since we have the year warranty and they advise living in the home and getting to know it for few months then filing warranty claims if needed. Lennar sales rep said they have 30 days to fix any claims. We’re definitely not listening to that advice. However I have some friends who bought from Lennar over the past few years and their agents told them the same, live in it for few months. They were told it’s a waste of money because inspectors won’t find much wrong and do not look deep enough. Almost sounds like it could be lack of due diligence from 3rd party inspectors in our area. We’re hoping to find a great inspector.
**My question- is Lennar required to fix everything and anything on the inspection report prior to us closing? Can they pick and choose what they fix on the report on the basis that it still meets city codes and regulations?
Our interest rate is currently locked in till 7/31 and we close on 7/17. The thought of possibly feeling pressured to rush into closing by 7/31 is making us nervous considering interest rates right now and the out of pocket cost that would be needed to keep our current rate locked in after the 7/31 deadline.
We have also heard that claims filed through warranty can be overlooked with the excuse that everything is up to code.

Na post ko na 'to sa isang subreddit pero dito din post ko ulit!
It's been a more than month since my last company terminated me because hindi ko nadisclose na non-rehirable ako from my previous company since nag immediate resign ako(health issue). Now, I haven't received my final pay. As per HR, it will take 30 days for the final pay to be credited but as of now, wala pa rin. 2 cut-off na sahod yung nakahold since kailangan daw nila ng assurance na ibabalik ko yung company asset nila(which I did).
Anybody got DOLE's email address? Need ko sila CC sa email since unresponsive yung HR(1 week bago sumagot).
