We are looking for 13 more users (for a total of 25) to run an online dynasty on Xbox Series S/X.
I'm a (wanna be) creative who loves NCAA Football and is excited for the new game as anyone. Like many people in this subreddit, I like to have head cannon and storylines for my players, assistant coaches, rivals, etc. During the early days of the pandemic, I joined up with an NCAA 14 OD for awhile where most of us made up funny coach names/personalities which we then used as our Discord server names.
As we came up on the new game's release this summer, in my boredom, I went about making up a coaching resume using real teams/players/stats for a two-person dynasty my friend from college and I will be doing. I genuinely had so much fun perusing NAIA, FCS, D2/D3 programs of the last decade or so to create a coherent backstory that I thought it would be fun to set up a bigger dynasty with more D&D character coaches.
For an example of what these would look like for each user, here is the one I'll be using:

Hall of Fame for user players: At the end of the career of any player on your team who you believe should be immortalized for their achievements on the field, you can nominate them for induction into our HoF to be voted on by all users. A two-thirds majority vote will land that player in our Discord channel HoF.
Annual awards show for user players/teams: On Week 12 of every season, I will send out a Google Form for the nominations of 15 categories like Offensive/Defensive Players of the Year, MVP, and Coach of the Year. At the conclusion of the season, ballots will be sent out (once again via Google Forms), tallied up, and winners revealed in our Awards Show. Winners will be recorded for posterity in another channel within our Discord.

The extent of Topic's recovery process will be determined by specialists in the U.S., but it will not be surprising if he will require a redshirt season -- similar to how Chet Holmgren, Joel Embiid, Michael Porter Jr. or Blake Griffin started their NBA careers. San Antonio (No. 8), Utah (No. 10), Oklahoma City (No. 12) and Portland (No. 14) are viewed by teams as potential landing spots depending on team doctors' full assessments of his medicals, which have yet to be distributed. Only teams picking in the top 15 will have access to those, per new CBA rules.

Holland's range appears to be a little wider than initially thought. He has fans among teams drafting in the top 10 but is casting a fairly wide net in workouts, including teams such as the Miami Heat at No. 15 and the Los Angeles Lakers at No. 17, in part because of his strong positional fit in those attractive markets. Holland's game might not be best-suited for a workout setting with his streaky jumper, especially with many lottery candidates opting for one-on-zeros, which means he'll have to find other ways to impress NBA teams with his toughness and aggressiveness. Teams say they are having a somewhat difficult time pegging his floor.

At this stage, Williams' range would appear to be among the widest of our projected lottery prospects. He has interest from teams in the top 10, including Detroit, Charlotte, Portland, San Antonio and Utah, but there are also teams picking outside the lottery that remain curious whether he might fall to them.
  1. Devin Carter PG/SG Providence
Carter has built up buzz throughout the pre-draft process and has worked himself comfortably into the Nos. 8-15 pick range. He worked out for the Los Angeles Lakers at No. 17 this week and has multiple workouts in the lottery still scheduled. While he has not accepted any type of promise from a team, he is trending in a positive direction. The San Antonio Spurs (No. 8), who have a need at guard, and the Memphis Grizzlies (No. 9), where his father, Anthony Carter, serves as an assistant coach, are viewed as the high end of his range. Another interesting landing spot would be the Miami Heat at No. 15, where his father played from 1999 to 2003 and coached from 2018 to '23, creating a level of familiarity. Carter will also be of interest to playoff-caliber teams that are considering moving up in the draft.
  1. Ja'Kobe Walter SG/SF Baylor
Walter has interest from teams drafting in the lottery and shouldn't fall too far out of it if he slips, bringing a 3-and-D skill set that's widely in demand.

Teams say McCain is taking a different strategy than most players who are in his draft range, which is believed to be around Nos. 9 to 20. He is refusing one-on-zero workouts in favor of competitive 3-on-3 group settings. With most of the teams in his range also looking for shooting finesse, including Memphis, Oklahoma City, Sacramento, Miami, Los Angeles, Orlando and Toronto, McCain likely won't have a very long wait to hear his name called on draft night.
  1. Zach Edey C Purdue
Teams say Edey's range appears to be in the Nos. 9-19 range based on the workouts he has conducted and scheduled. He was with the Toronto Raptors this past week, will visit the Los Angeles Lakers, and is in the conversation at Memphis (9), Utah (10), Chicago (11), Oklahoma City (12), Portland (14) and Miami (15).
Several teams say Edey's productivity ranks him as a top-three prospect in this class according to their draft models -- ESPN's Kevin Pelton had him ranked No. 2 in his stats-only draft projections.
  1. Tristan Da Silva SF/PF Colorado
He has interest from lottery teams, including the Memphis Grizzlies (No. 9) and Sacramento Kings (No. 13), and has scheduled workouts with teams drafting down into the teens, with the expectation being he'll come off the board somewhere in that part of the draft.

He should be off the draft board within the top 20 and has interest from the late lottery teams, including Memphis, Chicago, Oklahoma City and Sacramento.

Coach and Mrs. Coach – The Taylors were the victim of their own success in Philadelphia. Coach's team made the playoffs but had his reputation stained when some of his players were involved in fixing the games. His disciplinary efforts drew the ire of the South Philly mafia and caused him to compromise his integrity for the first time in order to protect his family. Tami's de-emphasis on standardized testing was ahead of its time. It was too successful and drew a lot of heat from the Commonwealth's Department of Education. Tired of fighting the system, they both left Philly in 2015 with their tails between their legs and settled in San Antonio. Coach became a quarterback scout and Tami started a homeschool curriculum program. Her business boomed post-pandemic while Coach's career has plateaued at the collegiate level.
Jason Street – Spent a few years as an agent then moved to Las Vegas and got involved with a sports gambling startup. Made over $10 million when it was sold to DraftKings but lost most in a messy divorce from Erin. He still had enough to start his own wheelchair basketball nonprofit and is currently training to be the first paralyzed astronaut to fly with SpaceX.
Billy Riggins – Recognized the craft beer craze of the 2010s and started his own, Riggins Radler. It was mildly successful allowing him to hire a manager for Riggins Rigs and live a solid middle-class life, even with three kids.
Mindy – Became the house mom at the Landing Strip, then the head bartender. Went civilian in 2017 as the marketing director for Billy's businesses.
Tim Riggins – Built his house and became a long haul trucker, but despite his promise never to break another law lost his CDL after getting hooked on amphetamines and later opioids. Currently scheduled for release in 2027.
Lyla Garrity – Joined a sorority at Vanderbilt, married a frat boy who was heir to a horse farm in Kentucky. She has two kids, 10,000 followers, and runs a podcast on “mindfulness.”
Buddy Garrity – After Buddy graduated and without his only friend Eric to steer him, Buddy slowly went downhill. He became an alcohol by drinking his own supply while running Buddy's into the ground. Died of a heart attack in 2018.
Becky – Cheated on Luke three months into his deployment. Became a travel stripper; then went straight in 2016 and became a flight attendant. She's based in Atlanta and lives the single life when not flying.
Luke – Got sent to Afghanistan but didn't see much combat. Came back to Dillon where he became the Assistant Pastor for his church. He runs the youth ministry and also works as a camp counselor.
Julie – Married Matt in 2012; their wedding song was “Mr. Sandman.” Divorced him in 2013 because she “wasn't happy.” Ran to the now-divorced TA and got engaged but left him at the altar. Moved back in with her parents in during the pandemic and never left. She works part-time as a cosmetologist.
Matt – Works as an accountant in Chicago but runs an Etsy store on the side where he sells designer rings based on his sketches.
Smash Williams – Played two seasons with the Buccaneers but didn't get much playing time. Leveraged his Alamo Freeze experience to get a corporate job with Raisin' Canes when they expanded into Texas.
Landry “Lance” Clarke – Moved to LA to become a music producer, but had to work as a mechanic to pay the bills. He found his break when he decided to “go country” as head of a western swing band based in Bakersfield.
Vince – Played all four years of college football, then became a motivational speaker and works for a youth outreach nonprofit in St. Louis.
Tyra – Got involved in state politics and became a Democratic “fixer” and strategist in Austin. She's still single.
J.D. McCoy - Played 1 year at Florida International before overdosing at a house party.
Devin – Joined ROTC at Colorado State and became a security officer in the Air Force. She became a corporate security officer with Exxon in Houston in 2019 and married in 2021.
Jess – Became a civil engineer but returned to Houston to help run her father's restaurants in 2021.
Hastings Ruckle – Became a sailing instructor in California, then found his way to New Zealand to work as a deckhand on a dive boat. He bought the business from the owner in 2022 and became the new captain.

Hi Reddit. I’m thinking about having a kid soon with my wife. Anyways, I grew up in Texas and it was full of Mexicans, Hondurans, Salvadorans and they all spoke Spanish, but I didn’t, and I always felt like I was missing out
But, I once knew a guy from Indonesia who learned English from watching nothing but SkyDoesMinecraft when he was young, so it gives me an idea. What if I just sit this kid down in front of the TV but instead of Cocomelon I feed him nothing but, like 31 Minutos and El Chavo and stuff between the ages of 2-10. He’d speak Spanish perfectly, plus it’d be cool, and come in handy in Mexico or Houston where people don’t really speak much English
Is this a good idea? The only drawback is see is that it could maybe ruin his language development or something. For context, me and my wife are both white and know maybe 10 words of Spanish each

  • On a serious note, like mentioned previously, seeing Oklahoma, BYU, and Utah down here was not expected. Maybe the Utah schools are overrepresented online, but as a Texan, Oklahoma has a massive fan and alumni base down here. And with the Pokes getting over double the votes I really expected Oklahoma to have more.
  • Baylor I suppose I could have seen being higher. Players seem to like rebuilds, and Baylor seems to be entering a rebuilding phase. In addition to some cool uniforms and a nice stadium this school should have probably gotten more votes.
  • Nothing really to note on the G5 side except for Northern Illinois. When the last NCAA football game came out, they were on top of the G5 world. Now they are absolutely dead last. Oh how the mighty have fallen.
Finally, the last way I'm going to sort this is by conference. Also included will be the conference's vote total compared to all total votes by percentage. I'm not going to include the percentage next to the teams anymore, mainly because I've already done it and I'm lazy.
For reference on the "Percent of entire total" row. There were a total of 6551 votes casted throughout the whole poll. So I am just dividing the total conference votes by this number to find out what percentage of votes went to the conference as a whole.

  • Biggest winners are the Big10 and the Sun Belt. While the Big10 is more balanced, both are carried by the high echelon of teams, certainly so for the Sun Belt. The Big10 didn't add much of anything by adding the 4 former Pac-12 schools.
  • Biggest loser by far is the MAC and it is not even close. Nobody wants some MACtion apparently.
  • Independents killed it as well. Highest votes per team by over 9 votes.
  • Remaining Pac-12 schools likely got a bump for their dire situation. Votes per team is quite high in comparison to other conferences.
In conclusion, I reckon most players will start out with their Alma Mater or favorite team. And then (once they've won a few nattys) jump straight into either a P5 rebuild or bringing a G5 team to ultimate glory. But I do want to bring attention to some of the teams that won't be played very often. Why not be unique and different, and give a school a chance you wouldn't normally look twice at? To anyone who is still here thanks for reading! Hopefully this weird week-long obsession of mine has piqued the interest of someone else!

2024.06.06 23:24 PermitGrand1024 CAN/USA vs USA plan.

I am going down to Texas for Ph.D. studies. I will be in Texas for nine to ten months of the year for the next three years. I am trying to figure out what to do with my cell phone while I am down there. I am currently on the Canada/USA/Mexico plan with Telus (150 GB of data, etc.) for $63 after tax.
It is a great plan; there are only two issues. 1. Although the plan has USA usage, the fine print says that you have to use it the majority of the time in Canada. 2. I have seen mixed reviews on the speeds for USA roaming.
The way I see it, I have two choices: 1. Get a US cell port, port my Canadian number to a service like Fongo, and have it forward my calls to my USA number. 2. Use my Telus phone and run the risk of them cutting me off.
Anyone have any suggestions or experiences?
I will be living in Houston, and I tend to be a heavy data user (between 80 and 110 GB) if that changes things.
Update: I was hesitant to contact telus directly, but I figured why not contact them if I can always switch my service provider if they have an issue. I laid out the situation the agent said it won't be a problem and I got him to send me a send me a text message laying out I double checked the details of this trip and he said it won't be a problem. Whether telus would honour that if there was an issue, who knows. But it is better than nothing.

I love 1972d. It's really well written, and playing as a Soviet puppet aside I have a soft spot for playing as third parties in general (even if you getting federal funding is the closest you can get to "winning"). Still, there's only guides for Fonda, Hayden, Kovic and Sadlowski (and the last one only works on Cakewalk!), and many people thought that some running mates are unwinnable on normal. I thought the same at first, but with CTS's console letting you get optimal RNG AND answer hints for most popular vote, you CAN win with all running mates on normal (with optimal RNG at least).
Anyway, here's the guide for Angela Davis. You can theoretically win on normal, but it requires a shit-ton of luck, so I recommend trying it out on easier difficulties first.
VISITS: All in California (funny thing, i thought that you might need to visit different states after i got the best results with "autovisit all", until it turned out that this command makes you visit EVERY STATE AT ONCE. With further testing I came to the conclusion that going all in on California was the best strat all along.)
  1. What's that thing that those kids in the Weather Underground are saying? “Dig it, first they killed those pigs...”
  2. We have to turn some heads if we're going to get anywhere. Let's rile up some of these angry kids and get a real fight going, inside and outside the floor!

Picking Up the Remnants

  1. SEC Gutted, but the bones are still there for a good conference
  2. ACC Gutted, but several teams fit the remained of the SEC.
    • SEC invites Clemson, Louisville, Georgia Tech and Virginia.
  3. The Big 12 has a solid core remaining, but the draw to the SEC will be too strong for some.
    • SEC invites Oklahoma State and UCF, giving them an Oklahoma and Florida team back.
  4. The B1G loses firepower, but retains the majority of their members
    • Filling in with Pitt, Kansas, Utah, Iowa State, and Cincinnati gives them a 16 team power conference back.

Spring 2073 The Debates of The Grand Constitutional Convention of The Republic
Introduction When the forty-five delegates of the Grand Constitutional Convention met in Spring 2073 in Austin, the nation was watching. The 45 delegates met in the Texas State Senate Chamber, and on morning one took an oath pledging to impartially undertake their duties. The convention's first act was to elect a presiding officer, initially, there was some discussion of electing President Alex Jones as presiding officer, but the President made it clear he would not accept the post and made known his desire for the role to instead go to someone else. The Convention as such chose Governor Ted Cruz, the former American Senator with a background in Constitutional law. With a presiding officer elected the convention opened, and the first order of business was an address by the President. Address By President Jones
“Delegates, citizens, and all those watching. 286 years ago in Philadelphia, our forebears, the Founding Fathers of the United States gathered much like we do today. They were tasked with doing something no one else in history had ever accomplished, creating a free republic, safeguarding the Liberty of the people, and promoting peace and the general welfare. They succeeded and created the greatest Republic in human history. Today we embark on the same quest they did, armed with the knowledge of what worked, and what failed. Our charge is to create a constitution that will safeguard Liberty from globalist tyranny, create peace and general welfare, and which can last the test of time. I am confident we can do so, assembled before me are the greatest minds of our times, the men and women who for 50 years of provisional rule have made Houston great. Today we make Houston even greater. Therefore with our charge clear, I hereby open these proceedings. And may the spirit of 1776 be among us as we debate…”

Federalism

The Convention first tackled the question of whether Houston should retain the federalist nature of the American Constitution. There was a consensus to do so immediately, all 45 delegates responded favorably to the initial motion to enshrine Federalism. But the debate then moved to the type of Federalism to be adopted. Texas Delegate Dan Crenshaw spoke of a need to “ensure that states are furnished with more rights than they enjoyed in the United States”. In particular, Crenshaw proposed abolishing the commerce clause and taking away the power of the Federal Government to regulate interstate commerce. This received considerable pushback from New Mexico Governor Martin Henrich, who offered his concerns about a “world where states can essentially hijack overall federal economic policy because of petty disputes with other states” Crenshaw's proposal as Henrich pointed out looked more like Canadian-style federalism than American. Crenshaw fought back noting that Canadian-style federalism had a greater emphasis on states' rights than American. However, Heinrichs opposition made little difference as the “Crenshaw Motion” as it came to be known picked up support from Florida, both Carolinas, Virginia, and Alabama. With that, the motion went to the floor and was carried 39-6 on party lines.
Houston would be a federal republic, but the federal government would lose much of the powers the old American government had, and indeed would more resemble Canada than the US.

The Executive Branch

The Convention then moved to the question of the Executive. This portion began with significant debate over whether the executive Presidency carried over from the old US should remain. In particular, all 39 Republican delegates noted abuses by Democratic Presidents like Barack Obama and Franklin Roosevelt. Tennessee Governor and former pro wrestler Glenn Jacobs in particular pointed out that Article II in the American constitution created what was essentially an “elected king…with little oversight, and no practical limits on his power outside of the individual interpretation of the present holder of the office.”
Democratic delegates fired back, noting the importance of a strong executive as a check on the Legislative branch. In particular, Arizona Governor Lupe Contreras noted that a President with sufficient power was needed for times of crisis. This disagreement on executive power subsisted for two full days of debate until President Jones intervened. In a short speech, the President made his position known and broke the deadlock
“While I understand the points made by the Gentleman from Arizona, and indeed would have agreed with them when I was a young man, I disagree now. The Executive branch cannot be a one-man show I would say I as provisional President wield too much power for one man. Therefore as the current occupant of the Presidency, I would endorse a reduction of my powers, in line with the pre-2021 Russian Constitution. Keeping some key powers in the hands of the President, but returning others to the legislative branch, and some as well in the hands of a new office.”
And with this, the deadlock broke as the majority of the convention took the president's view. And indeed they endorsed his view of a Russian-style Presidency. The Convention adopted the “Jones Motion” 40-5 which laid out the following A President is elected by a two-round popular vote of the people for a 4-year term with no term limit. A Prime Minister is appointed by the President with the approval of the Legislature. The President would take on a role similar to that of the former Russian President. Specifically as the “guarantor of the constitution”, and appointer of the cabinet, supreme court, and similar offices. The President would retain veto power which would still have to be overridden by a two-thirds majority, he would however lose much of his say on domestic policy which would instead be handled by the Prime Minister. The President would retain effective control of foreign policy, however, and of course, would remain Commander in Chief of the Armed Forces.

The Legislative Branch

With the contentious debates on the executive branch finished the convention moved to the legislative branch. The Convention immediately endorsed retaining a bicameral legislature, with an upper house and a lower house. However, tweaks were made. For the Senate the convention agreed unanimously that each state should send 3 Senators instead of 2, creating 42 Senators. The Convention also agreed to return to the original mode of electing Senators, that is by the vote of state Legislatures. Additionally, the terms of Senators it was agreed, should be four years rather than six. This new Senate would be named “The Federal Senate of The Republic of Houston”
The question of the lower house was somewhat more tricky. First and foremost the Convention agreed in line with the new executive branch, to drastically reduce the role of the Speaker of the Lower House, removing him from the line of presidential succession, and removing all partisan powers, leaving the speaker merely as a nonpartisan presiding officer. The Convention agreed that the lower house should retain a two-year term as set out in the old constitution, and after some disagreement did not add term limits. The President was also granted the power here to dissolve the lower house when the need arose. There was some disagreement on size, with some wanting a smaller upper house capped at around 150 seats. However, eventually, it was agreed the lower house should have 300 seats. Finally, the question was posed as to how the lower house should be elected, and after some disagreement election by first past the post voting was codified into law with other forms like ranked choice voting being prohibited. The lower house would be named “The House of Delegates of The Republic of Houston”
The name of both houses together would be “The General Assembly of The Republic of Houston”

The Judiciary

The Convention quickly agreed to make no changes to the overall structure of the judiciary. However, it was agreed after some debate that the Supreme Court should not have the power of judicial review, which delegates like Glenn Jacobs argued created “activist judges”. Additionally, the court would no longer have life appointments, instead, a justice would be appointed by a President for a 6-year term and confirmed by the General Assembly. Every six years a President would be able to renew a Justice's commission or revoke it, and conversely, the General Assembly had the same power. The Supreme Court is the name.

The Bill of Rights

The question of a Bill of Rights proved most contentious. The Convention by and large agreed that a bill of rights was desirable, but the scope of those rights was hotly contested. Democratic delegates did not want the right to bear arms included, while more conservative delegates did not want to include an establishment clause as in their view the status of Houston as a Christian nation was not in dispute. Additionally sparring over limits of free speech was pitched and dominated conversation for 4 days. Finally, the convention agreed to the following text of a bill of rights
  1. The General Assembly shall make no law prohibiting the free exercise of religion, or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.
  2. The right of the people to keep and bear arms, shall not be infringed.
  3. No soldier shall, in time of peace be quartered in any house, without the consent of the owner, nor in time of war, but in a manner to be prescribed by law.
  4. The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall be issued, but upon probable cause, supported by oath, and particularly describing the place to be searched, and the persons or things to be seized.
  5. No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the land or naval forces, nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.
  6. In all criminal prosecutions, the accused shall enjoy the right to a trial by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense.
  7. In suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise reexamined in any court of the Republic , than according to the rules of the common law.
  8. Excessive bail shall not be required, nor excessive fines imposed.
  9. The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.
  10. The powers not delegated to the Republic by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.

Approval By The Convention

With this after a month of work, the convention formally finished drafting its Constitution. And on April 5th 2073 the Convention voted on the draft constitution.

Ratification

With the draft approved it was now necessary for two thirds of the states to approve the draft. And on March 18th 2073 in simultaneous sessions in all 14 states, the state Legislatures of 12 states ratified the constitution, 1 rejected it, the final one, Arizona had a deadlock between the two houses.

Commencement

With this the Constitution of The Republic of Houston will come into effect on July 4th 2073, and the first elections under the new constitution have been set for November 7th, 2073.

HOUSTON – LIV Golf kicks off their second half of the season at the Golf Club of Houston. This is LIV’s first ever event in Texas. Texas becomes the 11th different state to host a LIV tournament.
The Course
The Golf Club of Houston was founded in 2003 and has hosted PGA events before, most notably the Houston Open from 2003-2019. It features a total length of 7,425 yards. Golf Digest ranked the course as one of the best public courses in Texas. The course features multi-tiered greens, strategic bunkers, and several water hazards.
Homegrown Talent
This is Patrick Reed’s hometown event. He was born and raised in Texas and lives outside of Houston. Reed, of 4Aces, had a lot to say about his return home,” I’ve been talking to so many people around here …and they’re all pumped and excited for it,” he said..
Players to watch:
Bryson DeChambeau, Captain of Crusher’s GC, is hot right now. He’s coming off a solo second place finish at the PGA Championship last month.
Richard Bland, of Stinger GC, is coming off his Senior PGA Championship win with a strong showing. Hopefully he can keep the success rolling coming in to Houston.
Anthony Kim, LIV’s wildcard player, will make his first start at the Golf Club of Houston in 14 years when he won the Houston Open by a playoff in 2010.

Trump’s latest quid pro quo

At a high-dollar fundraiser at Donald Trump’s Mar-a-Lago Club in April, the former president promised top oil executives that he would reverse Biden’s environmental rules and policies in exchange for $1 billion in donations to reclaim the presidency. Those in attendance reportedly included representatives from Chevron, Exxon, Occidental Petroleum, Continental Resources, Venture Global, and Cheniere Energy.
Yet oil giants will see an even greater windfall — helped by new offshore drilling, speedier permits and other relaxed regulations — in a second Trump administration, the former president told the executives over the dinner of chopped steak at Mar-a-Lago.
Trump vowed at the dinner to immediately end the Biden administration’s freeze on permits for new liquefied natural gas (LNG) exports — a top priority for the executives, according to three people present. “You’ll get it on the first day,” Trump said, according to the recollection of an attendee…Trump told the executives that he would start auctioning off more leases for oil drilling in the Gulf of Mexico, a priority that several of the executives raised…At the dinner, Trump also promised that he would scrap Biden’s “mandate” on electric vehicles…
Trump then repeated his pro-fossil fuel promises at a Houston fundraiser a couple of weeks ago, raising tens of millions of dollars from executives of many of the same companies that attended the Mar-a-Lago event. Harold Hamm, the executive chairman and founder of Continental Resources, hosted the fundraiser with Vicki Hollub of Occidental Petroleum, Jeff Hildebrand of Hilcorp Energy, George Bishop of GeoSouthern Energy, and Kelcy Warren of Energy Transfer Partners.
Trump drew standing ovations when he promised to get more natural gas pipelines built if elected and to restore fracking to areas barred under Biden, said Mark Carr, a Houston entrepreneur who was in attendance…Trump has emphasized tax cuts for the industry, "streamlining" the permitting process, and removing certain regulations, said donor and oil executive Dan Eberhart, who was in Houston for the event. "We can drill our way to energy security and low gas prices," said Eberhart…
The Texas events were pricy affairs: Host committee members were asked to pay $250,000 per couple and agree to raise another $500,000, according to the invitations. The chair was asked to donate about $845,000 per couple and raise another $1.69 million.
While offering increased permits for controversial drilling and pipeline projects is most likely to capture headlines, an analysis found that fossil fuel companies would profit more from Trump’s pledge to halt the Biden administration’s elimination of tax breaks. According to The Guardian, preserving the tax breaks would save oil and gas giants $110 billion—11,000% more than the amount Trump allegedly asked the executives for in contributions.
But the analysis shared with the Guardian shows that the biggest motivation for oil and gas companies to back Trump appears to be in the tax system, with about $110bn in tax breaks for the industry at stake should Joe Biden be re-elected in November’s election. Biden wants to eliminate the tax breaks, which include long-standing incentives to help drill for oil and gas, with a recent White House budget proposal targeting $35bn in domestic subsidies and $75bn in overseas fossil fuel income.
“Big oil executivess are sweating in their seats at the thought of losing $110bn in special tax loopholes under Biden in 2025,” said Lukas Ross, a campaigner at Friends of the Earth Action, which conducted the analysis…Lobbying records show that Chevron, Exxon, ConocoPhillips, Occidental, Cheniere and the American Petroleum Institute (API) have all met lawmakers this year to discuss this tax situation, likely encouraging them to ignore Biden’s plan to target the fossil fuel industry’s own carve-outs.
Trump’s quid pro quo offer has already reached receptive ears, with fossil fuel lawyers and lobbyists drafting “ready-to-sign executive orders” for his administration to enact should he win a second term.
Industry representatives have already prepared some executive orders for Trump to sign if he reaches the White House, said Stephen Brown, director of energy consulting firm RBJ Strategies and a former refining industry lobbyist. Undoing Biden’s actions would be a major target. “You’ll see a lot of Biden regulations that have come out in the past six months checked one way or another,” Brown said in an interview. “It’s going to be like shooting fish in the barrel — there’s just so much to go after.” [...]
“Supportive industries are going to have to prop up a second Trump administration with expertise,” said the person, who was granted anonymity to discuss confidential planning. “We’re going to have to write exactly what we want, actually spoon feeding the administration. There’s 27-page drafts moving around Washington.”
Meanwhile, Senate Democrats have launched an investigation into Trump’s “policies-for-money” scheme, seeking documents from the fundraising events, draft executive orders, and information on donations made by attendees to the Trump campaign and related PACs. This follows a previous investigation, opened by Democrats on the House Committee on Energy and Commerce last month, into allegations that American oil executives have been “colluding” with each other and OPEC to “manipulate global oil markets,” and another years-long probe into the fossil fuel industry’s campaign of misinformation about climate change.

Michigan’s pipeline

The long-running legal saga of Line 5, dubbed “America’s most dangerous pipeline” by environmental groups, reached both the 6th and 7th Circuit Courts of Appeal in recent months. No matter the outcome of either case, it is almost guaranteed to be appealed to the U.S. Supreme Court in the near future.

Background

Line 5 is a 645-mile oil pipeline owned by the Canadian multinational corporation Enbridge, carrying crude oil from Western Canada through Wisconsin and Michigan to Ontario, Canada (map). According to data obtained by the Freedom of Information Act, the 70-year-old pipeline has spilled more than 1.1 million gallons of oil in approximately 30 incidents over the years. One of the riskiest segments of the pipeline crosses the Mackinac Straits, through the Great Lakes, endangering the drinking water of more than 30 million people. Enrbidge’s own analysis indicated that at least one section of the pipeline has lost 26% of its wall thickness due to corrosion, heightening the likelihood of a crack or rupture.
In 2018, a ship’s anchor accidentally struck the portion of Line 5 that runs through the Straits, leaving deep gouges in the metal’s outer protective coating. To placate a worried public, Enbridge and outgoing Republican Gov. Rick Snyder’s administration set out to install a tunnel in the bedrock beneath the Straits and replace the underwater pipeline with a new portion. Construction has yet to begin, mainly due to legal challenges (see below), but a Michigan utility regulator granted the company permission to build the tunnel in December.

Cases

There are numerous ongoing legal cases involving Line 5, spanning across multiple state and federal court jurisdictions. Today, we’ll look at the two cases that have recently been argued in federal appellate courts.
First, the 6th Circuit is considering whether arguments over the pipeline’s future in Michigan were properly moved to federal court. The case, Nessel v. Enbridge, originated in 2019 when Attorney General Dana Nessel (D) sued Enbridge in Ingham County Circuit Court to force the shutdown of Line 5. The 1953 easement granting Enbridge permission to lay the pipeline across the bottom of the Straits of Mackinac violates the public trust doctrine, the state said, and therefore was invalid from its inception. Evidence obtained by Nessel also proves Enbridge has committed numerous violations of the easement that give the governor the authority to terminate the agreement, the AG’s office claimed.
Paragraph A.(10) of the Easement requires that each Pipeline must be physically supported (i.e., either rest on the lakebed or be supported by some other structure/device) at least every 75 feet…For virtually the entire life of the Easement, Enbridge disregarded its obligation to comply with the 75' pipe span requirement, and even failed to take corrective action when pipe spans exceeded 200' in length…
Paragraph A.(9) of the Easement requires Enbridge to maintain a multi-layer coating on the Pipelines. This protective coating is intended to prevent the steel from being exposed to environmental factors that could cause corrosion or other physical damage…in August 2017, Enbridge informed State officials that there were three small areas of bare metal exposed, and later was forced to acknowledge both that it had known of these coating gaps since 2014 and that some were apparently caused by Enbridge…Subsequent inspections showed dozens more areas of coating damage.
Enbridge moved the case to the Western District of Michigan federal court, where District Judge Janet Neff (a G.W. Bush appointee) denied Nessel’s request to return the case to state court in 2021. Nessel appealed to a 6th Circuit panel made up of two Trump appointees and a G.W. Bush appointee. The district court erred, Nessel’s office argued, by granting Enbridge’s request to move the case to federal court two years after the lawsuit was filed. Enbridge contended that the case should remain in federal court because federal issues—like the pipelines treaty with Canada—dominate the case.
The panel has yet to release its decision.
A separate court of appeals is hearing the second case because it involves a portion of the pipeline that crosses Wisconsin in the jurisdiction of the 7th Circuit. Approximately 12 miles of Line 5 run through the Bad River Band reservation, alongside the namesake river that flows into Lake Superior. At the time of the pipeline’s original construction, the owners of that land—a mix of Bad River Band members, non-members, and the tribe as a whole—granted Enbridge long-term easement agreements that were renewed over the decades. Then, in 2013, the Band decided it did not wish to renew the easements on 15 allotment parcels. Their decision was influenced by recent evidence of Enbridge’s deliberate indifference to pipeline damage and corrosion, eventually causing the second-largest inland oil spill in U.S. history in the Kalamazoo River, Michigan.
The Band sued Enbridge in 2019 for its refusal to remove the pipeline from their land; Enbridge countersued alleging that an agreement on different land parcels requires the Band to consent to renewed easements over all parcels. District Judge William Conley ruled in favor of the Band in 2022, writing that Enbridge had been trespassing on the tribe’s land for years and must pay $5 million in compensation. However, Conley did not grant the Band’s request to immediately shut down Line 5, instead giving the company three years to reroute the pipeline around Bad River land.
Both parties were unsatisfied with the ruling and appealed to the 7th Circuit, where a three-judge panel made up of two Trump appointees and a Reagan appointee heard arguments in February:
In its appellate brief the Band made clear that it wants Line 5 off its land immediately, not in three years, and that it wants a greater share of the estimated $1.1 billion in profits the company has made by running oil through Line 5 since 2013. It also rejected Enbridge's proposed reroute of the pipeline, which hugs the borders of the reservation and still runs through the Bad River watershed…The judges accused the Band of not taking any independent steps to address its environmental concerns over the Bad River meander, where the soil that covers the pipeline is eroding. [Judge] Easterbrook also took issue with [the Band’s attorney Paul] Clement's environmental arguments, claiming that to move the pipeline out of the Bad River watershed would only move it into "some other watershed."
Clement pushed back against this argument, as did the Bad River Band's Tribal Council Vice Chairman Patrick Bigboy after the hearing. Both claimed that the Band should not responsible for alleviating an environmental problem Enbridge's pipeline created, and further argued that to shore up barriers at the meander would only extend the company's trespass…[Enbridge attorney Alice] Loughran meanwhile accused the Band of refusing to work with Enbridge in order to find a solution to the issue.
While awaiting the panel’s decision, spring flooding further eroded the banks of the Bad River, bringing the waterway to within 12.5 feet of the pipeline. The Band filed an emergency motion with Judge Conley, warning him that erosion presents “an imminent threat” to the watershed, Lake Superior, and the reservation should the pipe be exposed and rupture. Conley denied their request to shut down the line:
Judge Conley stated that he would prefer to see more cooperation between the company and the tribe. Conley said that, “there will come a time when there will be an imminent risk.” Yet, Conley said, he was “disinclined” to find that the risk is imminent at this time, even though “I think it’s going to be increasingly likely.”

Cancer alley

Earlier this year, a Louisiana state appellate court ruled in favor of air pollution permits for a planned petrochemical plant situated among disadvantaged Black communities in “Cancer Alley.”
The plant, set to be built by Taiwanese company Formosa Plastics, would be the largest complex of its kind in the country and produce thousands of tons of toxic air pollution per year and more than 13.6 million tons of greenhouse gases per year. According to ProPublica, the complex—located just one mile from an elementary school—will “double to triple the levels of cancer-causing pollutants currently harming the community from existing industrial plants.”
The Louisiana Department of Environmental Quality (LDEQ) granted Formosa over a dozen air permits in 2020 despite the company’s admission that if the chemical complex begins operations, the air in parts of St. James Parish would violate the Environmental Protection Act’s national, health-based limits for soot and ozone-forming nitrogen dioxide.

Residents and environmental groups sued, arguing that “LDEQ’s decision violates the Clean Air Act” by granting the permits “even though Formosa Plastics failed to demonstrate that its emissions would not ‘cause or contribute to’ violations of certain national standards.” Judge Trudy White, a Democratic judge in the Baton Rouge-based 19th Judicial District Court, ruled against the state and Formosa, finding that LDEQ failed to offer evidence that “it had avoided the risk [of public health violations] to the maximum extent possible.”
LDEQ admits that it did not do a cumulative assessment of [Formosa]’s toxic emissions together with other sources…LDEQ does not explain how analyzing data about [Formosa]’s facility alone could support its conclusion on the cumulative emissions, i.e., that “emissions from the [Formosa] Complex, together with those of nearby sources, will not allow for air quality impacts that could adversely affect human health or the environment.” [...]
LDEQ failed to act “with diligence, fairness and faithfulness” as its constitutional duty requires when making a decision that affects environmental resources (here the very air people living near the [Formosa] site will be forced to breathe), LDEQ failed to conduct any kind of meaningful cost-benefit analysis. LDEQ’s failure to weigh, or in some cases even acknowledge, the full range of environmental harms resulting from its permit action, renders its conclusion that “the social and economic benefits of the proposed project will greatly outweigh its adverse environmental impacts” arbitrary and capricious.
The state and Formosa appealed, drawing a panel of Republican judges on Louisiana’s First Circuit Court of Appeals that reversed Judge White’s ruling. “DEQ is entitled to considerable deference in its conclusion that the social and economic benefits outweigh the environmental impact costs,” the panel wrote, “and we cannot say that its analysis or conclusion in this regard was arbitrary and capricious or otherwise characterized by an abuse of discretion.” In other words, the appellate court found that the LDEQ did not err by giving the creation of jobs, tax benefits, and community improvements (including the so-called “beautification of the nearby public park”) more weight than the environmental and public health harms in its decision to grant Formosa air pollution permits.
Residents and environmental groups asked the Louisiana Supreme Court to take up the case in March. The court, which consists of five Republican judges, one Democratic judge, and one independent judge, has not announced whether it will hear the case.
