I live on 7 acres with a lot of my wife’s family. My wife and I live in the main house and everyone else is spread out on tiny houses, including her father in law, sisters and one brother. In October of last year I heard a lot of screaming coming from my father in laws house, so I run out there and find his girlfriend drunk and screaming at him about not letting her son come live with us, a few moments later she pulled out a pistol and started pointing it at him and me and my wife, I immediately got my wife and ran and told my father to do the same. I called the police as soon as I got away from her, my father never ran. I told the police who she was and that she was brandishing a gun. She ended up charging my father in law who then struck her in the face and took the gun when she fell.
The police show up guns drawn and by this time we had told the police the gun was taken apart on the counter. After about 10 minutes of the police trying to figure out what happened but not taking any official statement from anyone they put my father in law in handcuffs and determined he was the offender. While taking him to the police car he did something (while in handcuffs) that warranted being taken to the ground. The officer who tried to to take him down failed to do so when my father spread his legs to stop the fall. The officer fell and apparently obliterated his shoulder into 78 pieces. After taking no statements the police determined she could stay on my property that night as she was not the offender. My father in law went to jail and is being charged with assault on a peace officer. The officer is suing me for damages he received on my property and is since retired due to his shoulder injury. We have video discovery of the entire incident and the audio when I called 911 on her for having a gun. This department has been fucking with us for years and I have many stories but unfortunately those are just heresay. Do I have a case on the officer for malingering? Or for the fact that I called the police on someone pointing a gun at me and my family and the same police showed up and arrested my father and let the offender stay?
A quick google search on the officer shows he has bounced from department to department in several states, costing one department in New York 2 million dollars in a suit against a minor for excessive force. He was also in internal affairs trouble for lying about a military event he was required to attend but it turns out he was just cheating on his wife. He was also let go of another department for losing against a civilian in a lawsuit because his statements “didn’t align with the evidence” but somehow had no problem hopping on my counties department.

The police show up guns drawn and by this time we had told the police the gun was taken apart on the counter. After about 10 minutes of the police trying to figure out what happened but not taking any official statement from anyone they put my father in law in handcuffs and determined he was the offender. While taking him to the police car he did something (while in handcuffs) that warranted being taken to the ground. The officer who tried to to take him down failed to do so when my father spread his legs to stop the fall. The officer fell and apparently obliterated his shoulder into 78 pieces. After taking no statements the police determined she could stay on my property that night as she was not the offender. My father in law went to jail and is being charged with assault on a peace officer. The officer is suing me for damages he received on my property and is since retired due to his shoulder injury. We have video discovery of the entire incident and the audio when I called 911 on her for having a gun.
