Grand World Phu Quoc was introduced by Vingroup as a real estate resort project that was highly sought after by investors. However, in response to these expectations, Vingroup and Techcombank have set up a maze-like scam to blatantly seize customer investments, estimated at OVER 1 BILLION USD.
GRAND WORLD LAND IS ONLY COMMERCIAL AND SERVICE LAND AND CANNOT BE SOLD AT RETAIL
The Grand World land has two certificates, CU 861652 and CU 861653, with a total area of 85.3 hectares. Certificate CU 861652 is state-owned land leased with annual payments, with an area of 407,951.7 m2. And certificate CU 861653 is state-owned land leased with a one-time payment, with an area of 374,975.4 m2. Both of these certificates clearly state that they are COMMERCIAL AND SERVICE LAND.

In addition, according to Decision No. 02/QD-BQLKKTPQ of 2019 of the Phu Quoc Economic Zone Management Board on the planning of the Grand World project, Article 1 clearly states: New Vision Real Estate Company Limited leases land for use for commercial and service purposes (to implement the project to build the Grand World high-end resort and villa complex).
Decision No.: 230/QD-BQLKKTPQ of 2018 of the Phu Quoc Economic Zone Management Board on the planning of the Grand World project also clearly states the project's planning function and nature: "Identified as a mixed-use tourism and service area with tourism services, resort guests, squares, trees, technical infrastructure,...".
Thus, from the project's red book to the decision documents of the BQLKKTPQ, it is clearly confirmed that the Grand World project land is planned as tourism and commercial land and is land leased with annual payments (certificate CU 861652) and a one-time payment (certificate CU 861653). According to Article 175 of the 2013 Land Law, land leased with annual payments is not allowed to transfer the right to use land [2]. And according to Article 174 of the current 2013 Land Law, the lessee is allowed to transfer the right to use land and attached assets owned by the investor to the land [3]. But that is in the case of transferring the entire land lot, project and all assets, facilities, not dividing and selling like dividing lots and selling land. Similarly, LDG Investment can only sell the entire right to use the land to Vingroup, not a part of the project.

VINPROUP SCAMMED CUSTOMERS BY SELLING WHAT THEY CANNOT SELL.

As stated above, the land of the Grand World project is state-owned leasehold land and cannot transfer land use rights (for land with annual rent) or must transfer the entire land use rights (for land with one-time rent). Vingroup cannot transfer the land use rights of the leased land to be divided into lots and sold. If Vingroup wants to sell to small and individual investors, it can only resell the right to exploit apartments and services.
But if it only sells the right to exploit, Vingroup will not be able to sell for much money. For that reason, there is reason to suspect that "Vingroup has taken advantage of investors' lack of legal knowledge to SCAM" by being vague with customers about "SELLING ALL REAL ESTATE" and issuing a sales contract as a "TOURISM SERVICE CONSTRUCTION SALES CONTRACT".

Article 19 of the 2014 Real Estate Business Law stipulates that the principle of buying and selling houses and construction works (or tourism works as Vingroup calls it) must be attached to land use rights. This is what Vingroup cannot separate and transfer to customers as mentioned above.
According to Appendix No. 01 issued with Circular 27/2018/TT-BTNMT, commercial and service land is land used to build business, service, commercial establishments and other works serving for business, services and trade. That means that the commercial and service land here is only state-owned land leased for businesses to exploit and operate commercial and service activities, not land for subdivision and sale of land plots with accompanying construction works. Thus, it is clear that all transactions transferring tourism service works in Grand World Phu Quoc are "ghost" transfers.
According to the signed TOURISM SERVICE CONSTRUCTION SALES CONTRACT, in clause 5.2 "Obligations of the seller", it is clearly stated that the seller "is responsible for procedures with the competent authorities of Vietnam to apply for a certificate of land use rights, house ownership rights and other assets attached to land for the buyer". According to Article 1 of Circular 23/2014/TT-BTNMT dated May 19, 2014: "This Circular provides for the Certificate of land use rights, house ownership rights and other assets attached to land (hereinafter referred to as the Certificate)".
The "Certificate" in the Sales Contract is understood to mean "Certificate of land use rights, house ownership rights and other assets attached to land".
Even though Grand World sold out the entire project in 2021, by September 15, 2023, the Kien Giang Provincial Department of Construction issued Document No: 2479/SXD-QLN in response to legal matters for a citizen (a project customer) as follows:
"Upon verification, the Department of Construction has the following comments: The Grand World high-class resort and villa project in the Bai Dai eco-tourism area, Ganh Dau commune, Phu Quoc district, Kien Giang province. So far, the Department of Construction has not received any legal documents related to the sale of houses in the project. Therefore, the Department of Construction has no basis to respond."

Why is it that when the project was sold out in 2021, but by 2023, the provincial agencies of Kien Giang province still do not have legal documents related to the sale of houses in the project? TECHCOMBANK COLLUDES WITH VINGROUP TO SEIZE CUSTOMER ASSETS IN A MAFIA-LIKE MANNER THROUGH USURY LOANS

The sales contract for the tourism project that New Vision signed with customers, referred to as buyers, is an illegal contract. Therefore, it is certain that the sales contract and the credit contract for payment are not eligible for notarization of "guaranteed transaction assets" at the Department of Natural Resources and Environment for mortgage in accordance with legal regulations.
As mentioned above, the "tourism projects" in the Grand World project are assets that cannot be "divided into parts or subdivided" for transfer. Therefore, when customers buy products in the Grand World project and need to borrow money, Vingroup and Techcombank colluded with each other to deceive customers. Techcombank lends money to customers, referred to as borrowers, in a mafia-like manner.
Specifically, in order to disburse the loan, Techcombank required the borrower, who is also the buyer of Grand World Phu Quoc tourism projects, to sign a power of attorney for all purchased assets and everything belonging to/located in the purchased assets to Sao Thuy Company at Nguyen Ngoc Notary Office. Sao Thuy is a subsidiary of Techcombank, responsible for collecting debts and harassing buyers/borrowers if they pay late or have the right to seize the property because the borrowebuyer has signed a power of attorney with them. This is a way to avoid going to court to enforce the auction of assets according to the legal process of the Law.
But why did the customer, who is also the borrower, have to accept this unreasonable request from TCB? Because before working with Techcombank on the loan and the method of borrowing, the buyer, who is also the borrower, had made an advance payment to Vingroup from 30% - 40% of the total value of the real estate that they had agreed to transact on the sales contract. Therefore, if they do not agree to sign the power of attorney as required by Techcombank, they will either not be approved for the loan, lose the entire amount of money that has been paid in advance, or have to pay the full 100% of the amount.
In fact, this method is no different from mafia loan sharking. Because it is clear that from the time the customer signed the power of attorney for Sao Thuy Company, the customer has transferred all of their assets to Techcombank. Thus, Techcombank and Vingroup can completely collude with each other to appropriate for other purposes. And this act is a complete violation of the regulations on banking activities.
With the above tricks, Techcombank has violated the regulations on lending in the activities of credit institutions as stipulated in Article 179 of the Criminal Code of 1999. By the 2015 Criminal Code, amended and supplemented in 2017, the name has been changed to the crime of violating the regulations on banking activities and other activities related to banking activities. The crime of violating the regulations on banking activities is committed intentionally and in an organized manner.

VINGROUP AND TECHCOMBANK CONSPIRE TO SEIZE CUSTOMER ASSETS WHEN MORTGAGING GRAND WORLD TO ISSUE BONDS.

Accordingly, on October 25, 2023, Thien An Investment Management Co., Ltd (Thien An) completed the issuance of the DTACH2328002 bond lot, with a value of 1.070 trillion VND, for a term of 5 years. Thus, the maturity date of this bond lot is October 25, 2028. Previously, on October 17, 2023, Thien An successfully issued the DTACH2328001 bond lot, with a value of 1.076 trillion VND, along with an interest rate of 9.7%/year, for a term of 5 years from October 17, 2023 – October 17, 2028.
Notably, the Grand World Phu Quoc project continues to be used by Thien An as collateral for the DTACH2328002 bond lot, after having used this asset as collateral for the DTACH2328001 bond lot, a few days earlier. That is, the total pledged value is 2.146 trillion VND.

Thời gian: 4 ngày 4 đêm . Phương tiện: Ô tô giường nằm/ tàu cao tốc/ oto

NGÀY 1 Tour Châu Hồng Hà ngắm anh đào: HÀ NỘI – HÀ KHẨU – DI LẶC ( Ăn trưa, tối)

Sáng: 02h00 Xe và hướng dẫn viên đón quý khách tại điểm hẹn. Đưa Quý khách khởi hành đi Lào Cai, trên đường đi đoàn nghỉ chân ăn sáng (Chi phí tự túc), sau đó đoàn khởi hành đi Hà Khẩu làm thủ tục xuất cảnh sang Trung Quốc.
Quý khách ăn trưa tại nhà hàng sau đó đoàn khời hành đi Di Lặc
Chiều: Đến Di Lặc đoàn tham quan khu danh thắng Đông Phong Vận Di Lặc – Nơi được ví như miền Nam nước Pháp với những cánh đồng hoa tím bạt ngàn và những công trình kiến trúc độc đáo. Được xây dựng năm 2014, là một khu nghệ thuật văn hoá cấp Acủa Trung Quốc.
Trong khu danh lam thắng cảnh có Bảo tàng Nghệ thuật Kính vạn hoa bằng gạch đỏ, những chai rượu và lâu đài hình ngọn lửa tất cả đều được làm bằng gạch đỏ. Nó nổi tiếng trên Internet vì hình dạng độc đáo, được gọi là "Lâu đài ma thuật tương lai kỳ diệu" và "Lâu đài cổ tích gần gũi nhất với trái tim bạn, công viên hoa oải hương với những biển hoa sắc màu.
Đoàn khởi hành về trung tâm thành phố Di Lặc ăn tối. sau đó về khách sạn nhận phòng nghỉ ngơi, tự do tắm khoáng nóng tại khách sạn

NGÀY 2 Tour Châu Hồng Hà ngắm anh đào: : DI LẶC – NGHI LƯƠNG – CÔN MINH ( Ăn sáng, trưa, tối )

Sáng: Sau bữa sáng, đoàn khởi hành đi Nghi Lương tham quan Rừng hoa anh đào Nghi Lương. Tại đây, quý khách thỏa thích chụp ảnh, ngắm hàng ngàn gốc hoa đào rực rỡ tại đây.
Trưa: Đoàn dùng bữa trưa tại Nghi Lương được mệnh danh là “Vựa lúa Côn Minh”, và thưởng thức món ăn Vịt Quay nổi tiếng của Trung Quốc – “Vịt quay Nghi Lương ” nổi tiếng như Vịt quay Bắc Kinh
Chiều: Đoàn khởi hành về Côn Minh tham quan: Công Viên Đại Quang - chiêm ngưỡng cảnh đẹp thiên nhiên non nước hữu tình, tìm hiểu nền văn hóa Trung Hoa thông qua các câu đối hay, trong đó có 02 câu đối dài nhất với tổng 180 chữ của các bậc văn sĩ nổi tiếng hạ bút khi đến công viên thưởng ngoạn.
Đoàn khởi hành đi ăn tối tại nhà hàng. Sau đó về khách sạn nhận phòng nghỉ ngơi.

Sáng: Ăn sáng tại khách sạn, Đoàn đi tham quan:
Hồ Điền Trì - một hồ nước ngọt lớn nhất Vân Nam, được mệnh danh là viên minh châu của Côn Minh.
Tham quan Làng Văn Hóa Vân Nam – Chiêm ngưỡng những nét đẹp cổ kính đậm chất Trung Hoa
Chợ hoa Đấu Nam - nơi có đủ các loại hoa của thành phố bốn mùa xuân, nơi đây tập trung tới hơn 70% lượng hoa của thành phố và là nơi phân phối chính cho nhiều đại lý hoa trên khắp đất nước Trung Quốc.
Trung tâm thương mại bán sỉ lớn nhất Côn Minh
Tối: Quý khách tụ túc ăn tối, khám phá ẩm thực Vân Nam. Nếu bạn là 1 tín đồ thích mua sắm thì không thể bỏ qua những khu phố đi bộ mua sắm ở phường Kim Mã Bích Kê vì có quá nhiều những hàng hiệu hay trang phục phù hợp với túi tiền và thẩm mỹ của bạn.

NGÀY 4 Tour Châu Hồng Hà ngắm anh đào : CÔN MINH – TÀU CÁO TỐC HÀ KHẨU ( Ăn sáng, trưa )

Sáng: Ăn sáng tại khách sạn, đoàn làm thủ tục trả phòng, sau đó xe đưa đoàn đi tham quan và mua sắm tại cửa hàng bán và giới thiệu đặc sản Vân Nam.
Trưa: Đoàn ăn trưa tại nhà hàng
Chiều: Xe đưa đoàn ra ga tàu Du lịch Côn Minh Trung Quốc đoàn làm thủ tục lên tàu về Hà Khẩu chuyến tàu lúc 13h20.
Về đến Hà Khẩu, đoàn làm thủ tục về lại Việt Nam.

- Giá tính cho trẻ em ngủ chung giường với bố mẹ, nếu Quý khách có yêu cầu ngủ riêng cho trẻ em vui lòng thanh toán 100% giá tour.
- Giá áp dụng cho khách hàng từ 12 tuổi đến 69 tuổi, từ 70 tuổi trở lên sẽ đóng thêm chênh lệch cho mức phí bảo hiểm cao cấp, từ 75 tuổi trở lên yêu cầu phải có giấy chứng nhận đầy đủ sức khỏe để đi du lịch nước ngoài của cơ quan y tế có thẩm quyền cấp và phải có người thân khỏe mạnh dưới 60 tuổi đi cùng.
- Do tính chất là đoàn ghép khách lẻ, Công ty sẽ có trách nhiệm thu nhận khách cho đủ đoàn (từ 10 khách người lớn trở lên) thì đoàn sẽ khởi hành đúng lịch trình. Nếu số lượng đoàn dưới 10 khách, Công ty sẽ thông báo cho khách và sẽ thỏa thuận lại ngày khởi hành mới, hoặc hoàn trả lại toàn bộ số tiền cho khách đã thanh toán trước đó
- Trong trường hợp chỉ có 1 khách (người lớn) đi với 1 trẻ em dưới 12 tuổi (không có chế độ giường riêng), Quý khách vui lòng thanh toán theo giá người lớn để bé có chế độ giường riêng
- Trường hợp Quý khách không được xuất cảnh và nhập cảnh vì lý do cá nhân (như hình ảnh, thông tin giấy tờ trong bản gốc bị mờ, không rõ ràng, passport hết hạn, không đúng quy định,…) Công ty sẽ không chịu trách nhiệm và sẽ không hoàn trả tiền tour. Hướng dẫn viên Công ty sẽ hỗ trợ và tìm biện pháp giải quyết tốt nhất cho Quý khách, mọi chi phí phát sinh do khách hàng chi trả
- Đối với trường hợp khách làm phẫu thuật thẩm mỹ khuôn mặt, bắt buộc phải làm lại hộ chiếu. Trường hợp khách không làm lại hộ chiếu công ty sẽ không chịu trách nhiệm về vấn đề xuất nhập cảnh của khách. Mọi chi phí về hủy phạt dịch vụ khách hàng sẽ phải tự chịu trách nhiệm.

Afternoon on August 31st 2015, as always, Mr. Nguyen Van Minh - a goat keeper in 24th Group, town Loc Thang, Bao Lam district, Lam Dong province, brought his dog with to get in the woods in 725 Provincial Highway to find missing goats. Arriving at the landfill of the local residential, his dog started barking constantly, he buried his head in a mound, pulling out a white cloth and hissing. Surrounded by curiosity, Mr. Chien pulled the cloth out to look. A stench smell came out and a man's hand exposed from the soil which appeared to be filled in a hurry
Receiving the report, Police of Bao Lam district immediately surrounded the scene on the night August 31st. The next day morning, the Lam Dong Province Criminal Police Department deployed six men - including policemen, investigators, forensic investigators to get to the scene. At the hole that found the body, the police assumed the clues surrounding this area weren't well protected. The heavy rains from highland combined with new trash bags stashed on the landfill had erased the important clues to examine
Taking the body out, it appeared to have gotten in a state of serious decomposition, the stench was awful. The victim was identified to be a male, about nearly 40. Initially found 5 wound marks on the body, especially on the top of the left side skull, it was a wound mark penetrated in the skull, about size: 0,55 cm (21,7 inches). Left side of the victim's neck has a stab mark and his body also had many other stab marks. The assumption showed that the victim might have passed away about 10 days ago, had signs to be murderered, he was then buried down the soil with the depth from about 1m (3 feet 3 inches). Fingers of the victim, all swelling, worn out the flesh, very difficult to track DNA. The forensic investigators had to use many methods to take the worn-out flesh of the victim's fingers, later kept it intact by using chemical, trying their best to sew, to recreate the samples. Three fingerprint samples of the male victim were brought to check for DNA that night
Arrived at the scene from the beginning, Major Pham Ngoc Dang, the chief of the investigation team - LDPCPD, assumed the scene contained many suspicious details. "When we got to the scene, we saw many unusual things. Suspicious because the scene that got the victim's body was not some kind cemetery but a hill full of pines. It's not buried properly but was filled with trash and dirt. The place we found the body is also away from where people live, victim's body also has suspicious things. We assume this could be a murder".
Besides dozens of policemen and investigators who went to other provinces to find missing people, all police stations in the provinces and its surroundings were also gathered to joint work with Colonel Nguyen Hong Huan - the vice chief of the investigation team of the LDPCPD
The unsolved mystery of the case got the answer when the policemen got a news: Fews past days before, the police of Bao Loc district got a report from a wife who said her husband - who was a cab driver had gone missing. Contacting the wife, the investigation team got the man's photos
Lieutenant Colonel Luong Dinh Chuc, chief of Criminal Prevention team in the district - now was the vice chief of LDPCPD, assumed the details about the appearance, clothes of unknown victim with the missing person was a match. "Right at this moment, the police of Bao Loc city also received a missing report from family members of a man named Hoang The Vinh - lives in Dac Lac, he's a cab driver. We're finding more information about this man to prove him and the body is the same person - also to find the suspicious people who involved in this".
All forces of Criminal Police, Police of Bao Lam district and Police of Bao Loc city were also gathered to recheck cases about possible missing cases in the province. After a few hours of a long focusion in rechecking information, police could finally identify the exact victim was Hoang The Vinh (35 years old, lives in Tan Lap ward, Buon Ma Thuoc city, Dac Lac province). Another meeting was soon conducted. Based on the details at the scene and the autopsy, based on the information found, the investigation team invited Hoang The Vinh's family members from Dac Lac to Lam Dong to verify the body. 1AM on September 1st, Vinh's wife confirmed: That was him.
Finished verifying the body, the victim's body was returned to his family so that they could escort him to return to Dac Lac to hold a funeral
From the murder scene, the victim's identity was found. Combined with the victim's lost properties like the white car INNOVA with license plate 47A - 099.07, smart phone, wallet, etc. Lieutenant Colonel Luong Dinh Chuc assumed the scene that found the victim's body could just be the second scene of a serious Robbery Murder. "From what we found at the scene and the statements of the man's family members, before he went missing, the INNOVA car, wallet, phone still there. But they weren't there at the scene. We assume this could just be the second scene to dump the body, it's a part of a robbery murder".
This time, many theories were drawn out for the investigation team:
Does the murderer live in Bao Loc city or not? Is he some kind of a member of an expert criminal group?

Does he ever have a criminal record, or is he a gambler, is he facing some kind of financial issues so he committed murder?

The connection between Buon Ma Thuoc (Dac Lac province), Bao Loc city and Lam Dong province, what are they to each other in this mysterious case?

More than 100 policemen of the LDPCPD, police of Bao Loc city and Bao Lam district were deployed everywhere to check on the relationships, traveling routes, history of victim Hoang The Vinh’s phone calls. Besides that, all individuals with unsual signs about financial, suspicious alibis in the entire Bao Loc city and Bao Lam district were all zoned for further investigations. Only ten suspicious suspects remained, later being brought to the station for interrogation to erase one to one. The last one remained was Kieu Quoc Huy. He was born in 1988, temporarily lives in Tue Tinh road, Bao Loc city, Lam Dong province. Right at 2PM, suspect Kieu Quoc Huy was summoned to the police station for interrogation to make things clear

Before being summoned to the police station, all profiles about Kieu Quoc Huy were prepared on the desk of the investigation team. From this, the relationship between Kieu Quoc Huy and victim Hoang The Vinh was cleared. On August 16th, Huy hired Vinh’s cab once, both of them went to a hotel in Bao Loc and had a certain conversation with each other. Not yet, the car Toyota Innova of the victim was also found stored inside Huy’s garage. However, in the interrogation, Kieu Quoc Huy constantly behaved calmly, he answered smoothly all questions selected by the investigators

Before coming to suspect Huy’s house to order him to arrive at the police station, Major Pham Ngoc Dang assumed this individual could be a dangerous and meticulous man. Needed to use every way to secure lives of policemen who come to him, to people who live near the man and the suspect himself. “From what we found at the murder scene to analyze the culprit, we found firearms in his house. So before we arrested him, our investigation team made rules to secure lives of the policemen, the people and the man himself so that we could continue to progress the investigation”.

At the police station, Huy behaved cunning, declining to be guilty. When he was asked about why the victim’s belongings like the car, phone, wallet were stored in his house, the suspect still declined. Huy stated that he was just an accomplice, about the victim’s belongings, he said his friend – Do Hoang Binh gave him. However, due to the repeated but not correct statements, Kieu Quoc Huy couldn’t fool the investigation team

Lieutenant Colonel Luong Dinh Chuc – who directly questioned Kieu Quoc Huy from the start of the interrogations until the end of the case, said. “When I asked him to explain about the car, Huy said it was Do Hoang Binh - a friend that gave it to him 10 days ago, only said he was an accomplice who had duty to keep the victim’s properties. But with my experience in this job, if there was really a case that made by a group of individuals, no way all those properties would stay in his place without no one sharing for team’s benefits. We confirmed this case didn’t have anyone but him who did it”.

Constant incorrect repeated statements, hoping to get away from his crime, Kieu Quoc Huy couldn’t fool the police. He couldn’t explain why the victim’s car was stored in his garage, he couldn’t explain why he possessed the car, why used the car to hang out with his girlfriend. He also couldn’t explain why only him used the junk sims to phone the victim's family members to fool them about Vinh’s missing, telling them that he was in debt of him a very large cash and the Vinh was on the run, no way to find him. On September 2nd 2015, Kieu Quoc Huy had to admit that there was no one in the case but him. Huy was the person that murdered the cab driver Hoang The Vinh

Sitting before the clues that he couldn’t explain, suspect Kieu Quoc Huy had to admit that he was guilty. He had committed the murder in a cold way to take away life of the cab driver Hoang The Vinh to steal all of his properties

Early August 2015, due to financial issues, Kieu Quoc Huy had prepared an AR-15 rifle, a knife, he put them in a guitar bag and went to Buon Ma Thuoc city. He pretended to take a cab from Buon Ma Thuoc city to return to Bao Loc city with a plan, murder and rob a cab driver while returning home. On August 16th, Huy bought and used a junk sim to make phone call, using to call a cab driver. Huy made a call to the Quyet Tien taxi service to hire a cab to Dac Lac but when he got in a cab, he saw the car was too old, so he withdrew and waited. Also on the same day, when Huy was drinking coffee to wait for a “prey”, he accidentally saw Hoang The Vinh who was picking up clients there. Vinh told him he was also working for Quyet Tien taxi, the victim’s car seemed still new, so Huy hired Vinh to drive him back to Bao Loc city

On the days driving in Bao Loc city, Kieu Quoc Huy asked Vinh to drive him around, hoping to find the right moment to kill but Huy realized he did not prepare for it well, so he stopped. On August 18th, Huy told Vinh to drive him back to Dac Lac, saying he would phone back when he was willing to return to Buon Ma Thuoc city and he would pay all money for the cab service. To make the murder, on August 20th, Huy entered Loc Thang town to buy a shovel, then stashed the tool in the bag alongside the AR-15 and the knife. He also researched how to disable CCTV planted in the cab. On August 21st, Huy phoned Vinh, asking the cab driver to pick him up to return to Buon Ma Thuoc

About 5PM on August 22nd, the cab of Hoang The Vinh went from Buon Ma Thuoc city to pick up Huy. Vinh didn’t know this would be the last drive he would have in his life, this man would never be able to return to see his family members anymore. When the cab arrived at the intersection and about to enter the Tuy Duc district (Dac Nong province), this was the border linked Vietnam with Cambodia. Huy asked Vinh to stop the car to watch the scenery. When Vinh got off the cab for toilet, Huy pulled the AR-15 out and fired a shot at the man’s head from the back, then used the knife to stab Vinh numerous of times and then dragged the driver back in the cab. Later, Huy drove the car back to Bao Loc with purposes when he comes across the B40 ridge, Loc Bac town, Bao Lam district, he would bury Minh. But Huy changed his mind when he arrived at the pine hill which was near a factory, he stopped the car, then used the shovel to make a hole and dragged Vinh’s body to dump in there before filling the dirt

About 1AM on August 23rd, Kieu Quoc Huy drove the cab that he stole back home, later he calmly went to sleep. The next day morning, he calmly cleaned the blood stains in the car, disposing of some papers, hiding shoes of the victim which still remained and stored the car in garage. Through searching in the murderer’s house, the police found a Toyota Innova car with the license plate 47A – 099.07, a Nokia LX smartphone, and 460,000 Dong, all were the victim's. Also, in the house, the police discovered 6 rifles, including 2 military guns (one was cocked with 20 rounds in magazine, one with a silencer). Two sport rifles, more than 80 bullets with various types, bullet shells, silencers, gunpowder boxes with batons, gasmasks, pocket knives, binoculars and 6 phones. Huy testified that he bought these weapons in 2013 in Dak Lak and Ho Chi Minh city, attempting to sell for money

From the dead body discovered on the pine hill, police of Lam Dong province had finally solved the murder case. But the case did not end there yet when the statements of suspect Kieu Quoc Huy and the properties discovered in his house led the investigation team to another more terrifying case. Another murder that occurred from 3 years ago…

Thinking the past had been buried by time, the murderer didn’t know he would be caught by his own trap. It was about 3PM to 8PM on September 1st, when the interrogation to question suspect Huy was still going on intensely

Hearing the interrogation directly, when the suspect said the name Do Hoang Binh, immediately Brigadier Bui Van Son – Chief of the LDPCPD thought. “When the suspect said it, we immediately thought about it. Who is Binh? What he is doing and where he is? So that we splitted the team to get into another investigation route to check on this matter”.

During the suspect Huy’s house searching, the police found 5 land use rights certificates of Mrs. Pham Thi My Hanh – Do Hoang Binh’s wife, were handed to Kieu Quoc Huy. The prices of the lands written in the certificates were 2,7 billion Dong. The gigantic properties in the hands of a person who did not have a stable occupation, making him suspected by the investigation team. Immediately, the information of the relationship between Kieu Quoc Huy, Do Hoang Binh and Pham Thi My Hanh was investigated by Lieutenant Colonel Luong Dinh Chuc and was later handed over to be taken care of by the Specialist Investigation Department. “In 2012, Huy was a worker of an aluminum bauxite factory in Tan Giang, Bao Lam district. At that time, he was a very close friend of a married couple - Mr. Do Hoang Binh (also a worker there) and Mrs. Pham Thi My Hanh. When we were making a search in his house, we found 5 certificates that wrote they handed their lands to him. There’s no way that man could have enough money for that couple to hand him the lands with the price 2,7 billion Dong. When the couple went missing, Binh’s mother and Hanh’s relatives received texts from their phones, saying both of them were running away because of high debts”.

After 24 days denying for saying he did not involve in the missings of the married couple, before the clues that he couldn’t answer, Kieu Quoc Huy finally had to turn himself in. He said he really murdered the couple in 2012. The detailed statements of the cold-blooded murderer made the investigators chilled to the bones by knowing his cold-blooded nature

According to the initial statement of suspect Huy. Knowing the couple owned the large properties, Kieu Quoc Huy planned to murder them to take lands. About 6PM on March 4th 2012, Kieu Quoc Huy came to visit Do Hoang Binh (31 years old) and his wife Pham Thi My Hanh (31 years old), live in 15th Group, Loc Thang town, Bao Lam district. Here, when Binh went to the house’s backyard, Huy followed him from behind, using a machete with a blow to the victim’s nape. Later, Huy went in the house to pick up a kitchen knife to stab Hanh many times, the murderer later dumped two victims down in the well. To get away from murder, he used bricks, trashes to fill the well to make sure the bodies wouldn’t be discovered. Huy shortly used all the ways he could think of to take over 5 lands, he phoned to the two victims’ family’s members to announce that the couple was in debt of him with a very large money. Long time not see each other because of living apart, seeing Binh and Hanh missing, the family members reported to the police but no suspicious was found. The family thought their son and daughter had sold the house and fled due to being chased because of high debts so that they couldn’t contact. The case had to be closed when the missing people weren’t found, it seemed to have to come in a dead end. After 3 years, the murderer confessed so it was exposed

Lieutenant Colonel Luong Dinh Chuc said it took time of constant interrogations for the culprit to admit the crimes he made from 3 years ago “It was a difficult case. The culprit was a cunning man, he had some sort of knowledge about the laws so it was quite difficult for us to question him. Meetings were held many times. Before every detail, even one information that he spoke up would have to be considered very carefully, our minds all had to be bright. Every new information he gave would need us to hold a meeting”.

After murdering the couple who were his close friends, Kieu Quoc Huy entered the house to find 5 certificates about land own rights, registration books, ID cards and locked the door. However, the detail that made Colonel Pham Hong Tuan surprised was the way how Kieu Quoc Huy could manage to legalize the process to take over 5 lands under his name quite easily. That showed the suspect’s cunning, meticulous, and calculated in every move. “The suspect turns out to be calculated, even in the way he committed crimes and the way he became defensive against us during interrogations. Wise and reckless. Despite his young age, his mind is some sort of an expert criminal”.

According to police, Tran Van Diem (28 years old, lives in Tu Ky district, Hai Duong province) is the 4th child in a family includes four brothers and sisters. Since his family is poor, he got in Ho Chi Minh city when he was 17, selling fruits and CDs to live. According to Colonel Dong, within four months (From August - December 2014), Diem murdered four people in Ho Chi Minh city, Quang Ngai, Hai Phong and Ba Ria - Vung Tau. Being reminded, he pulled out a knife and stabbed Phuoc, the man died while on the way to hospital. Fleeing the murder scene, Diem ran to Binh Tan district and entered Dong Nai province to hide
August 21st 2014, Diem hitchhiked a truck driver from Dong Nai to Binh Dinh, then took a fake name Ngoc, took a job in an arcade shop of May Xanh lottery group. Two days later, he took a drive to go to Quang Ngai to meet Pham Van Nghia (through the introduction of the lottery group) to find another new suitable job
Night of August 24th 2014, Diem planned to murder Nghia to steal his motorbike and his money. However, that afternoon, victim Le Minh Hiep (Nghia's friend) visited his house, he also made friends with Diem. Seeing this gay man possed an expensive motorbike, Diem switched the victim
To commit the murder, Diem said it was his first time in Quang Ngai, he wanted victim Hiep to drive him somewhere for a hang out. Both of them then arrived at an area which was near the Tra Khuc river. He asked Hiep to find somewhere deserted to "have a relationship". When going to the river, Diem from behind, pulled out a knife from his bag and hid it behind his pants. When Hiep stopped the motorbike, Diem pretended to drop his helmet accidentally, then grabbed the hair of the new friend, stabbing dozens of times until the victim collapsed at the crime scene
Taking the motorbike and other properties of victim Hiep, the murderer rushed to Tay Nguyen to hide. After a night in an apartment, Diem came down to Pleiku city (Gia Lai), took the name of victim Le Minh Hiep to sell the man's motorbike in a pawnshop for money 15 million dong. Knowing he was wanted, Diem hitchhiked to Hai Phong to hide. When money ran out, he met and made friend with victim Pham Van Can (a chef who teaches at home), promised he would "satisfy" this gay man
Night September 15th 2014, asking Mr. Pham to meet him in a deserted location, Diem pulled out a knife, stabbed the victim to death and then took his motorbike and his phone. He sold all the properties he stole and took a ticket using the pier station to return to Ho Chi Minh city, then bought cupping equipment and a bicycle. He came to Ba Ria - Vung Tau, doing cupping service with a man named Hieu
December 14th 2014, while drinking street coffee in Vung Tau city, Diem saw the shopkeeper of a vegetarian tavern - Nguyen Hoang Ngan (39 years old) wearing gold bracelets, so he approached and made friends. That night, he came to do the cupping service for the victim and asked for an overnight stay, then stabbed the victim to death, later stole some properties to sell, used for gamble
Police in Ba Ria - Vung Tau had gathered forces to investigate in many routes, plus concentrated on locations that have gay men and cupping workers. December 20th 2014, the police spotted Diem at the 4th Street, Tan Tao A ward, Binh Tan district, Ho Chi Minh city, together with a gay man

Do số liệu quá khủng khiếp, hay do không muốn thừa nhận đã thất bại trong việc răn đe tội phạm?

Vào tháng 8/2023, Liên minh châu Âu lên án chính quyền Việt Nam đang xử tử công dân của mình một cách không minh bạch, che giấu số liệu về việc thi hành án tử. [1]
Việc che giấu số liệu này đã tạo ra nhiều lời đồn đoán. Tổ chức Ân xá Quốc tế đã gọi chính quyền Việt Nam là “đao phủ số một ở Đông Nam Á”, và là một trong những nước thi hành án tử hình nhiều nhất thế giới. [2]
Vì sao chính quyền Việt Nam tuyên án tử hình công dân của mình nhưng lại không dám công khai số liệu về hình phạt này?

Số liệu về việc xử tử hình có thể rất khủng khiếp

Vào tuần lễ từ 21/8 đến 25/8, các tòa án tại Việt Nam đã tuyên ít nhất 5 bản án tử hình. Còn tuần trước nữa, từ 14/8 đến 18/8, có ít nhất 7 bản án tử hình được tuyên. Những con số này được cập nhật theo bản tin đã đưa của các báo, đài chính thống ở Việt Nam.
Mỗi tuần Việt Nam tuyên án tử hình đều đặn cho công dân của mình. Mỗi năm có hàng trăm người Việt Nam nhận án tử hình.
Năm 2017, Việt Nam từng công bố số tù nhân bị xử tử. Trong bốn năm (2013 - 2016) đã có 429 người bị hành hình. Việc công bố này khiến Việt Nam ngay lập tức nhận danh hiệu nước xử tử hình nhiều thứ ba trên thế giới. [3]
Từ đó đến nay, chính quyền Việt Nam đã ngừng công bố số liệu về việc hành hình công dân của mình.
Số liệu về việc xử tử ở Việt Nam có lẽ rất khủng khiếp. Việc công bố số liệu này đồng nghĩa với chính quyền Việt Nam tự công nhận mình là một trong những “đao phủ” hàng đầu trên thế giới.

Không có ý định xóa bỏ án tử hình

Bãi bỏ án tử hình là xu hướng tiến bộ trên thế giới. Một nước hướng đến xu hướng này sẽ giảm dần việc thi hành án tử để tìm cách giải quyết những bản án đã được tuyên trước đó.
Án tử hình ngày càng không còn là công việc nội bộ của một nước. Chính quyền Việt Nam hiện nay đang giam giữ nhiều tử tù người nước ngoài.
Việc công khai số liệu về việc thi hành tử hình từng năm là bằng chứng quan trọng đầu tiên cho thấy đất nước đó đang ở đâu trên tiến trình xóa bỏ hình phạt này.
Việc che giấu số liệu án tử hình của Việt Nam có thể ngầm xác nhận rằng số bản án tử hình được tuyên qua các năm là không giảm hoặc đang tăng.
Công bố một số liệu như thế cũng sẽ gián tiếp xác nhận Việt Nam không nỗ lực giảm dần án tử hình và tiến đến việc xóa bỏ hình phạt này theo xu hướng tiến bộ của thế giới.
Chính quyền Việt Nam có lẽ vẫn muốn duy trì hình phạt đối với công dân của mình nhưng không muốn thế giới chú ý đến nên đành phải che giấu số liệu về việc thi hành án.

Sợ phải thừa nhận án tử hình không làm giảm tội phạm

Tội phạm giết người và tội phạm liên quan đến ma túy lãnh án tử hình nhiều nhất tại Việt Nam. Chính quyền Việt Nam cho rằng việc duy trì án tử hình sẽ răn đe tội phạm. Khẳng định này có vẻ không chính xác khi bạn nhìn vào những con số sau.
Mỗi ngày Việt Nam có khoảng ba vụ án mạng, và con số này gần như không thay đổi trong gần 10 năm qua.
Bộ Công an cho biết từ năm 2014 đến năm 2019 đã xảy ra 6.850 vụ án mạng. Trung bình mỗi năm có 1.141 vụ án mạng, tức mỗi ngày có khoảng 3 vụ án mạng. [4]
Năm 2021, cả nước xảy ra 1.007 vụ án mạng. [5] Bộ Công an cho biết số vụ án mạng năm 2021 đã giảm 7,65% so với năm trước đó, có nghĩa là năm 2020 xảy ra 1.090 vụ án mạng. [6] Đây là hai năm xảy ra đại dịch COVID-19. Năm 2022, số vụ án mạng là 1.297 vụ.
Chính quyền có thể cho rằng án tử hình tuy không làm giảm tội phạm giết người nhưng đã giúp kiềm chế số vụ án mạng. Khẳng định kiểu này sẽ không phù hợp với tội phạm ma túy. 20 năm qua, số vụ án ma túy đã tăng hơn 200%.
Chính phủ cho biết số vụ án ma túy giai đoạn 2001 - 2007, tăng 33% so với giai đoạn 1995 - 2000. Theo đó, trung bình mỗi năm từ năm 2001 đến năm 2007 có 10.857 vụ án ma túy được điều tra. [7] Đến năm 2020, cả nước có 24.548 vụ án ma túy. Năm 2021 có 26.193 vụ án về tội phạm này. Năm 2022, có 26.967 vụ án liên quan đến ma túy. [8]
Sẽ còn hơi sớm để kết luận rằng án tử hình không làm giảm tội giết người và ma túy. Lý do là còn phải so sánh với số bản án tử hình được tuyên cho từng loại tội phạm qua các năm.
Nếu số bản án tử hình cho tội phạm đó gia tăng qua các năm mà số vụ án không có xu hướng giảm ở những năm tiếp theo, thì có thể có căn cứ cho rằng hình phạt này không răn đe được loại tội phạm đó.
Số bản án tử hình tại Việt Nam, đặc biệt dành cho tội phạm giết người và liên quan đến ma túy, có thể đã không giảm trong những năm qua. Nếu số lượng bản án này giảm, chính quyền có lẽ đã công bố công khai với thế giới để cải thiện hình ảnh của mình.
Nếu đúng như vậy, việc công khai số liệu có thể đồng nghĩa với việc chính quyền tự thừa nhận rằng đang xử tử công dân của mình một cách vô ích.
